Abstract

 Setiap perkawinan mempunyai harta yang dibawa dan diperoleh sebelum melakukan perkawinan dari masing-masing pihak suami atau istri. Sedang harta bersama dalam perkawinan atau disebut harta gono gini merupakan harga bersama yang dihasilkan melalui syirkah atau kerja sama antara suami dan istri. Para ulama berbeda pendapat akan hal ini, akan tetapi mayoritas mengatakannya sebagai syirkah abdan. Bila perceraian terjadi, maka dapat dilakukan pembagian harta bersama dengan mengkiyaskannya dengan syirkah abdan atau dengan cara lain yang disepakati.

Abstract

 Koperasi Langit Biru sebagai badan usaha memerlukan modal sesuai dengan lingkup dan jenis usahanya. Permodalan Koperasi Langit Biru didapat dari para anggota yang berinvestasi. Sistem yang dipakai adalah sistem bagi hasil, dimana setiap anggota yang berinvestasi akan mendapatkan profit sebesar Rp. 10.000,-/hari/Kg daging. Cara kerja Koperasi ini dengan menggunakansistem binary (jaringan), yaitu anggota yang diatas (upline) mengajak anggota baru (downline) minimal 10 orang untuk mendapatkan bonus dari koperasi. Pola operasional koperasi ini pada mulanya memukau para investor, akan tetapi pada saat mengalami kepailitan, maka timbul kekecewaan yang luar biasa dari berbagai kalangan. Karenanya, penelitian ini ingin menganalisis bagaimana hukum Islam memandang pola manajemen Koperasi Langit Biru ini.

Abstract

Multi Level Marketing is a method or technique of multi-level marketing and use direct selling approach. The uniqueness of this system lies in the distribution of its products will not be found in shops, supermarkets and stalls. Products obtained through direct distributors that are mainly individuals. But in the run still leaves some problems, especially in view of sharia, such as how the halal products, how the validity of the agreement, if it is appropriate reward with his work, how the ethical position of MLM, how the rule of law, as well as how to modify them in accordance with sharia.

Abstract

Nikah Siri is a term developed in the community, which means marriage under the hand; a process of marriage in accordance with the rules and regulations in Islam, as their guardian, witnesses and the Islamic marriage contract, just do not do the recording at the office of the Religious Affairs (KUA) as an official from the Ministry of Religion for those who perform marriages according to Islam and at the offices of those who hold civil marriage according to religious beliefs other than Islam. Without a recording then indirectly the government has not recognized the official bond, so there are matters relating to the rights of children and a wife who cann’t be met. Therefore, this study wanted to examine how Islam views nikah siri after seen the negative consequences thereof.

Abstract

The Qur'an interpreter Quraish Shihab provide conclusions and different interpretations of the religious establishment in providing legal arguments about the veil. He said that the head is not the nakedness because he thinks that the provisions will limit tolerable from the genitalia or female body is zhanniy not qathi ', in addition to the Qur'anic verse provides no details clearly and forcefully about the limits of the genitalia, such as what is mentioned in the Qur'an Surah An-Nur verse 31 and Surah Al-Ahzab verse 59. from these different thoughts, arise wide criticism from Muslim scholars to the thought of Quraish Shihab.

Abstract

Marriage is something that has been prescribed by religion. But in reality, people still have little understanding of the nature of marriage itself, so there is a carry but only run the Shari'a without ignoring other applicable rules. As well as Nikah Siri, although the law is considered valid marriage, but the rule of positive law in Indonesia has not considered valid. Therefore, raised view of the reviewer jurisprudence, especially from the schools of Shafi'i and Maliki.

Abstract

Polygamy is one form of marriage is debated by the public, either supporting or were refused, they give a different argument. Sociologically, the act of polygamy is still viewed percussion by the people of Indonesia, including the area of Bogor, West Java. They are looking at someone who is polygamous are very powerful in economic matters, being able to feed the whole family, but others consider that polygamy is bad for hurting woman and unfaithful to his first wife. Variety perspective is then deemed necessary to do research on sociological indication of Bogor on polygamy.
