Abstract

Each State has the right to navigate in its own territorial waters, in the open sea, and in the territorial water of another State. Requirements for the implementation of the right of peaceful navigation in Indonesian waters based on the domestic laws of Indonesia. However, the sovereignty of the coastal State remains bound by the provisions of the Convention itself and other international law.

Abstract

The rule of law is a state that takes the law first and guarantees the security of its citizens. The sustainability of ethnic, national and social life in Indonesia requires the implementation of the practice of the rule of law. The term Indonesian rule of law is often associated with the rechtsstaat and rule-of-law, based on the number of constitutions that have ever been made in Indonesia. These constitutions all affirm that Indonesia is a rule of law. Human rights must be taken into account when assisting prisoners. If rights are seen as a form of compensation that represents pain, then the only reason for suffering is for the prisoner to lose his freedom, both temporarily and for the rest of his life.

Abstract

Evidence is an important part of the trial process and is an important part of the trial of a case in court. The path of the accused is determined by evidence, which determines whether the accused actually committed the offense intended to be imposed on the accused who has been proven guilty. Basically, the purpose of the provisions of the Criminal Procedure Code on the need for expert testimony as evidence is to support certain elements of a crime, especially crimes that require testimony from someone who has special expertise related to the elements of the crime. This also means that expert testimony as a legitimate source of evidence cannot be considered the most important source of evidence.

Abstract

The study aims to determine how important the code of ethics of the legal profession is, in Indonesia, and how the application of the code can improve the quality of legal services and increase public confidence in the legal system. The purpose of the Code of Ethics is to ensure that legal practice is conducted with integrity, honesty, and responsibility, as well as to protect the public interest and preserve the dignity of the law profession. In addition, the study examines the problem and the efforts made to solve it. The research uses a qualitative approach by looking at literature, regulations, and case studies related to the code of ethics of the legal profession. According to the research, although the law profession has good codes, they often face problems such as lack of supervision, lack of ethical awareness of practitioners, and external pressure that affects professional decisions. This study shows that sustained ethical education, more surveillance, and firm sanctions for violations of the code of ethics are crucial.Thus, the integrity and professionalism of legal practice can be enhanced and public confidence in the legal system can be preserved.

Abstract

The implementation of legal protection for female workers under Indonesian positive law is regulated through various national and international legal instruments. Normatively, such protection includes: (a) Law No. 13 of 2003 on Manpower; (b) Minister of Manpower Decree No. 224 of 2003, together with company regulations or collective labor agreements; (c) international provisions established by the International Labour Organization (ILO); and (d) Minister of Manpower and Transmigration Decree No. KEP-226/MEN/2000 on Minimum Wages. Within this framework, companies are obliged to provide facilities for addressing grievances or complaints submitted by female workers as a form of legal protection. The grievance resolution process must be conducted hierarchically and progressively before being referred to a counseling team. In the event of an industrial relations dispute, the initial stage of resolution must be carried out through deliberation to achieve consensus. If deliberation fails, the parties may pursue legal remedies as stipulated in Law No. 2 of 2004 concerning the Settlement of Industrial Relations Disputes. This law establishes two mechanisms of dispute resolution: (1) non-litigation, which includes mediation, conciliation, and arbitration; and (2) litigation, through the Industrial Relations Court. Consequently, when disputes between employers and workers can no longer be resolved through deliberation, settlement may be pursued through judicial mechanisms to ensure legal certainty and the protection of female workers’ rights.
