Abstract

The development of Artificial Intelligence (AI) technology has brought significant transformation to the field of education, including language and law. One of the most prominent innovations in AI is the emergence of Large Language Models (LLMs) such as ChatGPT, GPT-4, and BERT, which are capable of understanding and generating contextual text similar to human communication. This article aims to analyze the role of LLMs as interactive media in language and law education at the university level, as well as to examine the accompanying challenges and ethical implications. The findings indicate that LLMs hold great potential in enhancing critical thinking skills, understanding of legal language, and active student engagement through AI-based dialogue. However, their implementation also faces risks such as diminished originality, algorithmic bias, technological dependency, and privacy violations. Therefore, the role of lecturers is crucial as ethical facilitators, knowledge curators, and guides of humanistic learning. With the right approach, the integration of LLMs can foster an adaptive, interactive, and ethically grounded education that promotes critical intelligence and academic integrity in the digital era.

Abstract

The development of the concept of punishment for children in conflict with the law in Indonesia through the Juvenile Criminal Justice System must prioritise a restorative justice approach, namely the settlement of criminal cases by involving the perpetrator, victim, families of the perpetrator/victim, and other related parties to jointly seek a fair settlement with an emphasis on restoration to the original situation, rather than retribution, including: criminal investigation and prosecution of children in accordance with the provisions of laws and regulations, unless otherwise specified in the Juvenile Criminal Justice System Law; juvenile trials by courts within the general court system; and guidance, supervision, and/or assistance during the criminal process or measures and after serving the sentence or measures. If diversion does not result in an agreement or the agreement cannot be implemented because one of the parties does not agree to its implementation, the juvenile justice process will proceed to juvenile criminal proceedings. In addition, every child in the criminal justice process has the right, among other things, to be free from torture, cruel, inhuman, and degrading treatment or punishment; not to be sentenced to death or life imprisonment; not to be arrested, detained or imprisoned, except as a last resort and for the shortest possible time; or to obtain justice before a juvenile court that is objective, impartial and closed to the public.

Abstract

State-Owned Enterprises (SOEs) are a form of business entity or legal entity established by the government to realise the welfare of the Indonesian people in accordance with the mandate of the 1945 Constitution. In the management and implementation of their business activities, SOEs in the form of limited liability companies have their own unique characteristics when compared to private limited liability companies, because these SOEs are also regulated separately by Law No. 19 of 2003 concerning State-Owned Enterprises, in addition to being regulated by Law No. 40 of 2007 concerning Limited Liability Companies. The background and considerations for the enactment of Law No. 19 of 2003 on State-Owned Enterprises include the fact that SOEs are one of the economic actors in the national economy based on economic democracy, playing an important role in the management of the national economy to achieve public welfare, whereas the implementation of the role of SOEs in the national economy to achieve public welfare has not been optimal. Therefore, management and supervision must be carried out professionally. In the management and supervision of SOEs, many directors (managers) of SOEs have been involved in special criminal cases due to errors or negligence in implementing the Business Judgment Rule. Moreover, currently there are not many references or jurisprudence that can save SOE directors if they are suspected of corruption, including the condition of government regulations that do not specifically regulate the application of the Business Judgment Rule.

Abstract

This study analyses the authority of customary institutions in community-based civil dispute resolution in Indonesia, with a focus on constitutional recognition and integration with the state judicial system. Using a normative and qualitative legal approach, this study explores legal bases such as Article 18B of the 1945 Constitution, the Village Law, and regional regulations that support the role of customary institutions as restorative mechanisms. Key findings show that customary institutions are effective in handling communal disputes such as customary land, customary inheritance, and family conflicts through deliberation and customary rituals, which emphasise the restoration of social harmony rather than an adversarial approach. However, challenges such as the heterogeneity of authority, overlap with formal law, and lack of documentation cause legal uncertainty. An analysis of the relationship with the state judicial system reveals the potential for hybrid synergy, in which customary decisions are recognised as non-litigation preliminaries, as seen in Constitutional Court decisions and court cases. This study recommends a national grand design to integrate legal pluralism in order to achieve inclusive substantive justice. Practical implications include strengthening regional regulations and inter-agency collaboration to reduce the burden on the formal judiciary.

Abstract

Abandoned land constitutes a significant issue in Indonesian agrarian law as it contributes to unequal land control and the suboptimal utilization of agrarian resources for economic development. This condition reflects the ineffective implementation of the social function principle of land rights in practice. This study aims to analyze the normative regulation of abandoned land and to formulate preventive measures through legal and economic approaches. The research employs a normative legal method using statutory, conceptual, and legal principle approaches, based on a literature review of primary and secondary legal materials. The findings indicate that, normatively, the regulation of abandoned land provides a clear legal basis for land control and enforcement; however, its implementation remains weak due to insufficient supervision and limited integration of economic policies. This study concludes that preventing abandoned land requires consistent law enforcement accompanied by economic instruments to encourage productive and equitable land utilization.

Abstract

This study aims to analyse community empowerment strategies in the child and women protection system initiated by the Women and Children Empowerment Agency (DPPA). The methods used are normative and empirical. The normative method examines the legal basis and policies related to the protection of women and children, while the empirical method explores field data through interviews, observations, and documentation of agency officials and community leaders. The results of the study show that community empowerment plays an important role in strengthening the social protection system for women and children. Through a participatory approach, the DPPA has succeeded in building synergy with the community in preventing violence and increasing legal awareness. However, there are still obstacles such as limited human resources, cross-sector coordination, and budget support. Overall, the community empowerment strategy by the DPPA is an effective and sustainable measure to create a safe, child-friendly, and gender-responsive environment.

Abstract

Legal protection for business actors is very important to create a fair, stable, and sustainable business environment within the framework of the rule of law. Formal businesses in Indonesia, whether run by corporations, cooperatives, or micro, small, and medium enterprises, are not affected by various legal risks that can hamper their operations. The purpose of this study is to examine how and how effectively legal protection is provided to business actors who run formal businesses in Indonesia, which are protected by applicable laws and regulations. The research method used is normative legal research using a legislative, conceptual, and comparative approach. Research materials include legislation in the field of business law, legal doctrine, and relevant scientific works. The results of the study show that Indonesia normatively has sufficient legal instruments to protect business actors, especially by regulating contracts, business competition, and intellectual property rights. However, various obstacles continue to hinder the implementation of such legal protection. Some of these obstacles include legal uncertainty, lack of law enforcement, and limitations on business actors' access to the judicial system. Therefore, regulatory harmonization, improved law enforcement efficiency, and institutional reform are needed to provide better and fairer legal protection for formal businesses in Indonesia.
