Abstract

Contemporary business actors often use arbitration, a method of resolving disputes outside of court. Arbitrase di Indonesia diatur oleh Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Penyelesaian Sengketa Alternatif. More and more cases are being registered with the Indonesian National Arbitration Board. Arbitrasi semakin penting dalam penyelesaian sengketa bisnis nasional dan internasional karena banyaknya kontrak bisnis atau perdagangan yang mencakup klausul arbitrase. Arbitration awards are final and binding, because arbitration follows the principle of final and binding. The decision immediately has permanent legal force from the moment it is pronounced because the arbitration decision is final and binding. Therefore, no further legal recourse can be taken against that decision. Article 70 provides the disputing parties with the opportunity to raise objections, while Article 60 states that the arbitration decision is final and has permanent legal force.

Abstract

The development of information technology has given birth to innovations in digital-based financial services, one of which is information technology-based money lending or online loans (fintech lending). This service offers easy access to financing, especially for people who have not been reached by conventional financial services. However, the emergence of various problems such as high interest rates, misuse of personal data, and unethical collection practices encourage the need for strict supervision from authorized institutions. The Financial Services Authority (OJK) as a regulator of the financial services sector plays an important role in regulating and supervising this service through OJK Regulation Number 77/POJK.01/2016. This study aims to analyze the role and authority of OJK in supervising online loan providers and evaluating the challenges faced in its implementation. The method used is a normative study with a statutory approach and legal literature. The results of the discussion show that OJK has the authority in the registration process, licensing, compliance supervision, consumer protection, and prosecution of violations. However, OJK also faces serious challenges such as the rise in illegal loans, limited resources, low public literacy, and regulatory gaps. Therefore, it is necessary to update policies, improve coordination between institutions, and strengthen digital literacy to create a healthy, fair, and safe fintech lending ecosystem for consumers.

Abstract

The Draft Law on Asset Seizure has been the focus of attention in the context of corruption eradication in Indonesia. However, the implementation of this bill raises several implications for human rights (HR) and social justice that need to be seriously considered. This research aims to analyze the implications of the Asset Seizure Bill for HR and social justice in the context of corruption eradication in Indonesia. Through a critical analysis approach, this study explores the positive and negative impacts of the Asset Seizure Bill on HR, including the right to privacy, freedom of speech, and the right to justice In accordance with Article 28G paragraph (1) and Article 28H paragraph (4) of the 1945 Constitution of the Republic of Indonesia. Additionally, this research also discusses the implications of the bill for social justice, including fair asset distribution and protection for vulnerable groups. The results of this study provide insights into the complexity of implementing the Asset Seizure Bill and the importance of ensuring that corruption eradication efforts do not violate HR principles and social justice According to Article 36 paragraph (2) of Human Rights Law No. 39 of 1999.

Abstract

Public services are a form of state responsibility in fulfilling basic needs and community rights. This research uses normative legal methods by examining Article 20 Paragraph (1) of Law Number 25 of 2009 concerning Public Services. The results show that the low quality of public services is caused by abuse of authority, bribery and nepotism, low apparatus competence, and unprofessional bureaucracy. Internal factors such as weak work systems, lack of performance indicators, and inadequate working conditions also worsen the quality of services provided to the community

Abstract

The internet does bring many benefits, but on the other hand it also creates new threats, one of which is cyberstalking harassment or intimidation carried out through cyberspace. This research discusses how to prevent and take action against cyberstalking perpetrators by referring to the 2016 ITE Law. Prevention efforts can start from simple things, such as maintaining digital security, saving evidence of disturbing messages, to reporting them to the authorities or social media admins. On the other hand, the government also needs to strengthen regulations so that law enforcement is clearer, while the public is required to be increasingly aware of the importance of digital legal literacy. In the end, protection from cyberstalking can only be effective if there is cooperation between individuals, authorities and the state.

Abstract

The development of online app-based public transportation in Indonesia has brought about significant changes in people's mobility patterns by offering easier access, efficient services, and high flexibility. While providing many benefits, this innovation also presents legal challenges, particularly regarding the responsibility of app providers and consumer protection. Through a normative legal approach, this article asserts that app providers cannot be viewed solely as technology facilitators but must also be regarded as business entities obligated to adhere to principles of safety, comfort, and consumer protection as stipulated in the Transportation Act. Additionally, the urgency of harmonizing regulations between the transportation and digital technology sectors is crucial to avoid overlapping authorities and ensure legal certainty. Therefore, the management of online transportation must be based on a balance between technological innovation and the protection of public interests, to achieve a fair, sustainable transportation system that aligns with national legal mandates.

Abstract

The status of the employment relationship between workers/laborers and companies is an important aspect of employment because it determines the form of the employment agreement that binds both parties, whether it is a Fixed-Term Employment Agreement (PKWT) or an Indefinite-Term Employment Agreement (PKWTT). This difference in status has direct implications for workers' rights, especially when the employment relationship ends. The legal basis is regulated in Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation into Law, specifically Chapter IV. However, this study focuses on analyzing PKWT and the rights obtained by workers/laborers after the termination of their employment relationship with the company.

Abstract

Verbal abuse in cyberspace is a form of online gender-based violence that is increasingly experienced by women, especially in Indonesia. This is related to the development of digital technology. The case of Baiq Nuril is a clear reflection of the problems of criminal law in Indonesia, particularly in the context of protecting victims of sexual violence and the implementation of the Electronic Information and Transactions Law (ITE Law). Baiq Nuril, a victim of verbal abuse by her superior, was criminalized under Article 27 paragraph (1) of the ITE Law after she recorded obscene conversations as a form of self-protection. This study uses a normative juridical approach by analyzing relevant legal instruments and their application in the Baiq Nuril case. The results of the study show that verbal harassment in cyberspace must be understood as gender-based violence that requires special legal protection, not just online communication ethics. The Baiq Nuril case is a real example of a legal framework that is not gender-sensitive and has the potential to cause problems. This relates to the application of criminal law and the criminalization of victims. In conclusion, this case provides an important lesson about the urgency of regulatory reform and the strengthening of amicus curiae, in order to achieve more responsive justice.

Abstract

Domestic violence is a serious problem in Indonesia, causing not only physical injuries but also leaving deep psychological scars on victims. Domestic violence can be experienced by women, men, and children. The mental recovery of victims is an important aspect that must be guaranteed by the state as part of the constitutional right to health. This article aims to examine the role of psychological counseling as a form of legal protection for victims of domestic violence within the framework of Law No. 23 of 2004 on the Elimination of Domestic Violence, as well as its relation to the fulfillment of the right to mental health. The study used a normative legal method with a legislative and conceptual approach. The results of the analysis show that psychological assistance is an integral part of the legal protection of victims as stipulated in the Law on the Elimination of Domestic Violence. This confirms that the recovery of victims is the responsibility of the state, while the 1945 Constitution and the Health Law guarantee the right of every citizen to health, including mental health. Thus, psychological counseling services cannot be viewed as an additional option, but rather as a legal instrument that must be provided in order to fulfill the human rights of victims. In conclusion, the fulfillment of the right to mental health through psychological counseling for victims of domestic violence is a tangible form of legal protection that needs to be strengthened with more comprehensivepolicies and regulations.

Abstract

The phenomenon of postpartum baby blues syndrome is often considered a psychological issue, but in reality it can have serious legal consequences, especially when it leads to violence against children and causes fatalities. This study aims to conduct a normative assessment of the relationship between baby blues syndrome and maternal violence against children, particularly from the perspective of criminal law and children's rights. The method used is normative legal research with a legislative, conceptual, and case study approach. The results of the study show that this syndrome is influenced by various factors that have the potential to encourage maternal violence against children. In criminal law, this psychological condition cannot be used as a reason to eliminate criminal responsibility, but it can be considered by the judge as a mitigating factor if it is proven that the perpetrator has a mental health disorder. Meanwhile, from the perspective of children's rights, all forms of violence are still considered serious violations that threaten children's rights to live, grow, and develop properly. Therefore, preventive measures are needed to reduce the number of mothers experiencing baby blues syndrome after childbirth while minimizing the risk of violence against children in Indonesia.
