Abstract

In today's world, technology is getting better. Computers, AI, and robots are getting more advanced. It makes things easier for people. People can shop, bank, send emails, study, and more online. Some people use technology to commit crimes. Cyber crime includes unauthorized access to computer systems, illegal content, data forgery, cyber espionage, cyber sabotage, infringement of privacy, carding, phishing, defacing, and cyber talking.

Abstract

Indonesia is rich in culture and traditions. One of them is traditional dance, which reflects the cultural wealth and serves as evidence of the unique diversity of Indonesian society. This study aims to discuss the implementation of Law No. 28 of 2014 on Copyright as an instrument for the preservation and protection of traditional dance from the threat of cultural claims by foreign countries. The method used in this research is normative juridical, by examining primary, secondary, and tertiary legal materials, such as legislation, journals, academic literature, and court decisions. The analysis and findings show that Article 28 of 2014 and Article 38 of the Copyright Law provide a strong legal basis for the state to hold copyrights over expressions of traditional culture. This includes regulating its use, legal prevention at the international level, and facilitating recognition by UNESCO in relation to traditional culture and cultural heritage. The challenges faced in this protection include a lack of public awareness, budget limitations, international legal challenges, and limited access for indigenous Indonesian communities to legal protection, which must be supported by the government and authorized institutions. Therefore, strategic steps such as digitization, data strengthening, inventory, international cooperation, and cultural promotion are required to provide more effective protection of traditional dance and prevent cultural claims by other countries.

Abstract

The phenomenon of exhibitionism in Indonesia is increasingly concerning because it can occur in various public spaces such as public transportation, highways, and even live broadcasts on social media. How is criminal law implemented in the context of criminal liability for perpetrators of exhibitionism? This research uses normative (normative juridical) research with a legislative and conceptual approach. In conclusion, exhibitionism is considered a criminal offense and is regulated by the Criminal Code and the Pornography Law. The Pornography Law (Law No. 44 of 2008) strengthens criminal sanctions against exhibitionism. Article 10 of the Pornography Law implicitly defines exhibitionism as displays of nudity or pornographic content in public places. Although the term "exhibitionism" is not always explicitly stated, this regulation confirms that Indonesian law criminalizes exhibitionism. Recommendation: There needs to be explicit regulation in the Criminal Code or a special law regarding exhibitionism as a criminal offense, as it is currently often interpreted as falling under the "morality" articles (e.g., Article 281 of the Criminal Code), the meaning of which can be vague or open to multiple interpretations. The aim is to facilitate law enforcement officials in establishing evidence and prosecuting.

Abstract

This study analyzes the effect of prenuptial agreements on the protection of marital assets among Generation Z within the framework of the Marriage Law and the implications of Constitutional Court Decision No. 69/PUU-XIII/2015. Normatively, the joint property regime poses the risk of asset commingling and debt liability; prenuptial agreements/separate property become mitigation instruments. The Constitutional Court ruling expands the scope of protection by recognizing marriage agreements that can be made and/or ratified after marriage (post-nuptial), thus providing flexibility for young couples. The method used is normative legal research (analysis of legislation, jurisprudence, and doctrine) enriched by limited empirical findings on Generation Z preferences (legal literacy, attitudes towards personal finance, and risk tolerance). The results show that prenuptial agreements are effective in separating ownership, reducing potential disputes, and protecting pre-marital assets, inheritance, and the business results of each party; while the post-nuptial scheme following the Constitutional Court's decision functions as a “remedial tool” when an agreement is not made before the marriage contract. The main obstacles include social stigma, low contractual literacy, and access to notary services. The study recommends improving Gen Z-friendly legal education, adaptive standard clause models (including debt and digital asset management), and simpler registration procedures to ensure legal certainty.

Abstract

The halal industry has become a rapidly growing strategic sector as public awareness of safe, healthy, and Sharia-compliant products increases. As a country with a Muslim majority, Indonesia implements a mandatory halal certification policy based on Law Number 33 of 2014 concerning Halal Product Guarantee (JPH Law), which requires all food products to be halal certified by 2026 at the latest. This study aims to analyze the implementation of the halal certification policy for food MSMEs in Pangkalpinang City and review its law enforcement against business actors who have not complied with these provisions. Using qualitative methods through literature studies, observations, and interviews, the study found that the implementation of halal certification is still hampered by the low level of understanding among MSME actors, limited capital, and procedural complexity. Law enforcement is implemented gradually through socialization, guidance, and administrative and criminal sanctions in accordance with the JPH Law and Government Regulation Number 39 of 2021. In conclusion, halal certification is not only a legal obligation but also a strategic opportunity for MSMEs to enhance competitiveness, expand markets, and strengthen consumer confidence. The successful implementation of  this policy requires effective collaboration between the government, certification bodies, and MSME operators to build an inclusive and sustainable halal industry ecosystem..

Abstract

The development of artificial intelligence (AI) technology has created new challenges in Indonesia's copyright law system. Artificial intelligence is now capable of producing works of art, writing, music, and other forms of expression that previously could only be produced by humans. However, Law No. 28 of 2014 on Copyright is still oriented towards the concept of human authorship, whereby only humans are recognized as creators and copyright holders. This situation creates a legal vacuum in determining the legal status of creative works produced in part or in whole by AI. Issues arise regarding the determination of the creator, ownership of economic and moral rights, and legal liability for copyright infringement involving AI systems.  This article uses a normative legal research method with a conceptual and legislative approach to analyze the extent to which Indonesia's copyright law system is able to accommodate developments in AI technology. The results of the study show that the current legal system is not yet able to provide adequate protection for AI-based works due to the lack of clear criteria regarding the level of human involvement required to obtain copyright protection. Therefore, regulatory updates are needed in the form of amendments to Law Number 28 of 2014 or the issuance of implementing regulations that regulate the limits of human roles, transparency in the use of AI training data, and legal protection mechanisms for works involving algorithms. These updates are important to ensure legal certainty, protect the rights of human creators, and encourage technological innovation and the national creative economy in the digital era

Abstract

Article 27 paragraph (2) of Law Number 1 of 2024 concerning Electronic Information and Transactions (ITE Law) contains a prohibition against any person who intentionally and without rights distributes or makes accessible electronic information that has “gambling content.” However, this phrase lacks a clear interpretation or definition, resulting in legal uncertainty in its application. This study aims to analyze the legal implications of the absence of a clear interpretation and its impact on law enforcement practices in the cyber realm. Using a normative juridical approach and conceptual analysis, this study finds that the absence of an explicit definition leads to differences in interpretation among law enforcement officials, potentially resulting in the over- criminalization of digital businesses and hindering consumer protection from covert gambling practices in the virtual world. In addition, the ambiguity of this phrase has resulted in weak law enforcement, as authorities find it difficult to prove the element of gambling in digital activities such as loot boxes, blind boxes, or luck-based lottery systems that are often used in online applications and games. As a result, the principles of legal certainty and justice as stipulated in Article 28D paragraph (1) of the 1945 Constitution have been neglected. This study emphasizes the need to establish implementing regulations or official guidelines that explain the objective indicators of “gambling content” in the digital space, including elements of economic value, dependence on luck, and potential financial gains. With the clarity of these norms, it is hoped that there will be uniformity in law enforcement, increased consumer protection, and the creation of fair legal certainty in the digital age.

Abstract

The purpose of this study is to examine how coercive fines, or dwangsom, are used as legal guarantees for parties who suffer losses due to breach of contract in land lease agreements. Land leases are civil law arrangements that can give rise to disputes, especially when one party fails to fulfill its obligations, such as paying rent after the agreed time or refusing to vacate the leased property after the lease term ends. In such circumstances, even though the court has issued a ruling, its implementation is often hampered by the absence of an effective enforcement mechanism. Therefore, dwangsom becomes an important instrument to ensure compliance with the judge's ruling through financial pressure on the defaulting party. This study uses a literature review method by examining primary, secondary, and tertiary legal materials, such as the Civil Code (KUH Perdata), Civil Procedure Regulations (RV), court decisions, scientific journals, and other legal literature. The analysis is conducted normatively by understanding the relevance and effectiveness of dwangsom in the Indonesian civil law system. The results of the study show that the application of dwangsom serves as a means of coercion so that court decisions can be implemented voluntarily and in a timely manner, thereby ensuring that the rights of the aggrieved party are fully protected. In addition, the application of dwangsom needs to be integrated with the principle of legal certainty in land administration to prevent disputes through clear registration and recording of rights.

Abstract

This study normatively examines the handling of children involved in narcotics abuse within the framework of achieving equitable law enforcement in Indonesia. The issue represents a multidimensional problem requiring an integrated legal, social, and psychological approach. According to Law Number 11 of 2012 on the Juvenile Criminal Justice System and Law Number 35 of 2009 on Narcotics, children in conflict with the law are entitled to special treatment. Employing a normative juridical method, this research analyzes relevant legislation and legal doctrines. The findings indicate that the resolution of narcotics abuse cases involving children should prioritize restorative justice principles, emphasizing recovery and social reintegration rather than punishment. Strengthening coordination among law enforcement institutions and implementing humane rehabilitation programs are essential to realize fair and child-centered law enforcement.

Abstract

This study aims to analyze the legal responsibility of laundry service providers for damage or loss of consumer clothing, as evidenced by the laundry receipt as proof of the service agreement. The receipt serves as written evidence containing the agreement between the service provider and the consumer. The research uses a normative legal method, with primary legal sources such as the Civil Code (KUHPerdata) and the Consumer Protection Law (UUPK), along with secondary and tertiary sources. The analysis is conducted descriptively by comparing the applicable legal provisions. The findings show that the legal responsibility of laundry service providers arises from the service agreement, as stated in Article 1239 of the Civil Code and the principle of unlawful acts in Article 1365. Providers are obligated to compensate if proven negligent, in accordance with Article 19 of the UUPK. The application of the principles of justice and consumer protection forms the basis for the laundry service agreement, ensuring consumer rights are protected.
