Al-Abqori: Journal of Islamic Thought Studies is peer-reviewed journal published by Hellow Pustaka Publisher in Collaboration with Sekolah Tinggi Ilmu Tarbiyah (STIT) At-Taqwa Ciparay Bandung. The journal is aimed to publish research contributing to the development of theory, practice, and policy making in Islamic Sciences Research. It therefore intends to create an interface between academic research and its practical application. Abstract

This study examines the implementation of maqashid shari’ah in addressing religious conflicts in Indonesia, particularly in issues involving the construction of houses of worship and the practice of interfaith tolerance. Tensions often arise due to differing interests, religious interpretations, and regulatory complexities, making this issue socially significant. The aim of this research is to analyze how maqashid shari’ah especially the protection of religion (hifdz al-din), life (hifdz al-nafs), and intellect (hifdz al-‘aql) can serve as a welfare-oriented framework for conflict resolution and social harmony. The method employed is a literature review by examining legal documents, national regulations, and academic studies related to maqashid shari’ah and religious conflict. The findings indicate that maqashid shari’ah provides a constructive basis for promoting tolerance through interfaith dialogue, fair regulatory implementation, and multicultural education. This research offers both theoretical insights and practical guidance for policymakers, religious leaders, and communities in formulating peaceful and just conflict-resolution strategies.

Abstract

Ba’i as-salam and al-istishna’ are Islamic sale contracts that allow transactions with advance payment and deferred delivery of goods. These contracts serve as solutions to the economic needs of society, particularly in the agricultural, trade, and manufacturing sectors. This article aims to examine the definitions of ba’i as-salam and al-istishna’, their Sharia foundations, the pillars and conditions of ba’i as-salam, the concept of parallel salam and istishna’, and examples of their application in modern economic life. This study employs a library research method using a descriptive-analytical approach. The findings indicate that ba’i as-salam and al-istishna’ are permissible in Islam as long as they comply with Sharia provisions, such as clarity of the contract object, agreed payment mechanisms, and avoidance of elements of gharar and riba.

Abstract

This research provides the emergence of early Islamic theological issues by focusing on two major sects, namely the Khawarij and the Murji’ah. The study aims to explain the historical background of the emergence of these two sects, their theological doctrines, and their influence on the development of Islamic thought. This research employs a qualitative method with a literature review approach, analyzing both classical and contemporary sources. The findings indicate that the Khawarij developed a strict and exclusive theology, including the practice of takfīr toward perpetrators of major sins, while the Murji’ah emerged as a moderate response by postponing judgment of faith to Allah (Swt.). Both sects made significant contributions to the discourse of Islamic theology.

Abstract

This study aims to analyze the implementation of Article 14 Paragraph (3) of South Ogan Komering Ulu Regency Regulation Number 23 of 2024 concerning the Provision of Parking Services on Public Roads and examine it from a siyasah fiqh perspective. The research method used was a qualitative method with a field research approach. Data were obtained through interviews with the Transportation Agency, market heads, parking attendants, and the public as parking service users, supported by secondary data from relevant literature. The results indicate that the implementation of the parking policy has been running quite well, indicated by the existence of a parking attendant legality system through a Decree (SK), the use of official barcode-based identification, and the provision of attributes as identification. Furthermore, the implementation of a deposit system with local governments serves as an indicator for determining parking legality. As of 2026, no significant reports of illegal parking or illegal levies were found. However, obstacles remain, such as incomplete parking attendant attributes and practices of evading supervisors. From a fiqh siyasah perspective, this policy reflects the principles of public interest, justice, and oversight (hisbah) in the management of public affairs. The government has fulfilled its role in maintaining order and preventing practices detrimental to the public. However, improvements in oversight and law enforcement are needed to ensure optimal and sustainable policy implementation.

Abstract

This study aims to examine the existence of the Mapati tradition in the lives of the Tuban community and to understand how it is maintained amidst the development of Islamic values. The Mapati tradition is a four-month pregnancy ritual imbued with symbolic meaning and prayers for the safety of the mother and unborn child. This study used a qualitative approach with descriptive methods through observation, interviews, and documentation of the local community. The results indicate that the Mapati tradition still exists and continues to be practiced, although it has undergone adjustments to Islamic teachings. Elements of local culture deemed inappropriate are being abandoned, while practices aligned with Islamic values, such as prayer recitation, tahlil (Islamic rituals), and almsgiving, remain. This demonstrates the process of acculturation between local culture and Islamic teachings, creating a distinctive form of religious practice. Thus, the Mapati tradition serves not only as a cultural heritage but also as a medium for integrating social and religious values within Tuban society.
