Abstract

Objective: This study aims to analyze the legal standing and binding strength of the PPJB Deed in land rights transfer transactions, as well as to analyze the legal protection for the parties involved in a PPJB executed after tax obligations have been fulfilled. Method: This study is a normative legal research utilizing a statutory approach and a conceptual approach, supported by primary, secondary, and tertiary legal materials collected through a literature review and analyzed qualitatively. As the analytical framework, the theory of the rule of law, the theory of legal certainty, the theory of legal protection, and the theory of contract are applied to examine the issues formulated in this research. Results: The results of the study indicate that the PPJB deed is a preliminary agreement that is obligatory, valid, and binding upon the parties, and possesses evidentiary value as an authentic deed, yet it does not result in the legal transfer of land rights. Legal protection for the parties is realized through the drafting of the PPJB by a Notary, the fulfillment of BPHTB and Income Tax (PPh) obligations, and the satisfaction of administrative requirements prior to the execution of the AJB. Novelty: Issues arise due to tax regulations specifying that the PPJB serves as the basis for when the Land and Building Title Transfer Tax (BPHTB) becomes due, whereas the legal transfer of rights only occurs after the AJB is executed and registered.

Abstract

Objective: This article argues that effective prevention requires criminal law to operate together with AML/CFT controls, anti-fraud systems, transaction monitoring, inter-agency coordination, early asset restraint and consumer protection. Method: The study combines doctrinal analysis of Uzbek legislation, risk-based compliance analysis, a limited comparison with Kazakhstan, Russia and the United States, and review of publicly documented enforcement episodes. Results: The principal gaps are the absence of published pyramid-specific typologies, a consolidated official warning mechanism, coordinated real-time response and a victim-oriented asset-recovery framework. Priority reforms should therefore focus on early detection and interruption of collection flows rather than on increasing punishment. Novelty: It proposes a legal-economic test for distinguishing pyramids from lawful commercial and investment models and identifies the transactional indicators available to banks and payment organisations.

Abstract

Objective: This paper examines a new trend in Nigerian politics that is defined by the increasing power of elite players who operate outside of official party lines. The paper examines how political players maintain their relevance in the face of rival party formations, the institutional framework that permits this kind of dual positioning, and the consequences of these dynamics for Nigerian democratic governance, party ideology, and accountability. Method: The study uses a qualitative and descriptive research design based on media reports, documentary sources, and previously published literature on Nigerian party politics. It is grounded in elite theory and patron-client theory. Results: The results show that through elite broking, institutional penetration, patronage networks, electoral coordination, and discursive control over political narratives, dominant political actors have been able to simultaneously influence both ruling and opposition parties due to weak party institutions, patronage-driven politics, and the personalisation of power. Novelty: The paper conceptualizes "political dualism" and "trans-partisan hegemony" as analytical frameworks for comprehending the growing convergence between ruling and opposition political structures in Nigeria's Fourth Republic, using Nyesom Wike's political trajectory as a case study. The study comes to the conclusion that the "Wike phenomenon" is a reflection of a larger structural situation in which formal party systems are increasingly replaced by transpartisan elite structures as a means of exercising substantive political authority.

Abstract

Objective: This study examined the implementation of the policy on digital learning media use at SDN 001 Barong Tongkok, Kutai Barat Regency, with particular attention to instructional planning, instructional implementation, learning process assessment, and its perceived contribution to students' learning motivation under Permendikbudristek Number 16 of 2022. Method: A qualitative descriptive design was employed with 13 informants, including the principal, teachers, the school operator, and education staff. Data were collected through semi-structured interviews, classroom observations, questionnaires, and documentation. Questionnaire responses were summarized using frequencies and percentages to support qualitative interpretation. Results: Policy implementation was generally perceived positively. In instructional planning, 10 informants (76.92%) strongly agreed and 3 (23.08%) agreed; in instructional implementation, 11 (84.62%) strongly agreed and 2 (15.38%) agreed; and in learning process assessment, 9 (69.23%) strongly agreed, 3 (23.08%) agreed, and 1 (7.69%) disagreed. Digital media were perceived to support students' interest, attention, enthusiasm, confidence in asking and answering questions, persistence, and classroom participation. Supporting factors included principal leadership, teacher competence and innovation, digital facilities, internet access, technical assistance, parental and school committee support, and positive student responses. Barriers included insufficient devices, unstable internet connectivity, uneven teacher competence, limited preparation time, differences in students' digital literacy, budget constraints, and inconsistent use across classrooms. Novelty: By integrating policy implementation, instructional processes, organizational capacity, and student motivation within a single elementary school case, this study shows that meaningful digital learning depends on leadership, teacher capacity, technical support, and institutional consistency rather than on technology availability alone.

Abstract

Objective:  This study aimed to analyze the level of community participation in the preparation of the Regional Government Work Plan in Nyuatan District, West Kutai Regency, based on Arnstein’s Ladder of Citizen Participation, as well as to identify the supporting and inhibiting factors affecting such participation. The study employed a descriptive approach by integrating qualitative and quantitative data. Method: Data were collected through interviews, observations, documentation, and a recapitulation of respondents’ responses. The data were analyzed using the Miles and Huberman model, which consisted of data reduction, data display, and conclusion drawing and verification.  Results: The results indicated that community participation was not situated at the level of non-participation. This was demonstrated by the predominance of strongly disagree responses for the manipulation indicator at 94.44% and the therapy indicator at 92.59%. For the informing indicator, 94.44% of respondents strongly disagreed that information was limited and communicated only in a one-way manner, although the interviews revealed that access to planning documents still needed to be expanded. The consultation and placation indicators each received 98.15% strongly agree responses, indicating that the community had been provided with opportunities to submit proposals and participate through community representatives. The partnership indicator received 92.59% strongly agree responses, delegated power received 96.23%, and citizen control received 92.59%, reflecting the development of dialogue, partnership, priority setting, and community involvement in monitoring and managing local development programs.  Novelty: Nevertheless, final decisions remained subject to governmental authority, regional priorities, and budgetary capacity. Supporting factors included the Development Planning Forum, government openness, village government support, the involvement of community leaders, and a deliberative culture. Inhibiting factors included limited public understanding, unequal access to information, inadequate feedback on proposals, geographical constraints, communication limitations, and the passivity of some community members. It was concluded that community participation tended to be positioned at the partnership level and was progressing toward delegated power, although it had not yet substantively achieved full citizen control.

Abstract

Objective: Government internal supervision plays a strategic role in ensuring compliance, accountability, and improved performance among civil servants. This study aims to analyze the implementation of the government internal supervision policy based on Minister of Home Affairs Regulation Number 107 of 2017 at the Regional Inspectorate of West Kutai Regency and to identify the role and constraints of internal supervision in improving civil servant performance. Method: This study employed a descriptive qualitative approach. Data were collected through interviews with the Regional Inspector, auditors or Government Internal Supervisory Apparatus personnel, representatives of the Human Resources Development and Personnel Agency, and civil servants, supported by observation and documentation. Data were analyzed using the Miles, Huberman, and Saldaña model, comprising data condensation, data display, and conclusion drawing and verification. Results: The findings indicate that the internal supervision policy has generally been implemented through policy communication, resource support, implementers’ commitment, division of responsibilities, standard operating procedures, and the Annual Supervision Work Program. Novelty: Based on George R. Terry’s supervision indicators, the process includes establishing standards, measuring work performance, comparing actual performance with established standards, and taking corrective action. Internal supervision contributes to improving discipline, compliance, professionalism, administrative quality, and personnel accountability. However, its implementation remains suboptimal due to limited numbers and competencies of supervisory personnel, budgetary and infrastructure constraints, extensive supervisory coverage, weak evaluation documentation, inconsistent discipline, and limited commitment among some audited entities to follow up on recommendations. Therefore, internal supervision has positively contributed to civil servant performance but requires stronger supervisory capacity, monitoring systems, and consistent follow-up.

Abstract

Objective: This study aims to analyze the role of the Mook Manaar Bulat Sub-District Government in implementing the Foster Parent Program for stunting reduction in West Kutai Regency, East Kalimantan, and to identify the supporting and inhibiting factors affecting its implementation. Method: This study employed a descriptive qualitative case study approach. Data were collected through interviews, observations, and document analysis involving sub-district officials, village governments, health workers, community leaders, integrated health post cadres, foster parents, and beneficiary families. Data were analyzed using George C. Edward III’s policy implementation framework, covering communication, resources, disposition, and bureaucratic structure, with source triangulation to ensure data credibility. Results: The findings show that the sub-district government plays a strategic role as a coordinator, facilitator, supervisor, mentor, and mobilizer of community participation. Cross-sector collaboration among village governments, health centers, integrated health post cadres, Family Welfare Empowerment groups, community leaders, and foster parents has strengthened program implementation. However, limited funding, fragmented data, geographical barriers, transportation constraints, inconsistent reporting, and low public awareness remain major challenges. Novelty: This study proposes a collaborative local governance perspective by highlighting the sub-district government as the key intermediary connecting government institutions, communities, and private stakeholders. The findings demonstrate that strengthening sub-district governance and cross-sector collaboration can improve the effectiveness and sustainability of stunting reduction programs in rural and geographically disadvantaged areas.

Abstract

Objective: This study evaluates the implementation of the Indonesia Smart Program (Program Indonesia Pintar/PIP) in improving educational access for economically disadvantaged students. It examines the program's effectiveness in reducing school dropout risk and identifies the factors influencing its implementation. Method: A descriptive qualitative approach was employed. Data were collected through interviews, observations, and document analysis involving the school principal, teachers, PIP beneficiary students, and their parents at SDN 001 Barong Tongkok, West Kutai Regency. Data were analyzed using policy implementation dimensions, including communication, resources, implementers' disposition, organizational structure, implementation process, and targeting accuracy. Results: The findings indicate that the implementation of PIP at SDN 001 Barong Tongkok has generally been effective. The school successfully carried out program socialization, beneficiary identification, data verification, proposal submission, and assistance during fund disbursement. The financial assistance contributed to reducing students' risk of dropping out by supporting essential educational expenditures, including uniforms, school supplies, books, and transportation-related needs. Program implementation was strengthened by effective communication, committed implementers, clear administrative procedures, and reliable beneficiary data. However, several challenges remain, including delayed information dissemination, incomplete administrative documents, and the exclusion of some eligible students from receiving assistance. Novelty: This study provides an empirical policy evaluation of the Indonesia Smart Program at the school implementation level by integrating policy implementation dimensions with beneficiary targeting accuracy. The findings offer practical evidence for improving educational assistance policies through more accurate beneficiary identification, continuous data updating, and strengthened implementation mechanisms to enhance equitable educational access.

Abstract

Objective: This study aims to analyze the role of the principal in improving teacher performance at SDN 015 Mook Manaar Bulatn, West Kutai Regency, Indonesia, based on the Regulation of the Minister of Primary and Secondary Education of the Republic of Indonesia Number 7 of 2025 concerning the Assignment of Teachers as School Principals. It also identifies the supporting and inhibiting factors affecting the implementation of the principal’s leadership role. Method: This study employed a descriptive qualitative approach. Data were collected through interviews, observations, and document analysis involving the principal, classroom teachers, and the school supervisor. Data were analyzed using the interactive model of data reduction, data display, and conclusion drawing to obtain a comprehensive understanding of the principal’s role in improving teacher performance. Results:  The findings reveal that the principal effectively implemented the seven leadership roles of educator, manager, administrator, supervisor, leader, innovator, and motivator, contributing to improved teacher performance. Leadership and motivation were rated excellent, while the remaining dimensions were rated good. Teacher performance was supported by strong leadership commitment, collaboration, and stakeholder support but constrained by limited resources, supervision time, technological competence, and reward systems. Novelty: This study contributes to the literature by examining principal leadership through the perspective of Indonesia’s newly enacted Ministerial Regulation No. 7 of 2025 and integrating it with Mulyasa’s seven-dimensional leadership framework, providing updated empirical evidence on policy-based school leadership for improving teacher performance in primary education.

Abstract

Objective: This scientific article comprehensively analyzes the most pressing problems of the criminal-legal evaluation of traffic accidents involving unmanned vehicles equipped with artificial intelligence technologies in modern society. Method: Within the framework of the research, gaps in the current criminal legislation have been thoroughly studied, particularly theoretical and practical issues such as identifying the subject of the crime, distinguishing between negligence and intentional guilt, and establishing the boundaries of legal liability for the manufacturer, programmer, remote operator, and vehicle owner. By engaging in a scientific debate with the views of foreign scholars and advanced international practices, the author has developed his own personal approaches. Results: The article also deeply discusses the ethical dilemmas of robotics, the criminal consequences of cyberattacks on computer systems, and the necessity of introducing corporate criminal liability. Novelty: At the end of the study, detailed, scientifically grounded, and step-by-step proposals and recommendations are put forward aimed at adapting the Criminal Code of the Republic of Uzbekistan to modern technological challenges, creating special blanket norms, and developing clear legal mechanisms for investigating such crimes.
