Abstract

Ketegangan antara idealisme normatif syariah dan realitas politik hukum dalam negara demokratis masih menjadi persoalan mendasar dalam pengembangan hukum Islam kontemporer. Pendekatan legalistik-tekstual yang dominan sering kali tidak mampu merespons dinamika sosial, pluralitas, dan tuntutan keadilan substantif. Dalam konteks ini, qawa’id maqashidiyyah menawarkan kerangka etik dan teleologis yang berpotensi menjembatani nilai-nilai syariah dengan prinsip-prinsip demokrasi modern. Penelitian ini bertujuan untuk menganalisis relevansi qawa’id maqashidiyyah dalam pembentukan legislasi syariah di negara demokratis serta menawarkan paradigma normatif baru dalam politik hukum Islam, yaitu Maqashid-Based Legal Democracy. Penelitian ini menggunakan pendekatan kualitatif dengan metode normatif-filosofis melalui studi kepustakaan. Data diperoleh dari sumber primer berupa karya klasik ulama ushul fiqh dan sumber sekunder berupa buku, artikel jurnal bereputasi, serta kajian kebijakan hukum di Indonesia, Malaysia, dan Tunisia. Analisis dilakukan secara deskriptif-analitis dan hermeneutik dengan triangulasi teori klasik dan kontemporer. Hasil penelitian menunjukkan bahwa qawa’id maqashidiyyah memiliki relevansi kuat sebagai dasar etik, epistemologis, dan prosedural dalam legislasi syariah di negara demokratis. Maqashid mendorong pergeseran paradigma dari legalistik menuju etik-normatif, memperkuat keadilan sosial, perlindungan hak asasi manusia, serta tata kelola pemerintahan yang demokratis dan inklusif. Paradigma Maqashid-Based Legal Democracy terbukti mampu mensintesiskan nilai syariah dengan demokrasi substantif tanpa kehilangan dimensi spiritual hukum Islam. Implikasi penelitian ini menegaskan bahwa maqashid al-syari‘ah dapat dijadikan kerangka normatif dan praktis bagi pembuat kebijakan dalam merumuskan hukum Islam yang etis, adil, dan responsif terhadap dinamika demokrasi modern.

Abstract

Islamic family law reform, particularly in the areas of divorce and child custody, has become a crucial issue in line with the increasing divorce rate and demands for gender justice and child protection in the modern era. Family law practice is often still dominated by a textual-formal approach that is not fully responsive to social and humanitarian dynamics. This study aims to analyze the role of maqasid al-syari’ah as a philosophical and methodological foundation in the reform of divorce and child custody law. This study uses a qualitative approach with a normative-philosophical legal research method through a literature review of primary, secondary, and tertiary legal sources, which are analyzed using deductive and inductive content analysis techniques. The results show that maqāṣid al-syarī‘ah, particularly the principles of hifz al-din, hifz al-nafs, hifz al-nasl, and hifz al-‘aql, play a significant role in driving a paradigm shift in Islamic family law from textual legalism to substantive justice. The maqasid approach has proven capable of accommodating the protection of women’s and children’s rights and bridging the gap between sharia norms and modern social realities. The implications of this research confirm that maqāṣid al-syarī‘ah can serve as a normative and methodological basis for reforming regulations and practices of religious justice that are more humane, gender-just, and child-oriented in the context of contemporary Islamic family law.

Abstract

Hadits Ahkam merupakan komponen penting dari sumber hukum Islam, khususnya dalam mengatur aspek praktis kehidupan Muslim. Sebagai subbagian hadits yang secara langsung membahas hukum, Hadits Ahkam telah memainkan peran penting dalam perumusan dan pengembangan hukum Islam sejak awal Islam. Meskipun demikian, otoritas dan fungsinya terkadang dipertanyakan atau disalahpahami, baik oleh kelompok Muslim tertentu maupun para sarjana non-Muslim. Artikel ini bertujuan untuk menganalisis posisi dan signifikansi Hadits Ahkam dalam proses penentuan hukum Islam. Dengan menggunakan riset pustaka kualitatif, studi ini meneliti ayat-ayat Al-Qur'an, Hadits Ahkam terpilih, dan pendapat para sarjana dalam disiplin ilmu usul al-fiqh dan studi hadits. Temuan menunjukkan bahwa Hadits Ahkam tidak dapat dipisahkan dari Al-Qur'an, berfungsi sebagai sumber penjelasan, pelengkap, dan otoritatif dalam memperoleh hukum. Penolakan atau marginalisasi Hadits Ahkam sebagian besar berasal dari kurangnya pemahaman komprehensif tentang hubungan antara Al-Qur'an dan Sunnah. Oleh karena itu, mengakui kedudukan yang tepat dari hukum-hukum Hadits sangat penting untuk menjaga integritas dan koherensi hukum Islam.

Abstract

This study examines the implementation of alimony law within contemporary family life through a socio-anthropological lens, focusing on the interplay between formal legal frameworks and socio-cultural practices. While alimony regulations are designed to ensure post-divorce economic justice, their application often diverges from legal prescriptions due to cultural norms, gender relations, and informal negotiation processes. Using a qualitative approach, this research draws on in-depth interviews, observations, and document analysis to explore how individuals interpret, negotiate, and comply with alimony obligations in everyday life. The findings reveal that alimony practices are not solely determined by legal mandates but are significantly shaped by local values, kinship structures, and power dynamics within families. In many cases, cultural expectations and social pressures either reinforce or undermine formal legal provisions, leading to variations in compliance and enforcement. Additionally, gendered perceptions of responsibility and economic roles play a crucial role in influencing both the willingness to provide and the ability to claim alimony. This study contributes to the literature by highlighting the gap between law in the books and law in action, emphasizing the importance of integrating socio-cultural considerations into legal policy design. It argues that effective implementation of alimony law requires not only institutional enforcement but also culturally sensitive approaches that acknowledge the lived realities of family life.

Abstract

This study critically examines the role of husband’s consent in abortion decisions from the perspective of Islamic law, with particular emphasis on the concepts of legitimacy and authority. While classical Islamic jurisprudence recognizes the husband’s position within the marital relationship, contemporary debates increasingly question the extent to which such authority should influence women’s reproductive rights. This research seeks to explore whether the requirement of husband’s consent constitutes a legitimate legal norm or reflects socio-cultural interpretations that extend beyond foundational Islamic legal principles. Using a normative and socio-legal approach, this study analyzes classical and contemporary Islamic legal texts, including Qur’anic interpretations, hadith, and scholarly opinions across different schools of thought, alongside contemporary legal practices in Muslim-majority societies. The findings reveal that there is no unanimous consensus among Islamic jurists regarding the necessity of husband’s consent in abortion, particularly in cases involving health risks, early-stage pregnancy, or emergency conditions. Instead, the requirement often emerges from patriarchal interpretations and socio-cultural constructs rather than explicit legal mandates. Furthermore, the study highlights a growing tension between traditional notions of male authority and evolving understandings of women’s autonomy and bodily integrity. It argues that the legitimacy of husband’s consent must be re-evaluated within a broader framework of justice (maqāṣid al-sharīʿah), which prioritizes the protection of life, dignity, and well-being.

Abstract

The rapid growth of Islamic finance has been accompanied by increasing concerns over its tendency toward formalistic legal compliance, often prioritizing contractual validity over substantive socio-economic impact. This study seeks to critically examine the prevailing legalistic orientation and to reframe the role of maqāṣid al-sharīʿah as a foundational framework for value-based impact in contemporary Islamic finance. While maqāṣid al-sharīʿah has long been recognized as the higher objectives of Islamic law, its operationalization within financial practices remains limited and frequently reduced to symbolic justification rather than substantive guidance. This research adopts a qualitative and conceptual approach, combining normative analysis of classical Islamic jurisprudence with contemporary socio-economic and financial discourse. It explores how maqāṣid al-sharīʿah—particularly the principles of justice (ʿadl), welfare (maṣlaḥah), and prevention of harm (ḍarar)—can be reinterpreted to address current challenges such as financial inclusion, ethical investment, and social equity. The findings reveal a significant gap between the theoretical ideals of maqāṣid and their practical implementation, largely due to institutional inertia, regulatory limitations, and the dominance of risk-averse, compliance-driven models. Furthermore, the study proposes a shift from a rule-based paradigm to a value-based framework that emphasizes impact-oriented finance. This transformation requires integrating maqāṣid into governance structures, product development, and performance measurement, thereby aligning financial activities with broader socio-economic objectives. The paper argues that such a reframing is essential to enhance the credibility, sustainability, and transformative potential of Islamic finance in the global financial system.

Abstract

The interaction between Islamic reformist movements and local cultural traditions remains a complex and contested issue in contemporary Muslim societies. This study examines how Muhammadiyah leaders interpret and respond to the Caci dance tradition performed in wedding rituals in West Manggarai, Indonesia, through the lens of ‘urf (customary practice) in Islamic law. While Muhammadiyah is often associated with a purifying approach to religion, local realities frequently require negotiation between doctrinal norms and deeply rooted cultural expressions. This research adopts a qualitative case-oriented approach, drawing on in-depth interviews, document analysis, and socio-religious observations to explore the perspectives of Muhammadiyah leaders in Tiwu Nampar Village. The analysis focuses on how ‘urf is utilized as a conceptual framework to assess the legitimacy of the Caci dance within Islamic teachings. The findings reveal a spectrum of views, ranging from rejection based on concerns over elements perceived as inconsistent with Islamic values, to conditional acceptance that emphasizes cultural preservation as long as it does not violate core religious principles. Furthermore, the study demonstrates that ‘urf serves as a mediating tool that allows for contextual interpretation of Islamic norms in relation to local traditions. Muhammadiyah leaders engage in a process of negotiation that reflects both their commitment to religious reform and their awareness of social cohesion within the community. This negotiation highlights the dynamic nature of Islamic law, where cultural practices are neither wholly accepted nor rejected, but critically evaluated based on their alignment with ethical and religious objectives. The study contributes to broader discussions on Islamic reformism, legal pluralism, and the accommodation of local culture within Islamic jurisprudence. It argues that understanding the role of ‘urf is essential for bridging the gap between normative Islamic teachings and lived cultural realities. Ultimately, this research underscores the importance of contextual and dialogical approaches in addressing tensions between tradition and religious norms in contemporary Muslim communities.
