Abstract

Several classical Islamic legal regulations related to child protection still exhibit patriarchal tendencies, which can lead to gender inequality. This is evident in aspects such as the distribution of custody rights (hadhanah), the obligation to provide for children, and the decision-making process that affects children's lives, which are often based on literal interpretations of texts without considering the essence and universal objectives of sharia (maqashid al-syari'ah). Therefore, this research aims to reconstruct the concept of gender just child protection within the framework of Islamic law. Methodologically, this research is a library research study with a qualitative approach oriented towards philosophical- normative analysis. Primary data sources include authoritative texts of the Qur'an and Hadith, as well as classical and contemporary works of Islamic jurisprudence, while secondary sources are obtained from academic literature related to gender studies, Islamic family law, and maqashid al-syari'ah. The data analysis technique was carried out through two main stages: thematic content analysis to identify prevailing legal discourse patterns, followed by critical-reflective analysis using the maqashidiyah approach to evaluate and reconstruct these concepts. The research findings reveal that several conventional fiqh constructions regarding child protection tend to ignore the principle of substantive justice, particularly in the establishment of rigid gender roles. As an alternative, this study reconstructs the concept of gender-just child protection through a reinterpretation of the hadhanah institution as a collective responsibility (takaful) based on the principle of the benefit of the child (maslahat al-thifl).

Abstract

This study aims to improve students’ religious attitudes through Fiqh learning using a Classroom Action Research (CAR) approach at MTs Al-Islamiyah Bebidas. The religious attitudes examined include discipline in worship, honesty, responsibility, social awareness, and learning engagement. This research employed the Classroom Action Research design based on the Kemmis and McTaggart model, consisting of planning, action, observation, and reflection stages. The research subjects were eighth-grade students of MTs Al-Islamiyah Bebidas. The study was conducted in two cycles. Data were collected through observation, questionnaires, and documentation, and analyzed using descriptive qualitative and quantitative techniques. The results indicate a significant improvement in students’ religious attitudes from the pre-action stage to the second cycle. The average level of religious attitudes increased from a low category in the pre-action stage to a moderate category in Cycle I and reached a good category in Cycle II. These findings demonstrate that contextual and applicable Fiqh learning implemented through Classroom Action Research is effective in improving students’ religious attitudes.

Abstract

The transformation of digitally-based work systems and the emergence of flexible working patterns after the COVID-19 pandemic present new opportunities and dilemmas for working women. On the one hand, flexibility in working hours and locations provides women with the space to balance their professional careers and domestic responsibilities. However, on the other hand, entrenched patriarchal norms mean that they continue to bear a double burden. This study aims to reveal the mechanisms of role negotiation between husbands and wives in families where the wife has a career in the context of flexible and remote work. This study uses a phenomenological qualitative approach with data collection techniques through literature study, document analysis, and observation of developing social dynamics. The results show that remote work encourages a more equal division of roles, both in household responsibilities and emotional support between spouses. However, traditional gender norms remain a major obstacle, causing women to often face psychological and social pressure. Education and gender awareness have been proven to influence a couple's ability to adapt. This study emphasizes the need for policies that promote gender equality in flexible work systems as an effort to achieve a balance of roles in modern families.

Abstract

This article aims to investigate the tradition of muhadlarah in Mts Salafiyyah Menganti Gresik. It focuses on how this tradition serves as a medium for Mts Salafiyyah students to learn and study Islam as Rahmatan lil 'alamin or Islam for All. By engaging in muhadlarah, students not only deepen their understanding of Islamic teachings but also learn to convey these teachings in a manner that is respectful, non-intimidating, and accessible to diverse audiences. This approach ensures that the values of kindness, tolerance, and universal welfare are integral to their religious education and future endeavors as da'is. This study employs a qualitative method and a sociological communication approach through in-depth interviews with various relevant resources, including the school's headmasters.  This study discovered that the tradition of muhadlarah plays a significant influence in developing students into autonomous individuals and, on the other hand, increasing their eagerness to study Islam as rahmatan lil 'alamin.  It was also discovered that teachers and assatidz play a vital role in directing the  students  to  study  and  understand Islam. In fact, by  conducting this tradition, students have a bigger    enthusiasm    on    reading    books    about    Islam, discussing Islam, and more importantly, attempting to know the danger of radical acts (radicalism) in religious lives and practices.

Abstract

This study discusses gender relations in modern households, focusing on the pattern and factors of domestic labor division between dual-earner couples. The research is motivated by the persistence of patriarchal culture that causes unequal domestic roles despite women’s increasing participation in the public sphere. The aim of this study is to analyze the forms of domestic labor division, the influencing factors, and the efforts to achieve equality within modern households. Using a qualitative descriptive approach through a literature review of academic sources and statistical data, the results indicate that domestic work division is influenced by economic factors, working hours, cultural norms, education level, presence of children, and power relations in the family. Efforts to promote equality include fostering awareness and communication, utilizing household technology, and providing emotional support between partners. In conclusion, gender equality in domestic life can be achieved when husbands and wives build cooperative relationships grounded in justice and compassion as taught in Islam.

Abstract

The phenomenon of inequality in marital relations, particularly in divorce practices, remains a significant issue in the study of family law in Indonesia. One crucial point is the concept of divorce, which shapes the distribution of power between husband and wife. This study examines the issue of gender inequality in the concept of divorce in classical Islamic jurisprudence (fiqh) and Indonesian positive law. The aim of the study is to analyze the fundamental differences between the right of divorce in both systems and to assess the resulting level of gender justice. Using a comparative literature study method, this study examines Islamic jurisprudence sources, laws and regulations, and empirical findings related to divorce practices. The results show that classical Islamic jurisprudence places the right of divorce as the husband's prerogative, creating an imbalance in power relations, while positive law provides a more equal space through divorce by divorce and divorce by lawsuit. However, the implementation of positive law still presents obstacles, such as the heavy burden of proof in divorce by lawsuit and weak guarantees of post-divorce support. The novelty of this study lies in the agreement on the reconstruction of the right of divorce, which emphasizes substantive equality between husband and wife. This proposal has the potential to strengthen women's protection and improve justice in the Indonesian family law system.
