Abstract

In jurisprudence there is an idea of  waqf mu’aqqat (waqf only in a certain duration). Imam Malik argues that the waqf contract is Mulazamat (the possession of a waqf object passes from wakif belongs to God-general). However, he argues that waqf is not necessarily done by Mu’abbad (forever); it may be done within a certain period of time, provided that the waqf shall not be withdrawn until the agreed duration is completed. Indonesian Muslims for hundreds of years have already identified waqf with (in the form of) land, and movable objects of a long lasting nature. Thus, Law no. 41 of 2004 and PP No. 42/2006 is projected as a means of social engineering (social engineering), make changes in thoughts, attitudes and behavior of Muslims to breathe with the spirit of the Act. One of the new regulations in the Waqf Act is the development of waqf objects.

Abstract

Endowments to save a great potential to be developed into a productive asset, which in the end was not only able to support socio-religious services, but also directed to support the various initiatives and social justice objectives. However, during this endowment has not played a significant role in realizing the benefit, the welfare of the people and social justice. Often heard slogan that endowments can be empowered to address issues of poverty, underdevelopment, poor nutrition, and so on. But there is no clear conceptual framework of how endowments can be developed to be an effective instrument for social change toward a more guarantee the welfare and justice. Abdullah Ahmad an-Na’im proposes transformation and reviewing their philanthropic tradition, in order to develop socio-economic communities, promote the fulfillment of human rights, political administration of justice, and guarantee the autonomy of the community. In addition to an-Na’im proposed above, there are several strategies in the development of productive endowments, among which are: the development of productive endowments through a reinterpretation of the concept of waqf, endowments regulatory legislation, issuance of certificates of endowment money, and productive waqf fund raising strategy.

Abstract

In Indonesia, Cash Waqf investments are IDR 1.4 trillion, showing the strong potential of the financial instrument. However, alternative investment models are needed to obtain optimal results. The models support strategic programs in various sectors, including education, health, economy, humanity, and da'wah. Therefore, this research aimed to identify Cash Waqf investment models using a qualitative method with a literature study approach. The literature review adopts the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) model. The results show that there are 10 Cash Waqf investment models implemented in Indonesia, namely (1) Micro, Small and Medium Enterprises (MSME) Financing, (2) Cash Waqf Linked Sukuk, (3) Islamic Social Entrepreneurship, (4) Education Management and Operations, (5) General Credit Loans, (6) Sharia Bank Cooperation, (7) Land Waqf Development, (8) Stock Waqf, (9) Hospitals, and (10) Waqf Bank. The government and Nadzir Waqf need to respond to the results by selecting a form of Cash Waqf investment with the highest value.

Abstract

The enactment of Law Number 23 Year 2011 on the Management of Zakat, making its own problems for sharia banking in helping the management of zakat. The role and function of sharia banking is not clear and weak. In addition to unclear, zakat management arrangements through sharia banking also pose legal political problems. This is because since the enactment of Law No. 23 of 2011 on the Management of Zakat is not accommodated expressly and concretely as an institution authorized as a manager of zakat. The vagueness of the role of sharia banking in zakat management regulation is a manifestation of vagueness and void of norms. Although the legal construction of banking roles and functions in accordance with Article 4 paragraph (2) of Law Number 21 Year 2008 concerning Sharia Banking is expanding, that is, syariah banking does not only carry out the activities of collecting funds and channeling public funds but can perform social functions as bait al-mall in collecting and distributing social funds of people as zakat. The enactment of the new zakat management law is expected to bring about big and positive changes, but in reality it seems not yet able to legally bind in applying the functions of zakat management.

Abstract

Various programs have been presented for the distribution of zakat, donations, and shadaqah that have been collected. The purpose of zakat, infaq, and shadaqah is not only to help the poor related to consumptive things, but it also has a permanent goal, that is to alleviate poverty. One goal of the Sustainable Development Goals (SDGs) in the first of the 17 goals and 169 targets,  specifically ending poverty in any form and anywhere. In addition, there are still benefits from zakat, donations, and alms for mustahics, including the health sector. The Sumedang Sehat program is a BAZNAS program in the Sumedang Regency in the health sector. As one program established and funded by BAZNAS Sumedang District, the Sumedang Sehat program requires evidence of the impact and how much impact it has on the program in order to be transparent about the zakat, infaq, and alms funds that have been distributed. This study aims to calculate the impact of a BAZNAS program, namely the Sumedang Sehat program, using social return on investment (SROI). The results of this study showed an SROI ratio of 51.22:1. Every IDR 1 invested resulted in IDR 51.22, which benefits both economically, socially, and environmentally. This means that the Sumedang Sehat program has provided benefits 51.22 times greater than the value of the invested input.

Abstract

This study investigates the implementation of Good Nazir Governance (GNG) in Indonesian Waqf Institutions, utilizing the GNG Index as an assessment tool. Despite the considerable potential of waqf in Indonesia, governance practices remain relatively underdeveloped. While the GNG Index presents a novel instrument for evaluating waqf performance, prior research on its application has been limited. This research aims to fill this gap by examining the extent to which waqf institutions adhere to GNG principles. Employing a mixed methods approach, combining qualitative and quantitative data collected through purposive sampling and a questionnaire, this study reveals that only 45 percent of the 20 sampled waqf institutions achieve a "compliant" rating on the GNG Index. These findings highlight the need for further efforts to enhance GNG practices in Indonesian waqf institutions.

In Islamic economics it is known that waqf institution as an institution to help social prosperity. The Prophet himself initially initiated this institution in accordance with the Qur'an which invites to spend and devote something of value and love in order to attain the goodness and happiness of Allah (al-birr). This research is descriptive analysis, the writer presents all data about waqf. This study concludes that the scholar's debate on al-mauquf 'alaih affirms that the effort to determine targets and provisions of wakaf is very open. The reference is that the goal should be qurbah or al-birr (virtue) either according to the size of shari'ah or wakif is the underlying principle of any contemporary interpretation in empowering the use of wakaf.

Abstract

The goal of this study was to examine the variables that may affect Muslims in the Z generation's desire to make digital zakat payments. The UTAUT theory was employed in this study. PLS-SEM was used to analyze the data and test the hypothesis. 158 users of digital payment systems responded to the survey in total. The study's findings indicate that while performance expectancy has no impact on the intention to pay zakat through digital payments, effort expectancy, social influence, conducive conditions, and trust do. Additionally, trust promotes conditions and mediates social effects on behavioral intention, but it does not mediate performance expectations or effort expectations.
