Abstract

The development of information and communication technology has led to a significant increase in children’s use of social media, which on the one hand provides educational benefits, but on the other hand poses various risks of violations of children’s rights in the digital sphere. This condition requires the presence of adequate and adaptive legal protection, while the legal framework in Indonesia still shows a normative vacuum, particularly regarding the minimum age limit for social media users. This study aims to analyze the legal regulation of child protection for social media users in Indonesia and to formulate an ideal legal regulatory concept to ensure the best interests of the child. This research is based on the theory of legal protection and the principle of the best interests of the child, employing a normative legal research method through conceptual and comparative approaches, supported by a literature review of primary, secondary, and tertiary legal materials. The results indicate that although Indonesia has enacted the Child Protection Law, the Electronic Information and Transactions Law, and the Personal Data Protection Law, these regulations do not explicitly regulate the minimum age of children as social media users, resulting in legal protection that remains general and reactive in nature. The discussion emphasizes that this normative vacuum has implications for weak legal certainty and the effectiveness of child protection in the digital environment, while placing greater responsibility for protection on the internal policies of social media platforms. This study concludes that more specific and comprehensive legal regulations regarding children’s use of social media, including the establishment of a minimum age limit, are necessary as a preventive measure to strengthen child legal protection in Indonesia.

Abstract

This study aims to analyze the application of diversion for a child perpetrator of a narcotics offense in Court Decision Number 3/Pid.Sus-Anak/2023/PN Jkt.Brt, as well as the factors considered by the judge in rendering the verdict. This is a normative legal study of a descriptive-analytical nature, employing statutory, case, conceptual, and historical approaches. The findings indicate that diversion could not be implemented in the case at hand because the penalty prescribed under Article 113 paragraph (2) in conjunction with Article 132 paragraph (1) of Law Number 35 of 2009 concerning Narcotics exceeds the seven-year maximum limit stipulated in Article 7 paragraph (2) of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System as a prerequisite for diversion; consequently, the child who was actually in an unequal and exploitative power dynamic with an adult perpetrator was processed through the formal judicial system. The study recommends harmonizing the diversion threshold in Law Number 11 of 2012 with the restorative justice threshold in the new Criminal Procedure Code, and highlights the need for affirmative regulations that explicitly acknowledge the status of the child as a victim of criminal exploitation (child criminal exploitation) within organized narcotics offenses.

Abstract

The ne bis in idem principle in civil law serves to prevent the repeated examination of disputes that have already received a final and binding judgment. However, in the practice of civil litigation in Indonesia, the examination of ne bis in idem exceptions is often conducted concurrently with the examination of the merits of the case, so that cases that are ultimately declared inadmissible must still go through all stages of the trial. This situation raises issues of efficiency and potentially conflicts with the principles of simple, speedy, and cost-effective justice. This study aims to analyze the procedural issues surrounding the examination of the ne bis in idem exception in civil cases and to formulate an ideal concept for its handling as a form of reform in civil procedural law. This study employs a normative legal research method using a statutory approach, a case-based approach, and a conceptual approach. Legal materials were obtained through a literature review of legislation, court decisions, legal literature, and relevant research findings, which were then analyzed qualitatively and prescriptively. The results of this study indicate that the absence of a clear mechanism for preliminary review of the ne bis in idem defense has led to cases that have clearly already been decided being heard through the final stages of trial, thereby reducing judicial efficiency and increasing litigation costs. This study proposes a reconstruction of a document-based preliminary examination mechanism for the ne bis in idem exception, which allows judges to conduct verification early on before proceeding to the substantive examination of the case. This model has the potential to strengthen the implementation of the principles of simple, expeditious, and low-cost justice, as well as to enhance legal certainty in the resolution of civil cases.

Abstract

This research is entitled “Legal Analysis of the Responsibility of Local Government in Addressing the Clean Water Crisis in Marisa Village, Alor Regency, East Nusa Tenggara.” This study aims to analyze the legal responsibility of the local government in fulfilling the community’s need for clean water and to identify the obstacles faced in addressing the clean water crisis. The results show that the local government has undertaken several efforts, including providing water facilities and infrastructure, developing and utilizing water sources, and distributing water to the community. However, these efforts have not been implemented optimally and have not fully met the community’s needs equitably and sustainably. The main obstacles include limited water resources, geographical conditions, inadequate infrastructure, suboptimal management, and budgetary constraints. From a legal perspective, this condition reflects a gap between the local government’s obligations under applicable laws and regulations and the fulfillment of the community’s right to clean water in practice. Therefore, strengthening local government responsibility is necessary through adequate infrastructure development, sustainable water resource management, equitable service delivery, and regular monitoring and evaluation to ensure that the people of Marisa Village can enjoy their right to clean water fairly and sustainably.
