Abstract

Domestic violence (DV) remains a serious and increasingly prevalent issue in Indonesia, despite two decades since the enactment of Law Number 23 of 2004 concerning the Elimination of Domestic Violence. This article analyzes the intricate relationship between domestic violence and the deeply entrenched patriarchal culture within Indonesian society. Employing a qualitative approach through normative legal research and literature review, the study reveals that patriarchal culture constitutes the fundamental root cause of domestic violence, where unequal power relations between men and women place women in subordinate positions, making them vulnerable to various forms of violence. The findings demonstrate that domestic violence is not a matter of economic status or social class, but rather a manifestation of societal perspectives and social constructions that normalize male dominance over women. This study concludes that addressing domestic violence requires a holistic approach that extends beyond legal instruments to encompass cultural transformation and gender equality, beginning from the smallest unit of society—the family. The research advocates for enhanced legal frameworks, improved gender sensitivity among law enforcement officials, and comprehensive educational programs to dismantle patriarchal norms that perpetuate violence against women in domestic settings.

Abstract

The convergence between digital technology and the Intellectual Property (IP) ecosystem has raised serious challenges for the protection of personal data attached to IP holders, ranging from unauthorized data use to identity misuse and data leakage. This study examines privacy protection as a form of digital justice within Indonesia's IP ecosystem and compares it with the legal frameworks of Japan, the European Union, and the United States. Using a normative legal method with a qualitative and comparative approach, this research analyzes primary legal materials, including Indonesia's Personal Data Protection Law, Electronic Information and Transactions Law, and sectoral IP regulations, alongside Japan's APPI, the EU's GDPR, and the US's DMCA and CCPA. The findings show that Indonesia already possesses a normative basis for privacy protection within its IP framework, yet this basis remains fragmented across several laws and has not been fully harmonized in policy or technical implementation. The scope of privacy protection in this context extends across three stages: registration and administration, technology development, and commercialization and enforcement. Comparative analysis reveals that Japan relies on strong institutional oversight, the EU embeds data protection as a fundamental right through privacy by design, while the US applies a flexible, sector-based approach. These findings suggest that Indonesia needs stronger institutional capacity and regulatory harmonization to achieve digital justice in its IP ecosystem.

Abstract

Narcotics-related offenses are serious crimes that frequently utilize couriers as intermediaries within illicit trafficking networks. Law Number 35 of 2009 concerning Narcotics currently fails to clearly distinguish criminal sanctions between drug dealers and couriers. This creates challenges for judges in delivering fair and proportionate verdicts. This study aims to analyze how judges interpret the criminal liability of narcotics couriers and to evaluate the legal reasoning applied in Cikarang District Court Decision Number 375/Pid.Sus/2025/PN Ckr. The study employs a normative-juridical method with a descriptive-analytical approach. Data were collected through a documentary study of legislation, court rulings, and relevant legal literature, followed by qualitative analysis. The findings indicate that the courier's criminal liability in this case was grounded in the element of criminal conspiracy, with the defendant's intent assessed based on their awareness of the risks associated with their actions. The judge applied a broad interpretation that tended to equate the status of the courier with that of the principal offender. Judicial reasoning focused more on formal legal certainty than on substantive justice for the courier, who occupied a vulnerable position. The study recommends a clear legislative distinction regarding sanctions for couriers and encourages judges to give greater consideration to the offender's sociological background to achieve more equitable sentencing.

Abstract

The regulation of rape as a criminal offense under Article 285 of Law No. 1/1946 concerning the former Criminal Code is considered gender-specific because it positions men as perpetrators and women as victims, making it unable to fully accommodate the development of sexual violence and the need for equal legal protection. The enactment of Law No. 1/2023 concerning the new Criminal Code through Article 473 introduces a gender-neutral concept that broadens legal subjects without distinguishing based on sex. This study aims to analyze the application of Article 473 of the new Criminal Code and its compatibility with the concept of Progressive Law. This study employs a normative juridical method using statutory and conceptual approaches. The findings indicate that Article 473 reforms the construction of criminal law by shifting the focus from biological aspects toward the protection of bodily integrity, sexual freedom, and consent. This provision is consistent with the principles of Progressive Law, which places human beings at the center of law, while strengthening human rights protection through the principles of equality before the law and non-discrimination. However, its effective implementation still requires harmonization of criminal procedural law, enhanced capacity of law enforcement officials, and changes in legal culture to ensure inclusive, equitable, and optimal protection for victims.

Abstract

Law Number 6 of 2023 introduced significant changes to the regulation of Fixed-Term Employment Agreements (Perjanjian Kerja Waktu Tertentu/PKWT) by promoting labour market flexibility while maintaining legal protection for contract workers. Nevertheless, the new framework has generated debate regarding the balance between business flexibility and workers' rights. This study aims to examine the legal protection of contract workers following the enactment of Law Number 6 of 2023, analyze the implementation of labour flexibility and legal certainty based on statutory regulations and judicial decisions, and evaluate whether the current framework achieves a fair balance between employers' and workers' interests. This normative legal research applies statutory, conceptual, and case approaches by examining Law Number 6 of 2023, Government Regulation Number 35 of 2021, Constitutional Court Decision Number 91/PUU-XVIII/2020, and relevant legal literature. The findings indicate that the current regulations provide legal protection through restrictions on the use of fixed-term employment agreements, mandatory compensation, and recognition of workers' rights. However, practical implementation remains constrained by the misuse of PKWT, weak labour supervision, and inconsistent law enforcement. Strengthening labour inspection and legal enforcement is therefore essential to ensure an effective balance between labour flexibility and legal certainty.

Abstract

The development of modern criminal justice systems has encouraged a shift in criminal case resolution through a negotiated justice approach. The introduction of the Guilty Plea mechanism (plea bargaining) under Law Number 20 of 2025 concerning the Indonesian Criminal Procedure Code expands the authority of public prosecutors in determining the direction of criminal case resolution. This development raises concerns regarding the limits of prosecutorial authority within the framework of the dominus litis principle, particularly concerning prosecutorial discretion and accountability mechanisms. This study aims to analyze the construction of prosecutorial authority in the implementation of plea bargaining and to formulate an appropriate model based on the dominus litis principle. This research employs a normative juridical method using statutory and conceptual approaches. The findings reveal that the New Criminal Procedure Code has expanded the meaning of dominus litis from controlling prosecution to determining criminal case resolution strategies. However, such expansion requires limitations through clear standards, legal accountability, and adequate oversight mechanisms. This study proposes the concept of Accountable Limited Dominus Litis as a model that maintains the prosecutor’s role as the controller of criminal proceedings while ensuring accountability, proportionality, and protection of defendants’ rights.

Abstract

Notaries who assume custody of a predecessor’s notarial protocol are frequently named as defendants in civil proceedings concerning deeds executed by the previous notary. This practice creates legal uncertainty regarding the scope of the protocol-holding notary’s liability for deeds that were not executed by them. This study aims to examine the legal responsibility of protocol-holding notaries and the legal protection afforded to them when they are named as defendants in civil litigation. The theoretical framework employs Satjipto Rahardjo’s Theory of Legal Protection and Subekti’s Theory of Legal Responsibility. This research adopts a normative juridical method using statutory, conceptual, analytical, and case approaches. Legal materials were obtained through library research involving primary, secondary, and tertiary legal sources and were analyzed using grammatical and systematic interpretation, as well as analogy and legal refinement constructions. The findings indicate that, in judicial practice, protocol-holding notaries are still frequently named as defendants because they possess or maintain the disputed deeds or minutes. However, there is no explicit legal provision establishing the limits of their liability for deeds executed by another notary. The Notary Position Act should expressly regulate the responsibilities of protocol-holding notaries, limiting their role to safeguarding and maintaining the notarial protocol and providing testimony concerning the relevant deed. They should not be treated as parties responsible for the substantive validity or contents of deeds executed by their predecessors.

Abstract

This study aims to examine the role of the Central Jakarta Population and Civil Registration Office in protecting personal data within the population administration system and to identify the legal strengths and weaknesses of such protection. This research employs an empirical legal approach, focusing on social reality, particularly how law is applied and functions in practice. Primary data were obtained through observations and interviews at the Central Jakarta Population and Civil Registration Office, while secondary data consisted of primary and secondary legal sources. Data were analyzed qualitatively. The findings indicate that the Office plays a role in storing, maintaining, ensuring the accuracy, and safeguarding the security and confidentiality of personal data. Personal data protection is administrative in nature and involves recording both general and specific personal data. Regarding legal force, the Population Administration Act provides legal authority to protect personal data through centralized legal authority, guarantees of fundamental rights, and obligations to maintain data security and confidentiality. However, several weaknesses remain, including the failure to accommodate modern personal data protection principles, an insufficiently clear definition of personal data, weaknesses in technical and security measures, the absence of criminal sanctions, and unclear boundaries of legal liability in cases of personal data breaches.

Abstract

The rapid advancement of artificial intelligence (AI) has transformed various aspects of human life while simultaneously creating new forms of criminal conduct that challenge the traditional principles of criminal liability under Indonesian law. This study aims to analyze the adequacy of the existing Indonesian criminal law framework in addressing AI-based crimes and to reconstruct an appropriate model of criminal liability capable of responding to the legal complexities arising from the use of AI. The research employs a normative juridical method using statutory, conceptual, and comparative approaches through the analysis of legislation, legal doctrines, and selected international regulatory frameworks. The findings reveal that Indonesian criminal law has not yet explicitly regulated criminal liability for AI-based crimes, resulting in legal uncertainty regarding the responsibility of AI users, developers, corporations, and digital platform providers. The study further proposes a reconstructed criminal liability model based on the principles of fault, foreseeability, and corporate accountability to ensure legal certainty and effective law enforcement in the era of artificial intelligence. It concludes that reforming Indonesia's criminal law is essential to establish a comprehensive and adaptive framework for criminal liability that balances technological innovation with legal protection and public interests.

Abstract

As online prostitution increases, the practice of pimps is increasingly being prosecuted under the Law on the Eradication of Human Trafficking (UU PTPPO), even though their actions are more closely associated with moral violations in the Criminal Code (KUHP). This study aims to analyze whether the actions of pimps, from a legal perspective, meet the elements of human trafficking, using Decision No. 27/Pid.Sus/2023/PN.Bkt as a case study. Through normative legal research methods with a qualitative approach, the decision is examined from the perspective of positive law and fiqh jinayah. The analysis results indicate that the application of UU PTPPO in this decision is less appropriate. The defendant's role as an intermediary (pimp) does not fulfill the essential element of "exploitation" as mandated by UU PTPPO, making their actions more relevant to be prosecuted under Articles 296 and 506 of the KUHP. Meanwhile, from the perspective of fiqh jinayah, the actions of pimps fall under the category of jarimah ta'zir, where the penalties are determined based on the judge's discretion (ijtihad). This study concludes that imposing penalties without carefully considering the fulfillment of the elements of the offense has the potential to create legal injustice and errors in the application of the articles in indonesian.
