Abstract

Mekotek dance is fragmentary of the mekotek tradition in Munggu Tourism Village which includes intellectual works within the scope of copyright and has been stated in real form and has rights that need legal protection. The aims of this study is to analyze the implementation of copyright registration for mekotek dance and to find out the form of legal protection. The methods of implementation carried out in the community service program are by Business Law Program, Sastra Faculty Program, and The partnership of Munggu Village tourist area Mengwi district Badung Regency. The results obtained in the study as follows, the implementation of copyright registration for dance mekotek can be done online and offline. For the management of the registration process, it is represented by the Chairman of the Munggu Village Tourism Awareness Group, namely Mr. Putu Suada. Of course, the implementation starts from looking for requirements documents such as the identity of the parties, filling out the application letter; affidavit of ownership; transfer letter of rights where all must be pdf, and proof of the work of mekotek dance in the form of storylines and MP3 videos. The registered creation will be subject to the registration fee. After everything is collected and then sent to the HAKI Partner to take care of online by waiting approximately 1 month to get the results in the form of copyright certificates. Therefore, the results of the registration will be in line to obtain legal protection and lead to quality tourism.

Abstract

Universities carry out the Tri Dharma of Higher Education periodically, namely Teaching, Research, and Community Service. In terms of community service activities, there is a sense of caring from campus elements who know directly about the community. The aims of this research are as a form of the Lecturer's dedication to the community, provide opportunities for Lecturers to carry out direct service with partners to the target object, in this case in the Tabanan construction workshop to carry out one of the Tri Dharma Colleges in terms of community service, and improving cooperative relations between universities, the community, and/or companies employing employees.The implementation methods carried out in community service are directly meet partners, discussions with workers and the administration about working time. The result shows that the existence of occupational safety and health regulations which are the operational standards of implementation for the workshop company in Tabanan, after socialization and legal counseling were held, where the company leadership understood and understood the existence of the law governing occupational health and safety and company leaders prepared physical facilities and non-physical company to maintain the safety of its employees. Moreover, if the company leadership does not prepare by the law's mandate, it will be subject to imprisonment or fines. Workers who are not accustomed to using PPE after socialization and legal counseling have been carried out are very understanding and understand that work-related work safety is not only for themselves but also for their families and environment.

Abstract

In society, the term customary law at the beginning of its birth was not widely known, what was known was only custom, but in that term the meaning of law was concluded but in many circles who did not understand customary law in depth they always questioned that custom is just a habit without legal elements. It is undeniable that a traditional village is a traditional village in Bali which has been autonomous since its inception. Each traditional village has its own management and assets, and has the authority to make awig-awig. The purpose of this program is to empower indigenous village communities so that they have a regulation in the form of pararem. The methods used in this service program are by giving lectures or legal counseling about the importance of a pararem in life in a traditional village,carrying out focus group discussions (FGD) on pararem design, and providing assistance in making traditional village pararem. The result shows that that the implementation of the community service program has succeeded in empowering the community and the program has been implemented properly. This is evident from the activities carried out in accordance with the stages that have been planned, namely legal counseling with the lecture method, conducting limited discussions (FGD), and mentoring. The assistance that has been carried out, partners are finally able to realize the pararem in the form of pararem penyahcah awig as many as 20 Pawos (articles). The success of this Pararem arrangement will indirectly increase public legal awareness.

Abstract

The role of paralegals in increasing public legal awareness has been widely studied. One of the important roles of paralegals in Bali, especially in the Jembrana Regency, is to minimize violence against women, which is still found in Bali, which is famous for upholding patrilineal lineages where there is an assumption that the position of men is higher than women. The aims of this research are to determine the increased awareness of the community in Tuwed Village, Melaya District, Jembrana Regency and understand about the protection of women in Tuwed Village, Melaya District, Jembrana Regency. The type of service carried out is empirical, so the type of writing approach is field data, which is used in this paper. Devotion is carried out by directly examining the spaciousness. The approach used is a case study approach. The result shows that The effectiveness of paralegals in preventing violence against women in Tuwed Village can be studied by linking the theory of Soerjono Soekanto, who argues that a law can be said to be effective if it meets five factors, namely, legal factors, law enforcement factors, facilities and facilities factors, factors society, and cultural factors. The role of paralegals in Tuwed Village can be said to be ineffective due to the lack of public knowledge about paralegals and lack of community knowledge related to violence against women, as well as constrained by factors of supporting facilities.

Abstract

The rise of corruption cases that occurred at the Village Credit Institution in Bali made the Sibetan village community worried, the same thing would happen in the Village Credit Institution of the Sibetan Traditional Village. Starting from that, community leaders of the Sibetan traditional village in collaboration with the Law Society of Warmadewa University organized cooperation in increasing public awareness. The study aim is to minimize corruption that is still found in Bali. Bali is famous for upholding a culture of law and order with the teachings of karma phala, it is means that whoever does the deed will receive the consequences of their actions. This happens because of a lack of knowledge about the law, especially corruption. The researcher used an empirical service method with the approach of local traditional institutions, in service to the field of corruption knowledge related to the rampant corruption in the Village Credit Institution in preventing corruption cases in the Village Credit Institution of Sibetan. The results show that there is a warm discussion in addressing corruption cases in Bali so that in the future it will not happen in the Sibetan Traditional Village.

Abstract

The COVID-19 pandemic has had a very broad impact on people's lives, especially with regard to traditional ceremonies in Bali. One of these activities is the Ngaben Ceremony (Pitra Yadnya). On the other hand, PPKM has been a policy of the Indonesian Government to combat the Covid-19 pandemic since early 2020. PPKM has a great influence in the Ngaben ceremony. Ngaben is a ceremony to purify spirits and smelting corpses by burning the bodies of people who have died. The formulation of the problem in this research; What is the role of law in carrying out the Ngaben ceremony in Bali? and how to use sanctions against people who violate during the Ngaben ceremony in Bali? This research approach, with legislation, the type of research used is normative legal research. The technique of collecting legal materials used in this paper is through literature study. The conclusions from the formulation of the problem are the role of law and sanctions against Restrictions on Community Activities violators in relation to the Ngaben ceremony, namely in accordance with applicable regulations, such as; Minister of Home Affairs Instruction Number 35 of 2021 and Governor's Circular Letter Number 12 of 2021.

Abstract

A good and healthy environment is a human right of every Indonesian citizen as mandated in Chapter 28H of the 1945 Constitution of the Republic of Indonesia. Unwise environmental management contributes to aggravating the decline in the quality of the environment, therefore it is necessary to increase environmental protection and management. The government's responsibility in protecting and managing the environment is a function of public services, to ensure that all residents have a good and healthy environment. So in development and so as not to damage the environment, the government fosters tourism business actors to comply with applicable regulations. Because if there is environmental damage, the government can be held accountable administratively, when the government neglects to carry out its obligations that are not in accordance with the aspirations of the community. This research is qualified as a normative and empirical legal research, by applying several types of approaches, namely, a statutory approach, a conceptual approach, a philosophical approach, a historical approach, a comparative approach, a case approach, including a cultural approach based on local community wisdom.The results of the study show that environmental protection and management is an effort to carry out very difficult, resulting in a decrease in the quality of the environment that is increasingly real. Therefore, the enforcement of administrative law is a real first step from the government to enforce the rule of law quickly for the protection of the environment. Administrative law enforcement, integrating the values ​​that develop in society in protecting and protecting the environment is an ideal form to protect and manage the environment wisely to realize development.If the government fails to protect and manage the environment in tourism development, the government can be held accountable administratively.

Abstract

Apuan Village is one of the villages located in Susut District, Bangli Regency. Apuan Village is one of the villages in the Susut District, Bangli Regency, which is rich in springs that have their own beauty so that they are worthy of being developed as a tourist attraction. Among the attractions in Apuan Village which were developed as tourist destinations are the Tibumana and Tirta Payuk waterfalls, which in addition to having beautiful panoramas are also often used as places for traditional self-cleaning. The management of tourist objects in Apuan Village during 2017 to 2019 is still managed by groups and individuals, so it cannot be optimized to improve the welfare of the people of Apuan Village. For this reason, cooperation is needed through a tourism object management agreement involving BUMDes so that management will be more professional. In order for BUMDes to be able to manage tourism objects, a legal umbrella is needed so that if later on the management of tourism objects is subject to a levy, then the levy is not an illegal levy. The solution to overcome partner problems is to provide legal assistance and counseling related to the legal form of tourism object management development programs through BUMDes and the realization of harmonious working relationships in the development of tourism object management in Apuan Village.

Abstract

West Bali National Park, Jembrana Regency is a nature conservation area that has native ecosystems, managed with a zoning system that is used for research, scientific, educational purposes, to support cultivation, tourism and recreation. West Bali National Park, Jembrana Regency is the only national park in Bali Province. Local wisdom is one of the things that must be considered in Environmental Protection and Management activities, especially in community activities to preserve the protected forest of the West Bali National Park. Partner Issues: 1) Lack of optimization of local wisdom towards the West Bali National Park in Supporting Village, especially Melaya Village, 2) There is no synchronization of the rights and obligations of the parties to the Conservation contract between the Village community and the Village Head, especially the Melaya Village. The research method used is empirical legal research, namely by primary data collection through observation, interviews, and distributing questionnaires. After the primary data has been collected, it is processed, using qualitative methods and analyzed using Descriptive analytical techniques to get conclusions with accurate data. The output targets of this service are: To form a draft conservation contract between the Village of Support (Desa Melaya) and the West Bali National Park Center, a reputable accredited Service Journal (Community journal of Law) and the Sutramas Journal, HKI, Print Media.

Abstract

The provisions of legal aid for the poor who are in conflict with the law by the Legal Aid Institute had been regulated by the provisions of Government Regulation Number 42 of 2013 concerning Terms and Procedures for Providing Legal Aid and Distribution of Legal Aid Funds, the Regulation of the Minister of Law and Human Rights Number 3 of 2013 concerning Procedures for Verification and Accreditation of Legal Aid Institutions, and the Decree of the Ministry of Law and Human Rights of the Republic of Indonesia Number M.HH-03.HN. 03.03 of 2013 concerning the Amount of Litigation and Non-Litigation Legal Aid Fees. Legal aid for the poor with this free system has conditions that must be met. They are really incapable, and there is a certificate from the local/village head that the person concerned is really incapable which is in accordance with the law. There was a problem occurred in Jepara Regency that there were still few accredited Legal Aid Institutions, and there were quite a lot of poor people who were in conflict with the law so that there was an imbalance between legal aid service personnel and the cases at hand. From the data obtained after being analyzed that in Jepara Regency, the legal aids for the people who were in conflict with the law for free were still not evenly distributed because legal aid assistants were not proportional to the number of cases faced by the people who were in conflict with the law. There were very few aid accredited by the Ministry of Law and Human Rights. Furthermore, if the community deals with unaccredited legal assistance, in this case, they will not receive financial assistance from the State in providing assistance.
