Abstract

Dangin Puri Village, located in East Denpasar, Denpasar City, Bali Province, covers an area of 0.65 km² with a population of 8,846 people (2021). This village holds significant potential for economic development through the empowerment of micro, small, and medium enterprises (MSMEs) in sectors such as handicrafts, culinary, and services. However, many local MSMEs still lack understanding and utilization of digital technology, which hinders their business growth. One notable example is UD Kayu Mas, a traditional gamelan handicraft enterprise that has not yet registered its creations under copyright law, leading to unclear legal protection and limited market expansion. Additionally, the craftsmen’s limited digital literacy and inadequate access to technological tools pose challenges in adopting digitalization. To address these issues, community service activities were carried out to socialize the importance of copyright registration and digital empowerment. The program introduced legal awareness through the registration of gamelan and gender laras nada gending in the form of plawah, unique to UD Kayu Mas. Empowerment initiatives involved students who practiced at UD Kayu Mas and supported the establishment of the Swasti Swara studio in Denpasar. The program also included digital training, such as creating online business profiles, using social media platforms (Instagram, Facebook), and utilizing online marketplaces for product marketing. The outcomes included improved legal awareness, better understanding of digitalization benefits, and enhanced digital skills among craftsmen. These efforts are expected to expand market reach, increase sales, and promote operational efficiency. The results were disseminated through an international journal publication, print media, and a four-minute promotional video on YouTube.

Abstract

Program Pengabdian Kepada Masyarakat yang dilaksanakan berfokus pada hasil keterampilan anyaman daun lontara menjadi Baku` Ma`udu yang telah menjadi tradisi dan budaya masyarakat Cikoang dalam merayakan Hari Besar Maulid Nabi Muhammad SAW. Baku` Ma`udu yang bersifat wajib pada perayaan Maulid Nabi Muhammad SAW maka dengan pembuatan Baku` Ma`udu juga membutuhkan proses yang sangat lama karena jenis kerajinan tangan yang dibuat dengan cara menganyam. Adapun yang menjadi permasalahan dalam pelaksanaan kegiatan pengabdian kepada masyarakat diantaranya adalah 1) kurangnya pemahaman masyarakat dalam pembuatan Baku` Ma`udu yang digunakan pada saat perayaan Maulid Nabi Muhammad SAW dan 2) tingkat kesejahtraan masyarakat yang kurang stabil karena sumber penghasilan yang minim. Metode atau tahapan pelaksanaan pengabdian kepada masyarakat memuat hal-hal diantaranya adalah Tahapan Sosialisasi, Tahapan Pelatihan, Tahapan Penerapan Teknologi, Tahapan Pendampingan dan Evaluasi dan Tahapan Keberlanjutan Program. Pada program kegiatan pengabdian yang dilaksanakan yaitu Pemberdayaan Kerajinan Tangan dalam Pengolahan Baku` Ma`udu pada Masyarakat diutamakan untuk kegiatan Ma`udu Lompoa di Cikoang Kabupaten Takalar. Hasil kegiatan program pengabdian kepada masyarakat yaitu dengan kunjungan ke lokasi, menganalisis situasi dan mengadakan pengamatan, melakukan pendekatan dengan pihak terkait, mengadakan musyawarah dan mencoba menjawab permasalahan yang ada. Hasil pengabdian dapat disimpulkan bahwa 1) Pemahaman masyarakat yang masih minim dalam pembuatan Baku` Ma`udu yang digunakan pada Hari Besar Maulid Nabi Muhammad SAW. Dan 2) Tingkat kesejahtraan masyarakat yang kurang stabil karena sumber penghasilan yang minim.

Abstract

Penelitian hukum ini merupakan kajian tindak pengabdian di Desa Adat Penglipuran sebagai desa wisata yang fokus pada pemberdayaan masyarakat melalui analisis Perjanjian Kerja Sama (PKS) dengan Pemerintah Kabupaten Bangli. Kajian menyoroti dampak ekonomi dari pembagian hasil pungutan (bruto) sebesar 60% untuk desa dan 40% untuk kabupaten, tingkat kesadaran hukum masyarakat adat saat proses perjanjian, peran tenaga ahli melalui Focus Group Discussion (FGD) dalam pendampingan, serta potensi verifikasi usaha wisata berbasis adat. Metode yang digunakan adalah kualitatif deskriptif dengan pengumpulan data melalui wawancara, FGD, dan telaah dokumen PKS. Hasil menunjukkan bahwa porsi pembagian saat ini berpotensi mengurangi kemandirian finansial desa, sehingga perlu direvisi menjadi 80–90% untuk desa. Kesadaran hukum prajuru dan warga masih terbatas, sehingga perlu penguatan literasi hukum. Selain itu, potensi ekonomi tambahan dari pengelolaan homestay, penyewaan pakaian adat, serta warung tradisional yang menjual pakaian, pernak-pernik, makanan, dan minuman khas desa menjadi sumber pendapatan penting bagi masyarakat. Penelitian merekomendasikan revisi PKS, peningkatan kapasitas hukum masyarakat adat, dan diversifikasi usaha pariwisata berbasis budaya sebagai strategi pemberdayaan masyarakat Desa Wisata Penglipuran.

Abstract

Legal aid for the Indonesian people must be provided equally in accordance with the mandate of the 1945 Constitution of the Republic of Indonesia and the principles of equality before the law and the right to be represented by a lawyer, which are fundamental human rights. This right must be provided fairly, including to those who are less fortunate. For the less fortunate, this right is the responsibility of the state, which provides legal aid free of charge (Prodeo). The issue in society is the lack of awareness about their right to receive free legal aid (Prodeo) from the government. Additionally, the public is also unaware that legal organizations also have the duty to provide legal aid to the community. The legal education program conducted by the Warmadewa University Community Service Team aims to increase legal awareness regarding free legal aid and the procedures for obtaining this right, using methods such as lectures and question-and-answer discussions. This program is expected to enhance public knowledge so that individuals facing legal issues can be assisted by lawyers in resolving the legal problems they encounter.

Abstract

The paper entitled “The Existence of Bale Kerta Adhyaksa as an Instrument for Resolving General Legal Cases in Bali” was prepared in connection with the enactment of the Draft Regional Regulation of the Province of Bali concerning Bale Kerta Adhyaksa into a Regional Regulation, which will take effect following the implementation of Law Number 1 of 2023 on the Criminal Code on 2 January 2026. This paper examines and discusses two legal issues relevant to the existence of Bale Kerta Adhyaksa, namely: (1) the authority of Bale Kerta Adhyaksa in Bali, and (2) the scope of the substantive provisions of the Regional Regulation on Bale Kerta Adhyaksa in Bali. The writing method is grounded in the doctrine of legislative law, thereby adopting a normative research type which utilizes normative or non-empirical research materials with a statutory approach and a conceptual approach, drawing from both primary and secondary legal materials. The analysis employs the concept of regulatory impact assessment and consistency analysis, applied both at the stage when the regulation was still in draft form and after its stipulation as a Regional Regulation of Bali Province. This analysis is carried out using systematic interpretation through inductive and deductive reasoning, presented in a structured and coherent manner. The authority of Bale Kerta Adhyaksa in Bali is to resolve general legal cases occurring within the jurisdiction of customary villages. Institutionally, it is expected to resolve cases by prioritizing a win–win solution, particularly for minor criminal cases and minor civil cases. Meanwhile, the scope of the substantive content of the Regional Regulation on Bale Kerta Adhyaksa in Bali includes the realization of an effective, efficient, comprehensive, and conclusive system for resolving general legal cases, as well as the reduction of the frequency of minor criminal and civil cases within customary villages areas. The formulation of case resolution is embodied in the form of a “Peace Statement Letter or Deed” and a “Peace Agreement Letter or Deed”, which are recorded in a mutual agreement between the parties, signed by them, and must be carried out in good faith. The decisions are final and binding.

Abstract

This study analyzes the legal position of temples (pura) as religious legal entities in the context of land registration following the enactment of Bali Provincial Regulation Number 4 of 2019 on Desa Adat (Customary Villages). The regulation introduces new classifications of legal subjects eligible for land registration, particularly concerning land owned by Desa Adat and temple property. These developments raise two fundamental legal questions: (1) whether temple-owned land can be categorized as land belonging to the Desa Adat, and (2) the legal basis for registering temple land under the 2019 regulation. The research adopts normative legal methods, relying on statutory, conceptual, and case approaches to clarify the legal norms relevant to temple land registration. Analysis is conducted through grammatical and systematic interpretation, enabling a structured understanding of the regulatory framework. Desa Adat is formally recognized as a holder of communal land rights under the Decree of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 276/KEP-19.2/X/2017, a status further supported by Bali Provincial Regulation Number 4 of 2019. Two forms of customary village land eligible for registration are identified: (a) land directly managed by the Desa Adat, including cemeteries, certain temple areas, and markets; and (b) land owned by the Desa Adat but managed by customary community members, such as village yards and ayahan land. The function of Desa Adat in customary land registration does not conflict with the Minister of Home Affairs Decree Number 556/DJA/1986, which is based on Government Regulation Number 38 of 1963 regarding legal entities permitted to hold land ownership rights. Nonetheless, these regulations differ substantially in scope and purpose. The key finding of this study is that temple land remains legally distinct from customary village land, as temples and Desa Adat constitute separate legal entities. Consequently, temple-owned land cannot automatically be treated as Desa Adat property, and its registration must follow legal provisions specific to temples as religious legal bodies.

Abstract

One factor for good law enforcement is legal awareness and compliance with the law. Legal compliance can be achieved through the existence of good regulations. In Bali, Customary Villages (Desa Adat) are traditional villages in Bali that have autonomy in creating regulations. Each Customary Village has its own administrators and assets, and has the authority to create regulations, known as awig-awig and/or pararem. The situation of the program partners is that they do not yet have a pararem panyahcah awig as a regulation for implementing awig-awig. The goal of this program is to empower the Customary Village community so that they have a regulation in the form of a pararem panyahcah awig. The methods used in this community service program are: (1) providing lectures or legal counseling on the importance of a pararem panyahcah awig in life in a Customary Village, (2) conducting focus group discussions (FGDs) on the draft pararem, and (3) providing assistance in creating customary village pararem. The result of this program is the development of a set of 64 articles (pawos) to address customary law (adat), in accordance with the mandate of the customary law (adat) outlined in the articles.

Abstract

This community service aims to strengthen legal governance and establish a multi-stakeholder partnership in managing Bongan Tourism Village, Tabanan, Bali. The program included focus group discussions (FGDs), legal and entrepreneurship training, and drafting a Memorandum of Understanding (MoU) among local institutions. The results show the preparation of a village regulation draft, increased community capacity, and a transparent partnership model. This program contributes to achieving SDG 8, 11, and 17
