Abstract

The existence of customary rule sanctions in the resolution of the issues of bad credits within village credit institutions in the customary village of Kerobokan has been included as one of banking laws that is legally entitled to receive legal. This research aimed to the positioning of customary law sanctions in resolving bad loans at VCI Kerobokan Customary Village and to know the forms of legal protection for VCI and how are the bad loans of customers from outside the traditional villages in Kerobokan. The method used in this research is normative legal research, namely to conduct library research by reviewing literature and analyzing statutory regulations relating to applicable provisions on VCI. This research found the settlement of the bad credit at the customary village of Kerobokan is manifested into ways. The first through preventive legal efforts, that is to say, the very moment of signing the contracts, the customers are sure to have all their incumbencies. The second is through repressive efforts that must be made on the basis of good faith. The implementation of the civil law is that the form of retribution and customary law from the customary village. Abstract

The regulation of technology transfer to Multinational Companies (PMN) to date still pays attention to the provisions of the Law of the Republic of Indonesia No. 25 of 2007 on Investment, especially Article 2 paragraph 1, in addition to Indonesia has also adjusted the provisions of national laws in the field of economy/trade with the provisions of GATT and WTO that hav been ratified through the Law of the Republic of Indonesia Number 7 of 1994, including adjustments to the provisions of the field of intellectual property rights (IPR) contained in the TRIPs, such as the Law of the Republic of Indonesia No. 14 of 2001 on Patents, The Law of the Republic of Indonesia No. 15 of 2001 on Brands, and the Law of the Republic of Indonesia No. 19 of 2002 on Copyright, and others covered as objects of intellectual property rights (IPR). The role of multinational companies (PMN) in the transfer of technology can be mentioned, among others: As a holding company that can be used for media, containers, information exchange, technology between countries in the international community which is further used, and useful for Indonesia; As a place for investment in order to obtain benefits for Indonesia; and As a place for the application of new technologies to be useful more efficiently and effectively benefit Indonesia, in addition to improving international economic trade.

Abstract

Abstrak Penanaman modal asing secara langsung (Foreign Direct Investment) dengan mendirikan sebuah perusahaan modal asing di Indonesia dapat mempercepat laju pembangunan nasional, tidak hanya pembangunan secara ekonomi namun juga pembangunan sumber daya manusia. Perusahaan modal asing diharapkan dapat menyerap tenaga kerja warga negara Indonesia dan melakukan alih teknologi melalui pelatihan kerja kepada pekerja lokal di perusahaan tersebut. Kewajiban perusahaan penanam modal dalam melakukan alih teknologi diatur dalam Undang-Undang Nomor 25 Tahun 2007 Tentang Penanaman Modal. Namun dalam pelaksanaannya belum dapat berjalan dengan baik karena terkendala oleh berbagai hal. Permasalahan dalam penelitian ini berkaitan dengan kewajiban perusahaan modal asing dalam pengembangan sumber daya pekerja lokal melalui pelatihan kerja dan alih teknologi di Kabupaten Badung serta kendala yang dihadapi. Penelitian ini menggunakan metode empiris dengan pendekatan sosiologis. Berdasarkan hasil penelitian di lapangan, perusahaan modal asing di Kabupaten Badung telah melakukan pelatihan namun ada beberapa kendala yang dihadapi, salah satunya adalah sumber daya manusia yang lemah. Upaya yang dapat dilakukan adalah diperlukannya peran lembaga pemerintah untuk turut serta melakukan pelatihan yakni melalui Balai Latihan Kerja (BLK) untuk bekerjasama dengan perusahaan modal asing dalam upaya pelatihan dan pengembangannya. Abstract The Foreign Direct Investment by establishing the foreign capital companies in Indonesia could accelerate the progress of the national development, not only in economic sector but important to develop the human resources in Indonesia. The foreign capital companies could employ the Indonesian workers and do transfer of technology through the work training to the local workers in the company. The obligation of the foreign capital companies in transfer technology has been regulated in Act Number 25 Year 2007 about Capital Investment. However the implementation cannot be done as well because of many factors. The issues in this paper about the obligation of the foreign capital companies in developing the local workers resources through the work training and transfer of technology at Badung Regency and the obstacles they have been faced. This research using the empirical method with the sociological approach. Based on the field research, the foreign capital companies at Badung Regency have done the training however they have the problems; one of the problems is the weakness of the human resources. The effort that they have to do is the role of the governance by held the training through the Job Training Center (JTC) and work together with the foreign capital companies in order to do the training and the development.

Abstract

Pelestarian lingkungan kawasan wisata alam oleh Kesatuan Pelestarian Hutan Konservasi Taman Nasional Bali Barat saat ini telah dilakukan dengan melibatkan berbagai pihak (mitra), salah satunya adalah kerjasama dengan Pemerintah Desa hingga kelompok masyarakat. Keterlibatan mitra dalam hal ini adalah Pemerintah desa yang disekitarnya terdapat Desa Penyangga pada Taman Nasional Bali Barat, mengakibatkan ketertarikan untuk mengajukan kerjasama dengan kesatuan pelestarian hutan Konservasi, yang berpotensi meningkatkan nilai keberadaan hutan dan fungsi pemberdayaan sosial, tetapi juga meningkatkan risiko kerusakan fungsi hutan akibat perilaku oportunitas mitra. Hubungan antara kesatuan pelestarian hutan Konservasi Taman Nasional Bali Barat dengan mitra pengelola dalam hal ini Pemerintah Desa, dapat dipandang sebagai sebuah hubungan kontrak antara Taman Nasional Bali Barat dan mitra yaitu Pemerintah Desa. Dalam hubungan antara Taman Nasional Bali Barat dan mitra dalam hal ini Pemerintah Desa tersebut dapat muncul berbagai permasalahan seperti ketimpangan informasi, hingga pelanggaran kesepakatan yang telah dibuat. Identifikasi atas biaya pengawasan yang dikeluarkan oleh Taman Nasional Bali Barat juga menjadi aspek penting dalam hubungan kontrak dengan mitra. Tujuan utama dalam penelitian ini adalah untuk menentukan hubungan usaha kontrak kemitraan yang optimal dalam pemanfaatan wisata alam Kesatuan Pelestarian Hutan Konservasi Taman Nasional Bali Barat, yang dapat dicapai dengan menganalisis kebijakan pemerintah desa yang mempengaruhi hubungan Taman Nasional Bali Barat, serta mengidentifikasi struktur hubungan kontrak dan menganalisis peran desa penyangga Taman Nasional Bali Barat. Berdasarkan hasil penelitian ini diharapkan dapat menjadi bahan pertimbangan bagi mitra dan Taman Nasional Bali Barat dalam menyusun kontrak kerjasama Konservasi, terutama pada kegiatan peran desa penyangga dalam pelestarian lingkungan wisata alam pada kesatuan pelestarian hutan Konservasi di Taman Nasional Bali Barat. Dalam hal ini Bendesa adat berperan mengawasi prilaku masyarakatnya agar tidak terjadi pelanggaran serta beperan manjaga harmonisasi keseimbangan sesuai konsep Tri Hita Karana, yaitu memprioritaskan keseimbangan hubungan antara manusia dengan penciptanya, hubungan manusia dengan manusia dan hubungan manusia dengan alam. Adapun luaran jurnal ilmiah yang menjadi sasaran adalah artikel yang di publikasikan dalam Jurnal Nasional Terakreditasi Kerta Wicaksana Fakultas Hukum, dan Laporan Penelitian Tahun 2022, serta HKI.

Abstract

Perjanjian perkawinan atau perjanjian pranikah yang diumumkan Notaris melalui media cetak merupakan pelanggaran kode etik Notaris, karena Notaris merupakan pejabat umum membuat akta otentik dibutuhkan masyarakat. Diperlukan tanggung jawab terhadap jabatannya, sehingga diperlukan lembaga kenotariatan mengatur perilaku profesi Notaris. Pada hakekatnya Kode Etik Notaris merupakan penjabaran lebih lanjut Undang-Undang Nomor 2 Tahun 2014 Tentang Jabatan Notaris, mengingat Notaris dalam melaksanakan jabatannya tunduk dan mentaati ketentuan Undang-Undang mengatur jabatannya, termasuk wajib menerapkan prinsip tata kelola perusahaan baik dengan menerapkan prinsip pengelolaan lingkungan hidup seperti diatur dalam Undang-Undang Nomor 32 Tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup. Tujuan penelitian ini adalah untuk mengetahui Apakah perjanjian perkawinan yang diumumkan oleh Notaris melalui media cetak merupakan pelanggaran kode etik seorang Notaris. Metode yang di gunakan dalam penelitian ini adalah metode penelitian adalah cara-cara berpikir dan berbuat, yang dipersiapkan dengan baik untuk mengadakan penelitian dan guna mencapai tujuan. Berdasarkan hasil penelitian hukum perjanjian perkawinan yang diumumkan melalui media cetak oleh Notaris merupakan perbuatan melanggar kode etik Notaris yang diatur dalam Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris, tercantum dalam kode etik organisasi Ikatan Notaris Indonesia (INI) merupakan satu-satunya organisasi Notaris berbadan hukum sesuai Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris. Artinya seluruh Notaris wajib tunduk kepada Kode Etik Notaris, adapun sanksi dijatuhkan Organisasi Ikatan Notaris Indonesia terhadap Notaris melanggar kode etik berupa : teguran, peringatan, schorshing (pemberhentian sementara), dan Onzetfing (pemecatan) yang ditugaskan Dewan Pengawas Notaris untuk menegakkan sanksi.

Abstract

Pengaturan perlindungan hukum dan pemberdayaan tenaga kerja lokal dalam Undang-Undang Republik Indonesia Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Peraturan Daerah (Perda) Provinsi Bali Nomor 10 Tahun 2019 tentang penyelenggaraan Ketenagakerjaan, serta Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal pada perusahaan yang berada di Desa Wisata Blangsinga Kabupaten Gianyar merupakan kajian dari peneliti. Perusahaan yang berada di Desa wisata Blangsinga mempekerjakan tenaga kerja lokal dalam semua bidang, dan hal ini sangat diharapkan kepada Pemerintah pada umumnya serta pengusaha sebagai investor dan tenaga kerja lokal pada khususnya bahwa pengaturan mengenai perlindungan hukum dan pemberdayaan tenaga kerja lokal memerlukan kebijakan tersendiri dari pengusaha, dimana pihak pengusaha tersebut juga wajib membina hubungan yang baik dengan semua pihak yaitu pihak investor, masyarakat Desa wisata Blangsinga dan pihak Pemerintah Kabupaten Gianyar, dalam hal ini adalah pihak Departemen Tenaga Kerja, karena kebijakan dan peraturan-peraturan yang dikeluarkan oleh perusahaan tidak terlepas dari pengawasannya, untuk menghindari kemungkinan terjadinya tindakan sewenang-wenang oleh pengusaha terhadap tenaga kerja lokal itu sendiri. Adapun tujuan penelitian ini adalah untuk mencegah terjadinya konflik sehingga diperlukan pembuatan standard objektif agar pihak investor juga dilindungi investasinya. Kendala-kendala dan hambatan yang dihadapi oleh suatu perusahaan dalam menerapkan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan Perda Provinsi Bali Nomor 10 Tahun 2019 tentang Penyelenggaraan Ketenagakerjaan, serta Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal dengan adanya kodrat manusia sebagai makhluk dimana saat-saat tertentu atau kondisi tertentu di bidang ekonomi mengalami kondisi keterpurukan, mendorong diberlakukannya Undang-Undang Ketenagakerjaan dan Perda Provinsi Bali Nomor 10 Tahun 2019 tentang Penyelenggaraan Ketenagakerjaan dan Undang-Undang Penanaman Modal. Dalam mengatasi kendala dan hambatan tersebut, pihak perusahaan sebagai Investor berupaya semaksimal mungkin untuk mewujudkan inti Undang-Undang Republik Indonesia Nomor 13 Tahun 2003 dan Perda Provinsi Bali Nomor 10 Tahun 2019 tentang penyelenggaran ketenagakerjaan, dan Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal yang menentukan bahwa Perusahaan wajib memprioritaskan pemberdayaan tenaga kerja lokal bekerja dimana perusahaan tersebut berdiri dan beroperasional, dengan memberikan kebijakan tertentu dengan diberlakukan setelah diadakan musyawarah antara pihak perusahaan dan aparat desa terlebih dahulu. Luaran Jurnal ilmiah yang menjadi sasaran adalah jurnal Nasional atau Jurnal Internasional bereputasi, serta laporan penelitian Tahun 2023, dan Hak Kekayaan Intelektual (HKI).

Abstract

The legal protection of local workers in the Law of the Republic of Indonesia Number 13 of 2003 concerning Manpower and Regional Regulation (Perda) of Bali Province Number 10 of 2019 concerning the implementation of Manpower, Law Number 10 of 2009 concerning Tourism, Regional Regulation of Bali Province Number 5 of 2020 concerning Standards for Organizing Balinese Cultural Tourism, in companies located in Saba Tourism Village, Blahbatuh District, Gianyar Regency is a study of researchers. Companies located in Saba Tourism Village, Blahbatuh District, Gianyar Regency employ local workers in all fields, and it is highly expected that the Government in general and employers as investors and local workers in particular that arrangements regarding legal protection and local labor development models require separate policies from employers, where the employer is also obliged to foster good relations with all parties, namely investors, the Saba Tourism Village community and the Government of Gianyar Regency, because the policies and regulations issued by the company are inseparable from its supervision, to avoid the possibility of arbitrary actions by employers against the local workforce itself. The method used is empirical legal research, with primary data through field research, secondary data through library research. The purpose of this study is to examine and analyze the local workforce development model in the Company located in Saba tourist attraction Blahbatuh District Gianyar Regency, as well as the constraints and obstacles faced by a company in applying the legislation. From the research results obtained that the local labor development model seen from the condition of the internal factors of local labor development in improving the economy of the Saba tourist village community is still greater than the weakness factors, while the condition of external factors is still greater than the opportunity factor threat. The local workforce development strategy in improving the economy is a wearknes-opportunity (WO) strategy, namely improving the skills of local workers in the formal or informal sector, especially for local workers, then improving facilities and infrastructure and supporting human resources (HR), the employment training center (BLK) for training and improving the business skills of local workers in various sectors, accelerating services and prioritizing business investment rules so that they can absorb more local labor. While the empowerment of local labor in the Krisna souvenir business, Ajik's milk pie business, Aloe Vera business, Villa and Restorant business, Turtle Breeder business, Plaminggo business located in the Saba tourist village, Gianyar Regency, in accordance with the Bali Provincial Regional Regulation Number 10 of 2019 concerning the implementation of Manpower has agreed with the Blangsinga traditional village to coordinate with the Customary Village and it has been agreed to employ local labor around 70% from local labor in the Blangsinga traditional village, and 30% from outside labor. This shows that the local workforce recruited comes from their birthplace or is native to the area where they live and are domiciled in the area and are proven by identity cards (KTP) and family cards (KK). As well as the role of traditional villages in empowering local labor is very large, very influential on the company's commitment and there must be approval from the traditional village every time they recruit workers, with the aim that there is a balance between the rights and obligations of companies operating in the village which contributes to the welfare of the surrounding community and automatically provides welfare from the economic aspect. The targeted scientific journal output is a Sinta 4 Accredited National Journal entitled KertaWicaksana Journal, as well as a 2024 research report, and Intellectual Property Rights (IPR).

Abstract

This study aims to determine the credit agreement or business loan between the customer and the cooperative and to find out the settlement in the event of a dispute in the credit agreement between the customer and the cooperative. This study uses empirical research methods where the method is based on positive law and norms. The results showed that the agreement made between the cooperative and the customer is based on the agreement of the parties who are ready to carry out their obligations and get rights. The obligation of the cooperative to provide loan funds to customers is the right of the cooperative to benefit from interest from customer loan funds. The obligation of the customer to pay the loan on time that has been agreed upon because he has lent funds, the right of the customer to get a loan for the customer's needs according to the agreement of the parties. Then, the agreement of the parties is not a guarantee that there will be no default, the importance of a legal attorney in an agreement makes it easier to resolve problems between the parties. Legal attorneys provide options for ending the case through the court (litigation) and settlement in a family way (non-litigation). Most parties use the non-litigation route because they want everything to be done quickly but at low cost. If the non-litigation solution does not find a middle ground, the case will proceed to court. Judge's rule applies to parties in litigation from the time until the costs incurred. Those who lost are willing to be asked for compensation for their actions.

Abstract

Traditional markets are meeting place for traders and buyers, where trade is carried out by negotiation and bargaining. However, along with the times there has been a decline in the performance of traditional markets due to the existence of modern markets and the weak competitiveness of entrepreneurs conducting activities in traditional markets. This study aims to explain the procedures for implementing the revitalization of the Regional Regulation of Badung Regency Number 7 of 2012 concerning the regulation of traditional markets in Badung Regency and to analyze the inhibiting factors for the implementation of the Regional Regulation. This study uses an empirical legal research type using a statutory approach. The data used are primary and secondary data. The results show that the implementation of the revitalization of traditional market development in the Badung area is one of the moves by the government in charge of the regions in terms of reviving and re-developing markets which previously experienced a decline due to competition with growing modern markets, for this reason, the promulgation of regional regulation number 7 2012 concerning the arrangement and fostering of traditional markets, shopping centers and modern shops to make the existence of traditional markets better and their development, the second obstacle to the implementation of regional regulation number 7 of 2012 concerning the arrangement and development of traditional markets, shopping centers and modern shops lies in the enforcement factor, regulations, funding factors, management factors and community factors.

Abstract

Credit agreements are usually accompanied by a collateral agreement and an insurance agreement. This insurance agreement is a means of transferring risk for the bank, especially life insurance in the event of a debtor's death, besides credit can also fall to the heirs if the debtor dies before paying off the remaining credit. This study aims to analyze the legal consequences of the Bank's Credit Agreement in the event that the Debtor dies and to find out the responsibility of the Insurance Party for the Bank's Credit Agreement in the event the Debtor dies. This study uses a normative research method with a statutory approach and a conceptual approach. The results show that the legal consequence of the credit agreement in the event that the debtor dies, there are two possibilities, namely that the credit goes to the heirs as regulated in article 833 of the Civil Code (Burgerlijk Wetboek) or the guarantee is executed by the bank, and the second possibility is that the credit is written off due to a life insurance clause or a life insurance agreement with a banker's clause, which means that the insurance company must be responsible for paying off the remaining debts of the debtor who died according to the terms and conditions of the policy, otherwise the interested party can file a summons to sue the insurance company. From this, the conclusion is that the parties must fully understand the contents of the credit agreement made, so that later if this risk occurs, there will be clarity on the payment of the debtor's remaining debt.
