Abstract

Ensuring the rights of all inmates, particularly women, is an essential obligation of basic human rights. Even during their temporary stay at Serang Detention Center for treatment and training, their rights must be upheld. The center not only provides maintenance assistance but also training for women. It is essential to adhere to the Corrections Law Number 22 of 2022 and Government Regulation Number 32 of 1999 and other related regulations to offer guidance and care in accordance with their rights. Women have distinct privileges from men, and it is crucial to recognize and provide accordingly. This research aims to explore how to uphold the rights of women inmates at Class IIB Serang Detention Center using empirical juridical research. The research sources include primary data obtained through direct interviews and secondary data from laws, books, journals, theses, and tertiary materials such as relevant websites. The research results indicate that the center offers paid training, including spiritual training, physical training, and independence training, that include the right to worship and celebrate religious holidays, maintain good health, and other rights regulated by law. However, there are challenges in providing these rights, such as a lack of self-reliance programs, insufficient accommodation for spiritual training for religions other than Islam and Christianity, and overcapacity concerns at Serang Detention Center.

Abstract

Batik is a culture that takes the form of a painting craft. The existence of batik with its beautiful motifs, designs and patterns has made batik art a preserved cultural heritage. This research aims to determine product development for Micro, Small and Medium Enterprises and forms of legal protection for batik in the Krakatoa Batik Studio, Cilegon City. This research uses a qualitative method with an empirical juridical approach. The primary data source comes from the Krakatoa Batik Studio, Cilegon City, while the secondary data comes from books, journals, encyclopedias, dictionaries and virtual sources. while the data processing technique is through interviews. The results of this research show that product development for micro, small and medium enterprises and intellectual property for batik at the Krakatoa Batik Studio in Cilegon City can be carried out by developing models, patterns, colors, batik patterns, variations and development of typical batik. in the Krakatoa studio which has the philosophy of the city of Cilegon, apart from that, it is no less important to collaborate with other batik craftsmen in making goods that have batik motifs, as well as development in terms of marketing, the Krakatoa batik studio has expanded into the online market by having a shop on Bukalapak, and Legal protection for Micro, Small and Medium Enterprises products and Intellectual Property for Batik at the Krakatoa Batik Studio in Cilegon City can be done by registering the intellectual works owned including copyrights, brands and patents to the directorate general of intellectual property to obtain legal rights and protection from the state.

Abstract

Abstract Cilegon City is an area that is prone to various types of disasters, including natural disasters. Natural disasters are natural phenomena that can cause damage and destruction to the environment which ultimately can cause loss of life, loss of property and damage to developments that have been built so far. Cilegon City is known as an industrial area that is prone to disasters, one of which is technological failure which is the most threatening threat to the people of Cilegon City. This area has the potential for complex natural disasters. Not only is there the threat of technological failure every year, this industrial city is also prone to floods, tsunamis, earthquakes and industrial disasters. Based on the records of the Cilegon Regional Disaster Management Agency (BPBD) every year, the threat of technological failure is ranked first. This research use desciptive qualitative approach. This aims to find out how the management functions of prevention, mitigation and control are carried out by the Cilegon City regional disaster management agency (BPBD), in dealing with the dangers of technological failure. The research results show that the disaster prevention process through a prevention and mitigation management approach in Cilegon City has been implemented even though there are stages that have not been optimal. Keywords: Disaster, Tecnology Failure, BPBD, Cilegon City Abstrak Kota Cilegon merupakan daerah yang rawan terhadap berbagai jenis bencana, termasuk bencana alam. Bencana alam merupakan fenomena alam yang dapat mengakibatkan kerusakan dan kehancuran lingkungan hidup yang pada akhirnya dapat menimbulkan korban jiwa, kerugian harta benda dan rusaknya pembangunan yang telah dibangun selama ini. Kota Cilegon di juluki sebagai daerah kawasan industri yang rawan terhadap bencana, salah satunya adalah kegagalan teknologi yang menjadi ancaman yang paling mengancam masyarakat kota cilegon. Daerah ini mempunyai potensi bencana alam yang kompleks. Tak hanya ancaman kegagalan teknologi setiap tahunnya, kota industri ini juga rawan terhadap bencana banjir, tsunami, gempa dan industri. Berdasarkan catatan Badan Penanggulangan Bencana Daerah (BPBD) Cilegon setiap tahunnya, ancaman kegagalan teknologi menduduki peringkat pertama. Penelitian ini menggunakan pendekatan deskriptif kualitatif. Hal itu bertujuan untuk mengetahui bagaimana pelaksanaan fungsi manajemen pencegahan, mitigasi dan penanggulangan yang dilakukan oleh badan penanggulangan bencana daerah (BPBD) Kota Cilegon, dalam menangani bahaya kegagalan teknologi. Hasil penelitian menunjukkan bahwa proses pencegahan bencana melalui pendekatan manajemen pencegahan dan mitigasi di Kota Cilegon telah terlaksana meskipun terdapat tahapan yang belum maksimal. Kata kunci: Bencana, Kegagalan Teknologi, BPBD, Kota Cilegon

Abstract

This research focuses on the implementation of E-Government and the influencing factors in the Investment and Integrated One-Stop Service Agency (DPMPTSP) of Cilegon City, with the aim of improving the quality of public services. The main issues include the rejection of permit applications due to incomplete documentation, the unreadiness of the OSS system, delays in service processing, and inadequate response to public complaints. The concept of e-government by Indrajit is used in this study to assess the success factors of E-Government implementation. The data collection method employed is the Study of Documents and Text Analysis. The results of the research show that overall, the implementation of e-government in DPMPTSP of Cilegon City provides positive benefits and advances in the delivery of public services

Abstract

A value contained in ethics must be a reference, goal and guide in acting and behaving that will bring positive consequences and influences morally. The practice of ethical violations in implementing the New Oncology project occurs in the form of dishonesty and weak integrity in implementing an agreement. The agreement must contain everything that has been mutually agreed upon so that a consensus agreement on the agreement is a valid (legal) agreement for both parties. party. This research aims to find out about the application of business ethics in construction work agreements and aims to find out the form of dispute resolution in construction work agreements on the New Oncology project regarding delays in work completion times at PT. Fahrenheit in Tangerang Regency. This study uses a qualitative method with empirical juridical approaches. The data used are primary and secondary data. The results of this research: 1. The application of business ethics in the construction work agreement on the New Oncology project is in accordance with the agreement but in practice there are defaults; 2. Settlement of legal disputes in this agreement is carried out by means of non-litigation, if a solution cannot be found in this method, it will be resolved by means of litigation. Abstract

The filling of the positions of President and Vice President is one of the important elements in the administration of the state. In the constitution, it is explained that the holder of governmental power is the President, assisted by a Vice President. Based on the constitution, Indonesia has regulated the mechanism for filling the positions of President and Vice President. The principles of the Indonesian state constitution or the basic law of the Republic of Indonesia contain the principles of democracy. The filling of the positions of President and Vice President underwent changes after the Indonesian Constitutional Amendment, from indirect elections to direct elections. This needs to be a point of attention regarding the meaning of the presidential and vice-presidential election system according to the Constitution. The research method uses a normative juridical approach with a descriptive-analytical type of research. Research results, first, the system of filling the positions of President and Vice President before the Amendment was chosen by the People's Consultative Assembly (MPR), whereas after the Amendment, they were directly elected by the people. Second, the construction of the appointment of the President and Vice President needs to be carried out by philosophically examining the values and spirit of the 1945 Constitution within the framework of representative elections

Abstract

The number of traffic accident fatalities in Indonesia remains a serious issue that requires thorough attention. Law No. 22 of 2009 on Traffic and Road Transportation (UULLAJ) was designed to reduce the number of accidents and improve road safety. This article aims to evaluate the implementation of this law in efforts to lower traffic accident fatalities. Using a qualitative analysis method, this study assesses the effectiveness of traffic regulations, government policies, as well as the supporting and inhibiting factors in its implementation. The research findings show that despite the regulations being enforced, challenges remain in law enforcement and public awareness levels. Therefore, increased cooperation between authorities and the public is necessary to ensure more effective rule enforcement in order to reduce the number of fatalities from accidents.

Abstract

This research aims to analyze community participation in the process of forming laws and regulations and the obstacles that accompany it. Community participation in the process of forming laws and regulations is a concrete manifestation of the implementation of sovereignty which is in the hands of the people. Regulations regarding community participation are regulated in Article 96 of Law Number 13 of 2022 which is an amendment to Law Number 12 of 2011. This regulation accommodates community participation which can be provided by providing written and verbal input, both online and offline regarding each stage of formation. The research uses normative methods and a legislative and conceptual approach that examines related laws and regulations descriptively. The research results show that community participation can be channeled through listening meetings, outreach, work visits, and various other forms of discussions facilitated by the government. However, in implementing community participation, normatively there are still several obstacles or evaluations regarding regulations, namely (1) limitations in the meaning of "community" who can submit their opinions or input to the process of forming statutory regulations; (2) limited evaluation materials that can be used as a basis for the community in providing their aspirations or input because based on Article 96 paragraph (4), the only ones that are open to access to the public are academic texts and draft regulations; (3) participation activities can only be carried out based on the wishes of the legislators; (4) there is no time limit or at least a minimum number of times the activity will be held; and (5) lack of implementing regulations relating to the regulations in Article 96 paragraph (9) because regulations regarding public participation should be regulated in DPR Regulations, DPD Regulations and Presidential Regulations.

Abstract

The COVID-19 pandemic has urged all countries to work optimally to minimize the resulting negative impacts. Cooperation is an unavoidable effort to create maximum efforts in handling COVID-19 because no single country can solve the COVID-19 problem independently. This paper discusses how to reflect on the cooperation carried out by the United States (US) and ASEAN to solve the COVID-19 pandemic. As a major power, the US has always played an essential role in global interactions, especially in times of crisis. However, under the Trump administration, bilateral and multilateral approaches to cooperation will face challenges. As an anti-globalist, Trump will try his best to calculate the benefits that the US gets in every form of cooperation. By using a transactional bilateralism approach, this paper explains how the motive for cooperation can occur in terms of US domestic factors in handling COVID-19, the Trump administration's rational calculations, to the strategic opportunities that the US can capitalize on its cooperation with ASEAN to resolve the problem.

Abstract

Australia has restored offshore detention to Nauru through the Pacific Solution despite continuing criticism globally and violations of human rights. Its continuation raises the question of how this highly debatable policy can still exist. Securitization theory is used in this study to show how asylum seekers are considered threats, resulting in strong state measures to maintain their safety. The study seeks to investigate how the Australian government and media support offshore detention, and to examine the tactics used by humanitarian organizations to challenge this approach. A qualitative case study approach is used in the study, which involves critical discourse analysis to look at political statements, media reports, and advocacy materials from 2024. An examination of the situation shows that both political figures and media used alarming and negative language to describe asylum seekers. These narratives changed public opinion and helped people think offshore detention was necessary for security. Critically, discussions advocating legal and moral points of view remained largely confined to a small audience. The conclusion is that this policy works only by being discussed as a security threat rather than its effects on the crisis.
