Abstract

Mystery Scoop has emerged as a randomized sales mechanism on digital marketplaces in which buyers select and pay for a package before the specific goods are determined. This mechanism raises questions under Islamic commercial law because material characteristics of the transaction object may remain uncertain when the agreement is made. This study employs a qualitative descriptive design with a normative legal approach. Data were obtained through documentary research, non-participant digital observation of Mystery Scoop practices on Shopee and related promotional content, and literature concerning fiqh al-muʿāmalāt and DSN-MUI Fatwa No. 146/DSN-MUI/XII/2021.  The findings show that the specific items are determined randomly after payment, while their type, quantity, quality, and economic value may remain insufficiently ascertainable beforehand. Such material uncertainty may constitute gharar and may also weaken the effective exercise of khiyār. Potential tadlīs, ghishsh, and tanājush/najsh, however, cannot be inferred solely from randomization and require evidence of specific seller conduct. The study argues that randomization is not inherently incompatible with Sharia when its scope is clearly bounded. A Sharia-compliant Mystery Scoop model should integrate pre-contract disclosure, bounded randomization, and post-transaction protection through khiyār and accessible complaint mechanisms, thereby preserving the element of surprise while strengthening transparency, informed consent, and buyer protection.

Abstract

This study examines the efficiency of local government functional spending in East Java in realizing hifdz al-‘aql and investigates whether regional area and population size explain variations in spending efficiency. A quantitative approach was employed using a Two-Stage Data Envelopment Analysis (DEA) covering 38 regencies and cities from 2019 to 2023. The first stage applied an input-oriented Variable Returns to Scale (VRS) model, with functional spending on education, economy, tourism-culture, and public order-security as inputs and the Education Index, represented by Expected Years of Schooling and Mean Years of Schooling, as the output. The second stage employed panel regression to examine regional area and population size as exogenous determinants. The results reveal an average efficiency score of 0.630, indicating considerable scope for input optimization or reallocation while maintaining existing educational outcomes. Regional area and population size have no statistically significant effects on efficiency variations. From a Sharia perspective, this efficiency gap should not be directly equated with isrāf, but understood as a normative indication for improving the management of al-māl al-‘āmm as an amānah to maximize maṣlaḥah. The study contributes to Islamic economic law by operationalizing hifdz al-‘aql as an evaluative framework that integrates empirical spending efficiency with Sharia-oriented public financial governance.
