Abstract

Armed robbery and piracy conducted by Somali pirates in the Horn ofAfrica region are international crime which threatens internationalpeace and security. These crimes have raised international concerns.In response to the threats, The United Nations Security Council issuedResolution No. 1851 that stressed the importance of the state,regional, and international organizations to actively fight piracy andarmed robbery. Responding to the resolution, the United Statesbecame one of the nations that response to these crimes; by issuingforeign policy that contains a variety of efforts in combating armedrobbery and piracy in the region. This research aims to determine therole of United States to overcome Somali armed robbery and piracy inthe Horn of Africa.This research uses theory of international crime, national insecurity,international actors, and foreign policy. This is analytical descriptiveresearch. Data collected by interview as well as related literatures.The result of this research shows that United States as direct centralactor lead the international actions to combat Somali armed robberyand piracy in the Horn of Africa Region by doing “smart power”approach.

Abstract

For several years, Indonesia has become the source, transit, anddestination country for human trafficking. According to IOM,Indonesia is South-East Asia’s second largest country for humantrafficking case after Thailand. To fight human trafficking inIndonesia, INP, as part of law enforcement body in Indonesia, hascooperated with IOM and givenspecial attention to this issue. Thisresearch aims to analyse thesupporting andobstructing factors to suchcooperation, considering the fluctuative number of human traffickingcase in Indonesia between 2007-2013. This research employs theoryof transnational crime, human rights, and liberal institusionalism todescribtively analysedata collected through interview as well as otherrelated literatures. The result shows that there are obstructing factorssuch as coordination, internal problem of INP, and time management,which hinder this cooperation from achieving its optimum outcome.

Abstract

Protection of war victims is an important issue due to the fact thatthere will always be crimes and violations to the things protected bythe law of war. Israeli military action toward Palestine is not onlyinterfering the security of Palestinians, but also obstructing thedistribution of humanitarian assistance for the victims of war.Established in 1968 and acquired mandate from the Government ofPalestine, Palestine Red Crescent Society (PRCS), as underbow ofInternational Committee of the Red Cross (ICRC), attempts to protectPalestinians as victims of war based on the rules of GenevaConventions 1949. Between 2002 until 2009, there were three militaryactions had been done by Israeli toward Palestine which increased thenumber of Palestinian war victims. This thesis is an explorative typeof research aimed to analyse challenges faced by Palestine RedCrescent Society in protecting Palestinian war victims between 2002until 2009. The result of this research showed that the most affectingchallenge came from external factor, that was the bureaucracy ofIsraeli military.

Abstract

Drug becomes important issues because they are threatening allaround countries. A transnational drugs trafficking as in the fase ofIndonesia-China conducted by an international syndicate resulted in aloss of both sides. On December 2, 2003 Indonesia and China agreedto sign a Memorandum of Understanding to combat transnationalcrime, cooperate of narcotics and drugs. Cooperation is carried outby The Indonesia National Police and The Ministry of Public Securityof China. Cooperation agreed upon by the two countries was valid forfive years, before needing a renewal on December 2, 2008. Theresigning process has been slow where several factors have indicatedthat two governments might have not been fruitful. Based on datamining through interviews, the result of this research is process resignatories,because there are several factors such as the existence ofthe counter draft, distribution of authority through the Mutual LegalAssistence system and the differences in the system of government.

Abstract

Humanitarian issues in Myanmar, in May 2012 was an issue thatdrew international attention, including Indonesia. The ethnic conflictbetween Rohingya and Rakhine led to crime against humanity.Following the humanitarian crisis in Myanmar, Indonesia promotepeace between Rohingya and Rakhine. This study seeks to explainIndonesia’s foreign policy in the case of ethnict conflict in Myanmar.This research employed idiosyncratic approach to explain therelationship between Indonesia’s foreign policy and personalcharacters of the leader. Conciliatory character of Susilo BambangYudhoyono’s leaderships affects participatory orientation inIndonesia’s foreign policy. Susilo Bambang Yudhoyono as Indonesiapresident become an important actor in policy making to promotepeace resolution in Myanmar. Abstract

High population density in Indonesia constricts the job opportunitiesfor Indonesian and gives impacts such as poverty and unemployment.These constricted job opportunities make the people in Indonesia seekfor a job abroad to fulfill their needs. The transmission of Indonesianlabour to Saudi Arabia is increasing every year, triggering the labourissues in Indonesia, such as many forms of harassment that entirelyconducive for human trafficking. This research aims to find outIndonesia’s efforts to prevent trafficking in person of Indonesianlabour in Saudi Arabia through the National Agency for ThePlacement and Protection of Indonesian Labour, as one of the bodiesdirectly responsible to president. To answer the problem, the theory ofinternational migration, the theory of human trafficking, humanrights, and theory of cooperation in the paradigm of liberalism, areused in this research. This research uses qualitative method withdescriptive-analytical type by using literature reviews and interviewsresearch technique. The result shows that the efforts done by theBNP2TKI in preventing trafficking in person of Indonesian labour arenot optimal yet, where there are still many weaknesses and constraintsin preventing human trafficking.

Abstract

Illegal fishing has become an important issue because it threatens themaritime security. The activity of illegal unregulated unreported(IUU) fishing in the Indian Ocean not only does it jeopardize themaritime security of Indonesia and Australia, but also does it causefinancial deficit to the country, moreover, if the activity of IUU fishingkeeps increasing it will endanger the sustainability both fish andenvironment. The situation encourages member countries of Food andAgriculture Organization (FAO) in devising an applicable concept tomany countries in the world regarding organized, responsible, andsustainable fisheries management and development, namely Code ofConduct for Responsible Fisheries (CCRF) which was settled in 1995.The activity of IUU Fishing in the Indian Ocean initiates Indonesiaand Australia to conduct a fisheries cooperation agreement toprevent, deter and eliminate illegal fishing in the Indian Ocean.Indonesia and Australia adopt the CCRF into the fisheries treaty. Thisresearch aims to identify the efficacy of CCRF implementation in thefisheries cooperation agreement between Indonesia and AustraliaGovernment to cope with IUU fishing. The result of the researchshows that CCRF as a regime is able to work effectively to cope withIUU fishing in the Indian Ocean.

Abstract

Drugs abuse is a criminal act which cause harm to state’s health,social and economy circumstances. So far, United Nation on Drugsand Crime (UNODC) drugs policy tend to do law enforcement andoperations to stifle drug supply. Portugal raise a different policy in2001 where drug use is no longer a crime act and only consider asadministrative offences. It show positive result and they try to promoteit into the Commission in Narcotic Drugs (CND). Using liberalinstitutionalism and global public policy theory, this research tries toanalyze the process of global policy adoption to challenge drugsabuse. It seeks to describe what kind of global policy adoption happenin CND is and the process in adopting national policy into globalpolicy. As the result, UNODC did not fully adopting Portugal’s drugsdecriminalization policy. But, Portugal and European Union’s role inpolitical process in CND earn policy adoption to the importance ofaccess to rehabilitation and treatment for drug users as a strategy tochallenge drug abuse.

Abstract

Haze pollution in Riau, Indonesia is an annual problem that should be dealtby Indonesia and Malaysia Governments. Haze pollution is a form oftransnational crime because it has been polluting the environment ofMalaysia. Riau haze pollution coming from forest fires and land adverselyaffecting the entire important aspects. The seriousness of the problem of hazepollution in Riau, need some immediate prevention attempts taken byIndonesia and Malaysia. Indonesia established bilateral cooperation withMalaysia to address this issue because Malaysia is the one that received themost severe negative impact of the haze. The results of the bilateralcooperation is an agreement in the form of a Memorandum of Understanding(MoU) between Indonesia and Malaysia for the prevention of forest fire andhaze in Riau. MoU between the two countries was signed in 2008 andlegitimate until 2013. However, the conditions in Riau due to haze pollution,is getting worse in 2013 which led to the smog disaster. Question problemthat arises is how the implementation of the cooperation between Indonesiaand Malaysia in response to the case of haze in Riau during 2008-2013. Thepurpose of research to describe and analyze the situation in Riau due to haze,haze reduction, and the implementation of cooperation between Indonesiaand Malaysia during the period 2008-2013. In answer to the problems andobjectives of the research carried out by using the theory of internationalcooperation, transnational crime theory, and the theory of environmentalcrimes in the paradigm of liberalism. This research is using a qualitativemethod with the type of descriptive-analytical by using literature reviews andinterviews research technique. The finding of this research is theimplementation of the cooperation between Indonesia and Malaysia has notgiven an effective and optimal results due to it’s lack of time, location, andlaw enforcement as well as human resources problems in Indonesia.
