Abstract

Micro, Small, and Medium Enterprises (MSMEs) contribute significantly to national economic development, particularly in strengthening the real sector and creating employment opportunities. Each year, the number of MSMEs continues to increase, including those in the food sector, which is rapidly growing across various regions. However, this growth is not accompanied by adequate legal awareness, as evidenced by the fact that many MSME actors in Blitar Regency still do not possess a Business Identification Number (NIB). In fact, ownership of an NIB is a legal obligation for MSMEs in accordance with Government Regulation No. 7 of 2021 concerning the Facilitation, Protection, and Empowerment of Cooperatives and Micro, Small, and Medium Enterprises. This study aims to analyze the legal awareness of MSME actors engaged in melinjo chip snack food processing regarding NIB ownership in Blitar Regency. The research employed an empirical juridical method. Data were collected through interviews, observations, and documentation, and were analyzed using a qualitative approach. The findings indicate that the legal awareness of these MSME actors is influenced by age, educational background, and social environment.

Abstract

This study aims to analyze the regulatory framework governing discipline for Government Employees with Work Agreements (PPPK) as specified in Law Number 20 of 2023 concerning the State Civil Apparatus (ASN), and to examine future regulatory directions to ensure legal certainty in the enforcement of discipline across all civil servants. The research adopts a normative juridical method with a statutory approach by reviewing relevant laws and legal doctrines. Data were collected through literature studies involving primary, secondary, and non-legal materials, and analyzed using a prescriptive method to provide normative arguments and a legal perspective on the issues observed. The findings indicate that disciplinary enforcement for PPPK currently relies on general provisions in the ASN Law of 2023, without comprehensive technical guidelines. In practice, most procedures still refer mutatis mutandis to Government Regulation Number 94 of 2021, which was originally intended for civil servants (PNS). This creates a legal vacuum that may lead to uncertainty and inconsistency in disciplinary enforcement. Therefore, a regulatory update specifically addressing PPPK is urgently needed to uphold the principles of justice, legal certainty, and equality within the national civil service system.

Abstract

This research is motivated by the enactment of Law Number 3 of 2025 concerning Amendments to Law Number 34 of 2004 on the Indonesian National Armed Forces (TNI), which has generated controversy regarding the expansion of civilian positions that may be occupied by active TNI personnel. The provision is considered to have the potential to weaken the principle of civilian supremacy, create political conflicts of interest, and cause disharmony with Law Number 28 of 1999 concerning State Administrators Who Are Clean and Free from Corruption, Collusion, and Nepotism. This study aims to analyze the conformity of dual civilian positions held by TNI personnel with the principle of civilian supremacy and to examine the forms of disharmony between the two laws. This study employs normative legal research using both statutory and conceptual approaches. Legal materials were collected through library research consisting of primary, secondary, and tertiary legal sources. The legal materials were analyzed using a prescriptive method in order to provide legal arguments and solutions to the issues examined. The results of the study indicate that the provisions concerning dual civilian positions held by active TNI personnel are not fully consistent with the principle of civilian supremacy because they may lead to military intervention in civilian affairs, political conflicts of interest, human rights violations, and tendencies toward authoritarianism. Furthermore, the revised TNI Law is considered disharmonious with the principles of legal certainty, orderly state administration, public interest, professionalism, and accountability as stipulated in Law Number 28 of 1999. Therefore, clearer legal norms and stricter limitations on the involvement of active TNI personnel in civilian positions are necessary to safeguard democratic principles, civilian supremacy, and legal certainty in Indonesia.

Abstract

This study examines the boundaries of legal responsibility of a notary who holds another notary's protocol when that protocol becomes the object of a court dispute, an issue not explicitly regulated under Indonesia's Notary Law (UUJN-P). Using normative legal research with a statutory and conceptual approach, this study analyzes Articles 62–65 of UUJN-P through grammatical, systematic, and teleological interpretation, supported by three court cases in which protocol-holding notaries were joined as co-defendants despite having no role in drafting the disputed deeds. The results show that UUJN-P only regulates the administrative mechanism of protocol transfer and safekeeping, without defining the scope of liability once a stored deed is disputed. Interpretive analysis indicates that the protocol-holding notary's responsibility is limited to administrative-procedural duties safekeeping, maintaining, and issuing copies of deeds while substantive responsibility for the deed's content remains with the notary who originally drafted it. Civil liability may only arise if negligence or unlawful conduct in managing the protocol is proven under Article 1365 of the Civil Code, and administrative sanctions require proven breach of custodial duty under Article 85 UUJN-P. Protocol-holding notaries may pursue preventive measures (formal handover reports) and repressive measures (raising exceptions in court, seeking institutional protection from the Notary Honorary Council and the Indonesian Notary Association). This study recommends that lawmakers amend UUJN-P to explicitly define the limits of a protocol-holding notary's liability.
