Abstract

Qur’an teaching required more than technical mastery of recitation and tajwid because effective instruction also depended on ethical orientation and productive teacher–learner relationships. This study aimed to construct an integrative competency framework for Qur’an teachers through thematic tafsir. It employed qualitative library research using a conceptual thematic (maudhu‘i) approach. Primary data consisted of QS. Al-‘Alaq [96]: 1–5, QS. Al-Kahf [18]: 65, and QS. An-Nahl [16]: 125, interpreted through selected tafsir works and supported by relevant hadith. Secondary data comprised scholarly literature on teacher competence, Qur’an education, and pedagogy. Data were collected through documentation, classified thematically, compared across interpretive sources, and synthesized through descriptive-interpretive and comparative analysis. Credibility was strengthened through source triangulation and interpretive traceability. The findings identified three interdependent dimensions: epistemic-professional, spiritual-personality, and pedagogical-relational competence. The novelty lay in explaining their functional integration within a Qur’anic competency architecture: knowledge formed the epistemic foundation, rahmah and moral-spiritual qualities provided ethical orientation, while hikmah, constructive counsel, dialogue, and gentleness shaped pedagogical transmission. The framework offered a conceptual basis for Qur’an teacher development and competency assessment.

Abstract

Halal food and beverages constitute a central element of Muslim life, yet contemporary discussion often separates Qur'anic norms, the tayyib principle, health and safety considerations, and modern halal assurance. This study aimed to integrate these dimensions and clarify their practical relevance. A qualitative library-research design was employed using a normative-theological perspective and thematic content analysis. Primary textual data were drawn from Q.S. Al-Ma'idah 5:3-4 and Q.S. Al-Baqarah 2:168, while supporting materials comprised peer-reviewed studies and Indonesian halal regulations published mainly within the last decade. The analysis generated four interrelated dimensions: normative lawfulness, tayyib quality, process integrity, and ethical-spiritual orientation. The findings showed that halal consumption could not be reduced to the absence of prohibited ingredients; it also required attention to lawful acquisition, cleanliness, safety, quality, traceability, and responsible consumption. Contemporary certification and supply-chain assurance therefore functioned as institutional mechanisms for translating Qur'anic norms into complex food systems. The study concluded that an integrated halal-tayyib framework provided a more comprehensive basis for Muslim consumption than a purely label-based approach

Abstract

This study examined the legal meaning of the command to maintain prayer in Qur'an 2:238, the juristic-exegetical significance of al-salat al-wusta, and the relationship between devotional discipline and moral formation. A qualitative library design combined thematic exegesis with qualitative content analysis. The primary corpus comprised Qur'an 2:238, four thematically related passages, and four classical and contemporary tafsir works, while 26 journal articles published in 2017–2025 formed the supporting corpus. The analysis showed that the imperative to maintain prayer conveyed a norm of continuous observance rather than episodic performance. The specific mention of al-salat al-wusta functioned as a normative emphasis on safeguarding a vulnerable or specially prioritized obligation without erasing interpretive disagreement over its identity. The command to stand before God in obedience linked legal compliance to inward attentiveness. The study therefore reconstructed prayer maintenance through four connected stages: ritual preservation, inward presence, value internalization, and behavioral transformation. Educational and psychological benefits were treated as supporting implications rather than substitutes for the verse's normative-theological meaning

Abstract

Hajj and Umrah were examined as forms of Islamic worship in which legal, spiritual, social, and contemporary institutional dimensions intersected. This study investigated their legal foundations, conditions of obligation, pillars, essential duties, procedures, and selected contemporary issues from an Islamic jurisprudential perspective. A qualitative library-research design with descriptive, analytical, and comparative approaches was employed. The analysis drew on the Qur'an, hadith, authoritative fiqh works, official pilgrimage guidance, Indonesian regulations, and traceable peer-reviewed studies, particularly recent literature on pilgrimage management and health-related istitha'ah. The findings showed that the obligation of Hajj for Muslims possessing istitha'ah was established by consensus, whereas the legal status of Umrah remained subject to recognized juristic disagreement. Contemporary issues involving proxy Hajj, women's travel without a mahram, health eligibility, and pilgrimage governance required an integration of classical legal reasoning, considerations of safety and welfare, and modern institutional evidence. The study demonstrated that combining doctrinal fiqh, cross-madhhab comparison, and verifiable contemporary sources produced a more precise and context-sensitive account of Hajj and Umrah

Abstract

The development of artificial intelligence (AI) has brought major changes to the production and dissemination of information through social media. In addition to providing benefits across various areas of life, AI also has the potential to be misused to create and disseminate hoax content that is difficult to distinguish from accurate information. This study aims to analyze the forms of AI misuse in hoax dissemination, the factors contributing to such misuse, and its assessment from the perspective of Islamic Criminal Law. This research employs normative legal research using a library research approach. Primary legal materials include the Qur'an, hadith, Law No. 1 of 2024 on Electronic Information and Transactions, and fiqh jinayah literature. Secondary materials consist of books, scholarly journals, and other relevant literature. The materials were analyzed using a qualitative descriptive method. The findings indicate that AI is misused in hoax dissemination through the creation of false news, narrative manipulation, dissemination of unverified information, and mass content production. From the perspective of Islamic Criminal Law, such conduct contains elements of al-kadhib, fitnah, tadlīs, and mafsadah and may therefore be classified as jarimah ta‘zīr.

Abstract

Narcotics abuse is a multidimensional offense that threatens individual health, family resilience, and social stability, requiring a firm, proportionate, and just legal response. This article analyzes the concepts and legal foundations of sanctions for narcotics abuse under Indonesian positive law and Islamic criminal law, focusing on their similarities, differences, and relevance to national narcotics-control policy. The study employs normative legal research with a comparative legal approach and descriptive-qualitative analysis of primary, secondary, and tertiary legal materials collected through library research. The findings show that Indonesian positive law applies a double-track system combining criminal punishment and rehabilitation under Law Number 35 of 2009 on Narcotics. In Islamic criminal law, narcotics abuse is classified as jarīmah ta’zīr through qiyas with khamr, with sanctions determined by ulil amri based on maqāṣid al-syarī’ah, particularly ḥifẓ al-‘aql. Both systems emphasize public protection and offender rehabilitation but differ in legal sources, forms of sanctions, and judicial authority. Integrating rehabilitative principles with maqāṣid al-syarī’ah may strengthen the effectiveness, proportionality, and fairness of narcotics-control policy in Indonesia.

Abstract

Domestic violence remains a serious legal and social problem in Indonesia, requiring case-resolution mechanisms that protect victims while accommodating restorative objectives. This study examines the termination of prosecution in the Miswaruddin domestic violence case through Prosecution Termination Decree No. PRINT-901/L.2.28.3/Eku.2/09/2025 and assesses its conformity with Regulation of the Prosecutor’s Office of the Republic of Indonesia No. 15 of 2020 and principles of Islamic criminal law. The study employed normative legal research using statutory and case approaches, supported by document and literature review. The analysis found that the case materials recorded reconciliation between the parties, the suspect’s first-offender status, support from community and religious leaders, and considerations concerning the children and family continuity. However, the available manuscript did not contain sufficient documentary detail to determine conclusively whether Article 44 paragraph (1) or paragraph (4) of the Domestic Violence Law applied or to independently verify every procedural approval stage. From an Islamic criminal law perspective, the restorative mechanism is relevant to ṣulḥ, taʿzīr, maṣlaḥah, and maqāṣid al-sharīʿah insofar as voluntariness, victim safety, accountability, and the prevention of repeated violence remain primary considerations.

Abstract

Sexual violence committed by a father against his adult daughter raises a difficult question of statutory choice when the parties remain biologically related but no longer share an active household. This study examines Case Reg. No. PDM-28/SIPIROK/Eku.2/11/2024 and the Public Prosecutor's decision to rely on Article 6(c) in conjunction with Article 15(1)(a) of Law No. 12 of 2022 on Sexual Violence Crimes (UU TPKS), rather than Law No. 23 of 2004 on the Elimination of Domestic Violence (UU PKDRT). Using a qualitative single-case design, the study draws on a semi-structured interview with the handling prosecutor, the indictment as a supporting case document, and relevant legal literature. The statutory comparison indicates that, within the prosecutor's legal construction, UU TPKS more directly addresses abuse of position, trust, and influence without requiring proof of direct physical force. Through Imam Asy-Syathibi's maqashid al-sharia framework, the sentencing demand is assessed against hifz al-din, hifz al-nafs, hifz al-'aql, hifz al-nasl, and hifz al-mal. The analysis further shows that the absence of physical violence cannot be equated with consent because non-physical coercion may arise from psychological domination, economic dependency, and unequal family power relations.

Abstract

This study examines the implementation and effectiveness of terminating prosecution on restorative justice grounds in assault cases at the North Padang Lawas District Attorney's Office. It employs an empirical legal (socio-legal) approach with a qualitative case-study design. Primary data were obtained from purposively selected categories of informants directly involved in case handling, while documentary data comprised case registers, the 2024 restorative justice case file, relevant legislation, and recent scholarly literature. The 2024 case was assessed against Attorney General Regulation No. 15 of 2020, and institutional effectiveness was analyzed using Soerjono Soekanto's five factors of legal effectiveness, supported by source and methodological triangulation. From January 2024 to June 2026, three assault cases were recorded: one case was terminated through restorative justice in 2024, while two cases proceeded to trial in 2025. The 2024 case demonstrates a voluntary settlement process, offender accountability, victim forgiveness, community participation, hierarchical approval, and termination of prosecution. The one-in-three proportion is descriptive and should not be treated as a stand-alone measure of effectiveness. The legal framework, prosecutorial facilitation, and available facilities support implementation, whereas limited human resources, divergent interests, victim willingness, and uneven public understanding constrain its reach. Restorative justice is therefore procedurally operational in eligible cases; however, broader substantive effectiveness cannot be generalized from the small case population and requires stronger case-level documentation and post-settlement evaluation.
