Abstract

Law Number 8 of 1999 concerning Consumer Protection regulates legal efforts to resolve consumer disputes through the courts. The lawsuit for damages is based on an unlawful act. The problem is how the concept of unlawful acts is a strict liability model for demanding compensation. The research method used is normative legal research. The results of this study explain that legal remedies through the concept of unlawful acts with this absolute liability model are by interpreting Article 19 paragraphs (1) and (3) of Law Number 8 of 1999. The concept of an unlawful act with a strict liability model is a plaintiff's obligation to prove the existence of a loss without having to prove a mistake. The recommendation is that the Government and the DPR immediately revise Law Number 8 of 1999 by strictly regulating unlawful acts as a legal norm in the law.

Abstract

The issuance of Law Number 5 of 1960 concerning Basic Agrarian Regulations or what can be called UUPA is aimed at the welfare and prosperity of the Indonesian people. This policy is a form of protecting the rights of the Indonesian people which regulates ownership of flats. In its development, land in Indonesia has also followed developments with the existence of flats, namely residential places with vertical floors on a horizontal plot of land and consisting of units that can be owned and used by each owner individually as regulated in Law Number 20 of the Year 2011 concerning Flats. The regulations regarding flat ownership have been regulated in Law Number 6 of 2023 concerning Stipulation of Government Regulations instead of Law Number 2 of 2022 concerning Job Creation. However, there is legal uncertainty regarding these two laws and regulations so appropriate efforts are needed to realize legal certainty regarding ownership of flats by foreign citizens (WNA). The type of research that will be carried out is normative juridical research that uses a library study model. This research uses a statutory regulation approach. The literature study carried out by the author is on related literature which shows that there is legal uncertainty regarding the regulation of flat ownership by foreigners. Due to legal uncertainty, an ideal policy is needed to protect the rights of Indonesian citizens (WNI).

Abstract

Infrastruktur jalan tol di Pulau Sumatera merupakan salah satu infrastruktur yang diprioritaskan pembangunannya. Disebabkan proyeknya yang layak secara ekonomi namun tidak layak secara finansial, pengusahaan jalan tol dilakukan oleh pemerintah melalui penugasan kepada PT Hutama Karya (Persero). Tentunya, penugasan ini akan membebani perusahaan dan bahkan merugikan perusahaan, karena proyeknya tidak layak secara finansial. Sepatutnya proyek penugasan dijamin oleh pemerintah, baik dari segi keuntungan maupun pinjaman, sehingga tidak merugikan perusahaan, karena perusahaan perseroan memiliki tujuan umum untuk mendapatkan keuntungan. Tujuan penelitian ini ialah untuk mengetahui dasar-dasar hukum mengenai penugasan pemerintah untuk pembangunan infrastruktur dan kompensasinya bagi perusahaan perseroan, dan untuk melihat apakah dasar hukum tersebut sesuai dengan proses bisnis pengusahaan jalan tol. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Pendekatan yang dilakukan adalah yuridis konseptual, dengan cara menelaah konsep kelayakan investasi pengusahaan jalan tol, arus suntikan dana segar dari pemerintah untuk BUMN, dan peraturan perundang-undangan terkait penugasan pemerintah kepada BUMN. Hasil penelitian ini menunjukkan bahwa hukum yang ada belum sesuai dengan kondisi bisnis pengusahaan jalan tol. Dalam peraturan yang mengatur kompensasi kerugian akibat penugasan, belum dijelaskan kondisi-kondisi kerugian, dan dalam praktek hukum tersebut, masih dirasa hanya sesuai untuk penugasan penyediaan barang publik, seperti listrik dan bahan bakar minyak (BBM). Sehingga, perlu adanya penyesuaian peraturan atau peraturan baru yang menjelaskan tata cara atau pedoman kompensasi kerugian akibat penugasan pengusahaan jalan tol yang tidak layak secara finansial.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana sistem pengawasan bagi orang asing yang tinggal di Indonesia menurut UU RI no 6 Tahun 2011 tentang Keimigrasian. Penelitian  ini  merupakan penelitian  hukum  Yuridis normatif,  Spesifikasi penelitian ini adalah penelitian “diskritif analisa”, karena akan menganalisis pokok permasalahan yang diteliti berdasarkan peraturan perundang-undangan.Undang-Undang Keimigrasian No. 6 Tahun 2011 memuat aturan hukum administrasi dan sanksi yang menjelaskan ketentuan pidana keimigrasian. Keimigrasian dalam kaitannya dengan aspek masuk dan keluar wilayah Indonesia adalah kewajiban untuk mendapatkan surat perjalanan (paspor) bagi siapa saja yang masuk atau keluar wilayah Indonesia, ada jaminan hak setiap warga negara. untuk keluar atau masuk wilayah Indonesia, masuk dan keluar wilayah Indonesia harus melalui pemeriksaan petugas imigrasi di pintu masuk perbatasan, sedangkan orang asing harus memiliki visa, visa diberikan kepada orang asing yang maksud dan tujuannya datang ke Indonesia bermanfaat dan tidak mengganggu ketertiban dan keamanan nasional. Orang asing yang tinggal di wilayah RI perlu ada pengawasan, agar orang asing tersebut tidak menyalahgunakan ijin tinggal yang telah diberikan. Di dalam praktek keimigrasian, banyak terjadi kasus pelanggaran terhadap batas waktu izin tinggal yang dilakukan oleh orang asing. Hal ini diatur dalam Pasal 124 huruf b UU RI No. 6 Tahun 2011 tentang Keimigrasian, maka akan dipidana dengan pidana kurungan paling lama 3 (tiga) bulan atau pidana denda paling banyak Rp. 25.000.000,. (dua puluh lima juta rupiah).

Abstract

Legal accommodation living in the national criminal law system is an important orientation in criminal law reform after the enactment of Law No. 1 of 2023 concerning the Criminal Code. This change is aimed at integrating living law as an instrument in achieving substantive justice in Indonesia. This research was conducted using juridical-normative methods and statutory approaches, specifically by elaborating Article 2 of Law No. 1 of 2023 concerning the Criminal Code and examining living legal accommodation arrangements using a progressive legal perspective. Progressive law was chosen as the perspective in this study because of its relevance to the movement of criminal code reform in Indonesia. The results of this study are divided into shows that the legal formulation that lives in the Criminal Code is in accordance with progressive legal concepts and values, including deconstructing legal positivism by expanding the principle of legality, applying a holistic paradigm, and reorienting legal goals to substantive justice. However, there is an important note related to the potentiality of legal arrangements living in local regulations that can tend to positivization, which has an impact on the phenomenon of norm reductionism. Hukum yang hidup dan telah terpositivisasi dapat kehilangan esensinya dan menjadi hukum positif. The progressive legal perspective directs that derivative arrangements of the Criminal Code be carefully formulated by aligning themselves with the five missions of the Criminal Code. The purpose of this study is to provide a comprehensive picture of progressive legal perspectives in legal accommodation that lives in the Criminal Code, so that it can be a guideline for policymakers in formulating strategies for implementing the Criminal Code in public life in Indonesia.

Abstract

The implementation of the Far East Law System in the mechanism of Restorative Justice in Indonesia based on Civil Law is an interesting topic to be discussed in a journal. This journal will explore the application of the Far East Law System in the context of Restorative Justice in Indonesia, which is based on Civil Law. Restorative Justice is an approach that involves offenders, victims, and the community in achieving a more holistic form of justice and restoration. In the Indonesian context, the implementation of the Far East Law System can contribute to strengthening the mechanism of Restorative Justice by emphasizing principles such as reconciliation, peace, and recovery. This journal will explore how the implementation of the Far East Law System can influence the process of restoring justice in Indonesia, as well as identify the challenges and opportunities in implementing this legal system. It is hoped that this journal will provide valuable insights into how the integration of the Far East Law System and Restorative Justice can enhance the effectiveness of the judicial system in Indonesia

Abstract

Community mining, as a means of fulfilling daily needs through the utilization of existing mining resources, is a prominent activity in various regions. This study delves into the specific issues surrounding mining practices within the East Cross area of Tanjung Ratu Hamlet in Bangka Regency. It critically examines the driving forces and factors enticing individuals to engage in this illegal tin mining activity while also assessing the effectiveness of law enforcement measures taken against such actors. Employing an empirical juridical approach, this research relies on field investigations to comprehend the on-ground realities and conditions. The study reveals a persistent trend of illegal tin mining activities being conducted by the local community in the Lintas Timur area of Dusun Tanjung Ratu, Kabupaten Bangka, dating back to the early stages of reform. Intriguingly, these illicit operations have extended beyond land boundaries into water territories, in direct contravention of Perda No. 3 of 2020, which designates the area as a zero mining zone. Consequently, those involved in mining activities within this zone are classified as illegal tin miners. Despite concerted law enforcement efforts, including police raids and other enforcement actions, the study exposes a glaring inefficacy in curbing these illicit mining activities, as many continue to operate even after such interventions. The study's primary objective is to shed light on the enforcement mechanisms employed against illegal tin mining in the Lintas Timur area of Dusun Tanjung Ratu, Kabupaten Bangka, while also highlighting the challenges encountered. Ultimately, it aims to offer policy recommendations to local governments for formulating more effective strategies to combat the persistent problem of illegal tin mining in Bangka Belitung.
