Abstract

ABSTRAKSIPerkembangan dinamika masyarakat telah memberikan dampak semakin bervariasinya kebutuhan masyarakat, khususnya masyarakat pengguna jasa Notaris (klien). Tugas Notaris selain membuat akta otentik, juga mempunyai kewenangan lain, salah satu di antaranya adalah mengesahkan tanda tangan dan menetapkan kepastian tanggal surat di bawah tangan dengan mendaftar dalam buku khusus.Dari hasil penelitian dengan tipe penelitian yuridis normatif, maka penulis berkesimpulan bahwa kekuatan hukum terhadap pembuktian untuk akta dibawah tangan yang telah didaftarkan (waarmerking) oleh Notaris tidak berpengaruh terhadap waarmerking itu sendiri artinya kekuatan hukum pembuktiannya akan berlaku sempurna apabila kedua belah pihak mengakuinya karena Notaris hanya membukukan saja dalam buku khusus, selain itu Notaris tidak memiliki tanggungjawab apapun atas legalitas akta dibawah tangan yang telah didaftarkan tersebut, karena setiap akta dibawah tangan yang didaftarkan Notaris hanya memberi Nomor Register dan Dicatat dalam buku khusus, tanpa dibacakan terlebih dahulu oleh Notaris, dengan kata lain bahwa pendaftaran akta bertujuan agar negara mengetahui tentang keberadaan akta tersebut.Berdasarkan kondisi riil dari hasil penelitian penulis, pada umumnya masyarakat tidak memahami arti waarmerking secara benar, oleh karena itu saran penulis  sebagai masukan bahwa seyogyanya Notaris yang bersangkutan dapat menjelaskan lebih dahulu arti waarmerking tersebut sehingga masyarakat akan dapat mengetahui dampak daripada akta dibawah tangan tersebut yang di waarmerking.

Abstract

 Development of social progress quite rapidly, with the widespread phenomenon of the rule of law, human rights, globalization, democratization, decentralization, transparency and accountability are given new paradigm in seeing purpose, task, function, authority of Indonesian police republic that caused many demand and hopes of the Indonesian people about the implementation of the Indonesian National Police duties that more oriented to the communities it serves. Investigation is investigating a series of actions in terms and be regulated in law  in looking for  the evidence also collect the evidence, whereas he evidence could make the case easily to solve so that we could easily find the suspect of the crime. In describing subject matter, the writer try to analyse  the data that the writer get, so the writer use all of the information’s, and data’s even its primary or secondary. Then try to analyse in qualitative and present in by describing the case.

As a judicial officer presence, stipulated in the legislation, such as the common law courts, religious courts, administrative courts of the State, while the working set in procedural law (HIR / RBg)In Article 41 of Law - Law No. 8 of 2004 states that the District Court bailiff is appointed and dismissed by the Supreme Court upon the recommendation of the Chairman of the District Court is concerned, while the Bailiffs Substitutes shall be appointed and dismissed by the Chairman of the District Court besangkutan. while becoming a substitute bailiff, a candidate must be experienced at - least three (3) years as a Public Servant civil (PNS) it is stipulated in Article 40 of Law - Law No. 8 of 2004

Abstract

Lahirnya public relation masih belum dibenahi dengan pasti dan masih banyak nieniMbL',..im1 kontroversi di antara para ahli. Glend dan Danny Grisworld (dalam Oemi Abdurrahman) mengemukakan bahwa pekerjaan public relation telah dilakukan oleh Cleopatra dengan segala kemegahan seorang Ratu menyambut Mark Antony ditepi sungai Nil. Transaksi jual beli barang terjadi di Jaman Neolithic, baik para penjual maupun Ratu Cleopatra berusaha mengadakan hubungan yang sifatnya dapat menyenangkan dan menguntungkan orang lain. Konon dari sinilah awal mula kegiatan public relation mulai tersentuh. Namun masih sulit untuk menentukan kapan pekerjaan public relation dilakukan secara terorganisir karena tidak ada dukungan pasti yang dapat menentukan kapan public relation seperti yang dipraktekkan sekarang ini..

Abstract

ABSTRACT Background contained in this thesis is that land has a very important position in customary law, because it is the only thing that even wealth will however remain in its original state, sometimes even become more profitable, in terms of the land is not necessarily economically will disappear. The fact that land is a place where families and communities, providing livelihood, a place where the people who died were buried. In the common law, the legal community as an integral part of the occupied land, there is a close relationship once the relationship is rooted in the view that the religio-magical, causing people to obtain legal right to control the land, utilizing the land, collect the result of growing -plants that live on land, it also hunt the animals that live there. Community rights law upon this land called seignorial rights or customary rights that existed before the making of a law governing the land of the Law. 5 of 1960 on Basic Agrarian.Implementation issues raised are the Basic Agrarian Law Against Land Registry We recognize two kinds of land transactions, the first which is a unilateral act, and the second is a legal act which is essentially a two-party transfer of land rights are accompanied by payment of the other party the land law is referred to as a sale transaction. This customary land transactions especially in Kalimantan called jada sell the cash payment and delivery with no requirement for ever and ever. This transaction, so that a legal act, then the transaction must be done with the help of the head of the fellowship and considered valid, it means the right to receive legal protection, to help the alliance chief witness typically earn money.According to the authors conclusion is that if the transaction is carried out without the knowledge of the head of the alliance, the transaction is not recognized by customary law and therefore the third party is not bound by it and by the recipient common ground is not recognized their rights to the land in question, this act is considered misconduct and should be bright Local governments in particular Samarinda National Land Agency to disseminate-socialization to all levels of society both society at large and in particular indigenous peoples understand how to register the land.Keywords:  Implementation, Land Registry

Abstract

ABSTRACTTechnical implementation rather than the rights of the ex- wife of her husband's former salary , salary division when the divorce was due to the will of the male civil servants salary divided as follows Legal consequences of divorce are as follows : At the level ba'in talaq , divorce is talaq which has entered level three where the couple is forbidden to reconcile his ex-wife before marrying another person prior to that person later divorced ; Divorce for li ' s, then the marriage can no longer be done for ever ; Treasure joint wealth is shared between husband and wife while the cost of maintenance and education is the responsibility of the father . More entitled to maintain his children are his mother , for the mother was married to someone else .

Abstract

ABSTRACT Main problem raises at post-mining area is environmental change physically change of morphology and land topoghraphy and degradation of soil productivity with result either infertility or denudation of land. Based on those changing, though reclamation is neede to be done. Despite avoiding erotion reclamation is done to maintain land ffrom instability and making more productive condition. Finally, reclamation is hopefully to yield added value to environment and creating much better condition compared with the past. Surfacial form of post-mining area is generally irregular and mostly as steep morphology. At the time reclamation, steep morphologies are formed to be like as usuall to maintain secured slope condition. Concerning with abandoned mining deposit which have utilitized yet, needed for attention of being potency for either exploitation by public or being managed it in order to avoid decreasing its economic value, also to get back the field like past.Based on the real condition in the district of Kutai Kartanegara, related to Government Regulation Number 78 Year 2010 about Reclamtion and Post-Mining, so reclamation and post-mining constitute important business activities prior to mining activities end. Legislation governing of reclamation and post-mining is in Pasal 96 (c) Undang-Undang Nomor 4 Tahun 2009 about Mineral and Coal Mining and Pasal 2 (1) Government Regulation Number 78 Year 2010 about Reclamation and Post-Mining.Research results from the author of Mining and Energy Services in East Kalimantan Province in Samarinda represented bythe generalminingstaffsection, Mrs. Darlina Manik and Mr. Sukariamat. Manymining companiesthatdo notperformreclamationandpost-mininga challenge forthe district /city. An efforttoaddress concerns andthisconditionisthrough theactivityormine reclamationobligations. Abstract

ABSTRACTIn the application or implementation is not easy to determine whether the proposed deed grosse have met the formal requirements and materially . Particularly with respect to the material terms of the deed grosse . In practice poses many problems due to the development in the presence msayarakat grosse based on the deed of the bank credit agreement as an agreement in principal . Grosse deed of acknowledgment of debt that is overlaid with other agreements in the form of power or authority to sell and install security rights and others in the grosse deed is not allowed because it causes rancaunya in execution , ie whether the executions carried out against grosse deed of acknowledgment of debt or the mortgage certificate . So this violates the rule of law set forth in Article 224 HIR and fatwa No. MA . 213/229/85/UM-TU/Pdt April 16, 1985 so grosse aktapengakuan acknowledgment of debt was not pure debt debtor to a creditor within a certain amount and cause grosse deed of acknowledgment of debt is null and void and the implementation of the execution can not be carried out . And the payment in installments , interest and penalties and other costs to the costs of the execution are overlaid in a deed of acknowledgment of debt grosse can not be justified in accordance with the nature of the deed grosse to be purely unilateral declaration of debituryang admit a certain amount of money owed to creditors that after with the rules in Article 224 HIR and fatwa No. MA . 213/229/85/UM-TU/Pdt April 16, 1985 , while pencamtuman clause on payment in installments , interest and penalties and other costs to the cost of execution should be included in the deed of loan agreement only.

Abstract

ABSTRACTRegarding the implementation effort in the preliminary agreement PT.Pengelola Housing Pandan Harum Tamara , both first -party and second party has been trying to implement the rights and obligations of each . Preliminary agreement regarding the sale of the house in general , based on Article 1338 of the Civil Code which states " All approvals are made legally valid as the law for those who make agreements that can not be reimbursed in addition to the agreement of both parties , or for the reasons stated by the law enough for the agreements to be implemented in good faith . Then the particulars of preliminary agreements stipulated in the Decree of the Minister of Housing Number : 09/KPTS/M/1995 on Guidelines for Sale and Purchase Homes In The Decree does not explicitly mention the definition of the preliminary agreement , but it can only be concluded that the preliminary agreement is agreements made before the house was completed.
