Abstract

ABSTRACTFrom the analysis that has been done, it can be concluded that the juridical organic law rigorously regulates the human rights material contained in the 1945 Constitution. Such reorganization is necessary because as mandated by the 1945 Constitution that to organize those rights must first be regulated in the law (article 28 of the 1945 Constitution). And in this case the already-established law made by the government are among others: Law no. 48 of 2009 on the Principles of Judicial Power. UU no. 12 Year 2012 on National Education System. Law No.21 of 1982 on the Basic Provisions of the Press. Law No.8 of 1985 on Community Organizations. Law No.3 of 1985 on Political Parties and Work Groups. Law No.13 of 2003 on Manpower. Ministry of Manpower Decree No. KEP-150 / MEN / 2000 Concerning the Implementation Guidelines for PHK. UU no. 13 of 2006 on the Protection of Witnesses and Victims and many others.In rearranging the human rights material, the law seems to regulate it strictly, because in its arrangement there is a concept that is not clearly understood (Law No.21 of 1982). Besides, there is also a rigid formula (Law No.2 Year 1989) that can make the private sector reluctant to participate in alleviating the government's task in an effort to educate the nation. There is also a strange provision in Law no. 22 Year 1957 because workers who will perform an action must inform the employer first. Or Law No.3 and Law No.8 1985 which requires that social organizations and political parties recognize only one ideology that is Pancasila. If it refuses, the government has the right to freeze and dissolve the relevant political organization or party. Such is the re-arrangement of human rights in organic law.

Abstract

ABSTRACT Irregularities in the use of credit cards that can be distinguished by behavior, namely: Deviations made by the card holder; Deviations made by merchants.Bank efforts to overcome various deviations either by card holder or merchant, among others are: To overcome the use of credit cards that exceed the credit limit made with transactions under the floor limit, the Issuer (bank) for the first time will give a warning to card holders not to use credit cards that exceed the credit limit, even if the card holders have sufficient funds. If the violation of the credit limit is exercised even if the warning has been given three times, the issuer (bank) may cancel the card and put it in the blacklist and the card holder shall be obliged to pay off all outstanding obligations; To overcome the frequent late card holder in paying his account bills, Issuer (bank) will give a warning to card holder.dengan give a penalty for late paying the account; Efforts or steps taken by the bank to tackle the actions of the merchant to make a higher price on the card holder are: The Bank for the first time will give warning to the merchant not to commit the infringing act. If the transaction deal is still committed by the merchant, then the issuer (bank) will further impose sanctions. The last attempt by the issuer (bank) is the cancellation / termination of the agreement; Efforts or steps taken by banks to solve merchant actions to duplicate sales draft or fictitious transaction are: Bank will give warning to the merchant and accompanied by sanction that will refuse payment of fictitious transaction if the fictitious transaction bill has not been paid by issuer. If the fictitious transaction bill has already been paid by the issuer and signed in the card holder bill account whose name and credit card number is used in the fictitious transaction, then the issuer (bank) will deduct / refund the invoice already paid by the issuer. If the invoice or fictitious duplication is repeated many times, it will be unilaterally terminated by the issuer (bank). In addition to the first way, the issuer (bank) can file a lawsuit to the District Court.Forms of legal protection against the parties in issuing credit cards include: Forms of legal protection for card holder in case of loss of credit card. By having a credit card by the card holder, then the card holder has the right to conduct transactions with the merchant. In the use of credit cards is not closed the possibility of credit card is lost

Abstract

ABSTRACT The research aimed at investigating and comprehending the flight corporation responsibility implementation on the passengers who underwent the losses, and the efforts which could be taken by the passengers towards the flight corporations on the losses they suffered.All the data obtained in the research either the primary or secondary data were analysed using the qualitative analysis technique, the data were then described by analyzing the existing problems.The research result indicates that the flight corporations having the role as the air carriers have the responsibilities on the passengers. The responsibilities are in the forms of the responsibilities on the accidents, goods losses, and departure times. The responsibilities are regulated by the clear rules in the Acts of Republic of Indonesia Number 1 Year 2009 concerning the flight, and the Regulation of the Minister of Transportation Number 77 Year 2011 concerning the responsibilities of the air carries. The research indicates that the implementation of the flight corporation responsibilities to the passengers has not been optimal. It can be seen that the flight corporations are still frequently escaped from their responsibilities in giving the compensations to the passengers. As for the next control efforts of the Airline is to disseminate the news throught a variety of visual and print media advertising in the form of social services or appeal installe in the airport area of about breaches carry valuables in the trunk. The warning sanction or hold a certificate issued to the airline if it is not liable for damages suffered by passengers.  Keywords: Responsibility Airlines, Airlines, baggage Goods Carrying, passangers, Compensation.

Abstract

AbstractIn order to provide legal certainty to the plantation development sector, especially in the field of land, it is necessary to have a right to land which gives authority to the right holder to control and physically entitate the land given the right. The right to land that can accommodate the field of plantation development is the Right to Use Enterprises (HGU). But on the other side of the current development of plantation land that has been clung to the Hak Guna Usaha (HGU) many claimed even occupied by the community for certain reasons that cause its own problems in order to manage plantation land.In order to grant location permit by Local Government begins with synchronization of data related institutions, so there is no overlap of licensing with the land / location of the land that will become the object of the Right to Use Enterprises.

Abstract

ABSTRACTIONIndonesia's economy is increasingly integrated into the global economy that puts the value of competitiveness, product quality and efficiency increasingly emphasized the need for the application of the principle of economic democracy in a legislation. The development of a sustainable economy should be able to increase the value added at each link of the national economy so that the Indonesian people are able to realize the economic sovereignty of Indonesia which is one of the benchmark is the increased capability in producing goods and services that are competitive in the global market. Achievement of this goal is becoming increasingly relevant for foreign trade, contributing in the national economy is increasingly important. Problems in export activity would arise when SMEs export oriented itself does not seek to minimize the obstacles to its activities as a result of lack of understanding of the procedures of export activity.      Therefore we need an independent export financing institutions that are capable of supporting a low-cost export financing to small and medium enterprises, export financing institutions like the developed world that have special advantages that have access to low cost international funding. Thus, the agency can provide export credits with low interest, so that the government does not have to provide interest subsidies or special policies to support export activities. Look at the experience of other countries, in order to optimize the foreign trade transactions, the Indonesian Export Financing Agency (LPEI) gave the facility is expected to financing, guarantees, and insurance in order to export in order to realize the national large-scale exports and the impact on economic development in Indonesia. Abstract

ABSTRACT This research is a Normative Empirical research. Data collection using methods through the collection of books relating to these issues and through field research that has the basis of implementation of Law No. 32 of 2009 on Protection and Environmental Management related to the Livestock Business License by looking at the procedure licensing of smallholder livestock business and the environmental impact of the business adjacent to the settlement. Abstract

ABSTRAK Keabsahan akan jual beli yang telah dinyatakan oleh Majelis Hakim dalam perkara perdata No. 30/Pdt.G/2002/PN.Smda masih premateur. Akan tetapi sudah menjadi kenyataan dalam suatu putusan. Untuk itu seharusnya pihak yang dikalahkan atau kurang puas atas putusan tersebut, menggunakan haknya untuk melakukan upaya hukum yaitu upaya banding selama putusan pengadilan tersebut belum mempunyai kekuatan hukum tetap (Inkracht Van Gewisjde), terhitung setelah 14 (empat belas) hari putusan itu diberitahukan. Akan tetapi apabila telah lewat waktu 14 (empat belas) hari sejak putusan diberikan kepada pihak yang dikalahkan namun tidak digunakan haknya, putusan pengadilan harus dianggap telah mempunyai kekuatan hukum tetap (Inkracht Van Gewisjde).Kekuatan hukum perjanjian jual beli terlepas dari asas kebebasan berkontrak sebagaimana tercantum dalam pasal 1338 KUH Perdata belum bisa dikatakan mempunyai kekuatan hukum. Akan tetapi sudah menjadi suatu kenyataan, kekuatan hukum perjanjian jual beli seperti dalam kasus ini untuk dapat dikatakan kekuatan hukum perjanjian jual beli tergantung dari keabsahan yang telah diputus oleh pengadilan. Adapun kenyataannya sebagaimana telah diputus oleh pengadilan bahwa ternyata perjanjian akan jual beli telah dikuatkan dan dinyatakan sah menurut hukum. Oleh sebab itu, mau tidak mau perjanjian jual beli antara Tergugat I dengan Tergugat II menjadi batal.

Abstract

ABSTRAK        Perjanjian pengikatan jual beli tanah, sering ditemukan dalam praktek sehari-hari di masyarakat maupun di kantor-kantor notaris. Perjanjian ini merupakan suatu perjanjian yang mendahului perjanjian jual beli tanahnya, yang harus dilakukan dihadapan PPAT (Pejabat Pembuat Akta Tanah). Dalam Pasal 37 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah dapat diketahui bahwa untuk peralihan hak atas tanah diperlukan suatu akta otentik yang dibuat oleh seorang pejabat umum yang disebut dengan Pejabat Pembuat Akta Tanah (PPAT) yang diangkat oleh pemerintah. Sehingga peralihan hak atas tanah tidak dapat dilakukan begitu saja tanpa memenuhi persyaratan yang telah ditetapkan oleh peraturan perundang-undangan yang berlaku. Namun dalam praktek sebelum dilakukannya jual beli tanah dihadapan PPAT yang berwenang, para pihak terlebih dahulu melakukan suatu perbuatan hukum dengan cara membuat akta pengikatan jual beli tanah di hadapan Notaris.    Akibat hukum terhadap akta otentik yang mengandung keterangan keterangan palsu adalah bahwa akta otentik tersebut telah menimbulkan suatu sengketa dan dapat diperkarakan di pengadilan. Oleh sebab itu maka oleh pihak yang dirugikan dapat mengajukan gugatan secara perdata ke pengadilan agar hakim dapat memutus dan mengabulkan pembatalan akta tersebut. Dengan demikian maka akta itu tidak lagi mempunyai kekuatan hukum karena telah catat hukum. Dan sejak diputuskannya pembatalan akta itu oleh hakim maka berlakunya pembatalan itu adalah berlaku surut yakni sejak perbuatan hukum/perjanjian itu dibuat..Kata Kunci : Pengikatan Jual Beli

AbstractThe press is a means of communication that is mass, so called mass media. There are advantages of this media when compared with non-mass media, which can convey a variety of messages simultaneously, simultaneously to the audience without borders, so it is said to have a weight of missal.Similarly, the press, for example, newspapers have their own peculiarities among other mass media such as television or radio, that is information that is delivered more complete, can follow the daily development, can be re-read and the price is relatively reachable by community members. In conveying information in the form of news, a press publishing is required to meet one of the criteria of the news, the actual news or just happened. Unless the news presented caught the attention of audiences.

Abstract

ABSTRACKIn connection with the criminal case that the defendant was sentenced for five (5) months, the authors argue that the punishment is very light. In connection with the problem of classification of criminal cases as stipulated embezzlement and threatened Article 374 Penal Code in conjunction with article 64 paragraph (1) Criminal Code is a criminal act embezzlement by weighting. As a result of the law against the perpetrators of criminal acts of embezzlement by weighting as stipulated in article 374 Criminal Code is imprisonment - the length of five (5) years. While the criminal case verdict No. 15 / Pid.B / 1999 / PN.Smda as described above, the perpetrators of criminal acts of embezzlement of company goods are carried in a row - were included in the classification of criminal cases by weighting by imprisonment for five (5) months. Therefore, the act included in the classification of criminal cases of embezzlement by weighting, the act should be achieved with sufficiently severe punishment.
