Abstract

This paper aims to identify and analyze on a law review of closed agreements by the Law Number 5 of 1999 on Prohibition of Monopolistic Practices and Unfair Competition as well as how the legal analysis of the alleged cases of agreements covered by PT Pelindo II (Persero) which occurred in Teluk Bayur in Padang, West Sumatra. In a legal review of the closed agreement as mentioned in Article 15 and 19 of Law Unfair Competition, it can be concluded that the closed agreements carried out in a business relationship tend to be favorable to the parties entered into a secretive and harmful for others who are not inside the circle of the agreement. Case Lease Agreement of Land between PT Pelindo II (Persero) with a third party is tying product whereas clauses designation stevedoring companies owned by PT Pelindo II (Persero) for the tenants are tied product, and the agreement is contrary to the principle of fair business competition especially Article 15 paragraph (2) of Law Number 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition. Keyword: Identification, Closed Agreements, PT Pelindo II

Abstract

This research aims to outline the policy choice of law in forming the Law on prohibition of monopoly and business competition. Based on the normative approach and by using secondary data, it can be concluded that prior to Act Number 5 of 1999 established, practices of monopoly and business competition are not regulated within the law, after the birth of that Law, business activity is prohibited if it proves detrimental to other businesses, consumers, society and the State. Businessperson that practicing monopoly and unfair business competition among another businessperson obviously threatened by administrative and criminal sanctions. Choice of law is made to anticipate the free market in the era of economic globalization in order to realize the prosperity and welfare of the people as mandated by the 1945 Constitution. Law enforcement of business competition in Indonesia submitted to the supervisor commission of business competition (KPPU), in addition to the involvement of police officers, prosecutors, and courts. Abstract

Constitutional Court Decision No.35/ PUU-X/2012 restored the function of indigenous forests to be managed by the indigenous peoples. The ruling establishes that indigenous forest is no longer a part of the state forest but part of the forest rights. Forest rights no longer only include forests on lands of the natural/legal entity but also are located in the area of indigenous peoples. The problem in this research is how the reconstruction of indigenous forest planning policy in Way Kanan regency after the issuance of the Constitutional Court Decision No. 35 / PUU-X / 2012 on Traditional Forest. The research used here is normative juridical-empirical. The data used is secondary data and primary data, and then is performed by juridical qualitative data analysis. Based on the research results, the arrangement of indigenous forests done by Way Kanan District Government is started with the assistance and mediator, data collection, research conduct and the confirmation of the existence of customary law communities along with indigenous areas, cooperating with the partnership between indigenous peoples and the concessionaires of Forest Management Rights (HPH), and accelerate the formation Regional Regulation on the Recognition of Indigenous Peoples. Indigenous forest planning policy was blocked because Way Kanan Regional Regulation that specifically related to customary law communities has not been established, there is something confusing associated with the administration of indigenous forests and the intervention of interests of the party holding Forest Management Rights (HPH).  Keyword: Reconstruction, Regulation, Indigenous Forest

Marine Police Regional Police Banten Province is breakthrough in the development of creative, aware of the importance of knowledge of the social and cultural life of the operational environment. However, the problem is: First, how the pattern of development of the concept of Creative Breakthroughs Marine Police Banten ?; Second, how the implementation of the concept of creative breakthrough Marine Police Banten?. Abstract

The main objective of this research is to discover the idea of innovation of Indonesia's legislation system on food security/seafood which has been heavily influenced by trade relations between Indonesia and the European Union as a group of major importing countries. This is a case study that largely examines and presents trade disputes between Indonesia and some major importing countries, especially with the EU countries as a major group of country importers of fishery products and seafood from Indonesia. The various disputes and complaints found in this case study demonstrate the fact that the marine fisheries sector as one of Indonesia's mainstay sectors has a very potential economic value for the country's foreign exchange earnings. There is a very close relationship between the fisheries sector with the fulfillment of people's living needs as well as the development of the economic sector in general, including food safety aspects. This should be addressed appropriately and efficiently by the government by adjusting and even updating laws and regulations in this sector by the international food standard/food security; given the numerous demands and rejection of most of Indonesia's trading partner countries in this sector. Keyword: Indonesian Fisheries, Policy Reform, Compliance, Food Safety Requirements, Importing Countries.

The emergence of the tax debt based, First, Formal Doctrine. The emergence of the tax debt based on formal doctrine is a form of tax collection system based Oficial Assessment System. Abstract

In the Kingdom of Saudi Arabia (KSA), Islamic Shariah is the foundation of the laws of the state. While the modern Saudi legal system encompasses both written and unwritten laws, Shariah is still considered supreme and hence directs most of the state’s regulations. Nevertheless, currently, those who aim to practice law need to acquire a foundation of all prevailing laws. Due to the supremacy of Shariah, most universities still do not offer comprehensive degree plans, which often poses limitations to the development of legal education in the Kingdom. This study aims to address this conundrum by examining the various degree plans in Saudi universities, scrutinizing whether they offer comprehensive degrees, which should encompass both Shariah laws yet also the newly codified rules. This research draws upon secondary sources, which analyze the progress of the legal education in KSA and its effects on future legal practitioners. Results suggest that the legal curricular should be redesigned to improve the capabilities of prospective legal professionals by integrating the non-codified rules of law with the Islamic law in a more practical, realistic and efficient manner.  Keywords: Legal education, Shariah, Saudi Arabia.

AbstractSOA Usage Status Determination Regulation in line with those mandated by Government Regulation Number 27 of 2014 on Management of State and Regional Assets has been regulated in Minister of Finance Regulation Number 246/PMK.06/2014 on Procedures for the Implementation of State Assets Utilization and Minister of Finance Regulation Number 41/PMK.06/2015 on Delegation of Certain Authority and Responsibility From State Assets Manager To State Assets User. The implementation of SOA Usage Status Determination in Regional Office Directorate General of State Assets Lampung Province and Bengkulu Province is not yet optimal because a little number of SOA status been defined. SOA optimization through utilization in order to gain state’s revenue through non-tax revenue is not the main goal, but the optimal use of SOA in order to support the implementation of the tasks and functions of Ministry/Agency. Implementasi SOA Status Penggunaan Penentuan di Kanwil DJKN Provinsi Lampung dan Provinsi Bengkulu belum optimal karena sejumlah kecil status SOA telah ditetapkan. SOA optimasi melalui pemanfaatan untuk mendapatkan penerimaan negara melalui penerimaan negara bukan pajak bukanlah tujuan utama, tetapi penggunaan optimal dari SOA dalam rangka mendukung pelaksanaan tugas dan fungsi Kementerian/Lembaga. Abstract

The main purpose of this study is to find out the weaknesses in the application of the Compilation of Islamic Law in Indonesia, especially some of the provisions in it that tends to be gender biased; so that innovative ideas can be found to strengthen even the re-formulation of gender-sensitive legislation but still based on Shariah values and customary law. It is normative law research that uses a normative legal case study in the form of legal behavior products, among others by examining the Compilation of Islamic Law especially in the level of its implementation. Abstract

The importance of the protection of victims of crime to obtain serious attention, it can be seen from one form of protection by the state is the administration of justice. In addition completeness of legislations, witness and victim protection agency (LPSK), law enforcement agencies, relevant government agencies, and other parties relevant, then the judicial function plays an important role. The function of the court not only making verdict, but also recept report of compensation, or restitution, announce it and ordered the agency or the parties to implement the decision and so on. By applying legal sanctions to the perpetrator, then it implies that it is a form of attention (protection) judicially to victims of crime. Legal protection to women who are victims of this crime is not just limited to the penalization to the perpetrators, but also to the consequences that happened to him, like a pregnancy caused by rape. Keywords: Protection, Victim, Rape
