Abstract

Hand-rolled Kretek Protection as a Handicraft Product of Geographical Indication is an urgency because even though this product has taken r deep roots in Indonesian’s Culture, but because of the negative stigma of the danger of Cigarette made this product existence decreased over time, causing many small Hand-Kretek industries bankrupt and many Kretek-Roller Labourer Fired. The Study of Hand-Rolled Kretek as a Handicraft Product of Geographical Indication of Kudus District uses a Sociological Approach Method with Juridical-Empirical research method. The Primary data used in this research are Data Obtained from related people or Institution with the help of relevant literature, Documents and comparison to similar regulation from other countries as a secondary Data to find out whether Hand-Rolled Kretek is in accordance with product law provisions that can be a Geographical Indication Product of Handicraft or not and what implication that may occur. The result of the research shows that hand-rolled kretek can be a product of Geographical Indication because, regarding history, its distinguishing potential, and economic potential are sufficient, and are by the rules given, morality, religion and public order stated in Law No. 20 of 2016. The implications that arise can be seen both in the field of Economics such as increasing state income and employment, in the field of Social which can straighten the negative stigma of Hand-rolled kretek, and also in the field of Law where Hand-Rolled Kretek as a Geographical Indication Product of Handicraft can be used as a Reference for other industries to become a Geographical Indication products. Keyword: Hand-Rolled Kretek, Geographical Indication, Handicraft Product, Kudus District.

Abstract

This research aims to describe the carbon trading according to international law and its implementation in Indonesia. It uses juridical-normative research methods. Climate change is one of the major environmental issues in the world, it causes an adverse effect to human life. Basically it comes from human activities. To follow up the issue, then countries try to solve it by taking an action to reduce the emissions. Through the first Earth Summit in Rio De Janeiro-Brazil in 1992, which produces the Convention on Climate Change (UNFCCC); one of the achievements of the UNFCCC is the Kyoto Protocol, wherein the Protocol contains two important things, namely the commitment of developed countries to reduce the rate of emissions compared to 1990, and the possibility of carbon trading mechanisms. Indonesia is one of the countries that have ratified both the UNFCCC through Law No. 6 of 1994, and the Kyoto Protocol through Law No. 17 of 2004. There are also some related regulations. However, of all existing laws, the government has not put out implementing regulations or instructions about carbon trading specifically. Keywords: Carbon Trading, International Law, Indonesia.

Abstract

Globalization has placed Indonesia in a dilemma in creating the welfare of the people. Many legislations with liberal character are disallowed through the constitutional review by the constitutional court. The liberal character then becomes constraints for government to realize social welfare, thus harming the economic interest of people and contrary to the constitution (UUD 1945). Efforts to create welfare cannot be separated from state sovereignty in determining the economics welfare policy in the form of law. The State needs to adopt policies of recalibrating sovereignty to realize its objectives. Sovereignty is the essential requirement to be able to build pengayoman law character, ideology by Pancasila ideology and UUDNRI 1945. The legal substance of pengayoman law (protection and succor) will realize a balance between global interests and the interests of the nation. Pengayoman Law integrates the efficiency and freedom with fairness and welfare excellence. Also, the Pengayoman Law always opens the space to give a guarantee/partiality to the poor through social policies that are based on human dignity. Keywords: Welfare, Challenges, Globalization, Dilemma

Pasal 126 Ayat(1)  Undang-undang Nomor 32 Tahun 2004 mengatur bahwa Kecamatan dibentuk di wilayah Kbupaten/Kta dengan Perda berpedoman pada Peraturan Pemerintah.  Berdasarkan ketentuan tersebut Kota Bandar Lampung mengeluarkan Peraturan Daerah Nomor 14 Tahun 2000 tentang Pembentukan Organisasi Kecamatan dan Kelurahan Kota Bandar Lampung.  Camat hanya mempunyai wewenang dari pendelegasian tugas dari Bpati Walikota untuk menangani sebagian urusan otonomi daerah(hanya mempunyai wewenang delegatif).   Kata Kunci:  Pembentukan Kecamatan dan Kelurahan,  Perda Nomor 14 Tahun 2000

Abstract

This research uses a normative juridical approach to study the law enforcement against the criminal acts of destruction of crops, about the regulation on the Civil and Agrarian Law. The research approach uses a normative juridical approach that is based on legislation, theories, and concepts related to writing research. The result of the research asserts that the law enforcement against the criminal acts of destruction of crops based on the judges of the Supreme Court Decision No. 1909 K / Pid / 2010, using the viewpoint of Agrarian Law to the principle of horizontal separation asset that the holders of rights to land only control the extent of its surface, while the building or anything inherent in the land have different ownership rights to its land. The criminal law enforcement using viewpoint of Law No. 5 Of 1960 Regarding The Basic Regulations On Agrarian Principles (UUPA) did not need to prove the ownership of the land between the two conflicting party but to prove who the owner of the destroyed crops is. If the plant grows the property of the complainant party then the reported person will meet the elements as perpetrators of criminal acts in the Article 406 paragraph (1) of the Criminal Code. However, by using the legal basis of the Law Number 51 PRP of 1960 on Prohibition to Using the Land without Obtaining the Permission from the Owner of the Land or the Authorized Person (the “Law No 51 PRP/1960”), landowners can maintain proprietary rights and submit the case to the legal process procedure, hence it does not need to happen that the crop destruction by the owner of the land will be entangled in criminal law pursuant to the Article 406 paragraph (1) Criminal Code. Keyword: Law Enforcement, The Criminal Acts, The Destruction of Crops.

Abstract

In conducting regional autonomy, the regional government needs funding, and one of the funding sources is regional retribution. Middle Lampung had provisioned 3 Regional Regulations which regulated retributions of common service, business service, and particular permit. Implementations of these three regional regulations could not yet be applied fully. The arrangement of retributions of telecommunication tower control, animal slaughter house, and advertising business permit had their own orientations. The regulation of retribution collection of telecommunication tower control was no longer in accordance with Decision of Constitutional Court number 46/PUU-XII/2014 on May 26th, 2015. The Regent Regulation about the conduct of retribution collection from animal slaughter house had not been yet provisioned, there was no qualified animal slaughter house and human resource. Regent Regulation about advertising business retribution collection had not been yet provisioned and there was no data of advertising business available as basics for collecting retribution. Keywords: Evaluation, Regulation, Retributions

Abstract

The criminal law policy of the authority restriction in investigation against the notary is at the stage of policy formulation of the law provided authority Honorary Council of Notaries in the proceedings against the notary is to give consent to the investigator, prosecutor or judge to take copies Minuta Deed and / or letters attached to Minuta Deed or the Protocol Notary Notaries in storage. The legal implications for restricting the authority in the investigation of the Notary of the proceedings for the notary is not in accordance with equality of citizens before the law should not discriminate between the treatments of nationals who commit criminal acts. Abstract

The authority PT. Pelabuhan Indonesia II (Persero) Cabang Panjang in land management Ports after enactment Law Number 17 of 2008 on Shipping have experienced changes. Where the scope of portland management includes the formulation of Port Master Plan, the provision of portland, port monitoring land use, and exploitation of the portland. The results showed that the scope of authority land management port is a portland concession. it relates to the status of PT. Pelabuhan Indonesia II (Persero) Cabang Panjang as a Badan Usaha Pelabuhan(BUP) which has the function of a role as a port operator. As for the formulation of the Port Master Plan, the provision of portland, port monitoring land use under the authority of the Port Authority which has the function of a role as a regulator. In a land concession pass port, PT. Pelabuhan Indonesia II (Persero) Cabang Panjang is not included in the Port Enterprises whose business activities can run only after getting the concession of the port authority. Because granting concessions only to Port Business Entities are new. In addition, in article 344 paragraphs (2) of Law Number 17 of 2008 on Shipping provides legal certainty on the legal status of SOEs Ports presence in the business activities of port services. Keywords: Authority, the Port Authority, PT. Abstract

Special autonomy has been given to the people of Papua was not automatically change the demand to break away from the Unitary Republic of Indonesia. Even conflict and violence are still common, not much the case in the period before the special autonomy granted. Legal awareness that should have been animating soul Indonesian citizens, to the condition of Papua away than they should. Disputes, inter-tribal warfare, even against migrants have often heard. The tribes in Papua does have a unique custom that sees itself as the center of the universe, the best of all. Papua leadership so very, very difficult to put together. Even if the idea is basically the idea Papuanisation fruit Dutch education is taught to the people of Papua to foster its own distinct sense of nationalism with the nation of Indonesia. The result appears separatist movements such as the Free Papua Organization (OPM) and the West Papua National Committee (KNPB). To avoid the disintegration of the nation, the central government issued Law No. 21 of 2001 on Special Autonomy for Papua. That is, the people of Papua entitled to set its own country with the regulations stipulated by law. This legislation is expected to become a sedative from the turmoil in Papua. Although it remains to be an evaluation and improvements here and there. Such as optimizing the alignment of the central government towards the implementation of special autonomy, optimizing the role of the Papuan People's Assembly, and optimization of special autonomy fund supervision. Abstract

The presence of foreigners in the area of Lampung is increasing rapidly. But most foreigners are missing or doing activities that are inconsistent with the purpose of providing immigration permit. Results of research and discussion show that law enforcement criminal act of abuse of a residence permits the immigration done by administrative measures and actions pro-justice immigration. Obstacles to the enforcement of the law against the crime of abuse of a residence permit immigration because the number of immigration officers who conduct surveillance and monitoring of the presence of foreigners is still lacking, a lack of coordination and cooperation across sectors, the lack of investigators Immigration master a foreign language other than English, the limited number of facilities operational support and Lampung people that are non-cooperative which reports or complaints from the public about the existence or activities of foreigners who are nearby are very limited. Suggestions from this study are the immigration officers should increase oversight of the existence and activities of foreigners. Pro-justice in law enforcement actions should be effected, in order to ensure a deterrent effect to the perpetrators and other foreigners so as not committing a crime similar immigration. In addition, Lampung people are expected to cooperate with immigration officials to make a complaint about the existence or activities of foreigners who are nearby. Keywords: Law Enforcement, Residence Permit, Immigration
