Jurnal Cita Hukum is an international journal published by the Faculty of Sharia and Law, Universitas Islam Negeri Syarif Hidayatullah Jakarta, Indonesia. The focus is to provide readers with a better understanding of legal studies and present developments through the publication of articles, research reports, and book reviews. Jurnal Cita Hukum specializes in legal studies, and is intended to communicate original researches and current issues on the subject. This journal warmly welcomes contributions from scholars of related disciplines. It aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning Indonesian laws and legal system. Published exclusively in English, the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. The Review, hence, welcomes contributions from international legal scholars and professionals as well as from representatives of courts, executive authorities, and agencies of development cooperation. The review basically contains any topics concerning Indonesian laws and legal system. Novelty and recency of issues, however, is a priority in publishing. The range of contents covered by the Review spans from established legal scholarships and fields of law such as private laws and public laws which include constitutional and administrative law as well as criminal law, international laws concerning Indonesia, to various approaches to legal studies such as comparative law, law and economics, sociology of law and legal anthropology, and many others. Specialized legal studies concerning various aspects of life such as commercial and business laws, technology law, natural resources law and the like are also welcomed.

Abstract

The study of the concept of partnership legal relationship patterns in the palm oil industry business world aims to explore the idea of partnership relationship patterns between farmers, processors, and suppliers in the oil palm plantation supply chain, as well as the role of each party in improving operational efficiency, sustainability, and competitiveness for business actors. Partnership legal relationship pattern theory emphasizes the importance of synergy and collaboration between various actors in the supply chain to achieve common goals. The purpose of this study is to examine the pattern of legal relationships in supply chain partnerships between the private sector and oil palm planters to enhance the competitiveness of business actors. Qualitative research methods with normative research types, descriptively analyzed to examine and explain the research objects to be researched through legal and conceptual approaches, with literature study data collection techniques to identify effective partnership models, such as partnerships between farmers and processing plants, which are based on agreements or contracts, as well as vertical partnerships that integrate various stages in the supply chain. Qualitative research methods with normative research types, descriptively analyzed to examine and explain the research objects to be researched through legal and conceptual approaches, with literature study data collection techniques to identify effective partnership models, such as partnerships between farmers and processing plants, which are based on agreements or contracts, as well as vertical partnerships that integrate various stages in the supply chain. The results of the study show that a good partnership can facilitate technology transfer, improve cultivation practices and strengthen the bargaining position of business actors and in general, the application of the concept of legal relationship patterns of oil palm plantation supply chain partnerships between private parties and private parties, oil palm planters in realizing the competitiveness of effective business actors in the supply chain can be a key strategy to increase the competitiveness of business actors and ensure Sustainability of the palm oil industry.

Abstract

This study examines the role of the State Border Guard Service of Ukraine in preventing administrative military violations during the ongoing state of martial law. The research emphasizes the growing importance of optimizing the efficiency and functionality of border control agencies amid heightened security challenges. Using a qualitative research method with a juridical-normative and comparative approach, the study explores legal frameworks, institutional practices, and foreign experiences to identify best practices for Ukraine. Using a literature review, legal documents, government decrees, and international conventions on border protection are systematically reviewed to determine the legal basis and administrative procedures governing preventive measures. Meanwhile, the comparative qualitative analysis involves examining case studies from other countries that have implemented effective systems for preventing administrative offenses in border services. In addition, qualitative interviews with border officials, legal experts, and defense policymakers were conducted to gain practical insights into the challenges faced in enforcing administrative discipline under martial law. The findings reveal that while Ukraine has a solid legal foundation for border protection, gaps remain in coordination, documentation, and personnel training. Drawing on both domestic and international perspectives, the study identifies adaptable mechanisms to enhance the efficiency of combating administrative and military offenses. Ultimately, this research offers policy recommendations to improve preventive measures, strengthen legal accountability, and ensure that Ukraine’s border security system remains resilient, transparent, and compliant with international norms during periods of military emergency.

Abstract

Ensuring justice during the ongoing war in Ukraine represents one of the most pressing challenges for contemporary international law. This study examines the pivotal role of international judicial institutions—particularly the International Criminal Court (ICC), the European Court of Human Rights (ECHR), and various ad hoc tribunals—in enforcing accountability for war crimes, upholding human rights, and preserving the rule of law amid armed conflict. Using a qualitative research method, the study relies on comparative analysis as well as historical and legal approaches to understand how these institutions function within complex geopolitical contexts. Through qualitative data collection and interpretive analysis of court decisions, international conventions, and reports from global organizations, the research identifies structural and procedural challenges faced by international courts, including political interference, difficulties in gathering evidence, and limited coordination with domestic jurisdictions. Moreover, the study explores the role of international cooperation and judicial precedents in building a more consistent and enforceable global justice system. The findings suggest that while international courts play a critical role in prosecuting war crimes and deterring future violations, their effectiveness is often constrained by issues of state sovereignty and the lack of uniform enforcement mechanisms. Therefore, the paper argues for a strategic consolidation between international and national legal systems to ensure that justice is not only pursued but also realized in practice. Ultimately, this research contributes to the broader discourse on strengthening international criminal justice in the era of hybrid conflicts and global political polarization.

Abstract

The scientific article focuses on the theoretical and applied problem of applying the rule-of-law principle in the criminal process in Ukraine under martial law. It is stated that in such critical conditions for Ukraine, most elements of the rule of law are negatively affected in the form of relevant restrictions, the necessity of which is of an objective nature due to the need to prevent global threats to the independence and territorial integrity of the state, repel armed aggression, ensure national security, as well as real and potential threats to human rights and freedoms. It is emphasized that to prevent violations of constitutional rights and human liberties, the problem of combating crime and protecting human rights under special legal regimes should be solved through such interrelated components as: legislative establishment of permissible restrictions on rights; creation of a mechanism for monitoring the adoption of measures that provide for limitations on rights; activities of institutions that ensure the protection and restoration of violated rights. It is concluded that in connection with the military events in Ukraine and numerous facts of committing illegal acts, it is essential to ensure not only the effective investigation of criminal offenses, the preservation of evidence, and ensuring the proper quality of investigative (search) actions, but also compliance with the rule of law and other principles of criminal justice. This requires a comprehensive approach: improving criminal procedural legislation, involving international organizations, and enhancing the skills of justice and law enforcement officials. It is emphasized that, under such conditions, international cooperation in criminal proceedings is of great importance to Ukraine and helps improve both the regulatory framework and practical experience. It is summarized that to unconditionally bring to justice those responsible for committing war and other crimes on the territory of Ukraine, criminal proceedings must be conducted in accordance with the general standards, requirements, and procedures of international judicial institutions, which will testify to the rule of law in the country, even in conditions of forced restriction of the rights and freedoms of citizens.

Abstract

This study explores the role of economic law in promoting Vietnam’s economic growth and global integration, particularly focusing on the legal framework governing international contracts for the sale of goods. Using a qualitative research method with a normative-juridical and comparative approach, the study analyzes legal documents, case studies, and expert opinions to identify weaknesses in Vietnam’s current economic law system. Through in-depth interviews with legal scholars, business practitioners, and policymakers, as well as content analysis of international trade agreements, the research examines how inconsistencies in legislation and differences in legal interpretation often lead to contractual disputes and economic inefficiencies. The findings reveal that improving Vietnam’s economic law requires not only legislative reform to ensure consistency, transparency, and conformity with international legal standards, but also enhanced legal literacy among enterprises. By understanding and applying the law correctly, businesses can better safeguard their rights and optimize their participation in international trade. The research highlights the need for comprehensive legal education, institutional support, and harmonization efforts to strengthen Vietnam’s commercial legal infrastructure. Ultimately, the study concludes that aligning Vietnam’s economic law with international norms will promote more effective and sustainable global economic integration, boost investor confidence, and contribute significantly to the nation’s long-term economic resilience and competitiveness in the global market.

Abstract

There has been a rise in financial misconduct and white-collar crimes in today's competitive economic landscape. The notable surge in observed accounting fraud cases has drawn significant attention from investors, academic researchers, the media, the public, and financial regulators. This study aims to develop a model to mitigate fraud risk in companies, grounded in managers' cognitive styles. A qualitative grounded theory approach was employed to construct this model, and the categorized indicators were validated using both a confirmatory factor analysis model and the Q-model approach. In this study, insights from 10 accounting and auditing professionals were used to identify and validate indicators aligned with the foundational model. Based on identified concepts related to fraud risk platforms, the findings led to the formulation and validation of a paradigm encompassing 22 primary categories. These categories include Supervisory, Economic, Political, and Social Factors, Managerial Pressure, Organizational Determinants, Management Cognitive Style, Governance Factors, Corporate Structural Variables, Managerial Motivational Drivers, Industry-Specific Factors, Legislative and Regulatory Framework, Employee-Related Determinants, Individual-level Determinants, Cultural Influences, Managerial Incompetence, Financial Literacy of Executives, Ethical Considerations and Organizational Commitment, Organizational Consequences, Ethical Consequences, Effectiveness Strategies, and Organizational Efficiency Strategies. These categories were incorporated into the paradigm framework as dimensions of causal conditions, contextual factors, intervening factors, strategies, and outcomes. The categorization of indicators in this proposed model was validated through confirmatory factor analysis with Smart PLS, further reinforcing the findings.

Abstract

The article is devoted to clarifying the place of financial administrative sanctions among other sanctions in public law which constitute a single ‘right of responsibility’. Financial administrative sanctions are a widespread phenomenon, as they allow the states to respond promptly to violations of public order, while increasing budget revenues. The purpose of the article is to find out whether there is a single ‘right of liability’ and what exactly it includes; to establish how certain types of public law liability are distinguished from each other, in particular, to characterise the difference between financial administrative sanctions and criminal law sanctions; and to find out the extent to which criminal law guarantees are extended to the system of financial administrative sanctions. The article provides a rationale for the existence of a single ‘right of liability’, which is divided into two branches based on the criterion of the subject of liability - criminal liability and administrative sanctions. The authors compare financial administrative sanctions and criminal sanctions by the subject and substantive criteria. The authors substantiate the view that criminal law guarantees should be applied when imposing financial administrative sanctions on a person. The study is based on the current state of legal doctrine, and therefore the article is of a theoretical nature. The results of the study make it possible to determine the true legal nature of financial administrative sanctions and can be used to develop concepts of legislative acts, as well as in law enforcement. Abstract

This article aims to analyze academic integrity both as a legal category and as an indicator of legal culture, highlighting its essential role in shaping the quality and morality of higher education. It argues that the implementation and internalization of academic integrity must be prioritized by all actors within the educational system to ensure the sustainable development of the Russian scientific and academic environment. Violations of academic integrity—such as plagiarism, data falsification, or dishonest assessment practices—pose significant risks to the educational process, leading to diminished public trust, intellectual decline, and the normalization of deviant academic behavior. To achieve its objectives, the study employs a qualitative research methodology, using a normative and socio-legal approach. Data are collected through documentary analysis of Russian legislative frameworks, academic codes of conduct, and relevant legal documents regulating education. In addition, in-depth interviews with legal scholars and education policy experts provide interpretative insights into the relationship between law, ethics, and academic practice. The qualitative analysis allows the study to explore not only the normative aspects of academic integrity but also the underlying cultural and institutional factors affecting its enforcement. The findings reveal that the absence of a precise legal definition of academic integrity hinders consistent interpretation and enforcement. Thus, effective regulation should be grounded in well-formulated legislative provisions aligned with international legal drafting standards. Ultimately, the article identifies the key features of academic integrity as a legal category and underscores its pivotal function as both the moral foundation and legal instrument for advancing education quality and social development. Abstract

The purpose of the research is to consider ways for the interpretation of legal norms in modern jurisprudence. Main content. It has been established that interpretation will result in a general conclusion or a sum of the findings reached by the subject of interpretation in the process of clarifying the rule of law (legal norms) using the entire set of interpretation methods, which is adequate to the actual content of this rule and meets the criteria of truth and correctness of the result of interpretation... Methodology: The methodological basis of the research is presented as comparative-legal and systematic analysis, formal-legal method, interpretation method, hermeneutic method, as well as methods of analysis and synthesis. Conclusions. It has been concluded that the procedure for achieving the goal of interpretation should be as follows: grammatical interpretation, teleological interpretation - clarification of compliance of the essence of legal norm content with the principles of law, systematic interpretation, special legal interpretation, logical interpretation, functional interpretation, historical interpretation - repeated application of the interpretation procedure when receiving new data. Abstract

The Constitution of the Republic of Türkiye states that every Turkish citizen has the right to enter public service and that, in recruitment to the service, there will be no discrimination other than those features required by the position. The Constitution also states that civil servants and other public officials will perform the primary and permanent duties of public service, and that their qualifications, appointments, duties, powers, rights, and obligations will be regulated by law. In this framework, the legal status of civil servants is regulated by the Civil Servants Law no.657. According to this law, those wishing to be appointed to the civil service must meet general and specific conditions, in addition to passing the civil service entrance examination. However, the Civil Servants Law introduced some different regulations for exceptional civil service. The exceptional civil servant positions are listed as restrictions in Article 59. Accordingly, regardless of the provisions for predicted appointments, examination results, staff progression, and promotion grades, appointments can be made to exceptional positions, of which there are a great many, such as parliamentary and ministerial civil servants, some specialists and specialist assistants, ministerial advisers, private secretary directorates, embassy and consulate personnel, and members of the Supreme Council for Religious Affairs.  This provision may be used for purposes other than those for which it was intended. Therefore, subjecting the appointment of civil servants to objective criteria will both eliminate this possibility and ensure the provision of public services of the required quality and sufficiency.
