Abstract

Crimes against the economy pose a significant challenge to the development and maintenance of economies across the world. The Indonesian government has enacted a number of laws, notably Law Number 20 of 2001 concerning the Eradication of Corruption Crimes, in order to address this issue and find a solution. This legislation plays a significant part in the fight against economic criminal activity in all areas of the economy. The purpose of this research is to investigate the challenges and elements that contribute to the success or failure of anti-corruption efforts. This study employed an empirical research method, which is a type of legal research that involves examining primary and secondary data, specifically data obtained directly from the public through field studies and literature studies. Field studies and literature studies are two of the most significant challenges facing efforts to eradicate economic crime in Indonesia. This study has significant implications that will enhance knowledge, provide advice, and provide suggestions to boost the efficacy of the execution of Law Number 20 of 2001 in eliminating economic crimes. These implications are crucial because this research will promote understanding, provide direction, and provide recommendations. It is anticipated that these repercussions will serve as the foundation for specific policies and actions that will boost the level of success achieved in the fight against economic crimes in Indonesia.

Abstract

The purpose of this research is to examine and analyze the influence of profitability, good corporate governance, and environmental disclosure on the firm value of mining companies listed on the Indonesia Stock Exchange. The research method utilized is descriptive research with a quantitative approach. The study population encompasses all mining companies registered on the Indonesia Stock Exchange (IDX) within the period from 2019 to 2022. In this study, a non-probability sampling technique was employed, specifically purposive sampling, resulting in a sample size of 72 from a span of 18 companies over 4 years. The variables under scrutiny include Return on Assets (ROA) as a measure of profitability, the proportion of independent board commissioners as an indicator of good corporate governance, the number of GRI disclosures as an indicator of environmental disclosure, and Tobin’s Q as a gauge of firm value. The analytical methodology and hypothesis testing were carried out using the Partial Least Square (PLS) method with SmartPLS 3.2.9 software. The PLS analysis consists of three stages: Outer Model, Inner Model, and Hypothesis Testing. The hypothesis testing results show that profitability has a significant impact on firm value, while good corporate governance and environmental disclosure do not exhibit a significant influence on firm value. These findings contribute to the understanding of how these factors interplay within the mining sector. However, this study has several limitations, including the variables used, the company's disclosures, and the limited period. Subsequent research can address these limitations and delve deeper into exploring the relationships of these variables or other variables with firm value.

Abstract

This study aims to analyze the effect of Environment, Social Governance (ESG) disclosures on the market value of companies in Indonesia during the COVID-19 pandemic. The sample consists of Indonesian companies listed in the SRI-KEHATI index for 2020-2021. The data was taken from Bloomberg and then analyzed using the regression model. The findings show that ESG disclosure has a significant effect on the company's market value. The results of this study add new evidence to previous findings about the effect of information disclosure, especially related to the environment, social and governance and confirm the signaling theory. The implications of this research are expected to provide investors with material considerations in determining investment. In addition, disclosure of ESG which has a positive influence on market value is expected to contribute to increasing the application of sustainability aspects in the business world in Indonesia. This study has several limitations, namely limited access to websites providing ESG disclosure score data. In addition, the variables used to look at market value factors only use ESG, which based on the results of data processing, there are more than 80% of other factors that can affect market value.

Abstract

AbstrakThe existence of internet encourages changes in trading system. The conventional trading has moved online, through the marketplace platform. There are various conveniences from marketplace platform existance, but it can create problems for trademark rights holders due to many imitation (fake) products are traded on the marketplace platform by irresponsible sellers. Lifestyle demands that are oriented towards exclusive brand (brain minded) with low economic level encourage buyers to buy counterfeit products because the prices are much cheaper. Thus, the circulation of imitation products increasingly widespread on the marketplace platform. The purpose of this recserach is to find out the forms of violations by sellers who trade imitation products and the responsibility of marketplace platform providers for the circulation of imitation products. The research methode using juridical approach. The results show that the circulation of imitation products is an act that is detrimental to the holders of trademark rights because sellers trade their products by including a registered brand. In positive law there is no specific regulation that marketplace platform providers are responsible for the distribution of counterfeit products. However, platform providers have an obligation to ensure that all activities on their platform do not conflict with applicable laws and regulations. Keywords: E-commerce, Marketplace, Imitation Product, Trademark Right

Abstract

Sumenep Regency has great marine management potential. Because Sumenep Regency's position is surrounded by sea, there are many benefits for the Regional Government of Sumenep Regency as well as for its people. With good management, it will produce multiple profits for regional income. One of them is for cultivation activities, either at sea or on land. Apart from the good water conditions, the coastal area has a suitable substrate for cultivation such as seaweed, fish, and shrimp cultivation. This research focuses on the role of local governments in managing fishermen's marine products, starting from catching fish or cultivating fish in the sea, then there is fish that is sold directly either at auction or directly to markets and buyers or middlemen, as well as fish that are processed in such a way as ingredients. or processed products and marketed to the public, so that they have added value, not just catching fish and selling them, but thinking about how to innovate. This requires the role of the Regional Government through related agencies in changing the mindset and managing fishermen's marine products so that they have value and high selling prices. This research aims to understand and analyze the obligations of local governments in managing fishermen's marine products as well as understanding, analyzing, and formulating appropriate regulations for managing fishermen's marine products in Sumenep Regency. This research is empirical research that examines social phenomena and realities in society. This research was carried out by analyzing the problem of marine product management as an effort to improve the welfare of fishermen’s from the perspective of regional autonomy. In fact, with regional autonomy, the role of regional government is very important for fishermen’s to be competitive and independent in solving fishermen's welfare problems. The results of this research show that there is a mindset of fishermen’s who are still just catching and selling, then in terms of regional level regulations in Sumenep Regency, there are no regional regulations that provide legal certainty regarding the protection and empowerment of fishermen’s, especially the management of fishermen's marine products.

Abstract

PT. Petrokimia is seeing escalating difficulties in their supply chain system. Supply Chain Risk Management evaluations can be conducted using many methodologies. Supply Chain Risk Management (SCRM) is a process that involves identifying, evaluating, and reducing risks that have the potential to disrupt the smooth operation of the supply chain, which includes the movement of goods and services. This research combines prior studies by employing a hybrid approach known as House of Risk (HoR) and Interpretive Structural Modeling (ISM). The House of Risk (HoR) method is employed to identify registered risk agents by assessing the importance of preventative measures and selecting priority actions. The ISM methodology is utilized in this study to construct a structural framework for examining the contextual associations among risk elements in the company's supply chain. The organization experienced many hazards, with a total of 20 risk events generated by 30 risk agents across the Plan, Source, Make, Delivery, and Return stages. According to the Pareto diagram concept, there are 11 risk agents that require prioritized mitigation. Out of the 10 risks identified, 1 risk is categorized as dependent while the remaining risks fall within the autonomous sector. Among the 11 primary risk factors, the one with the highest ARP value is anticipated to serve as a benchmark for addressing several hazards that have arisen in the company's supply chain. The research has studied and generated mitigation measures to avoid production losses, time losses, and quality reduction resulting from hazards that may hinder the achievement of company objectives.
