Abstract

Space is a region under international jurisdiction. No single country or other subject of international law is permitted to claim ownership of space. This is due to the establishment of one of the main principles in space law, i.e. the province of all mankind principle. This principle emphasizes that space belongs to all mankind and must be fully utilized for the benefit of humanity. The phenomenon of commercialization in space having occurred in modern era is the impact of the rapid progress of science and technology. Commercialization in space is an activity to utilize the region, and then to gain economic benefits. Not only countries but also the private sector with high technology and large resources has participated in the implementation of space commercialization. The forms commercialization of space include, among others, space tourism, telecommunications, insurance, and others. This phenomenon has been debated until today, considering that space belongs to all mankind and must be fully utilized for the benefit of humanity. However, in reality, what happens is that this region is managed by several developed countries and private sector for their economic interests. This study aims to comprehensively analyze commercialization in outer space from the perspective of the province of all mankind principle, one of the main principles in space law. This analysis aims to provide certainty concerning the implementation of commercialization and ensure fairness in the utilization of outer space.

Abstract

This study aims to uncover the meaning behind the tradition of émbu in buying and selling transactions in Madura. The study employs a phenomenological approach focusing on the understanding and meanings attributed by the individuals involved. Data were gathered through participatory observation and in-depth interviews with émbu practitioners in several traditional markets in Madura. Émbu refers to the additional gift given by sellers to buyers after a transaction. The émbu tradition reflects trading ethics and strengthens social relationships among the Madurese community. The study findings indicate that the émbu tradition holds several significant meanings for the Madurese people. Émbu is seen as a symbol of appreciation, gratitude, efforts to maintain social harmony, and a marketing method. It helps foster customer loyalty and builds trust between sellers and buyers. Émbu enhances cultural solidarity and reinforces Madurese identity amidst economic globalization. This study contributes to strengthening the role of local wisdom in social and cultural values that influence economic practices in society. It underscores the importance of preserving local wisdom in the era of globalization as a form of cultural wealth worth preserving. The uniqueness of this research lies in uncovering the various complex dimensions of the émbu tradition, which have been underexplored in previous literature.

Abstract

This study aims to analyze the development of sustainable business models in Micro, Small, and Medium Enterprises (MSMEs) in Kualuh Hulu District, North Labuhanbatu Regency, using the Maqashid Sharia approach. Maqashid Sharia, as a conceptual framework in Islamic law, focuses on five main goals: safeguarding religion, soul, intellect, heredity, and property. This research uses a qualitative method. The results of the study show that most MSMEs in Kualuh Hulu have not fully implemented sustainability principles in their business operations. The analysis further identifies several inhibiting and driving factors in the implementation of sustainable business models that are in accordance with Maqashid Sharia. Hindering factors include a lack of knowledge and resources, while driving factors include community support and positive market potential for halal and environmentally friendly products. This study suggests several strategies to develop sustainable business models for MSMEs based on Maqashid Sharia, such as capacity building through training and mentoring, strengthening sharia-oriented business networks, and developing products and services that meet sustainability and sharia standards. Thus, it is hoped that MSMEs in Kualuh Hulu District can increase competitiveness while contributing to sustainable economic development and in accordance with Islamic principles.
