Abstract

Shaḥrûr methodology and legal implications have been widely written by researchers, but only some researchers elaborate Sunnah in depth analysis. In discussing Sunnah, Shaḥrûr mentioned the problems that have serious implications, such, whether all the words, actions and silence of Muhammad is the result of revelation or ijtihâd of Muhammad himself? Shaḥrûr assumed that Sunnah is actually the result of ijtihâd of Muhammad himself and it is not revelation. Therefore, definition that has been established on Sunnah (everything that comes from Muhammad either of the words, deeds and statutes) is not appropriate. Dissolving this definition for Shaḥrûr became possible because these definitions are not made by Muhammad himself, but by the next generations. According to him, Sunnah is derived from the word sanna which means the ease and flow smoothly. Thus, what is said, done and set by Muhammad is an example of how such limits practiced in space and time of Muhammad. He is not the last and not the only laws that must be done. Based on the definition that has been made, Shaḥrûr divided Sunnah into two categories, namely sunnah risâlah and sunnah nubûwah. Sunnah risâlah maintains on law, morals, and good manners, while sunnah nabûwah preserves objective sciences. Further, it implies that the adherence to sunnah risâlah is an obligation, adherence to sunnah nubûwah is non-compulsory.

Abstract

This article aims to elaborate methodological investigation of ḥadîth criticism of the historians point of view. It also observes the salient differences between them and the scholars of ḥadîth, as both are often on different worldview. Through descriptive-analytical study, the author comes to the conclusion that there are at least two methods of ḥadîth criticism in historian perspective that are [1] critical in analysing the companions of the Prophet and [2] critical to the content (matn) of ḥadîth. By shifting paradigm framework, it suggests that both of them should not be rejected. Both perspectives should be used as a method to develop the tradition of ḥadîth criticism, although at some points, they have to be put on critical consideration. On the other side, the historian perspective might be useful to encourage the weaknesses which has been existed in conventional science of ḥadîth criticism.

Abstract

This paper reviews the hermeneutic Khaled M. Abou El-Fadl, in his work entitled Speaking God’s Name: Authority and Women. This figure is interesting to study because his theory stems from the fact that they experienced. At first he was an admirer salafi, then criticize ideologies. This paper focuses on the thoughts on the meaning and religious texts. To unload thinking Khaled used descriptive-analytical method. Apparently, hermeneutics offered Khaled influenced by several prominent Western hermeneutics, especially Gadamer and Gracia. From there, he formulated the five preconditions which adopted in interpreting the sacred text of someone’s religion.

Abstract

This article examines tafsîr maqâṣidî in epistemological outlook. It studies the origins, methodology, and validation of its construction. Based on depth literary analysis, this article argues that tafsîr maqâṣidî cannot be separated from its origins in the historical development of Islamic law. It can be seen from the rise of tafsîr maqâṣidî that is much more originated and established from maqâṣid al-sharî’ah in terms of Islamic law. The basic framework of tafsîr maqâṣidî is not only developed by Muslim scholars who are well educated in Islamic law such as Ibn ‘Âshûr and Jaser Auda, but also initiated by scholars of theology such like Muḥammad ‘Abduh and Muḥammad Rashîd Riḍâ. The article also suggests that the movement of maqâṣid al-sharî’ah thoughts including tafsîr maqâṣidî has relevant effort in constructing Islamic knowledge which is well known in contemporary Islamic discourse as islamization of knowledge. On the origins, tafsîr maqâṣidî is like tafsir bi al-ra’y that attempts to find a logical basis and methods that is appropriate to Islamic sources, and on the same time it tries to put a logic and reason as the basis for interpretation. On methodological side, tafsîr maqâṣidî is built in two traces of tafsir tradition that is well known as naqlî and ‘aqlî methods. And on validation, tafsîr maqâṣidî forms itself into a wide creativity in using naqlî and ‘aqlî methods by emphasizing on rational and empirical study with special reference to maṣâliḥ mursalah.

Abstract

Violence and radicalism in the name of religion which leads to terrorism has emerged as a complicated issue in contemporary Indonesian Islam. The emergence and development of radicalism were actually caused by a lack of understanding of the Qur’an. The verse of the Qur’an has been interpreted textually and partially. This, by far, are happened in Paciran Lamongan in the recent years. Reconstruction of understanding verse of the Qur’an on vulnerable communities that is easily affected by movement of Islamic radicalism has been properly carried out, so that it can give a new atmosphere, and it can be the prevention to face the violence movement. Deradicalization of understanding to the Qur’an is a solution-based action to prevent violence and radicalism in the name of religion.

Abstract

For several decades, the role of Muslim female in political arena is limited and still dominated by Muslim male figures. Religious doctrines seem to take part in constructing women into social life. Women are still perceived as secondary person before men, having much emotional feelings, and incapable to handle such social problems. It has been much demonstrated by traditional scholars that the providence of men is being a leader, having much power, and is rightly superior to women. In this case, contemporary feminist Muslim such like Fatima Mernissi, Riffat Hassan, Asghar Ali Engineer, and Fazlur Rahman has contended this notion. They argue that there was possibly different impression on the interpretation of Qur’an that affects Qura’nic worldview towards the existence of women. According to them, Qur’an was precisely revealed to liberate women from social subjection. This article scrutinizes methodological framework in establishing a new light of understanding Qur’anic verse on women, especially on the issues on the origins of women creature, leadership, attestation and the right for inheritance.

Abstract

This article aims to explore the ḥadîth thematically on the act of lesbianism in the normative roots. The methods used are operationally by generating ḥadîths that are related to the topic, making typology, defining the primary ḥadîth, takhrîj, and analyzing it in textual and contextual perspective. This article finds that some ḥadîth which are talking straightly on lesbianism are narrated by al-Ṭabrânî. It suggests that the act of lesbianism is a sinful deeds that are similar to the act of sexual intercourse (zinâ). In the wide analysis, it can be noted that Islam does not give space for making it legal for the doers of lesbianism. It is not only because the act of lesbianism has been considered as deviation from the nature of human sexual orientation, but also because it certainly contradicts to the basic legal of human relation. Otherwise, there are ample of ḥ adîth giving instruction to prevent people from such action, that is by not to open and look at other human genitals (‘awrat), not to have body contact  that arouse sexual desire, and to emerge awarness of sexual identity and sexs by not to follow the deeds or dressing the opposite gender clothes.

Abstract

This article deals with the contextual understanding of Syuhudi Ismail to the ḥadîth. Syuhudi is one of the inspired Indonesian Muslim scholars who has high attention to the study of h}adîth. His work entitled Hadis Nabi yang Tekstual dan Kontekstual: Telaah Ma’anil Hadis tentang Ajaran Islam yang Universal, Temporal dan Lokal, has been considered as one of the most valuable contributions in promoting the dynamic, progressive and universal understanding of Islam. By applying descriptive-comparative analysis and contextual approach, this article finds that Syuhudi’s contributions in formulating the concept and practice of contextual understanding of the ḥadîth are quite different from other Muslim scholars. This is due to the basic assumption of Syuhudi’s understanding that the prophet has several roles at the mean time, the necessity of applying universal value of Islam, and the actual change of the society. This, in turn, brings Syuhudi’s contextual understanding into the idea of differentiated meanings of the ḥadîth which are universal, local and temporal.

Abstract

  Text will always interacting with the context. He always dialectic with the conditions in which the text was born. Therefore, to understand a text, an understanding about the context becomes a necessity that must be done, not least the understanding of hadith texts. Without understanding a variety of variables and circumstances behind the text that includes historical aspects, sociological, psychological, and so on, then this will potentially misinterpretation. This article explores the ideas of Jamal al-Banna on the methodology of contemporary traditions. He offers concepts and methodologies so resolutive and intelligent in understanding the Sunnah of the Prophet. He also shows how Muslims should ideally interact with the Sunnah. Departing from the description, it will be explored in this article about Jamal al-Banna Sunnah thinking which will then be analyzed in this hermeneutic perspective. According to him, Muslims today should make the Sunnah as a model of ijtihad, which also means keeping the existence of Sunnah. That is, people now have to follow the path and methodology, not the spoken word; follow the Sunnah of the Prophet, do not follow the text of the hadith.

Abstract

This article tries to explain the concept of Islamic wasaṭîyah (Islamic moderate) from the prophetic ḥadîth point of view. It, then, attempts to elaborate the prophet’s attitudes and sayings which have to do with the issue of moderation. It should be noted that many researches have focused more on the polemical ḥadîth that are mistreated by some radical Muslims to legitimate their arguments, but are little to investigate the moderation side of the ḥadîth. Methodologically, the article employs thematic method to collect ḥadîth from the classical book and then analyze it by the contextual frame. By searching of the terminological explanation of moderation, it can be summarized that the prophetic ḥadîth has little to say about moderation in term of wasaṭîyah, but there has ample of word which is equivalent to the term, that is al-qaṣd. Those ḥadîth has brought several principles and characteristics, such like al-khayrîyah (chosen), al-‘adâlah (fairness), al-tasâmuḥ (tolerant attitude), al-tawâzun (balance), al-istiqâmah (consistency), and raf‘ al-ḥaraj (eliminating difficulties). Those principles are significant in terms of demonstrating the peaceful life and arguing the violent and intolerant conducts. The contextual analysis of the ḥadîth has argued that those values should be put on the universal principles which Islam has come along with.
