Abstract

Abstrak: Selama era Reformasi, sistem pendidikan nasional sedang menghadapi sejumlah problem. Dalam aspek tujuan pendidikan nasional, misalnya, lembaga- lembaga pendidikan tampak belum bisa mencapai tujuan pendidikan nasional secara utuh. Pembentukan akhlak mulia dalam diri anak sebagai salah satu bagian dari tujuan pendidikan nasional masih menjadi persoalan. Banyak faktor penyebab problem ini, antara lain adalah kurangnya peran orangtua dan guru dalam membentuk akhlak anak sejak usia dini. Tulisan ini akan menyajikan pandangan Ibn Miskawaih tentang urgensi pembentukan akhlak anak sejak usia dini. Kajian ini menemukan bahwa seorang anak akan mampu menampilkan akhlak mulia manakala pendidik, baik orangtua maupun guru, mampu memahami kejiwaan anak sembari mulai mengajari dan membiasakan anak dengan akhlak mulia sejak kecil, serta memilih lingkungan yang sehat secara moral untuk anak tersebut.Abstract: Early Childhood Character Building in the View of Ibn Miska- waih. During the reformation era, the national education system is apparently facing some problems. On the goal of national education, for instance, educational institutions have not achieved their goals in the true sense. The noble character building in the child as part of the national education objective has yet become problem. There are a number of factors that led to these problems, some of which are the minor role of the parents and teachers in building child’s character since early childhood. This writing cast some lights on the importance of child character building since early childhood in Ibn Miskawaih’s view. This study finds that a child will be able to be acquainted with noble character when educators, whether parents or teachers, are capable of understanding the child’s psychological state and begin teaching to live with it since childhood. Also contributed to the character building success is choosing healthy environment morally for the child.Kata Kunci: akhlak, anak usia dini, Ibn Miskawaih

Abstract

Abstrak: Secara tegas, hukum pidana Islam dan Indonesia mengatur tentang hukuman mati. Tetapi, di Indonesia eksistensi hukuman mati masih menjadi perdebatan. Ada pendapat bahwa hukuman mati bertentangan dengan Hak Asasi Manusia (HAM) dan ada juga menilai hukuman mati dimaksudkan untuk melindungi kepentingan umum. Untuk mengkaji pertentangan pandangan tersebut, perlu dilakukan analisis secara kritis dengan mengunakan pendekatan yuridis normatif. Disimpulkan bahwa dalam pelaksanaan hukuman mati, baik hukum pidana Islam maupun Indonesia mem- berlakukan secara hati-hati dan dengan batasan yang telah ditentukan oleh undang- undang. Dengan batasan-batasan inilah diharapakan dapat mengimbangi pandangan antara yang mendukung dan menolak hukuman mati di Indonesia. Hukuman mati dalam hukum pidana Islam untuk melindungi agama, jiwa, harta, akal, dan keturunan yang merupakan karunia Allah SWT. yang harus dilindungi, di mana pelanggarnya pantas dihukum mati.Abstract: The Debate of Capital Punishment in Indonesia: A Comparative Study between Islamic and Indonesian Criminal Law. Strictly speaking, the Islamic and Indonesian criminal law provide for capital punishment. However, the existence of the death penalty in Indonesia is still debatable. It is assumed that the death penalty is against human rights, but others consider it as to protect the public interest. In order to discuss the contravening views, this paper is an attempt to critically analyzed the issu by using a normative juridical approach. It is concluded in its implementation of capital punishment both the in Islamic and Indonesian criminal law is carefully applied and with the limits prescribed by law. Such restrictions are expected to balance the views between the pro and against capital punishment in Indonesia. The death penalty in Islamic criminal law is to protect religion, life, property, intellect and descendant. The five basic human rights is given by the Almighty God that should be protected, the violator of which is liable for capital punishment.Kata Kunci: hukuman mati, hukum pidana, Islam

Abstract

Abstrak: Pemikiran al-Qâdhî  ‘Abd  al-Jabbâr Tentang Qiyâs. Al-Qâdhî  ‘Abd  al-Jabbâr selama ini lebih terkenal sebagai pemikir ulama Mu`tazilah yang sangat mengagungkan supremasi akal, namun ia memiliki pemikiran di bidang ushul fiqh seperti tertuang dalam karyanya Al Mughnî fî Abwâb al-Tawhîd wa al-‘Adl. Dalam salah satu pembahasannya ia berbicara tentang kehujjahan qiyas sebagai dalil syara`. Tulisan ini berusaha mengelaborasi pandangan al-Qâdhî  tentang kehujjahan qiyas sebagai dalil hukum. Penulis menemukan bahwa `illat dengan sendirinya memiliki konsekuensi  hukum sekalipun tanpa adanya aturan syara’. Pendapat ini berbeda dengan pandangan mayoritas ulama Sunni yang menyatakan bahwa illat tidak memberi implikasi hukum, kecuali ada dalil syara` yang menjelaskannya.  Sebagai contoh, memabukkan dalam minuman keras sebelum ada syariat pengharaman bukanlah `illat pengharaman khamr dan `illat dijatuhkannya hukum hadd kepada peminumnya. Pemikiran al-Qâdhî ini tampaknya diwarnai oleh ajaran Mu`tazilah yang menjadikan akal sebagai penentu baik dan buruk serta alat bagi kewajiban menjalankan yang kebaikan dan meninggalkan keburukan.   Abstract: Al-Qâdhî ‘Abd  al-Jabbâr’s Thought on Qiyâs. Although widely known as a Mu‘tazilite ‘ulamâ who support the supremacy of intellect, al-Qâdhî also well verse in the realm of Islamic legal theory as reflected in his Al Mughnî fî Abwâb al-Tawhîd wa al-‘Adl. In one of his excerpt, he discusses the position of analogy as a base for argument in Islamic law which becomes the focus of this essay. The author maintains that according to al-Qâdhî `illat or cause by itself has a legal effect even though prior to the existence of God’s rules provided for a certain case. Such view is in contrast with those of Sunni majority who argue that Divine revelation is required for ‘illat to be legally effective. For example, intoxication in alcoholic drink prior to its divine prohibition is not a cause for its banning nor is it a motive for punishment of the drunken person. Such al-Qâdhî’s thought seems to be influenced by his affiliation with Mu‘tazilite creed in which intellect is highly admired for it can determine the good from bad thing, and it also function as a means of performing obligation and avoiding the bad things as well. Kata Kunci: Hukum Islam, qiyâs, al-Qâdhî  ‘Abd  al-Jabbâr, ushûl al-fiqh

Abstract

Abstrak: Artikel ini berupaya menstudi aturan yang dikeluarkan Walikota Lhokseumawe yang melarang perempuan duduk mengangkang pada saat mengendarai sepeda motor karena dianggap melanggar ajaran Islam. Aturan tersebut telah menimbulkan kritikan yang deras tidak hanya dari para aktivis tetapi juga dari masyarakat banyak yang dianggap sebagai bentuk ketertinggalan dan penindasan terhadap hak asasi kaum perempuan. Salah satu kunci memahami permasalahan tersebut adalah dengan melihat kembali identitas orang Aceh, budaya dan tradisinya yang merupakan aspek antropologi. Penulis menyimpulkan bahwa aturan tersebut bukanlah cara terbaik melindungi kaum perempuan, juga bukan cara yang Islami, tetapi ini hanyalah budaya klasik yang dipopulerkan kembali oleh Suaidi untuk menarik perhatian masyarakat seolah-olah dirinya telah memenuhi keinginan masyarakat Lhokseumawe. Dengan aturan tersebut, ia mencoba melindungi moral dan perilaku, dan di sisi lain ia telah menjajah dan mendiskriminasi rakyatnya sendiri.Abstract: Islamic Syariah and Ngangkang Style: Identifying Local Wisdom and Acehnese Women Identity. This article studies the regulation issued by Lhokseumawe Mayor who banned the women from straddling while sitting on motorcycle, regarding it as against the Islamic law. This regulation has sparked strong criticism not only from activist but also from pluralist, both inside and outside the Aceh province alike. For some, this regulation is considered as backward step and for others as a form of discrimination against women’s right. One key to understand this problem is by looking at the Acehnese identity and culture which constitute aspects of anthropology. The writer concludes that such law is neither the best way to protect the women nor the Islamic solution, but an ancient culture to be popularized by the Mayor to direct the attention of the Lhokseumawean as if he has fulfilled their interest. By introducing this regulation he seems to protect morality and behavior, but at the same time he has discriminated his own people.Kata Kunci: qanun, identitas, kearifan lokal, ngangkang, perempuan Aceh

Abstract

Abstrak: Tulisan ini bertujuan mengungkapkan relevansi pemikiran Ibn Sahnûn mengenai kurikulum pengajaran pendidikan dasar Islam dengan praktik kurikulum pengajaran pada institusi-institusi pendidikan dasar Islam masa kini. Berdasarkan analisis deskriptif, analisis isi, dan analisis kritis, penulis berargumen bahwa kurikulum pengajaran pendidikan dasar Islam menurut Ibn Sahnûn masih relevan dengan praktik kurikulum pengajaran pendidikan dasar Islam masa kini. Hal tersebut setidaknya berdasarkan: 1) aspek prinsip penyusunannya, yaitu prinsip tawâzun (keseimbangan) antara materi-materi ukhrawi dengan duniâwi, intelektual dengan spiritual, materi- materi teoretis dengan praktis, dan prinsip relevansi, yaitu kesesuaian kurikulum pengajaran dengan kebutuhan masyarakat, dan 2) dari aspek dasar utama yang menjadi landasan penyusunan kurikulum pengajaran, yaitu dasar agama dan sosial.Abstract: Ibn Sahnûn’s Islamic Educational Thought: Critical Analysis of Teaching Curriculum in the Institution of Islamic Elementary Education. This paper aims to reveal the relevance of Ibn Sahnûn thought on teaching curriculum of Islamic primary education to the practice of the current teaching curriculum in Islamic primary education institutions. Based on descriptive, content, and critical analysis to form a reflective thought, the results of present study showed that the teaching curriculum of Islamic elementary education of Ibn Sahnûn still relevant to the practice of it nowadays, especially from (1) the principles of it composition aspects, the principle of tawâzun (equilibrium) between the materials of the hereafter with worldly ones or (intellectual with the spiritual aspect), the theoretical material with practical, and the principle of relevance, the suitability of the teaching curriculum to the needs of the community, and (2) the primary basis on which the teaching curriculum is developed, which is the basis of religion and social issues.Kata Kunci: Ibn Sahnûn, kurikulum pengajaran, pendidikan dasar Islam

Abstract

Abstrak: Tulisan ini mencoba mendiskusikan teori hermeneutika yang ditawarkan oleh Fazlur Rahman mencakup kritik Rahman terhadap teori sebelumnya, baik tradisional maupun kontemporer. Penulis menemukan bahwa Rahman menekankan pentingnya memahami al-Qur’an sebagai keseluruhan dan menjadi satu kesatuan yang utuh. Rahman juga membedakan antara hukum umum (prinsip) dan hukum temporal, dan menekankan pentingnya mempertimbangkan konteks untuk memahami al-Qur’an secara tepat. Penulis berargumen bahwa tujuan akhir teori Rahman adalah untuk membangun harmonisasi tiga aspek ajaran Islam dalam ranah hukum, etika dan hukum yang harus saling mendukung antara satu sama lain, yang didasarkan pada tiga prinsip dasar tatanan hubungan manusia yakni egalitarianisme, keadilan dan konsultasi mutual.Abstract:Fazlur Rahman’s Hermeneutics: An effort to Build Harmony Between Theology, Ethics and Law.This paper attempts to discuss the hermeneutical theory proposed by Fazlur Rahman. It includes therefore the discussion of Rahman’s critique on the existing theories both traditional and contemporary ones. The author finds that Rahman emphasizes the importance of understanding al-Qur’anintegrally as a single whole. He also distinguishes between general laws and temporary laws as well as stresses the importance of considering context to understanding al-Qur’an correctly. The author argues that the ultimate purpose of the theory is to build a harmony among three aspects of Islamic teaching: law, ethics, and theology, each of which has to support one another. In addition, there are three principles on which laws on human relation have to be built, namely egalitarianism, justice, and mutual consultation.Kata Kunci: Al-Qur’an, hermeneutika, Fazlur Rahman, penafsiran

Abstract

Abstrak: Sebagai model pendidikan Islam tertua di Indonesia, pondok pesantren (pontren) mempunyai peran strategis dalam pelestarian ajaran Islam, terutama terlihat dalam transmisi tradisi bermazhab melalui kegiatan pembelajaran fikih dengan kurikulum dan referensi sejumlah kitab-kitab klasik yang bersifat doktrinal dan monoton. Hasil penelitian terhadap 12 (dua belas) pontren di Kalimantan Selatan dengan pendekatan studi kasus melalui metode wawancara mendalam, observasi, dan dokumentasi menunjukkan kuatnya tradisi bermadzhab dalam fikih yang ter- institusionalisasi dalam kurikulum dan sistem pembelajaran fikih. Hasil penelitian menunjukkan bahwa di dalam pembelajaran fikih, baik yang diselenggarakan melalui sistem klasikal atau nonklasikal, bandongan/wetonan, ceramah dan atau diskusi, pelembagaan mazhab terlihat pada bahan ajar/kitab fikih yang digunakan dan konsep serta paradigma guru tentang mazhab. Hal tersebut berimplikasi pada terciptanya alumni yang eksklusif dalam memahami dan menyikapi perbedaan pendapat.Abstract: the Paradigm of Islamic Legal School Adherents in Pondok Pesantren (Islamic boarding school) of South Kalimantan. As the oldest model of Islamic education in Indonesia, pondok pesantren has strategic role in the preservation of the thought of Islam, especially noticeable in transmission of the tradition follow mazhab through learning activities with curriculum and several classic books as references in doctrinal and monotonous approach. Result of study in twelve (12) pontren in South Kalimantan in case study approach through indepth interviews, observation, and documentation methods showed strong tradition in follow madzhab institutionalized in the curriculum and learning systems of fiqh. The study also showed that in the study of fiqh, both held by a classical (bandongan/ wetonan) or non-classical system (lecture or discussion), the institutionalization of mazhab appear on teaching materials/book of fiqh used, concepts and paradigms of teachers on mazhab. These conditions may lead to boosting the creation of exclusive alumni in understanding and addressing differences of opinion amongst Islamic legal schools.Kata Kunci: hukum Islam, fikih, madzhab, pondok pesantren, salafi, khalafi

Abstract

Abstrak: Pandangan Ahl Sunnah dan Syi‘ah terhadap Hadis Ahl al-Bayt. Hadis (kitâballâhi wa ‘itraty…) merupakan salah satu hadis yang menimbulkan perdebatan sengit antara dua aliran dalam Islam: Ahl Sunnah dan Syi`ah. Tulisan ini berupaya memaparkan persepsi kedua aliran tentang Ahl al-Bayt yang merujuk pada jalur sanad hadis ini dan menjelaskan kekuatan dalil al-Qur’an dan hadis sebagai pendukung argumentasi kedua aliran ini. Penulis menyimpulkan bahwa bagi kaum Syi`ah hadis ini dianggap sahih sehingga dijadikan pijakan dalam doktrin mereka tentang Ahl al-Bayt (keluarga). Mereka juga hanya membatasi keluarga Nabi pada ‘Ali, Fathimah, Hasan dan Husein saja. Sebaliknya, kelompok Ahl Sunnah berpendapat hadis ini dha‘îf karena terdapat perawinya yang cacat, meskipun sebagian mereka ada yang dapat menerima hadis ini karena adanya faktor penguat dari sanad lain, sehingga berimplikasi pada pemahaman mereka terhadap Ahl al-Bayt yang tidak hanya terbatas pada keempat sosok tersebut.Abstract: Ahlussunnah and Syi’ah’s Views on the Hadis Ahl al-Bayt. The Prophetic tradition (kitâballâhi wa ‘itraty…) is one of the most debated hadiths amongst the two mainstreams Islam: Ahl Sunnah dan Syi`ah. This paper tries to elucidate the understanding of both sects on Ahl al-Bayt by referring to the chain of transmitters of this hadith while explaining the quality of the Quanic and Tradition arguments as s support for their opinion. The witer comes to the conclusion that, for the Syi’ah this hadith is perceived as reliable and thus it becomes the bases for their doctrine of Ahl al-Bayt. They also confine the Prophet family to only Ali, Fathimah, Hasan and Husein. For Ahl Sunnah, however, they hold that such hadith is unreliable due to its weak transmitter, although some of them accept it with the availability of other lines of transmitters and thus imply in their understanding of  Ahl al-Bayt which is not only limited to the four mentioned figures.  Kata Kunci: takhrîj hadis, Ahl al-Bayt, Ahl Sunnah, Syi’ah

Abstract

Abstrak:Gerakan Islamisme Radikalisme dalam Islam terlahir tidak hanya karena faktor pemahaman keagamaan yang literal terhadap ayat-ayat al-Qur’an atau faktor derivasi politik, sosial dan ekonomi saja, akan tetapi juga karena faktor bacaan yang kurang tepat terhadap sejarah Islam yang dikombinasikan dengan idealisasi berlebihan terhadap Islam pada masa tertentu. Tulisan ini mengungkap bagaimana faktor sejarah gerakan lokal berkontribusi pada memunculkan radikalisme. Kajian ini menggunakan pendekatan historis dengan memahami kronologis dan proses munculnya radikalisme Islam pasca Orde Baru di Sumatera Barat. Penulis berargumen bahwa kemunculan radikalisme Islam semakin terbuka, terlebih ketika dihadapkan pada keinginan pengulangan periode sejarah kejayaan Islam secara eksklusif, tanpa disertai kajian yang komprehensif tentang Islam dan masyarakat Muslim. Penulis juga menemukan bahwa gerakan radikalisme Islam di Sumatera Barat memiliki ketersambungan historis dengan gerakan Paderi abad ke-19. Abstract: Islamist Movement in the Post-New Order Era West Sumatra. Islamist movement or radicalism  emerges not only due to the literal understanding of verses of the Qur’an nor is it political, social and economic factors but it rather due to inappropriate reading of Islamic history combined with an excessive idealization of Islam in a given time. This writing tries to unveil how historical factor of local movement had contributed to the emergence of radicalism. This study uses a historical approach, by understanding the chronology and the process of the emergence of Islamic radicalism in the post-New Order West Sumatra. The writer argues that the emergence of Islamic radicalism is open even wider when it generated with the desire to repeat the period of Islamic glory without a comprehensive assessment of Islam and Muslim society. He also argues that Islamic radicalism movement in West Sumatra has a close historical bond with that of the 19th century Paderi.Kata Kunci: Islamisme, pergerakan Islam, radikal, Sumatera Barat

Abstract

Abstract: Zakat Management in the Post Declaration of Islamic Syariah in Aceh. One of the most noted consequences of declaration of the implementation of Syariat Islam in Aceh has been a spirit for the management of zakat which was resulted in the introduction of several regulations. The author argues that by referring to these laws and qanun there is a tendency that the management of zakat are being managed by the government. However, such system is not similar to that of the BAZIS (Badan Amil Zakat Infaq and Shadaqah). This article is an attempt to analyze the management of zakat focusing on systems applied in Baitul Mal and in the BAZIS, the extent to which they are similar or different. The author maintains that the system used in Baitul Mal is more effective and as such makes such institution closer to society and cuts down bureaucratic complexity.Kata Kunci: pengelolaan zakat, BAZIS, Baitul mal, Aceh
