Abstract

The tolerant spirit of Islam has inspired Ottoman rulers to adopt policies relating to non-Muslim citizens. The leadership crisis in the Ottoman Empire and the Western interests through capitulation have changed judicial system in the empire, including the system for non-Muslims that allows them to conduct their own judiciary and provide absolute freedom of religious matters. Tanzimāt, which is expected to bring improvements to the legislation system in Ottoman Empire, has marginalized Islamic law which is only enforced in aḥwāl al-shakhṣiyyah. Sultan Abdul Hamid II tried to maintain Islamic law by codifying Western European style. Some legal codifications contain qawāid fiqhiyyah (principles of Islamic law) which are sourced from the books of the Hanafi School of jurisprudence, and some others adopt Western laws by taking a few opinions of Islamic jurisprudence. This study analyzed various literatures related to policies towards non-Muslim citizens in the Ottoman era. The study uses descriptive and qualitative methods with a content analysis approach. Broadly speaking, this study found that the Ottoman Empire had given good treatment to non-Muslim citizens. The non-Muslim citizens get various facilities from the State, including the establishment of special institutions that handle their own affairs, although at the same time they have been used by Western countries to support their interests in Ottoman Empire.

Abstract

As a great figure, Ibn ‘Arabi’s thoughts greatly influenced the Sufis who came after him. In fact, some researchers in the field of Sufism say that there are new characteristics that have emerged in the history of Sufism after Ibn ‘Arabi, namely philosophical Sufism. The same influence can also be found in the tradition of Sufism thought on Ottoman, one of them is Üftade. In his work entitled Vâkıât, Üftade mentions Ibn ‘Arabi’s name more than 40 times in various topics of discussion. For example, Üftade claimed that he had met Ibn ‘Arabi several times in his dreams, Ibn ‘Arabi’s level of wilāyah and so on. By using the content analysis method, this paper tried to see how the Üftade’s view of Ibn ‘Arabi’s thoughts actually was, his works and his level of wilāyah among other Sufi figures.

Abstract

The Ngali-Renda conflict is habituated. It has taken for years. It has grown in its severity. It is not the case that the people of Ngali and Renda and the government do nothing in dealing with the conflict. However, the conflict is still there and waiting its trigger to appear. This research is significant in that it analyzes the traditional factors and interventions of the conflict. Applying qualitative research and historical, socio-cultural and phenomenological approaches showed that the Ngali-Renda conflict transformed from ndempa (empty-handed fighting) to lewa (armed fighting). Ndempa implied the spirit of honesty, openness and patriotism. It occurred every year in rest period of cultivation and took one or two month. Although ndempa was kapoda ade (serious and violent), it was kadihi ade (no intention to do harm) and for play and pleasure. On the contrary, lewa was more violent and caused casualties because the fighters used big knifes, arrows and firearms.

Abstract

This research studied the status of political promises declared by Mayor candidates of Surabaya election 2020 during their campaigns started from September 26, 2020. It was field-library research with qualitative analysis. Data were collected by observing online media that particularly reports the election's campaign activities. They were then analyzed by using Islamic theology and jurisprudence approaches combined with structural-functionalism, symbolic interactionism, and social contract theories. It found four main remarks: first, Quranic verses and Prophetic traditions as theological underpinnings have definitely guided moral standards of Islamic politics, especially how to make such political promises. Secondly, the political realism of promises is a language of transactional politics and communication practice. Thirdly, political promises could only be legitimated by fulfilling strike pre-requirements and within very urgent conditions. Finally, the legal status of political promises must be contextual and conditional.
