Abstract

Abstract: The Book of Enoch presents an explanation of Moon in a different way when compared to many ancient manuscripts. The periods of the Moon associated with the Moon phases are illustrated in a unique way that, in first glance, requires a deep understanding. This explanation is different with what science has explained nowadays. To begin with, the previous research of this subject on the Book of Enoch is out to dated. Therefore, this research conducts a new approach to examine the Book of Enoch using Islamic perspective where this study is rare to conduct. This study utilizes qualitative research with content analysis to gain the answer in depth. This research also uses triangulation method to investigate the data and obtain the validity of the results. Overall, the Moon phase in the Book of Enoch has the same understanding as the modern science. The Book of Enoch describes implicitly the appearance of Moon in the northern hemisphere. The explanation of Enoch lunar-day in each month is followed by the Urfi Islamic calendar. Then the statement about “once the month is 28-day” is based on the using of Callippic cycle in Charles opinion while in the author’s opinion that the Book of Enoch shows the sidereal month cycle. In addition, the theory which has been adopted by Islamic astronomy has a strong relationship with this manuscript since it is believed that this manuscript is attributed to Prophet Enoch or Idris. Abstrak: Kitab Henokh menyajikan penjelasan tentang Bulan dengan cara yang berbeda jika dibandingkan dengan banyak naskah kuno. Periode Bulan yang terkait dengan fase Bulan diilustrasikan dengan cara yang unik sehingga sekilas memerlukan pemahaman yang mendalam. Penjelasan ini berbeda dengan penjelasan ilmu pengetahuan saat ini. Pertama-tama, penelitian sebelumnya mengenai subjek Kitab Henokh ini sudah ketinggalan zaman. Oleh karena itu, penelitian ini melakukan pendekatan baru untuk mengkaji Kitab Henokh dengan menggunakan perspektif Islam dimana penelitian ini jarang dilakukan. Penelitian ini menggunakan penelitian kualitatif dengan analisis isi untuk memperoleh jawaban secara mendalam. Penelitian ini juga menggunakan metode triangulasi untuk menyelidiki data dan memperoleh keabsahan hasil. Secara keseluruhan, fase Bulan dalam Kitab Henokh mempunyai pemahaman yang sama dengan ilmu pengetahuan modern. Kitab Henokh menggambarkan secara implisit penampakan Bulan di belahan bumi utara. Penjelasan hari lunar Henokh di setiap bulannya diikuti dengan penanggalan Islam Urfi. Kemudian pernyataan “satu bulan ada 28 hari” didasarkan pada penggunaan siklus Callippic menurut pendapat Charles sedangkan menurut pendapat penulis Kitab Henokh menunjukkan siklus bulan sidereal. Selain itu, teori yang dianut oleh ilmu astronomi Islam mempunyai kaitan erat dengan naskah ini karena diyakini naskah ini milik Nabi Henokh atau Idris.

Abstract

Abstract: Dispute resolution in the waqf land context is a matter of particular legal complexity; thus, it requires special attention. This research aims to provide a comparative analysis of waqf land dispute resolution mechanisms in Indonesia and Malaysia, with a focus on the role of local cultural values and Islamic legal norms. The present research employs a normative legal research approach, which involves the identification of legal rules, principles and doctrines to provide a resolution to the legal issues under consideration. The results indicate that the resolution of waqf land disputes in Indonesia and Malaysia uses divergent legal and cultural approaches. Despite the adherence to the Islamic waqf principle, there are discernible discrepancies in the dispute resolution methods, legal structures and cultural influences exhibited by these two nations. The influence of local cultural values on the two nations is evident. Indonesia places significant value on deliberation, cooperation and social sustainability, whereas Malaysia places greater emphasis on negotiation, mediation and economics. This research aims to provide tangible insights into institutional reforms and digital innovations in waqf governance and expand comparative analyses to other Islamic jurisdictions, thereby enriching the global discourse on waqf legal practices and dispute resolution.

Abstract

Abstract: This conceptual exploration examines the deep meaning of ḥabs as a common living heritage extending beyond mainstream financial interpretations that consider private waqf an innovation of Islam and cash waqf being the best innovation in private waqf. Through the conceptual-hermeneutic approach, Rizq (divine provision) precedes human notions of ownership and city organisation, with the first ḥabs being Bayt (House of Allah) built by Ādam. This research highlights the spiritual relevance of the sacred milieu of Makkah and critiques modern economic concepts that prioritise material growth and individual ownership over the holistic understanding of life and divine provision inherent to the deep meaning of ḥabs. Finally, this research advocates for a re-evaluation of how we perceive wealth, ownership and societal well-being considering ḥabs as a dynamic, connected living system.

Abstract

Abstract: A Restraint of Trade clause stands between employers to safeguard legitimate protectable interests and the employee's right to exercise a profession freely. Therefore, this research aims to conduct a comprehensive examination into enforcing restraint of trade agreements in South Africa, critically analyzing the judiciary's balance between the legitimate protectable interests of employers and the constitutionally enshrined right of employees to freedom in occupation and profession. A doctrinal review of key South African case law is carried out, where judicial enforcement depends on a value judgment between public policy and contractual freedom, particularly under section 22 of the Constitution. Furthermore, this research engages with the Islamic legal framework on restraint of trade, drawing on foundational concepts such as hurriyat al-kasb (freedom to engage in lawful trade), gharar (prohibition of uncertainty), and the ethical obligations embedded in shurut (contractual conditions). The results show that Islamic jurisprudence imposes strict moral limitations to ensure no clause unjustly inhibits a worker’s right to earn a lawful livelihood while acknowledging the sanctity of contracts. Selected Islamic countries legally approach restraint of trade clauses within a legal system grounded in Sharia principles and statutory law as reported through a comparative analysis. The implications of restraint clauses are also assessed in the context of a digitalized economy, where traditional notions of geographic and jurisdictional limits become blurred. In the absence of precedent, South African courts can rely on territoriality (place of work) or nationality principles (parties’ origin) to determine jurisdiction over cross-jurisdictional digital labor disputes. The contribution advocates for the creation of a robust legal framework to address restraint enforcement in virtual environments, striking a balance between innovation-driven business protection and the fundamental rights of workers under constitutional and Islamic legal traditions.

Abstract

Abstract: Zakat is part of the five pillars of Islam which is considered significant in poverty alleviation in addition to the promotion of social justice and economic redistribution. Therefore, this study aims to examine the role of zakat in alleviating poverty in order to achieve Sustainable Development Goal (SDG) 2: Zero Hunger with a specific focus on food security. The trend is associated with the importance of a robust social safety net that meets the basic sustenance needs of all members of society. This shows the possibility of zakat serving as a continuous mechanism of wealth redistribution from an Islamic perspective. A literature review with a case study method was used to explore successful zakat practices in Muslim-majority countries to effectively alleviate hunger, support small-scale farmers, and enhance social welfare. It was concluded that zakat could be effectively integrated into contemporary economic and social policies to play a meaningful role in improving food security and promoting sustainable poverty alleviation. The process could further serve as a contribution to the achievement of SDG 2.

Abstract

Abstract: Animals possess certain rights like human beings, including the right to life, liberty, health, well-being and reasonable abode. So far, only the right to life of animals has been given due consideration; however, unlike other inanimate objects, animals are emotional and intelligent beings who also deserve dignity and respect. Sometimes animals are killed without reason, which violates their right to life. Some of them, including chickens, pigs and cows, do not see outdoors except on their way to slaughterhouses, which violates their right to liberty. Business has been cited as justification, but mistreatment should be stopped at any cost by way of minimising the use of animals for industrial purposes and reducing their pain and suffering during this process. Available laws focus on the right to life of animals, while other rights, including the right to liberty, dignity and health, are ignored. While animals are emotional and intelligent beings, they are also entitled to all other rights associated with them, just like humans. Therefore, it is imperative that all other rights available for animals should also be protected. The paper argues that animals possess certain rights that are available to human beings and also intends to focus on the rights of animals on the basis of their emotional and intelligent characteristics using doctrinal and socio-legal research methodology. This paper further provides a comprehensive framework for the rights of animals that are ignored under available laws and to also suggest possible measures to implement the same.

Abstract

AbstractThe substitute heir (plaatsvervulling) is not explicitly mentioned in the Qur'an and has opened various interpretations in Islamic inheritance law. One of them is the opinion issued by M. Yahya Harahap that legitimate Indonesian Law perspective on substitute heir. The opinion stated that grandchildren can replace their parent’s position as an heir of their grandfather, if their parent deceased before the grandfather. This interpretation is different from inheritance law in other Islamic countries. This paper is aimed todiscuss the background and  istinbath al hukmi used by M. Yahya Harahap in describing substitute heirs. With critical study on various library materials and interview, it was found that M. Yahya Harahap’s reason to determine the substitute heirs was influenced by customary law, and apllied 'urf and istilah (Mashlah Mursalah) as istinbath hukmi.Key words: istinbath al hukmi, inheritance law, wasiat wajibah, substitute heirAbstrakTidak disebutkannya ahli waris pengganti dalam Al-Quran secara tersurat telah mem­buka berbagai penafsiran dalam hukum waris Islam. Salah satunya adalah pendapat yang dikeluarkan oleh M. Yahya Harahap. Pendapat tersebut menyatakan bahwa cucu dapat mengganti posisi keahliwarisan orang tuanya yang lebih dahulu meninggal dari kakek untuk berhak mendapatkan harta warisan orang tuanya. Hal tersebut berbeda dengan penafsiran hukum waris pada umumnya, yang salah satunya tertuang dalam ketentuan kewarisan di Mesir, tidak dengan memberikan hak waris namun berupa wasiat wajibah. Tulisan ini bertujuan untukmengetahui latar belakang pendapat dan istinbath al hukmi yang digunakan oleh M. Yahya Harahap dalam mene­tapkan ahli waris pengganti. Dengan metode studi kritik terhadap berbagai bahan pustaka, ditemukan bahwa alasan penetapan ahli waris pengganti M. Abstract

AbstractHumans as khalifatullah are provided by Allah with minds and qalbu, so they can differentiate mashlahah (good) from mafsadat (bad). The potential of minds, situation, condition, and environment of each person is different, that has made the mashlahah is different for each person. This study is aimed to determine the epistemological process of individual mashlahah to be a communal mashlahah. This research begins with the view that the door of ijtihad is always open to anyone who has the credibility to do so, and the notion that not every issue has been answered by previous fuqaha, and reaffirm Islam as the religion of rahmatan lil 'aalamiin This research applied the descriptive philosophical method, and used various books of scholars and experts that related to ushul fiqh, qaidah fiqh, and the objective of Islamic Law as data source. The results of this study show that epistemologically, individual welfare can be explored through understanding and analysis of two sources of Islamic law (the Qur'an and the Sunnah) about the ease in carrying out the legal provisions contained in it as stipulated in surah al-Baqarah verse 185 and 286, by using ushul fiqh and fiqh rules. The hadith of the Prophet لا ضرر ولا ضرار is a legal basis that can provide information about individuals mashlahah that can be used as a standard for public selfare. By refers to illat factors of law in every person, a law can be applied only to people who have equal illat. If all humans have the same illat, then the law can be applied to all humans.Keywords: mashlahah, the objective of Islamic law, ushul fiqh, fiqhAbstrakManusia sebagai khalifatullah dibekali oleh Allah dengan akal dan qolbu, akal dapat berfungsi untuk mengetahui mana hal yang mashlahah (baik), dan mana yang mafsadat (buruk).  Potensi akal, situasi, kondisi, dan lingkungan setiap orang berbeda-beda maka mashlahahnya pun akan berbeda pula satu sama lainnya. Penelitian ini bertujuan untuk memaparkan proses epistemologis kemaslahatan individu menjadi kemaslahatan yang umum serta dasar hukum yang melandasinya. Penelitian ini berawal dari pandangan bahwa pintu ijtihad selalu terbuka bagi setiap orang yang mempunyai kredibilitas untuk melakukannya, dan anggapan bahwa tidak setiap persoalan yang ada sekarang sudah dijawab oleh para fuqaha terdahulu, juga harus adanya pemikiran kembali terhadap Islam dan mengukuhkannya sebagai agama rahmatan lil ‘aalamiin. Metode penelitian yang digunakan adalah metode filosofis deskriptif, dengan sumber data adalah kitab-kitab karya ulama dan para pakar ushul fiqh yang berhubungan dengan Tujuan Hukum Islam, Mashlahah, Qaidah Fiqh dan Qaidah Ushul Fiqh. Hasil penelitian menunjukan bahwa secara epistemologis, kemash­lahatan perseorangan dapat digali melalui pemahaman dan analisis terhadap dua sumber hukum Islam (al-Qur’an dan al-Sunnah) tentang kemudahan-kemudahan dalam menjalankan ketentuan hukum yang ada di dalamnya seperti dalam surat al-Baqarah ayat 185 dan 286, dengan menggunakan kaidah ushul fiqh dan kaidah fiqh untuk men­jelaskan keduanya. Hadits Nabiلا ضرر ولا ضرار  merupakan landasan hukum yang dapat memberikan keterangan tentang kemash­lahatan individu yang bisa dijadikan standar dari kemashlahataan umum. Dengan melihat kepada faktor illat hukum pada setiap individu, hukum dapat diterapkan hanya kepada orang yang mempunyai persamaan dalam illat hukum. Apabila seluruh manusia memiliki illat hukum yang sama maka hukum dapat diberlakukan kepada seluruh manusia.Kata kunci: mashlahah, tujuan hukum Islam, ushul fiqh, fiqh

Abstract

AbstractOne of the legal requirements for marriage is the existence of marriage legal guardian (wali). If the legal guardian cannot act for certain reasons, the position of the guardian is transferred to a magistrate guardian (wali hakim). The magistrate guardian is discussed in various fuqaha jurisprudence and fiqh books. In Indonesia, these opinions were then uniformed through Minister of Religion Regulation Number 30 of 2005 concerning Magistrate Guardian. The applied method in this study is descriptive analysis, by describing the opinions of jurists in various fiqh books and their transformation to uniform provisions in the Minister of Religion Regulation Number 30 of 2005 concerning magistrate guardian. Sources based on the Islamic jurists’s opinions include Bidāyat al-Mujtahid wa Nihāyat al-Muqtashid, Fiqh al-Sunnah, Al-Muwatha, Fath al-Mu‘īn and Fath al-Wahab. This study shows that the most visible transformation is President as wilayah ammah, the general ruler of the country, and gives power to the Ministry of Religious Affairs to appoint the Head of Religious Affairs Distric Office to become a magistrate guardian in their respective region.Keywords:  Marriage guardian, wali aqrab, magistrate guardianAbstrakSalah satu syarat sahnya perkawinan adalah adanya wali nikah. Apabila wali nikah tidak dapat bertindak atau karena sebab-sebab tertentu maka kedudukan wali nikah ber­pindah kepada wali hakim. Bertindaknya wali hakim sebagai wali nikah terdapat dalam berbagai pendapat fuqaha dalam kitab fiqh yang beragam. Di Indonesia pendapat tersebut kemudian diseragamkan melalui Peraturan Menteri Agama Nomor 30 Tahun 2005 tentang Wali Hakim. Metode yang digunakan dalam penelitian ini adalah deskriptif analitis, dengan menggambarkan pendapat fuqaha dalam kitab fiqh yang beragam sehingga menjadi ketentuan yang seragam dalam Peraturan Menteri Agama tersebut. Sumber yang berdasarkan pendapat fuqaha dalam kitab fiqih diantaranya ialah Bidāyat al-Mujtahid wa Nihāyat al-Muqtashid, Fiqh al-Sunnah, Al-Muwatha, Fath al-Mu‘īn dan Fath al-Wahab. Penelitian ini menunjukkan bahwa transformasi paling kental adalah ketentuan mengenai presiden sebagai wilayah ammah yang memberikan kuasa kepada Menteri Agama untuk menunjuk kepala Kantor Urusan Agama Kecamatan sebagai wali hakim di wilayahnya masing-masing.Kata Kunci :  Wali nikah, wali aqrab, peraturan menteri agama, wali hakim

Abstract

AbstractThe diversity of cultures and traditions in Indonesia gives rise to religious rituals (Islam) that synergize with Shari'a. It is very ironic if these deeds carried out by Muslims in Indonesia are accused as superstitious, bid'ah, and khurafat acts, since they are not in accordance with the Qur'an and Sunnah. This condition has caused a reaction from one of traditionalists namely Hasyim Asy'ari who was very concerned in preserving local traditions which were considered has Shari'a touch. This study uses descriptive analysis methods and is based on the idea that some rituals of Indonesian Muslims cannot be separated from culture and tradition. This is considered as something new or bid'ah. Hasyim Asy'ari argues that not all new things are deviant, because even though there is no valid argument, they may still rely on Shari'a. By understanding the meaning of bid'ah as well as the traditions, it is clear that Islam is present and develops in Indonesia through wisdom-based da'wah. That way, the author feels traditions such as tahlilan, group dhikr, istighatsah, prophet’s mawlid, and nisfu sya'ban must be preserved in the context of Islamic peaceful da'wah filled with wisdom in the nuances of Indonesian culture.Keywords : Culture, tradition, bid'ah, Hasyim Asyari, ShariaAbstrakKeberagaman budaya dan tradisi di Indonesia memunculkan ritual keagamaan (Islam) yang bersinergi dengan syariat. Sangat ironis jika amaliyah yang dilakukan oleh umat Islam di Indonesia dituduh sebagai perbuatan tahayul, bid’ah, dan khurafat, karena dianggap tidak sesuai dengan al-Qur’an dan al-Sunnah. Hal ini menimbulkan reaksi dari kaum tradisionalis yaitu Hasyim Asy’ari yang sangat peduli dalam melestarikan tradisi-tradisi lokal yang dianggap telah bernafaskan syariat. Penelitian ini menggunakan metode analisis deskriptif penelitian serta didasarkan pada pemikiran bahwa amaliyah umat Islam Indonesia tidak lepas dari budaya dan tradisi. Hal tersebut dianggap sebagai sesuatu yang baru atau bid’ah. Hasyim Asy’ari berpendapat bahwa tidak semua hal yang baru itu berstatus sesat, karena meskipun tidak ada dalil yang sarih namun bisa jadi tetap bersandar pada syariat. Dengan memahami makna bid’ah sekaligus tradisi di atas jelas bahwa Islam hadir dan berkembang di Indonesia melalui dakwah yang bernuansa hikmah. Dengan begitu, penulis merasa tradisi-tradisi seperti tahlilan, dzikir bersama, istighatsah, maulid nabi dan nisfu sya’ban harus tetap dilestarikan dalam rangka dakwah Islam yang penuh dengan hikmah dalam nuansa budaya Indonesia.Kata kunci : konsep bid'ah, Hasyim Asyari, hukum Islam
