Abstract

Abstract: In accordance withthe results of the preliminary study, there is aneedto compose an instructional book on law education for high school students. It needs to be done in order to widen the students, knowledge. The advanced study aims at developing the instructional book, and testing the levels of attractiveness, effectiveness, and effrciency of the book. Methods being used in thls developmental study are expert evaluation trial, small group trial, and big group trial' The product is evaluated by experts in iaW instructional media, and teaching and learning' Based on the recommendation of the experts, the researcher makes some improvements on the product' Afterwards, the small group triaiis conducted. The results showthatthe attractiveness level is 19oh;mean of the formative tests scores is 76,6; and the subjects need 18 minutes in average to accomplish everything per chapter. Further, the researcher conducts the big group trial' There is a betterment inthe results: the atffactiveness level is 79,2Vo: mean of the formative tests scores is 83; and the subjects need 20 minutes in average to accomplish everything per chapter'

Abstract

Abstract: Territory is an important element of a country. After the development of the territorial countries foundation, i.e. countries struggling for their boundaries explicitly, countries has tried to put some basis that can be accepted by all parties. Indonesia is a very broad archipelagic state consisting of thousands of islands joined by waters. The position of this country makes it have explicit and clear regulations. The government has struggled by many ways in order to unite thearchipelagic Indonesia. Therefore, Indonesia will not be harmed by other countries. The existing regulations are also hoped harmless for others. Archipelagic conceptions as territorial conceptions in the firther development prove to be the conceptions of institutional politics with wide dimension. It seizes not only geographical physical aspects, but also political, economic, socio-cultural, peacefulness, and forhess aspects. The success ofstruggling in creating archipelagic conceptions thesedays can be categorized asjuridical success. However, it can be a foundation for the development of this country in the future.

Abstract

Abstract: Judicial Commission and Supreme Court are two state institutions mentioned in the Constitution I 945 . They are in Chapter Judicial Authority. Supreme Court is one of the judicial authority implementers. On the other hand, judicial Commission is an institution, which has a control duty. In carrying out the duty, Judicial Commission is authoritive in giving suggestions to the chief ofSupreme Court when giving sanctions to judges. In settling the authority disputes between Judicial Commission and Supreme Court, Judicial Commission initiates a petition of dispute settlement to Constitutional Council. In the petition, Judicial Commission states that there is a constitutional violation on the authority of Judicial Commission in the field of controlling the judges done by Supreme Court. In the petition, Judicial Commission also explains that the existence ofArticle 65 ofGovernment Law No. 24 of 2003 is a fonn of inconsistency to the Constitution 1945. Therefore, material tests of the quo article need to be conducted. Judicial Commission can do those two things at the same time looking at the settlement of petition of constitutional review on Government Law No. I of1987.

Abstract

Abstract: Discourse politics in socio-cultural and political analysis often raise debates. The debates come out in terms of the positioning of local culture products when they are communicated with the concepts of statesmanship/nationalism. In this case, it can bring a shift from a local culture concept to the political one. If it happens, the state tendency in controlling local cultures is bigger. It is due to the desire ofthe state/government to get its legitimacy and strengthen its hegemony latently. Theemergence of a local culture group "macapetan" in Trenggalek indicates that there is a practice of hegemony of Orde Baru (social-political order in Indonesia since 1966-1998). Using qualitative reseinch, the hypothesis is proved, beginning fiom the establishment of the mqcqpat clu'b "Pama- Pamf' to the persistence of macapatan cult.)re. Moreover, the materials used in tembang macapqt show the hegemony of Orde Baru.However, the existence of macapatan club in Trenggalek seemsto have positive meanings for the society as the culture agents.

Abstract

Abstrak Lingkungan hidup merupakan sumber kehidupan manusia, binatang, tumbuhan dan makluk hidup lainnya. Lingkungan hidup memiliki sistem yang merupakan sistem kehidupan itu sendiri. Sedemikian pentingnya peran dan fungsi lingkungan hidup bagi kehidupan makluk di bumi, maka upaya perlindungan lingkungan hidup merupakan prioritas yang harus dilakukan oleh seluruh umatmanusia, agar kelangsungan sistem kehidupan tetap terjaga. Salah satu upaya perlindungan lingkungan hidup adalah dengan pengaturan prinsip tanggung jawab mutlak (strict liability) dalam hukum lingkungan. Pemberakuan prinsip tanggung jawab mutlak (strict liability) dilakukan secara terbatas pada kegiatan-kegiatan yang memiliki potensi menimbulkan dampak besar dan penting terhadap lingkungan hidup.

Abstract

Regional Representative Council (PRC) is a new state institution based on the third amendment of the Constitution 1945. It is regulated in the Stipulation of Atticle22 C and Article 22D of the Constitution 1945. This institution is the substitute of regional and assembly delegations, as we know before. It is only a weak party; however, it has a quite strong power. Therefore, it emerges criticisms that PRC is no more than a group of staffs who are sub ordinate to the Parliament. As a result, it leads to the idea of the next amendment of the Constitution 1945, particularly on the power of pRC. In the reality, there are many disregarded cases dealing with regional autonomy that should be the attention of PRC. Take, for example, managements of regional finances from public allocation funds. as well as from natural resources of the regions. Other cases are poor nutrition, starving, and floods as the result of bad space managements. These cases get only minor attention from PRC' In this case, pRC is considered insensitive to the issues and developments of the regions. Therefore, the Fifth Amendment needs to be taken into account. However, before we go further' we need to prepare the grand design. There should be clear what are being improved. In the end, the amendment wili not be the process of mending or patching only. Yet, the peoples can take the benefits of it.

Abstract

Abstract: The four-time amendments ofthe Constitution 1945 have brought quite big implications in the structures of Indonesian constitutional law It is particularly on the organization of the state institutions dealing with the classes, residences, duties, and mandates of the institutions. Take, for example, the president, Before the amendments, president as the holder of the executive power was judged executive heavy. On the other hand, after the amendments, there is a quite significant power resfiietion. However, there is also a strengthening; the president is chosen directly by the peoples. As the result, he has strong political legitimacy. Here, the power restriction of the president is done through controls of the Parliament. The conhols include the mechanisms ofjudgments and agreements of the Parliament on some authorities that fi,rlly belonged to the president before, On one side, the restriction gives a positive impact in avoiding abuse of power, On the othet side, it also emergesanother problem in the statc running because it looks excessive and not proportional,
