Abstract

Judicial Review is the testing effort by the judicial institutions of the laws that were set by the legislative branch of power, and executive. This is giving authority to the judge as an application of the principle of checks and balances based on separation of powers system of the country. In principle, the testing system of laws and regulations in Indonesia can be distinguished between the concept of testing legislation under the laws of the laws under the authority of the Supreme Court (MA) and testing the concept of laws against the Constitution which is the authority Constitutional Court (MK). However, there are weaknesses in the testing process of the legislation under laws that were tested by the Supreme Court, because in principle the authority of the Supreme Court just testing the laws and regulations under legislation against the law, and the Supreme Court can not test regulations under the 1945 Act directly. So the question then is, what if the law relied upon by the Supreme Court to examine the legislation under the law being applied is actually contrary to the 1945 Constitution. In addition, by placing the testing system of laws and regulations in Indonesia are located at the two institutions --- the Supreme Court and Constitutional Court, then in certain cases, be substantially decision may lead to overlapping of the decision made by the two agencies. Therefore, this article will focus on whether the testing system (yudicial Review) against the legislation in Indonesia is in practice so far has been pretty ideal, and have guaranteed the principle of legal certainty and sense of justice in society. Additionally, this article tries to give an idea to rearrange the need for testing the system against the legislation in Indonesia, with full authority to test the legislation in Indonesia to the Constitutional Court (MK), this idea is a process Ius Constituendum

Abstract

Regional Representatives Council(DPD) is astate agency subject to the provisions ofArticle22 and Article 22DC 1945 Amendment. This institute is a substitute of regional representatives and group representatives as we have ever known before. Various parties think that DPD authority by are still weak and as if only as a subordinate staff of experts with the }Iouse. This lead to the idea of thenecessity of returning to the 1945 Constitution amendments, particularly with respect to the authority to strengthen the authority of the Council. DFD has a huge role to accommodate the aspirations of the region associated with the implementation of regional autonomy, both in terms of financial management sourced from the General Allocation Fund, as weil as the poteirtial of natural resources in the region, spatial, poverty, natural disasters, health, environmentand others. While the Council has not and is not even sensitive to the issues that come into direct contact with development interests and welfare of local communities. The idea of the Fifth Amendment must be seriously considered and studied, since amendments to the constitutionis a necessity. The idea of the needfor further amendments to the 1945 Constitution should be appreciated by first preparing a clear grand design ofthe material constitutionneeds tn be amended. Therefore, the amendmentis not just a patch work. And the most urgent one is that pecple candirectly take benefit from the amendment.

Abstract

Regional Representative Council (PRC) is a new state institution based on the third amendment of the Constitution 1945. It is regulated in the Stipulation of Atticle22 C and Article 22D of the Constitution 1945. This institution is the substitute of regional and assembly delegations, as we know before. It is only a weak party; however, it has a quite strong power. Therefore, it emerges criticisms that PRC is no more than a group of staffs who are sub ordinate to the Parliament. As a result, it leads to the idea of the next amendment of the Constitution 1945, particularly on the power of pRC. In the reality, there are many disregarded cases dealing with regional autonomy that should be the attention of PRC. Take, for example, managements of regional finances from public allocation funds. as well as from natural resources of the regions. Other cases are poor nutrition, starving, and floods as the result of bad space managements. These cases get only minor attention from PRC' In this case, pRC is considered insensitive to the issues and developments of the regions. Therefore, the Fifth Amendment needs to be taken into account. However, before we go further' we need to prepare the grand design. There should be clear what are being improved. In the end, the amendment wili not be the process of mending or patching only. Yet, the peoples can take the benefits of it.

Abstract

Abstract: This research was made to meet the needs of PPKn teaching books in Vocational High Schools using a life-based learning approach. This PPKn book innovation is packaged interactively by using augmented reality and quick reality code (QR-code) technology which are increasingly in demand as educational media in developed and modern countries. This study uses the ADDIE model. The results of the validity test by 9 validators obtained a percentage of material validation of 96.89%, media validation of 92.37% and validation of field learning 97.21%. These three results indicate that the developed textbook is very valid and can be implemented. The effectiveness test was obtained from the results of paired t-tests measured that this textbook was able to improve abilities significantly.Abstrak: Penelitian ini dibuat untuk memenuhi kebutuhan buku ajar PPKn di Sekolah Menengah Kejuruan dengan menggunakan pendekatan pembelajaran berbasis kehidupan. Inovasi buku PPKn ini dikemas secara interaktif dengan menggunakan teknologi augmented reality dan quick reality code (QR-code) yang semakin diminati sebagai media edukasi di negara maju dan modern. Penelitian ini menggunakan model ADDIE. Hasil uji validitas oleh sembilan validator diperoleh persentase validasi materi 96,89%, validasi media 92,37% dan validasi pembelajaran lapangan 97,21%. Ketiga hasil tersebut menunjukkan bahwa buku ajar yang dikembangkan sangat valid dan dapat diimplementasikan. Uji efektivitas diperoleh dari hasil uji-t berpasangan yang menunjukkan bahwa buku ajar ini mampu meningkatkan kemampuan secara signifikan.

Abstract

Penelitian ini bertujuan untuk mengetahui pengaruh pemberian apersepsi scene setting terhadap kesiapan belajar siswa. Metode penelitian ini adalah metode kuantitatif. Pada penelitian ini, variabel independennya yaitu pemberian apersepsi scene setting dan variabel dependennya yaitu kesiapan belajar siswa. Teknik sampelnya dengan total sampling. Data yang dikumpulkan dengan menggunakan kuesioner. Populasinya yaitu kelas X SMA Kertanegara Malang yang berjumlah 30 orang. Uji asumsi klasik menggunakan uji validitas data, uji reliabilitas data, uji normalitas data, dan uji linieritas. Kemudian Data yang telah terkumpul dari dua kuesioner tersebut, dianalisis dengan menggunakan uji regresi linier sederhana. Hipotesis yang digunakan yaitu terdapat pengaruh pemberian apersepsi scene setting terhadap kesiapan belajar siswa. Kesimpulan dari penelitian ini adalah Pemberian apersepsi scene setting berpengaruh terhadap kesiapan belajar siswa  pada pelajaran PPKn dengan nilai signifikansi 0,00 (0,000 < 0,05). Besarnya kontribusi melalui nilai koefisien determinasi (R square) sebesar 0,811 atau 81,1%, yang mana variabel pemberian apersepsi scene setting memberikan sumbangan pengaruh sebesar 81,1%.

Abstract

History that tells related to the Indonesian nation has been a maritime nation since long ago, including known from the history of Srivijaya and Majapahit and the famous figure of Admiral Hang Tuah. This article aims to introduce and understand the values of the educational character of the VAT-based Admiral Hang Tuah. Pocket books are small, light, and practical books containing essential and interesting information (material). The religious character education pocket book contains much information related to strengthening character education, archipelago insight, nautical culture, and character values of Admiral Hang Tuah. This type of research is the development research of the ADDIE model. The results of the discussion, first, the development of the pocket book of the character of Admiral Hang Tuah consists of five stages of development: analysis, design, development, implementation, and evaluation. Second, the feasibility of the media pocket book of character education of the character of Admiral Hang Tuah contains three things: the feasibility of the content of the book, the feasibility of language, and the feasibility of the media. Based on the overall results of the pocket book assessment, material experts, linguists, and media experts obtained a score of 4.4, with a very decent category. Based on the response of students of class VII A Junior High School Hang Tuah 4 Surabaya with a pocket book shows an average score of 4.6, which belongs to the category is very feasible. The conclusion of the development of pocket book media education of the character of the kebaharian Admiral Hang Tuah through five stages and the feasibility of pocket book media are based on the assessment of material experts, linguists, and media experts as well as the student's response to the pocket book of the character of the nautical.Sejarah yang menceritakan terkait bangsa Indonesia telah menjadi bangsa bahari semenjak dahulu, di antaranya diketahui dari sejarah Sriwijaya dan Majapahit serta terkenalnya tokoh Laksamana Hang Tuah. Tujuan dari penulisan artikel ini adalah mengenalkan dan memahami nilai-nilai pendidikan karakter kebaharian Laksamana Hang Tuah Berbasis PPKn. Buku saku merupakan buku yang berukuran kecil, ringan, dan praktis yang berisi suatu informasi (materi) penting serta menarik. Buku saku pendidikan karakter kebaharian memuat banyak hal informasi terkait penguatan pendidikan karakter, wawasan nusantara, budaya bahari, dan nilai-nilai karakter Laksamana Hang Tuah. Jenis penelitian ini adalah penelitian pengembangan model ADDIE. Hasil pembahasan, pertama, pengembangan buku saku karakter kebaharian Laksaman Hang Tuah terdiri dari lima tahap pengembangan yaitu: analisis, perancangan, pengembangan, implementasi, dan evaluasi. Kedua, kelayakan media buku saku pendidikan karakter kebaharian Laksamana Hang Tuah memuat tiga hal yaitu kelayakan isi buku, kelayakan kebahasaan, dan kelayakan media. Berdasarkan hasil keseluruhan penilaian buku saku berdasarkan ahli materi, ahli bahasa, dan ahli media memperoleh skor 4,4 dengan kategori sangat layak. Berdasarkan respon siswa kelas VII A SMP Hang Tuah 4 Surabaya dengan adanya buku saku menunjukkan skor rata-rata sebesar 4,6 yang termasuk kategori sangat layak. Kesimpulan pengembangan media buku saku pendidikan karakter kebaharian Laksamana Hang Tuah melalui lima tahap dan kelayakan media buku saku didasarkan pada penilaian dari ahli materi, ahli bahasa, dan ahli media serta respon siswa terhadap buku saku karakter kebaharian

Abstract

The purpose of this study is to describe the Jetiskidul Village government's strategy in managing water resources for the welfare of the Jetiskidul Village community, to analyze the impact on community welfare after the management of water resources by the Jetiskidul Village government, to analyze the constraints in the management of water resources in Jetiskidul Village, and Analyze solutions to overcome these obstacles. This study uses a qualitative approach and descriptive methodology. Data collection includes observation (direct observation), interviews, and documentation. Informants, events, and documents are all sources of data for this research. By using field note studies, observations, interviews, and documentation, researchers collected data from the field for data analysis, followed by data reduction, data presentation, and drawing conclusions. Based on the findings of this study, the water resources management strategy in Jetiskidul Village has been implemented through drilled wells and the Community-Based Water Supply and Sanitation Program (PAMSIMAS). The effects of the water resources management strategy are meeting daily water needs, business development, improving community hygiene, and increasing village original income. Constraints in the management of water resources in Jetiskidul Village, attitudes and perceptions of the people who were initially opposed to late payment of contributions, and a lack of manpower. The solution to the difficulties faced by the village government in managing water resources in Jetiskidul Village is to consult with the community, approach the community, and provide a monthly billing card. Tujuan dari penelitian ini ialah untuk mendeskripsikan strategi pemerintah Desa Jetiskidul dalam mengelola sumber daya air untuk kesejahteraan masyarakat Desa Jetiskidul, menganalisis dampak terhadap kesejahteraan masyarakat setelah dilakukan pengelolaan sumber daya air oleh pemerintah Desa Jetiskidul, menganalisis kendala dalam pengelolaan sumber daya air di Desa Jetiskidul, serta menganalisis solusi untuk mengatasi kendala tersebut. Penelitian ini menggunakan pendekatan kualitatif dan metodologi deskriptif. Pengumpulan data meliputi observasi (pengamatan langsung), wawancara, dan dokumentasi. Informan, peristiwa, dan dokumen semuanya menjadi sumber data untuk penelitian ini. Dengan menggunakan studi catatan lapangan, observasi, wawancara, dan dokumentasi, peneliti mengumpulkan data dari lapangan untuk analisis data, yang dilanjutkan dengan reduksi data, penyajian data, dan penarikan kesimpulan. Berdasarkan temuan penelitian ini, strategi pengelolaan sumber daya air di Desa Jetiskidul telah dilaksanakan melalui sumur bor dan Program Penyediaan Air Minum dan Sanitasi Berbasis Masyarakat (PAMSIMAS). Efek dari strategi pengelolaan sumber daya air ialah pemenuhan kebutuhan air sehari-hari, pengembangan usaha, peningkatan kebersihan masyarakat, dan peningkatan pendapatan asli desa. Kendala dalam pengelolaan sumber daya air di Desa Jetiskidul, sikap dan persepsi masyarakat yang awalnya menentang keterlambatan pembayaran iuran, dan kurangnya tenaga kerja. Solusi atas kesulitan yang dihadapi pemerintah desa dalam pengelolaan sumber daya air di Desa Jetiskidul ialah dengan melakukan konsultasi dengan masyarakat, melakukan pendekatan kepada masyarakat, dan memberikan kartu tagihan bulanan.

Abstract

AbstractIn this research article, there are two legal issues to be studied, namely: (i) Implication of Constitutional Court Judgment Number: 33 / PUU-XIII / 2015 in order to break the chain of political dynasty in Indonesian; (ii) what legal instrument can be used in breaking the chain of political dynasties after the Judgment of the Constitutional Court Number: 33 / PUU-XIII / 2015. This research is a normative legal research using statute and case approach. The result showed that the Judgment of the Constitutional Court Number 33 / PUU-XIII / 2015, has granted the annulment of the formulation of Article 7 letter r of Law 8/2015 and its explanation. According to the Court, such article is contradictory to the 1945 Indonesian Constitution. Following the decision, efforts to break the chain of political dynasties in Indonesia through legal instruments can no longer be done. The Constitutional Court's ruling is believed to further enrich the emergence of political dynasties in Indonesian. AbstrakPenelitian dalam artikel ini, terdapat dua isu hukum yang akan dikaji yaitu: (i) Implikasi Putusan Mahkamah Konstitusi Nomor: 33/PUU-XIII/2015 dalam rangka memutus mata rantai dinasti politik di Indonesia; (ii) instrument hukum apa yang dapat digunakan dalam memutus mata rantai dinasti politik pasca Putusan Mahkamah Konstitusi Nomor: 33/PUU-XIII/2015. Penelitian ini menggunakan metode penelitian yuridis normatif dengan menggunakan pendekatan peraturan perundang undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa Putusan Mahkamah Konstitusi Nomor: 33/PUU-XIII/2015, telah mengabulkan pembatalan rumusan Pasal 7 huruf r UU 8/2015 dan penjelasannya karena menurut MK bertentangan dengan UUD Negara RI Tahun 1945, terutama Pasal-Pasal yang mengatur tentang Hak Asasi Manusia. Pasca putusan Mahkamah Konstitusi tersebut, tentu upaya memutus mata rantai dinasti politik di Indonesia, melalui instrumen hukum tidak dapat dilakukan lagi. Putusan Mahkamah Konstitusi tersebut diyakini semakin menyuburkan munculnya dinasti politik dalam perpolitikan di Indonesia.

Abstract

The role of civil society power in the history of reform in Indonesia cannot be underestimated because the economic crisis did not solely cause the fall of Suharto's New Order regime. Still, the role of civil society forces was very large and well consolidated. This study used qualitative research. The theory used is the theory of power relations. The results of the study found that in the era of Soeharto's New Order, the relationship between the state and civil society was still not seen to play its role; it can even be said that the existence of civil society was very weak and weakened by the regime, although at the end of the New Order, civil society was well consolidated which eventually gave birth to the reform movement and was able to overthrow Suharto's regime. The results also found that, after the reformation in Indonesia, the civil society movement experienced a golden age at the beginning of the reform because the position of civil society was quite strong and well consolidated in overseeing the course of the democratic system. However, in recent years civil society movements have stagnated and even seem weakened because they are in the circle of power.

Abstract

This study aims to instil the character education of mutual cooperation, which gradually weakens along with the development of technology. This research is expected to develop students’ caring attitudes toward the surrounding environment. As well a balanced increase in knowledge, this means educating students not only intelligently but also of good character. This study uses a qualitative approach with a descriptive type. Data collection techniques using observation, interviews, and recordings. The result of this study indicates that the role civics teachers play an active role in the classroom. How civics teachers at SMAN 01 strengthen mutual cooperation character education by (1) Teaching mutual cooperation education through learning activities such as group assignments, (2) Strengthening character education through daily habits, (3) instilling a caring attitude toward the surrounding environment to students of SMAN 01 Batu. In addition, the SMAN 01 teacher minimizes the problem of mutual cooperation character education is done by fostering understanding and awareness of the quality of position to students, such as community service activities every Friday, division of group tasks, and much more. Learning that puts forward the value of character seeks to add insight or knowledge for students to continue to behave, behave, and act in accordance with the knowledge that has been given. Penelitian ini bertujuan untuk menanamkan pendidikan karakter gotong royong yang lambat laun melemah seiring dengan perkembangan teknologi. Tidak hanya itu, penelitian ini diharapkan dapat mengembangkan sikap peduli siswa terhadap lingkungan sekitar. Serta peningkatan ilmu pengetahuan yang seimbang, ini berarti tidak hanya mendidik siswa yang hanya cerdas tetapi juga berkarakter baik. Penelitian ini menggunakan pendekatan kualitatif dengan tipe deskriptif. Teknik pengumpulan data menggunakan observasi, wawancara, dan dokumentasi. Hasil penelitian ini menunjukkan bahwa peran guru PPKn berperan aktif di dalam kelas. Cara guru PPKn di SMAN 01 dalam penguatan pendidikan karakter gotong royong dengan (1) Mengajarkan pendidikan gotong royong melalui kegiatan pembelajaran seperti pemberian tugas kelompok, (2) Memberikan penguatan pendidikan karakter melalui pembiasaan sehari-hari, (3) Menanamkan sikap peduli terhadap lingkungan sekitar kepada siswa SMAN 01 Batu. Serta, cara guru SMAN 01 dalam meminimalisir permasalahan pendidikan karakter gotong royong, yaitu dilakukan dengan menumbuhkan pemahaman dan kesadaran kesamaan kedudukan kepada siswa, seperti kegiatan kerja bakti setiap hari jumat, pembagian tugas kelompok, dan masih banyak lagi. Pembelajaran yang mengedepankan nilai karakter tersebut berupaya untuk menambahkan wawasan atau pengetahuan siswa untuk tetap bersikap, berperilaku, dan bertindak sesuai dengan ilmu yang telah diberikan.
