Abstract

Abstract: In conducting the state implementation, Indonesia as a state needs regulations in accordance with the national cultural values. The values are mirrored in Pancasilaas the spirit of constitutional laW which is The Constitution 1945. Indonesian governmental system is presidential; the president is the state chief and the governmental chief. The state power is in three powers, that are legislative, executive, andjudicial powers. Those three powers have relations in sharing the powers.This practice is not the same as the original theory of Montesquei about power divisions. In the implementation, The Constitution 1945 has supporting institutions. They are People's Consultative Council, House ofRepresentative, President, Supreme Court, Constitutional Council, Judicial Commission, Financial investigator, Police, and the Army.

Abstract

Abstract: This article at knowing the parties that become the victims of the hot mud overflow, knowing the form and value of the loss, and investigating how far PT Lapindo Brantas and Bakie Group that is presumed as the causes the mud. This reasearch was conducted by qualitative approach. Conclusions is direct victims of the hot mud overflow mainly including most of Porong sub district, Tanggulanginand Jabon. While the indirect victims are all societies that used Gempol-Porong road access. The losses form of material and immaterial, the material losses about Rp ll,l trillion. The hot mud overflow of Sidoarjo has violated human right: wide society right for good and heatthy, environment, right for education, right for employment and good life, and violate property right of Sidoarjo populations. The hot mud overflow of Sidoarjo caused by the Banjarpanji I well drilling that is done by PT Lapindo Brantas.Then PT Lapindo Brantas and the Bakrie Group should responsible for the occurrence.

Abstract

Abstract: Discourse politics in socio-cultural and political analysis often raise debates. The debates come out in terms of the positioning of local culture products when they are communicated with the concepts of statesmanship/nationalism. In this case, it can bring a shift from a local culture concept to the political one. If it happens, the state tendency in controlling local cultures is bigger. It is due to the desire ofthe state/government to get its legitimacy and strengthen its hegemony latently. Theemergence of a local culture group "macapetan" in Trenggalek indicates that there is a practice of hegemony of Orde Baru (social-political order in Indonesia since 1966-1998). Using qualitative reseinch, the hypothesis is proved, beginning fiom the establishment of the mqcqpat clu'b "Pama- Pamf' to the persistence of macapatan cult.)re. Moreover, the materials used in tembang macapqt show the hegemony of Orde Baru.However, the existence of macapatan club in Trenggalek seemsto have positive meanings for the society as the culture agents.

Abstract

Abstract: A border region is a leading point of one country against another country. The border region needs special attention and priority from central as well as local governments as there are considerable issues sunound it. One crucial thing that should be the main focus in the border region is the issue of economic development and local communities' welfare. Data used in this paper is mainly based on the field research in Nunukan District, East Kalimantan Province in 2010. The discussion in this paper is emphasized on the development of local natural resources for achievingeconomic development and the welfare of local people in Nunukan District

Abstract

LawNo.32Year2004 onRegionalGovernment is the elaboration and implementation of the provisions of Article I 8 paragraph (2) of the Constitution of 1945 which determined that the area set up and manage their own affairs in accordance with the principle of autonomy and assistance. This law does not need to be revised. On the other hand, this law has to be maintained in practice because thisactual law has been set up all aspects oflocal governance/decentralization.

Abstract

Women empowerment effort is an integral part of national development. Therefore, women empowerment effort is an on-going attempt in accordance to the dynamics of rapid economic and social culture changes in this modern era. The targets of women empowerment are to develop women’s potentials which enable them to take the benefit of their right and opportunities the same as men do; and to use their right and potentials the same as men do on development resources. In this way, women can develop their own capacity for actulizing their roles as men’s equals partners for family and state development. Abstract

President as the state organizer can establish a state institution which can give the president advice, although the institution is not in the state government. The amendment of Constitution of 1945 has eliminated Supreme Advisory Council, which was the permanent state institution. In the state governance practice there is Presidential Advisory Council. This institution is not set in the Constitution of 1945 (called as non-permanent state institution). The existence of this institutionbecome problematic. It is due to the fact that non-permanent institution is the same as the permanent one.

Abstract

The wealth of natural resources in Indonesia tremendous push legislation makers to formulate and adopt legislation that is expected to give birth to prosperity and justice. This research aims to describe the legal basis for contractual arrangements work as one of the agreements relating to mining activities. Works contracts and agreements set works with: (1) Law No. 4 of 2009, (2) Act No.25 of 2007, and (3) of Government Regulation No. 23 of 2010, (4) the Minister of Energy and Mineral Resources No. 1614 of 2004. The procedure for application for a permit contract of work can be done through three pathways based plan which will be the location of the area of ??mining. First, through the Governor-General if the area to be mined are in the two regions of the province. Secondly, through the Governor if the area to be mined are at two district / city different. Asses, a through Regent / Mayor if the area to be mined are at the district / city. In any licensing always involve the President, the Parliament, the Minister of Energy and Mineral Resources, BKPM, Director- General, Governor, Regent / Mayor, the bank and the Applicant.

Abstract

Abstrak: this research was conducted with the aim to describe: (1) the stages of moral development of students grade students Pesantren Mahasiswa Al-Hikam Malang, (2) the analysis of the stages of moral development of santri mahasiswa Pesantren Mahasiswa Al-Hikam Malang.In this descriptive study, researchers sought to describe how the results of the stages of moral development santri mahasiswa of class IV. Through this type of research data that has been collected in the form of the results of the questionnaire moral dilemmas (DIT) Jamest Rest systematically arranged, accurate and factual.Research findings indicate that (1) the highest level of students are students in Law And Order level of 62.5%, (2) as much as 22.2% in stage Nice Girl and Good Boy, (3) the third largest stages are stages Social Contract which amounted to 12.5%, (4) Stages of Jamest Rest which serves as an internal check that Meaningless much as 2.5%.Keywords: stages of moral development, santri mahasiswa, Lawrence Kohlberg.

Abstract

Abstrac : In order to implement regional autonomy based on Law No. 22 of 1999, that the granting of autonomy to the local city / county is based on the principle of decentralization in the form of autonomy, real, and responsible. Granting authority on the basis of the principle of decentralization, causing all fields are left to local governments in the implementation of an autonomous basically become the authority and responsibility of local city and county governments fully, both concerning the determination of policy, planning, implementation, monitoring, control, and evaluation. This study aimed to describe the factors that affect the implementation of regional autonomy and decen-tralization in the provision of recommendations for the implementation of decentralization in au-tonomy. The results showed that there are four variables that can explain the performance of the implementation of decentralization in the regional autonomy in the city / county, namely managerial aspects, aspects of Human Resources organization, aspects of bureaucratic culture, and ethics of public service.Keyword: decentralization, regional autonomy
