Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

The Draft Law on Gender Equality is present in the community through a variety of responses. Response to the RUU-KKG more colored by a misunderstanding. While poisitif response against based on the fact that the RUU-KKG largely do not conflict with religious teachings in Islam. Among the positive response was given by Muhammadiyah as described in this article. The focus of this article is to study RUU-KKG readings on various laws and Tajdid Muhammadiyah the Legal Affairs Committee. Muhammadiyah insights about women's leadership alignments on gender equality. Alignments were seen in the decision, as well as the fatwa discourse proposes that provides an opportunity for women to show up as a leader in various levels in the public space. In fact, of the time of its emergence, the study of the Legal Affairs Committee of the law of women in politics and became a judge can be regarded as a pioneer in its field.

Abstract

In the substantive understanding of religion, there is no differentiation between man and woman. The Al-Quran enshrines the principles of justice, equality, democracy and muasyarahbilma’ruf(humanizing actions). This manner of interpretation must become the basis in understanding the connection between religious teachings and the Draft Law on Gender Equality. To see Islam in a theological light, indeed there are several religious texts which directly differentiate man and woman, but what we must realize is that the Quran which was bestowed upon the Prophet not only contained provisions on how to life one’s life, but also the method to organize life itself. Understanding Islam depends greatly on our manner of interpretation. If a patriarchal reading of Islam were to be fostered, then the result will be rejection of the draft law on the pretenses of religious desecration. However, if we were to understand religion on the basis of equality, then a solution to the existing problem will surely be found.

Abstract

The drafting of the Draft Law on Gender Equality has brought criticism, many  of which based on reactionary-ideological grounds unsuitable to productive discussion, and it is indeed regrettable that such responses against the draft law were not made in an academic framework and in accordance with the principle of proportionality. In a democratic state, gender equality is a fundamental part rooted deeply in human rights, similar to racial, ethnic, class, special-needs and religious equality. Thus as a democratic nation state, Indonesia is obliged to fulfill the basic rights of each of its citizens without regard to origin or gender. Such rights encompass a variety of aspects: the right to life, security, health, education, economic, political and socio-cultural rights. All basic rights must be fulfilled equally to avoid discrimination. Thus, normatively, the 1945 Constitution of the Republic of Indonesia has guaranteed equality of all citizens, whether male or female.  In a global context, Indonesia has also ratified the CEDAW (Convention on the Elimination of all forms of Discrimination Against Women) through Law No. 7 of 1984. Indonesia’s commitment to improve gender equality is also written down in the MDGs (Millennium Development Goals). Therefore, through a philosophical-juridical-sociological viewpoint, gender equality (enshrined in law) is both a constitutional mandate and a contemporary demand

Abstract

This article discusses of KKG in theological perspective al-din al-Qayyim in alQuran. In this case, this perspective is something new developed. The old conception that developed in the community is always viewed from the perspective of law or jurisprudence. Theological concept that carried the authors in this case done in depth through the verses found in the Qur'an in the context of al-din al-Qayyim. Jurisprudence approach commonly used for this are not able to address the true essence of the problem. Such an approach makes fiqh not able to uncover the goals and ideals of the Qur'an in realizing real goodness in all areas of life, including the nine areas set out in the Bill. Through theological approach al-din al-Qayyim can manifest a new enlightenment.

Abstract

The Draft Law on Gender Equality is an early draft at the socialization stage, still to receive inputs from the society. However, there have been many negative responses and many Islamic groups reject it wholesale. Their argument interalia, is that the draft law is secular in nature and is thus contradictory to fundamentalist Islamic teachings and law. This article will attempt to discuss and position the draft law within the ambit of Islamic law. The general conclusion is that while most of the ideas contained within the draft law is much in line with the principles of Islamic law, several articles which conflict with Islamic law need to be revised and changed. The shortcomings and errors within the draft law are indeed in need of criticism, but it should not be a reason to reject the entire draft law

Abstract

Maqashid Asy-Syari’ah is an extraordinary method to view and develop Islamic ideas and spirit in many circumstances. It is often used as an analytical knife to solve problems and the application of Islamic law. This Article will attempt to read and analyze the Draft Law on Gender Equality through this method. The existence of this yet unsanctioned law has raised controversy. But such controversies should instead be used as materials to revise and perfect the draft law instead of a reason to reject it outright. The result of the analysis of the draft law shows that it generally contains the values of Islamic law. However, it is undeniable that there are several mistakes and errors which must be discussed to be perfected. The decision  whether to issue the law should depend on a costbenefit analysis.

Abstract

Gender equality is a great desire of the world community. Measure of a country's development is the existence of gender justice. This principle is a process that ensures a balance between men and women in access and opportunities, participation in decision-making and control of development benefits. The existence of strong current in the international world coupled with the lack of readiness of the people of Indonesia, where the response is sluggish as evidenced by the birth of KKG bill was cause polemics. There is not a society that can spontaneously accept those values but are not always opposed to these values permanently.
