All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

Nowadays the meaning of the jilbab has shifted and become somewhat misinterpreted. Understandings of the  purpose of the jilbab began with Tauhid, the principle teaching of Islam. The Tauhid teaches the true meaning of devotion to God or godliness, and also the true meaning of how to be human. The Tauhid teachings bring about recognition of sameness before God, and the obligation to respect other people without discrimination based on differences in sex, gender, ethnicity or religion. In Indonesia, the jilbab is not only worn as a form of identity but as a fashion accessory. It is not clear whether the use of the terms jilbab or hijab are to be interpreted as head coverings to the chest for women or not. For this reason, there is a need for a comprehensive understanding of the terms to be taken from a holy book, in this case the Al’Qur’an and hadis, so that there is no longer a distortion in meaning. A full understanding of the verses and hadis in relation to the jilbab and the hijab is not limited to symbolic use. Whether of not the use of the veil is merely symbolic, it must be considered in the current context of the rise of capitalist religiosity.

Abstract

This article will discuss the thoughts of Muhammad Syahrur  on the hijab. For Muhammad Syahrur, the  veil is a matter of shame and embarrassment in custom, not a question of halal and haram. In his view, women should dress in accordance with the conditions, situations and local customs, so heavoided considering interference from either natural or social factors. This view is certainly different from that of the majority of commentators (mufassir) who think the veil is part of God’s commands associated with the issues of halal and haram. This study offers the thought of Muhammad Syahrur as an alternative in relation to the concept of the veil in the context of Indonesian society.

Abstract

The problem of the veil remains a controversial issue that requires ongoing debate. This is inevitable because  the use or wearing of a veil is closely associated with culture. In terms of etymology, the term hijab was not known in Indonesia until the coming of Islam. In the history of Indonesia, females are more familiar with the term kerudung than jilbab (both meaning veil). In the contemporary era, however, the term jilbab is arguably also marginalized by the term hijab. This word shift must have been influenced by the local culture. If the term can shift, so too can the meaning of its functions and benefits. Through this article, the author tries to read the veil from its shifting meanings and functions. For Roland Barthes the shift in meaning is called myth. It is very interesting to present the veil from the perspective of mythology, so that at a glance we can see the shift in the meaning of the veil in the Muslim community, ranging from a status symbol from the pre-Islamic era to the time of the Prophet, and now to a symbol of piety and  lifestyle.

Abstract

Discussion of the jilbab is truly very interesting. In several past studies, the concept of wearing the jilbab has  been seen as very controversial. There have been several contemporary Islamic scholars (ulama) with interesting perspectives on the jilbab. One of these Indonesian scholars is the Islamic interpretor (Mufassir) M. Quraish Shihab, who has written a book on the jilbab. Although the jilbab is not the area of concern of the author, using prior knowledge I will look at M. Quraish’s rationale in making the controversial decision to write on the jilbab and also at his research methodology. It is his research methodology on law-making that the author particularly focuses on in this paper.

Abstract

Abstract

Wearing the veil relates very much to hermeneutical reception to the Qur’an, though the development and  variety of designs are in accordance with socio-cultural as well as political circumstances. This article discusses the existence of veil in West Sumatera, among the Minangkabau people after Paderi period. Applying a social-history approach with a descriptive-analitical method, this research ends with some interesting findings. In the past in West Sumatera, a specific veil called a mudawarah or lilik became popular as an effect of the reformation of Islamic Education there. The political policies of the New Order period, as well as during the reformation years of increased capitalism, the veil developed a new shape and the wearing of the mudawarah was slowly marginalized. This phenomena shows that although the aesthetic shape of the veil comes from initial text, its development shows such a creative interpretation of the text

Abstract

The case of the veiling of policewomen shook the country last year. Former President Susilo Bambang Yudoyono was  asked to take part in deciding whether policewoman should be allowed to wear the veil when on duty. Kapolri (Chief of Police in Indonesia) made the decision “to allow” policewomen to wear the veil but then revoked the decision after a few days. Of course, there was strong argument. On the one hand, the veil is an obligation  for Islamic policewoman, and it is also a basic right to use the veil or not. However, the problem arises when basic rights are not accommodated by Kapolri.  Mashood A. Baderin offers the doctrine of a ‘margin of appreciation’ in relation to the case of policewomen and the veil in Indonesia. Baderin emphasizes legal dialogue between Islamic law and International Law on Human Rights so that this dialogue between citizens, policewomen and Kapolri can lead from parochialism, violence, and rivalry towards the integrity of law in Indonesia.
