Abstract

Employment agreement between employer party and employee party is made by using fixed agreement, so within the process of making agreement is not through pre-contract steps as it is normally initiated with negotiation process between employee party and employer party and also this agreement is made under hand. Although employment agreement is made in term of fixed agreement and under hand, but this agreement keeps on the effort to refer to regulation listed in Article 1320 Civil Act and Article 52 point 1 of Indonesian Republic Regulation no. 13 of 2003 as it is the legal main condition for an agreement and also as the basic law of employment agreement.The legal consequence of employment agreement which is made between employer party and employee party that the sanction assigned to employees who violate the regulation agreed in this employment agreement, namely: If employer or employee terminate employment agreement within certain period prior ended, so the party who terminates this employment agreement must pay compensation to other party at the rest salary of the worker until the period or the worker should finish his contract period, except termination of employment agreement die to serous force/fault from employee. Any dispute taken place as consequence of this employment agreement should be settled by both parties through Registration Office of District Court Denpasar.

Abstract

Passenger accident insurance coverage is a mandatory social insurancecompulsory for all passengers who use public vehicles by PT. Jasa Raharja(Persero). This journal using empirical methods in order to know what legalaction can be done in case of denial of victim compensation funds by PT. JasaRaharja (Persero). Abstract

Lembaga Perkreditan Desa (LPD) merupakan salah satu lembaga keuangan desa, berfungsi untuk menghimpun dana dalam bentuk tabungan dan deposito dari krama desa, dan memberikan kredit hanya kepada krama desa. Pemberian kredit dengan jaminan fidusia kepada krama desa oleh LPD di Desa Pekraman Bedha Kabupaten Tabanan. Tulisan ini bertujuan untuk mengetahui alasan-alasan yang menjadi dasar pertimbangan dan pelaksanaan LPDDesa Pekraman Bedha memberikan kredit dengan jaminan fidusia serta untuk mengetahui cara penyelesaian yang dilakukan terhadap krama desa sebagai debitur melakukan wanprestasi.Dalam penulisan ini pendekatan masalah yang dipergunakan adalah pendekatan secara yuridis empiris, yaitu penelitian yang menitikberatkan pada fakta dilapangan dan diperkuat dengan penelitan kepustakaan. Kata Kunci : Kredit, JaminanFidusia, Lembaga Perkeditan Desa, Desa Pekraman Bedha

Abstract

Indonesia’s Bank duty as the central bank is regulated in Law number 10 year 1998 about Banking. Indonesia’s Bank responsibility in the process of liquidation is to build and monitor the banking business in Indonesia. The research method used in this writing is normative and the problem approach applied is state approach, namely by investigating and analyzing the prevailing policies or regulations. Indonesia’s Bank responsibility is to save the banks when they are in critical conditions. While Indonesia’s Bank authorities are clearly regulated in the Law number 10 year 1998 about Banking, in article 37 paragraph ( 2) b.

Abstract

Mutual fund is a place for lenders/investors to investment their funds intoportfolio by Investment Manager, in other words, the Investment Manager has animportant role in managing investors funds. Especially the funds which ismanaged by Investment Manager is huge, but the rules about it deemedinadequate caused the Investment Manager often did mistakes by ignoringInvestors right which is makes the investors loss and unprotected. The issues thatwill be discussed, how is the legal protection that given to mutual fund investorsand the responsibility of manager investment who did default to their investors.The legal research that used is empirical legal research by some interview. Fromit, shown the protection that given to investors is about openness ManagerInvestment information which is responsibility as any loss that investors get butno more than the fee that given by investors to the Manager investment.

Abstract

Along with the rapid development of world trade, incuding Indonesia, the particulary demanding employers to use a practical means of payment. Especially in busy entrepreneurs who often travel abroad and require tools that are practical and flexible payments that can provide ease, smoothness and comfort of the parties involved in a transaction. Public demands are answered by the bank to issue credit card as a substitute for cash payment. But in practice often found problems related to non performance in accordance with performance agreements have been agreed. It is then in practice lead to disputes between the parties.

Abstract

This writing shall be entitled as “Flight Aviation Liabilities towards Lost and Damaged Passengers’ Luggages “. This writing shall apply the normative analysis method combined with statutory approach. Indonesia as one of the country whose aviation business had emerged fast recently, indicated through the increasing quantity of airline services. Contrastingly, such phenomenon had been inflicted by the lack of response and seriousness of numerous aviation services in terms of claim during the lost or damaged luggages of passengers’ occured. Consequently, this condition had entered the court without any notification or understanding of the passenger concering the claim of luggage mechanism which is considered complicated and imbalance amount of compensation.

Abstract

Di Kota Denpasar masih sering terjadi masalah-masalah yang terkait dengan ketenagakerjaan khususnya di minimarket. Fenomena yang terlihat terkait dengan permasalahan ketenagakerjaan di minimarket ini, antara lain; jumlah tenaga kerja yang terus meningkat setiap tahunnya, masih banyaknya perusahaan-perusahaan dalam menggunakan tenaga kerja di minimarket tidak sesuai dengan peraturan perundang-undangan, masih banyaknya pekerja minimarket wanita yang dipekerjakan di malam hari, masih banyaknya hak-hak dari tenaga kerja yang tidak diberikan seperti hak mendaptkan perlidungan hukum ketika mengalami kecelakaan kerja, serta masih banyaknya terdengar terjadinya kasus-kasus kecelakaan kerja yang mengakibatkan cacat fisik, mental hingga meninggal dunia.Dalam tulisan ini penulis ingin mengetahui bagaimana perlindungan pemerintah terhadap tenaga kerja di minimarket.Pemerintah telah mengeluarkan Undang-Undang Republik Indonesia Nomor 13 Tahun 2003 tentang Ketenagakerjaan, yang didalamnya secara jelas dan tegas telah melindungi hak-hak dari tenaga kerja. Pemerintah Kota Denpasar juga telah berperan terhadap perlindungan tenaga kerjamelalui pengawasan terhadap perusahaan-perusahaan, dan memberikan sanksi terhadap perusahaan yang tidak melaksanakan Undang-Undang Ketenagakerjaan ini dalam menggunakan tenaga kerja di perusahaannya. Adapun kesimpulan dari tulisan ini adalah bentuk perlindungan tenaga kerja yang diberikan oleh perusahaan secara preventif dan juga represif, serta jaminan kecelakaan kerja diluar dari Jaminan Kecelakaan Kerja Badan Penyelenggara Jaminan Sosial. Kata Kunci : Perlindungan Hukum, Kecelakaan Kerja, Minimarket.

Abstract

Through Regulation Number 7, Year 1994, Indonesia has ratified WTO Agreement. GATS is part of WTO Agreement and is located in Annex IB of the Agreement. GATS-WTO that is multilateral ties binds Indonesia. The Agreement of GATS-WTO has implication of law in which Indonesia must adapt all rules in tourism towards rules and principles of GATS-WTO. Indonesia must also announce regulations made by the Government having effects in the performance of GATS.
