Abstract

Honorary Council Election (DKPP) is considered very progressive because in less than two years from its inauguration, it has solved around 127 cases. However, there are several decisions made by DKPP which are controversial because they make decisions and give sanctions to not only violations of ethical codes,  but also administrative sectors and conflicts related to general elections. The problems of this research are: first, what are the limits of DKPP’s authority in investigating and making decisions on ethical code violation during general election? Second, how is the relationship pattern among KPU (Election Supervisory Committee), Bawaslu (Election Watchdog), and DKPP which is based on electoral integrity in conducting general election? This research employed statute and conceptual approach as well as qualitative analysis. The findings show that: first, the limits of DKPP’s authority have been governed in the Constitution of Elections. DKPP only has authority to investigate and make decisions on the notions of ethical code violations which are done by election committee. Second, the pattern of the relationship among election committees in Indonesia has actually adopted the electoral integrity principles, but it will be better if DKPP, in doing its duties, does not overlap with the authority of other agencies or institutions so that they can work professionally.

Abstract

The verdict of the Constitutional  Court, as the nature of a court decision, implies the rights that the justice seekers enjoy. It is unfortunate however, the appeal procedure for those who are not satisfied with such verdict is not issued yet, and this may produce the disadvantages  for the purpose of affording justice. For such reason,  the amendment on the Constitutional  Court procedures, particularly in appeal procedures, is highly demanded.

Abstract

This research discusses the problem of legal certainty in economic globalization and tax court as legal enforcement instrument and tax dispute settlement through tax court. This research uses qualitative research method which secondary data is legal source. Using this method, this research found: First, tax court might be an important instrument in the effort of creating legal certainty; Second, tax court is a court under Supreme Court which exercise court (kehakiman) power in the matter of taxation; Third, tax dispute is a dispute in the matter of taxation between subject of tax (wajib pajak) and government official which has authority in taxation.Key word : Tax court, legal certainty, economic globalization

Abstract

Mata Kucing resin (Shorea Javanica) is the main commodity of Pesisir Barat Regency which is wellknown worldwide and is one of the best resin types in the world. Mata Kucing resin has the potential to be a Geographical Indication, but it has not yet been registered to the Directorate General of Intellectual Property Rights. This research discusses the obstacles why Mata Kucing resin (shorea javanica) has not been registered as a Geographical Indication and the efforts of the government of Pesisir Barat Regency to preserve Mata Kucing resin (shorea javanica) as a way of preserving its forest area. This research employed normative-empirical approach (applied law research). The conclusion based on the research finding is that neither the citizens nor government of Pesisir Barat Regency have fully understood the benefits of registering Geographical Indication so that they have not prepared any requirements to register Mata Kucing resin. The effort to preserve resin is through limiting the cutting of Mata Kucing resin trees in Lampung Province as stated in the decree of Forestry Minister Number S.459/Menhut-VI/2010.

Abstract

This research focuses on corporate criminal liability for gross violation of human rights. Based on normative legal research, this research reveals; first, extending criminal responsibility beyond individual to corporation for gross violation of human rights is required because national states are sometimes unwilling or powerless to properly sanction corporations for fear of negative economic consequences. Corporation also results serious or systematic human rights violations and encourages criminal conduct by maintaining a corporate culture that condones or even rewards violations of the law; second, Canada and Australia have opened a prosecutorial window by suing Unocal and Anvil Mining Limited as the perpetrator of crime against humanity; last, In Indonesia prosecuting corporation for human right violations will resulted into reformulation of criminal conduct of abetting, limitation of corporate responsibility and punishment and treatment.Key words : Corporation, criminal responsibility, gross violation of human rights

Abstract

The research studies and analyzes the settlement of the indemnification to passengers due to flight accident. The scope of the research involves the obligation of the airlines company, aircraft producer, and insurance company in settling the indemnification to passengers who die, are injured, or disabled due to flight accident in Indonesia using liability theory. This research uses normative law method with qualitative approach which is explanatory and evaluative in form to find the solution to a problem by applying descriptive analysis. The result of the research concludes that, first, the indemnification to the passengers who die, are injured, or disabled due to flight accident is based on the principles of absolute liability. Second, the indemnification from insurance company to the passengers as the first party insurance is paid as the amount of the indemnification incurred as stated in the insurance agreement, based on the premium paid.

Abstract

This research discusses the problems as follows: First, what main principles acting as the legal source of sharia contract law are; and, second, what the philosophical basis of the prohibition of taking interest in sharia contract law is. The method used in this research is normative juridical. The legal materials used are primary and secondary materials. The method of the research is philosophical approach. This research concludes that first, religious practice principle/basis acts as the main foundation of the legal source of the sharia contract law, and other principles act as the supporting factors to complete it. The principles of goodness and justice have ultimate position as the elaboration of religious practice principle since the values of goodness and justice are the soul and objective in all contracts made by the related parties; second, the philosophical basis of the prohibition of taking interest is subject directly to Al Qur’an. The prohibition of taking interest in sharia contract is the manifestation of the equality between the capital owners, and the consequence to take the risks and results courageously and responsibly. The prohibition agrees with the principles of goodness and justice, where there is no action of taking side at one of the related parties that are involved in a contract which means that both parties are in the equal position.

Abstract

Can international law be enforced? This begs a question, thus problem, in the theory of law: whether there can be enforcement of law in absence of sovereign authority, as is the case of International law. International law has become its own legal order with its own unique way of operating. This writing is a normative research on the sources and reality of the actors of international law. It is found that international law is enforceable and that there are two ways that international law can be enforced, i.e. enforcement by “authorities” formed by treaty regimes, and by non-authorities (including enforcement individual states and by the international community). It is also found that these enforcement means have their weaknesses.
