It is widely understood that Islamic court in Indonesia is not an independent body of court of justice or judiciary system. This is caused mainly by  the lack of legal support. So, it may be concluded that the dependency of religious court in Indonesia is as a sensible consequence of the flaws in the existing legal framework

Abstract

The state and district financial management is an important part in the governmental arrangement in Indonesia. To decide the problem of state and district financial status, it should be placed in the context of constitutional and governmental system which is followed in Indonesia. The problem that would like to be investigated is how is the relation between the central government and district government in the frame of state and district financial management. This research used the investigation of normative law. The approach method used was jurisdiction. The data compiling is conducted through literacy study. In this research, the compiled material would be qualitatively analyzed. The result of this research has concluded that the basic law in applied the state and district financial management is different. However, both are still in an inseparable relation since both are conducted in the frame of Negara Kesatuan Republik Indonesia (United nation of Indonesia Republic).Key words : State finance, district finance

Abstract

This study is focused on the aspect of law enforcement, especially on tax law. The study additionally examines the process of tax laws enforcement that tends to emphasize on the criminal law rather than on administrative one. This research was conducted by using a normative juridical method focused on primary and secondary materials.The result of the research shows that merely emphasizing the criminal aspects of tax law enforcement will only jeopardizes the primary goal of tax administration in collecting tax revenue that is highly needed for public needs such as building schools, bridges, hospitals, fuel subsidies, and so on. Conversely, using an administrative approach will maximize tax revenue because it will make taxpayers and tax officers feel safe every time they face a tax dispute.

Abstract

Islamic tenets, especially Al-Qur’an and al-Sunnah, govern various aspects, including the human basic obligations and human rights. Thus, these rights and obligations perform as a part and parcel of Islamic tenets which are harmoniously relate each and others, as has been clearly apparent from the practice during Medina period by the Prophet PBUH. Whereas fiqh,which is considered as  a derivation of those two basic sources, opens for differences due to the time and place differences.

Abstract

This research discusses: First, the practices of states in marine natural resources utilization by foreign countries. Second, regulation model of marine natural resources utilization by foreign countries to be able to give contribution for fishery industry in Indonesia. The method used in this research was normative juridical, The conclusions are first¸ the practices of coastal states in marine natural resources utilization by foreign countries have complied with the international sea law provisions considering some aspects, namely conservation, economic, and culture. Second, regulation and implementation models of natural resources implementation in Indonesia fishing area that can develop fishery industry in Indonesia are through an integrated fishing company by the establishment of a joint-venture company. Abstract

The A Limited Liability Company has a company organ which runs the company functions, and the activities of the staff of the organ are not for the interest of themselves but for, on behalf of, and as a form of responsibility of the company as a legal entity. The problems discussed here are: First, is the legal action of the board of commissioners of PT. JOBS DB to temporarily suspend the board of directors of PT. JOBS DB categorized as illegal? Second, what are the legal effects of the action of the board of commissioners of PT. JOBS DB to temporarily suspend the board of directors of PT. JOBS DB which is categorized as illegal? This research aims to find out if the legal action of the board of commissioners of PT. JOBS DB to temporarily suspend the board of directors of PT. JOBS DB is categorized as illegal and the legal effects of the action of the board of commissioners of PT. JOBS DB to temporarily suspend the board of directors of PT. JOBS DB which is categorized as illegal. This research is a normative legal study using qualitative analysis. This research concludes that Sung Samuel Ham Wing as the commissioner of PT. JOBS DB and PT. JOBS DB have violated the provisions regulating the procedures of the termination of the member of the board of directors in both the Laws of Limited Liability Company and the Articles of Establishment of the company, and they have performed the illegal action in accordance to the Article 1365 of Civil Law Code. Therefore, the action of the termination is illegitimate and must never be considered exist.

Abstract

The change of Corporate Social Responsibility (CSR) to be a legal obligation has made CSR become formality to fulfill certain obligations. The drafting process of the Constitution of Limited Company (UU PT), especially related to CSR regulations, has not fully reflected the characteristics of laws which are responsive in the middle of democratic political configuration. Therefore, this research focuses on discussing how the legal politics in the amendment of Consitution No 40 Year 2007 regarding Limited Company especially related to Article 74 which is about Corporate Social Responsibility and its explanations are. This was a normative legal research which was analyzed by using qualitative analysis. The findings show that the drafting process of UU PT has not fully reflected the characterstics of laws which are responsive in the middle of democratic political configuration. CSR regulations in UU PT, practically becoming the characteristics of Indonesian corporation laws, overlap with other existing laws.

Abstract

This article aimed to study The Failure of Implementation of Good Corporate Governance (GCG) on Public Companies in Indonesia. Implementation GCG, specifically in public companies, is very important because it could enhanced corporate profit and shareholder gain in long term By using normative legal methods, this article demonstrated: First; GCG is a concept emphasizing the importance of the user right of financial statement to get the information accurately and timely; and the company management liability to provide the information accurately and perform the company fundamental value. Second; implementation GCG failed in Indonesia. It just because many public companies still hesitated to fully implement GCG. Third, Indonesia does not need more law. What is needed is a changed legal culture that will put to work these laws and institutions as they are designed to be used and commitment in every aspect of professional life to implement GCG.
