Abstract

This paper aims firstly, to identify the background of how the Vrijwillige Onderwepping and Toepasselijk Verklaring policies are made. Second, to explore the influence of the policies of Vrijwillige Onderwepping and Toepasselijk Verklaring in realizing legal unification in the Dutch East Indies. The method used is normative juridical with statutory and historical approaches. At the end this paper concludes that, First, the vrijwillige onderwepping and toepasselijk verklaring policies were made to bridge two different perspectives even though the ultimate goal is unification. Second, this policy greatly influenced the submission of the natives to European law although complete unification was never achieved due to the arrival of the Japan in 1942.

Protection of normative rights of the workers in Indonesia still weakness and necessary improve by government or labour organization. They treated dishonour by employer in work relationship on production process. Tripartite relationship is not running well too due government always to employers side than workers. Its impact, conflict between employer and workers can not to avoid. Harmonization and normative rights protection for workers.

Abstract

The legally binding of a collateral contract on the Al Qardh Al Hasan on The MandiriSyariah Bank in Yogyakarta indicates that the rules of Syariah does not regulate what kinds of collateral contracts. The procedure of collateral contract must be based on the rules of conventional law applied as apublic regulation which legally binding to all Syariah Bank in Indonesia.

Abstract

The regulation of the obligation to implement patents by patent holders to create products or use of the processes in Indonesia is still relatively problematic. For example, the Regulation of the Ministry of Law and Human Rights No. 15 of 2018 concerning the Use of Patents by Patent Holders (Permenkumham No. 15 of 2018), actually negates Article 20 of Law No.13 of 2016 concerning Patents (2016 Patent Law). This study examines and evaluates the issue of regulating the obligations of patent holders to create products or the use of processes in Indonesia. This research uses the normative juridical method by using secondary data. The results of the study concluded that the 2016 Patent Law and Permenkumham No. 15 of 2018 as a basis for its implementation is still relatively short and has several weaknesses. Such as the unclarity of when the patent starts, the scope and type of patents that must be implemented, the implementation delay is not accompanied by criteria (reasons) whether or not a delay can be made, the time limit for submitting the application for a delay that does not pay attention to the duration of patent protection, the absence of anticipatory provisions to overcome the conditions of delay request rejection from the Ministry, as well as arrangements for the extension of the delay that is not paired with a deadline and criteria for the extention allowance.

Abstract

An agression used by USA and its allies to Irak is apparanthy not legal for the absence strong legal arguments. The inclusion ofthe use ofthe UN Resolution No. 627 and 1441, the pre-emptive strike and anticipatory self-defence are obviously contravene againts the international obligations and the general principle of international accepted by civilizednations. As a result ofthe invalidity ofwar, the USA andits allies cannot escape from legal responsibility. Not only because its military aggression was not permitted by the Security Council, butalso because the role ofmilitar troops did hotcomply the demand ofthe 1948 Geneva Convention. Thousand civilians of Iraq aiid'public facilities were ruined toprove in significant that USA should take responsibility both collectively or individually, especially in treating bodly prisoners in Guantanamo andAbu Ghraib.

Abstract

This study examines: first the authority of VAT on Religion Affair Office (KUA) in Sub district of Bogor City Region in creating an orderly administration of registering the underage marriages, and secondly the assessment of the relevance of underage marriage with the high divorce rates in Bogor City Region.This is an empirical juridical research. From the results of this research, it can be concluded that, first, the  VAT  Institution  in  Bogor  City  has  made  some  maximum  efforts  to  create  the  orderly  marital administration as mandated by law. It is also reaffirmed by the Circular of the Ministry of Religion of RI regarding  the  implementation  of  the  Marriage  Administration  System  (SIMKAH),  which  increasingly narrows  the  space  for  people  to  do  an  underage  marriage.  Second,  the  prevalence  of  underage marriage has the relevance to the high divorce rate also dominated by couples aged 21-30 years. It is because even if the marriage is 'not registered', due to being underage according to the law, it still has an  opportunity  to  obtain  legality  through  legal  action  to  submit  a  marriage  permit  application  in  the Religious  Court.  In  addition,  emotional  immaturity and  household  unpreparedness  are  the  factors  of high divorce among young couples undergoing an underage marriage.

Abstract

The reciprocity principle is the main principle in the integration of banking service in the ASEAN region, where it is scheduled to take place in 2020. The banking industry is complex and strictly regulated, therefore, research on the meaning of reciprocity in the ASEAN Banking Integration Framework (ABIF) becomes an interesting and relevant study. The problems examined in this study include: first, how are the meaning and the legal binding power of the reciprocity principle based on ABIF? Second, how is the Indonesian Government's effort to implement the reciprocity principle based on ABIF? This research was conducted by using normative method. The results of the study concluded that, first, the reciprocity principle based on ABIF is a basic principle of reciprocal treatment between member countries aimed at realizing ease of access and banking operational flexibility. This principle does not apply automatically and without conditions, but is based on the commitment and readiness of each country. Second, the Indonesian Government's efforts to implement the reciprocity principle have been carried out through the issuance of Law Number 4 of 2018 on the Ratification of the Protocol to Implement the Sixth Commitment Package in Financial Services in the ASEAN Framework in Services.

Abstract

This research includes first, to study juridical understanding related to the concept of "three-dimensional form" found in industrial brand and design; second, to analyze whether the three-dimensional form in the industrial  brand  and  design  overlapped;  and  third, to  provide  prescription  for  the  three-dimensional overlapping arrangement. This research is a normative legal research using a legislative approach, a case approach, and a conceptual approach. From the results of this research, it can be concluded that the first, three-dimensional  form  is  potential  to  get  protection  in  two  different  IPR  regimes,  namely  brand  and industrial design. Second, these conditions then lead to overlapping arrangements in the brand regime and industrial design regime. Although both brand and industrial design protect the three-dimensional form, the object of protection is different. This is due to the basis of the protection of each regime (the brand emphasizes differentiation, while industrial design emphasizes the new aesthetic impression). Third, the condition is given a suggestion to provide a boundary between the three-dimensional brand and industrial design, as seen from several aspects: general forms, forms that should not be listed, public perception, distinctiveness due to use and expansion of the rejection space for the signs to be made as a brand.
