Abstract

This article focuses on the study of Flight Information Region (FIR) management in the Riau and Natuna Islands, which since 1946 is still controlled by Singapore. Although various attempts to take over the control have been carried out by the Indonesian government, it is yet  to produce any meaningful results. The limitation of the problem in this study is first, the implications that arise from the management of FIR by Singapore on the Riau Islands and Natuna airspace. Second, the efforts that have been made by the Indonesian government to take over the management of FIR by Singapore over the Riau Islands and Natuna airspace. This research uses a normative legal research by analysing the legal issues through international treaties, legal regulations and other literature related to FIR management. The results of the study concluded first, the management of FIR by Singapore over the Riau Islands and Natuna influenced the enforcement of Indonesia's airspace sovereignty and national defence. Secondly, Indonesia's efforts and readiness to take over aviation navigation services include the formation of a special team from several ministries and other relevant institutions to prepare technical and operational steps as well as diplomatic steps in the framework of restructuring the FIR.

Abstract

This research is motivated by the conceptual conflict between civil inheritance law and company law in the form of commercial partnership (CV). The problems to be examined are first, the concept of legal protection of the rights of the heir to the complementary partner on the inheritance which has become a collateral for the debt of the CV, and second, the formulation of the concept of legal protection given to creditors of the CV for the death of the complementary partner whose heir is not willing to take responsibility for replacing their predecessor. The method used in this research is normative legal study by collecting library data. The results of this study concluded that first, the new complementary partner must be responsible for the debt of CV. Therefore, the new complementary partner must return the inheritance guarantee to the heir. Second, concurrent creditors must have a copy of the deed of CV to examine who is responsible if undesirable things happen in the CV, as a form of legal protection for themselves.

Abstract

Legal language can be utilised as a means to manipulate interests. A specific approach is needed to identify the potential distortion behind the text of positive legal norms. This study applies a legal semiotics approach. Through the semiotic square model, the potential for distortion at the conceptual level can be brought up to the surface. The result of the interpretation shows that Article 35 paragraph (1) letter c of Law Number 2 of 2011 on Political Parties has the potential to be a means for corporations to infiltrate their interests. The opposing conceptual relations of meanings that can come up include: the corporate contributions to political parties which can be used as a means to influence the economic policies that would only favour the corporations; demanding the regulations that only protect, facilitate and benefit corporate activities; as well as investment field for the corporations to request the licensing and project or tender facilities. In the end, political parties do not have the sovereignty, independency and integrity.

Abstract

In some parts of Indonesia, the community structure and government are still strictly adhered to the customary system, such as in West Sumatra and the Ambon Maluku area. With the implementation of a modern government system in the form of the village as the lowest government under the Camat, based on Law Number 5 of 1979 on Village Government, the customary community unit underwent many changes. This study discusses the existence of traditional villages after Law Number 6 of 2014 on Villages. The formulation of the research problem is how is the existence of the State in Ambon City and Nagari in West Sumatra as a traditional village after the implementation of the Village Law and how is the traditional village system viewed from the modern constitutional system in Indonesia? This is a field research that focuses on the state in Ambon and Nagari in West Sumatra, by using a comparative model and a sociological approach as well as an empirical legal research. The results of the study conclude that the Village Law has accommodated traditional villages with the right of origin over their structure. Likewise, traditional villages in Ambon country which have a King, Saniri Negeri, Soa, Fam, Kewang and Marinyo, and in West Sumatra Nagari have Nagari Customary Density Guardians and Nagari Consultative Body. In these traditional villages, there are customary values that have changed due to the influence of democracy and Indonesia's modern state system. That being the king and guardian of the village who are directly elected. The function of customary institutions in the settlement of customary cases is also diminished due to the existence of the Indonesian national legal system.Key Words: State; Nagari; Village LawAbstrakDi beberapa wilayah Indonesia, struktur masyarakat dan pemerintahannya masih ketat dengan sistem adat, seperti di Sumatera Barat dan daerah Ambon Maluku. Dengan diberlakukannya sistem pemerintahan modern berupa desa sebagai pemerintahan terendah di bawah Camat, berdasarkan Undang-Undang Nomor 5 Tahun 1979 tentang pemerintah Desa, maka satuan masyarakat adat tersebut mengalami banyak perubahan. Penelitian ini membahas tentang eksistensi desa adat setelah Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Adapun rumusan masalah penelitian ini yaitu bagaimanakah eksistensi Negeri di Kota Ambon dan Nagari Sumatera Barat sebagai desa adat pasca pemberlakukan Undang-undang Desa dan bagaimana sistem desa adat tersebut ditinjau dari sistem ketatanegaraan modern di Indonesia? Penelitian ini merupakan penelitian lapangan yang mengambil fokus pada negeri di Ambon dan Nagari di Sumatera Barat, dengan mengunakan model perbandingan, dan pendekatan sosiologis, serta merupakan penelitian hukum empiris. Hasil penelitian menyimpulkan bahwa Undang-Undang Desa telah mengakomodasi desa adat dengan adanya hak asal usul atas strukturnya. Begitu juga desa adat pada negeri Ambon yang memiliki Raja, Saniri Negeri, Soa, Fam, Kewang dan Marinyo, serta pada nagari Sumatera Barat memiliki Wali Nagari Kerapatan Adat Nagari dan Badan Musyawarah Nagari. Dalam desa adat ini, terdapat nilai-niai adat yang berubah karena pegaruh demokrasi dan sistem ketetanegaraan modern Indonesia. Seperti adanya Raja dan wali nagari yang dipilih secara langsung. Fungsi lembaga-lembaga adat dalam penyelesaian perkara adat juga semakin berkurang karena adanya sistem hukum nasional Indonesia.Kata-kata Kunci: Negeri; nagari; undang-undang desa

Abstract

Indonesia began its BITs termination movement in early 2014 by calling off the Netherlands-Indonesia BIT 1992. As of today, 29/55 of the country’s BITs that are in force have been terminated. By adopting the normative research method and utilising statutory and conceptual approaches, this paper examines two issues: first, mapping the landscape of international investment law in Indonesia in the epilogue of its long-standing BITs regime hence the probable government’s deliberations behind the action; and second, in what way would the BITs termination movement truly serve Indonesia’s national interests and benefit its economic development while promoting and protecting foreign investments – particularly on the core element of the investors’ direct right to investment arbitration. At last, the paper concludes its discussion by offering two answers: first, two lifeboats are reserved for the protection of the country’s present foreign investment, the implementation of “Sunset Cause” contained within Indonesia’s BITs as well as protectionism provisions under the country’s national investment law and other relevant regulations; and for the second, two diverged roads are laid out to choose for the protection of future foreign investments in Indonesia, the country’s Regional Trade Agreements (RTAs) containing investment provisions or its newly born model BIT which, needless to say, at least the latter must be formulated with delicate manner if the goal is to prevail Indonesia’s interests.Key Words:  Bilateral Investment Treaties; foreign investors; investor-state contracts; new model BIT; Regional Trade Agreements; sunset clauseAbstrakIndonesia memulai gerakan terminasi BIT-nya sejak awal tahun 2014 dengan membatalkan BIT Belanda-Indonesia 1992. Sampai hari ini, dari total 55 BIT negara tersebut yang masih berlaku, 29  di antaranya telah dihentikan. Dengan mengadopsi metode penelitian normatif dan menggunakan pendekatan perundang-undangan dan konseptual, tulisan ini mengkaji dua masalah: pertama, pemetaan lanskap hukum investasi internasional di Indonesia dengan berakhirnya rezim BIT yang sudah berlangsung lama juga analisa kemungkinan pertimbangan-pertimbangan pemerintah di balik tindakan tersebut; dan kedua, dengan cara apa gerakan terminasi BIT ini dapat benar-benar melayani kepentingan nasional Indonesia dan menguntungkan pembangunan ekonominya namun pada saat yang bersamaan juga mempromosikan dan melindungi investasi asing – terutama pada elemen inti yakti hak langsung investor untuk mengajukan arbitrase. Sebagai penutup, makalah ini mengakhiri diskusinya dengan menawarkan dua jawaban: pertama, dua sekoci disediakan untuk melindungi investasi asing negara saat ini, yaitu penerapan “Sunset Cause” yang terkandung dalam BIT Indonesia serta pasal-pasal pelindung dalam UU Investasi negara tersebut serta peraturan terkait lainnya; dan untuk yang kedua, dua pilihan jalan ditawarkan untuk melindungi investasi asing di Indonesia di masa depan, yaitu Regional Trade Agreement (RTA) negara tersebut yang mengandung bab investasi atau model BIT baru yang akan lahir yang, tentunya, paling tidak yang terakhir ini harus dirumuskan secara hati-hati jika tujuannya adalah untuk memenangkan kepentingan Indonesia.Kata-kata Kunci:   Bilateral Investment Treaty; investor asing; perjanjian investor-negara; model BIT baru; Regional Trade Agreement; Sunset Clause

Abstract

The focus of this research is to offer an option for the ideal insurance business legal entity form. This study aims at two things. First, to examine the legal consequences on the choices of various legal entities to administer insurance. Second, to analyze the ideal form of legal entity for insurance business. This is a normative legal research with regulatory and conceptual approaches. The presentation of the analysis is carried out in a qualitative descriptive manner. The results of the study conclude that: first, the legal consequences of the insurance provider are the characteristics inherent in the legal entity form of the provider. Second, although a Limited Liability Company (PT) according to the legal form is the most appropriate legal entity in administering insurance, Cooperation and Mutual have advantages in unifying the ownership and consumer functions. Their goal is to focus more on togetherness and ensuring member satisfaction and not just making a profit. This uniqueness can have a positive impact on reducing potential conflicts of interest between consumers and company owners which are common in PT. The form of Cooperative and Mutual is more in line with the mandate of Article 33 paragraph (1) of the 1945 Constitution of the Republic of Indonesia.Key Words: Insurance legal entity; limited company; mutual; cooperationAbstrakFokus penelitian ini menawarkan pilihan bentuk badan hukum usaha perasuransian yang tepat (ideal). Penelitian ini bertujuan untuk memperoleh dua hal. Pertama, mengkaji konsekuensi hukum pilihan berbagai badan hukum penyelenggaran asuransi. Kedua, menganalisis bentuk badan hukum yang ideal usaha perasuransian. Jenis penelitian merupakan jenis penelitian normatif dengan pendekatan perundang-udangan dan konseptual. Penyajian analisis dilakukan secara deskriptif kualitatif. Hasil penelitian menyimpulkan bahwa: pertama, konsekuensi hukum penyelenggara perasuransian adalah bergantung pada karakteristik yang melekat pada bentuk badan hukum penyelenggara tersebut. Kedua, meskipun bentuk Perseroan Terbatas (PT) menurut pandangan pembentuk Undang-Undang merupakan badan hukum yang paling tepat dalam menyelenggarakan perasuransian, namun Koperasi dan Mutual memiliki keunggulan dalam penyatuan fungsi kepemilikan dan fungsi konsumen. Tujuan keduanya lebih fokus pada kebersamaan serta memastikan kepuasan anggota dan bukan sekedar menghasilkan profit. Keunikan ini bisa berdampak positif mengurangi potensi konflik kepentingan antara konsumen dengan pemilik perusahaan yang umum terjadi pada PT. Bentuk Koperasi dan Mutual lebih berkesesuaian dengan amanat Pasal 33 ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945.Kata-kata Kunci : Badan hukum perasuransian; perseroan terbatas; mutual; koperasi
