Abstract

Public servant have an abligation to transparent on public policy related to citizen interest. This value is one of the important point in the Democratic Government and Good Governance principles. To apply the principle of transparent and public accountability if is need General principle law of administration (government). The "Batu" case is "maladministration of public servant". The problem is the period and requirement of the promotion is contradictive with regulation. But for all of the problem the Mayor of Kota Batu and Chief of Regional Administration of Public Servant Regional II East Java should be responsible.

Abstract

In Indonesia, criminal acts are so various, especially which place women as the victims. One of the forms or frightening criminal acts through women is sexual violence. Sexual violence that undergoes women frequently is classified to the serious human rights colliding or extra ordinary crime which not only causes physical suffer but also causes educational and psychological looses through the victims. The victims (women) have suffered layered suffers due to sexual violence suffering. By sexual violence, women have been conducted as the subordination of the men biological capacity besides his threatening educational future.

Abstract

The error, overlapping and the error of the arrangement of the legislation in finishing law problem in the form a group and in the state, can be minimize by understanding kind, function, material content authority hierarchy and also the arrangement of the legislation.The regulation No. 10/2004, appears as the Progress that give orientation, standard for the regulation maker and the up holder of law in Indonesia. Never the less, there is some thing that have to be analyzed deeply and decide the degree of the kind of the legislation arrangement in which it is explained in section 7 (1) jo section 7 (4) jo section 7( 5) about the kind and the hierarchy of the legislation arrangement in Indonesia.The decision of the position of the legislation arrangement in hierarchy of the legislation arrangement is placed in the context of the formal valid of the legislation arrangement such as Lex superior Derogat Lex Inferior Lex Specialis Derogat Lex Generalis and also Lex posteriori Derogat Lex Priori. So the decision of the position of the legislation arrangement is devised based on the legislation arrangement which command in the hierarchy of the legislation arrangement.

Abstract

From this research, it is found out that firstly the concept of power belongs to the regime of Administrative Law To prove the element of misuse of power therefore, it is necessary apply legal concept under Administrative Law regime. In practice, however to determine whether there is an element of misuse of power court relies upon principle of reasonableness and carefulness as a parameter that are only suitable to determine materially unlawful act. Doing as such, the court mixes up two parameters of different legal regimes in determine the element of misuse of power.

Abstract

The objective of this article is to argue that the issue of equal and unequal position of the parties is irrelevant to commercial contract. The essence of commercial contract that ponders business relationship without interruption does not deal with the issue of mathematical equality; rather it emphasizes on proportional exchange of interests of the parties irrespective of result obtained by the parties. There are three important things in this paper found. First, the principle of proportionality is applied in the entire phases of contract, i.e. in negotiation, formation, and enforcement phases. Second, the principle of proportionality is not perceived from mathematical equality perspective but it is viewed from fair exchange process and proportionate result, which is acceptable by both parties. Third, the principle of proportionality is a doctrine of "fair contract", which improves the doctrine of freedom of contract that may lead to unfairness. It is recommended in this dissertation that jurists, currently be not regard the doctrine of freedom of contract sacred; rather they shall find other philosophical basis to develop "fair contract" procedurally as well as substantively.

Ethics refer to desirable conduct. Detemerning what is desirable conduct in a given situation depends on what values one follows. The value recommend to guide in positive law Jurisprudence is the study of values concerning law and legal systems. Schools of jurisprudence present different values for judging whether positive law is appropriate ethical conduct.
