Penelitian ini bertujuan untuk mengetahui segala jenis Eksekusi yang dapat diberlakukan terhadap objek jaminan yang dibebeni dengan Hipotek. Dari berbagai jenis eksekusi yang ditawarkan mulai dari Eksekusi dengan Titel Eksekutorial (yang berdasarkan adanya irah-irah dalam akta hipotek), yang kedua melalui Parate Eksekusi yang dapat dilaksanakan tanpa melalui jalur pengadilan, melainkan hanya dengan adanya kuasa menjual oleh kreditor, dan yang terakhir melalui penjualan di bawah tangan dengan kesepakan antara debitor dan kreditor untuk mencari pembeli dengan harga tertinggi. Berdasarkan hasil penelitian dapat disimpulkan bahwa dalam pelaksanaan eksekusi objek jaminan terkait wanprestasi yang diberikan tersebut masih tidak melindungi kepentingan Kreditor. Di mana dalam hal ini ketika objek jaminan tersebut masih dalam kegiatan bongkar muat dan pelayaran. Ketika dalam proses kegiatan bongkar muat, kapal tidak dapat dilaksanakan Eksekusi atas objek jaminan tersebut. Selain itu terdapat kendala lain, yaitu manakala objek jaminan tersebut sedang berlayar, baik di perairan Indonesia ataupun di Luar Negeri, akan mempersulit eksekusi objek jaminan tersebut. Sehingga dari beberapa kendala di atas dapat semakin melemahkan posisi Kreditor. Penelitian ini merupakan penelitian normatif. Hasil yang didapatkan dari penelitian ini adalah diperlukan penafsiran ketentuan peraturan Hipotek kapal dan juga ratifikasi konvensi internasional yang terkait, agar tidak ada lagi kekosongan hukum.This study aims to determine all types of Execution that can be applied to the object of collateral that is provided with a Mortgage. From the various types of executions offered starting from Execution with Executive Titles (which are based on the existence of irregularities in the mortgage deed), the second through Parate Execution which can be carried out without going through the court, but only with the power of selling by creditors, and the last through sales with agreements between debtors and creditors to find buyers with the highest prices. Based on the results of the study it can be concluded that in the execution of the object of collateral related to the default given still does not protect the interests of the creditor. In addition, there are other obstacles, namely when the object of guarantee is sailing, whether in Indonesian waters or abroad, it will complicate the execution of the object of the guarantee. So that from some of the obstacles above can further weaken the position of creditors. This research is normative research. The results obtained from this study are necessary to interpret the provisions of ship mortgage regulations and also the ratification of relevant international conventions, so that there will be no more legal vacancies.

Suatu kenyataan bahwa notaris maupun notaris pengganti adalah pejabat umum, yang diberikan kewenangan oleh Undang-Undang untuk membuat akta otentik, sejauh pembuatan akta tersebut tidak dikhususkan bagi pejabat umum lainnya. Dengan adanya persamaan kedudukan hukum antara notaris dengan notaris pengganti tersebut, maka tidak ada keragu-raguan lagi bahwa akta-akta yang dibuat oleh notaris pengganti mempunyai kekuatan hukum yang sama dengan akta-akta notaris, artinya bahwa akta-akta yang dibuat oleh atau dihadapan notaris pengganti bersifat otentik dan mempunyai kekuatan pembuktian yang sempurna sebagaimana dimaksud dalam Pasal 1870 KUHPerdata. Permasalahan timbul saat akta yang dibuat oleh Notaris tersebut terdapat kesalahan. Penelitian ini merupakan penelitian dengan metode normatif. Hasil yang didapatkan adalah Notaris maupun notaris pengganti dapat dituntut ganti rugi bilamana mempunyai kesalahan substantif dalam akta yang dibuatnya, yang tidak sesuai dengan kehendak para pihak akta tersebut merupakan tanggung jawab dari masing-masing pejabatnya. Notaris yang digantikan tidak bertanggung jawab atas kesalahan notaris penggantinya, karena notaris maupun notaris pengganti masing-masing mempunyai hak dan kewajiban masing-masing dalam jabatannya, dan telah disumpah secara pribadi.A fact that a notary or a notary substitute is a public official, who is given the authority by law to make an authentic deed, insofar as the deed is not specified for other public officials. With the existence of legal equality between the notary and the substitute notary, there is no doubt that the deeds made by the substitute notary have the same legal force as the notary deeds, meaning that the deeds made by or before the notary substitutes are authentic and have perfect proof power as referred to in Article 1870 of the Civil Code. Problems arise when the deed made by the Notary has an error. This research is a research with normative methods. The results obtained are a Notary or a substitute notary can be sued for compensation when having a substantive error in the deed made, which is not in accordance with the wishes of the parties the deed is the responsibility of each of its officials. The notary who is replaced is not responsible for the error of the successor notary, because the notary and notary substitute each have their respective rights and obligations in their positions, and have been sworn in person.

Kejahatan di dunia maya salah satunya adalah cyberporn, pornografi di internet tidak dapat dihindari lagi karena arus informasi dan komunikasi yang ada semakin canggih. Hal ini dikarenakan sex adalah suatu hal yang dapat membawa profit cukup besar dalam dunia bisnis, terlebih lagi melalui jasa e-commerce. Pornografi yang merambah sampai ke dunia maya dapat dengan mudah diakses oleh siapapun, dan tanpa batasan usia, kelamin, tingkat pendidikan, maupun stratifikasi sosial. Hal tersebut jika dibiarkan dan tidak dicegah maka akan sangat merusak mental bangsa Indonesia khususnya bagi generasi penerus bangsa. Oleh karena itu penelitian ini mempunyai tujuan untuk mengkaji dan menganalisa faktor-faktor penghambat dalam pencegahan dan penanggulangan cyberporn di dunia cyber. Metode penelitian yang digunakan yaitu dengan pendekatan yuridis empiris, dengan data primer dan sekunder, dan analisa secara kualitatif dan disajikan secara deskriptif. Pada penelitian hukum normatif terhimpun dalam suatu kodifikasi atau bahan tertulis lainnya, dalam penelitian empiris akan mengaitkan hukum pada usaha untuk mencapai tujuan-tujuan serta kebutuhan konkrit di dalam masyarakat. Penelitian ini mengkaji dan mengolah data penelitian dengan menelusuri upaya-upaya yang dilakukan oleh pemerintah Indonesia memberikan pencegahan dan penanggulangan terhadap cyberporn.One of the crimes in cyberspace is cyberporn, pornography on the internet is inevitable because the flow of information and communication is increasingly sophisticated. This is because sex is something that can bring considerable profit in the business world, especially through e-commerce services. Pornography that extends to cyberspace can be easily accessed by anyone, and without limitation of age, sex, level of education, and social stratification. If left unchecked and prevented, it will seriously damage the mentality of the Indonesian people, especially for the next generation. Therefore, this study has the aim to examine and analyze the inhibiting factors in the prevention and control of cyberporn in the cyber world. The research method used is an empirical juridical approach, with primary and secondary data, and qualitative analysis and presented descriptively. In normative legal research collected in a codification or other written material, in empirical research will link the law to efforts to achieve concrete goals and needs in society. This study examines and processes research data by tracing the efforts made by the Indonesian government to provide prevention and control of the cyberporn.

Negara Indonesia selaku negara pantai diwajibkan meletakkan batas teritorial laut yang sesuai dengan UNCLOS 1982 demi menjamin kepastian wilayah laut, darat, dan udara. Australia dan Indonesia mengadakan perjanjian mengenai batas wilayah laut. Pada tahun 2002 Timor Leste merdeka menjadi negara baru. Timor Leste tak punya batas laut permanen sementara Indonesia dan Australia berbagi kekayaan alam di Celah Timor. Pada tahun 2004 Timor Leste memulai kembali negoisasi dengan Australia. Pemerintah Indonesia menyatakan belum bisa mengambil sikap atas kesepakatan perbatasan maritim antara Timor Leste dengan Australia. Australia dan Timor Leste merupakan dua negara yang secara geografis berdekatan dengan Indonesia. Untuk itu, perlu adanya regulasi yang jelas agar status wilayah laut masing-masing negara dapat dipertanggungjawabkan. Kesepakatan perbatasan maritim antara Australia dan Timor Leste akan berimplikasi bagi wilayah laut Indonesia. Implikasi kesepakatan itu dapat memicu sengketa baru antara Indonesia dan Australia. Untuk mengetahui dampak perjanjian tersebut diperlukan analisa sesuai UNCLOS 1982 dan Hukum Internasional. Penelitian ini merupakan penelitian normatif.Indonesia as a coastal state is obliged to place a territorial sea boundary in accordance with UNCLOS 1982 in order to guarantee the certainty of sea, land and air. Australia and Indonesia have agreements on maritime boundaries. In 2002 East Timor became an independent state. Timor Leste has no permanent sea boundary while Indonesia and Australia share natural resources in the Timor Gap. In 2004 Timor Leste restarted negotiations with Australia. The Indonesian government says it has not been able to take a stand on the maritime boundary agreement between Timor Leste and Australia. Australia and Timor Leste are two countries geographically adjacent to Indonesia. Therefore, there needs to be a clear regulation so that the status of marine areas of each country can be accounted for. The maritime border agreement between Australia and Timor Leste will have implications for Indonesia’s marine territory. The implications of the agreement could trigger a new dispute between Indonesia and Australia. To find out the impact of the agreement requires analysis according to UNCLOS 1982 and international. This is a normative research.

KONSTRUKSI LEMBAGA JAMINAN UNTUK SAHAM SEBAGAI BENTUK DUKUNGAN PERKEMBANGAN BISNIS Fani Martiawan Kumara Putra

Utang-piutang sebagai kegiatan bisnis, sudah barang tentu bingkainya adalah perjanjian, kemudian pengamannya adalah agunan atau jaminan. Pada prinsipnya tidak ada utang tanpa adanya jaminan, karena walaupun tanpa adanya jaminan yang disepakati oleh para pihak, tetap akan ada jaminan yang diberikan oleh undang-undang sebagaimana Pasal 1131 Burgerlijk Wetboek. Pengaturan mengenai penjaminan juga semestinya berkembang mengikuti tuntutan perkembangan bisnis, namun selama belum ada pengaturan yang baru, dan masih perlunya identifikasi permasalahan yang lebih komprehensif, maka jalan keluarnya sudah barang tentu menggunakan penafsiran. Semakin berkembang pola bisnisnya, berkembang pula karakteristik utang-piutangnya, maka wajar manakala benda yang menjadi obyek jaminan juga berkembang. Sebagaimana saat ini, saham dapat dijadikan obyek jaminan. Sebagaimana aturan yang mendasarinya, saham dapat dijadikan obyek jaminan Gadai atau Fdusia. Undang-Undang memberikan 2 (dua) pilihan lembaga jaminan untuk obyek saham, oleh karenanya dalam penelitian ini akan dicari konstruksi lembaga jaminan untuk saham sebagai rumusan permasalahannya. Penelitian ini merupakan penelitian normatif. Hasil yang didapatkan dari penelitian ini adalah saham dengan segala aspeknya, akan lebih dapat mendukung kegiatan bisnis dan juga dapat diterapkan prinsip-prinsip penting Hukum Jaminan bagi debitornya manakala dijaminkan dengan lembaga jaminan Fidusia.The frame of a debt as a business activity is an agreement, then the security is collateral. In principle, there is no debt without collateral, because even if there is no collateral agreed upon by the parties, there will still be security object provided by law as Article 1131 Burgerlijk Wetboek. Arrangements regarding security law should also develop following the demands of business development, but as long as there are no new arrangements, and there is still a need to identify more comprehensive problems, the solution is certainly to use interpretation. As the pattern of business develops, the characteristics of debt are also developed, so that naturally the collateral object will also develop. As of now, stocks can be used as collateral objects. As with the underlying rules, stocks can be used as collateral for Gadai or Fiducia. The Law provides 2 (two) choices of collateral institutions for stock objects, therefore this study will look for the construction of security institutions as a formulation of the problem. This research is normative research. The results obtained from this study are stocks with all aspects, will be more able to support business activities and also can be applied important principles of security law for debtors when secured with Fiducia security institutions.

Penelitian mengenai akibat hukum pembatalan akta kelahiran terhadap anak bertujuan untuk mengetahui akibat hukum yang berpengaruh terhadap anak, serta meninjau dari penetapan dan putusan hakim di pengadilan yang berperan dalam tindakan hukum pembatalan akta kelahiran. Penelitian ini menggunakan metode penelitian hukum, karena dalam menghadapi isu hukum maka perlu proses untuk menemukan aturan-aturan hukum, prinsip-prinsip hukum, serta doktrin hukum yang berkaitan dengan isu hukum tersebut. Dalam penelitian tipe yuridis normatif, digunakan metode deduktif yang berawal dari hal yang bersifat umum lalu diterapkan pada rumusan masalah dan dapat menghasilkan jawaban yang bersifat khusus dan sah. Berdasarkan hasil penelitian, dari berbagai aturan hukum, doktrin serta putusan dan penetapan pengadilan, bahwa pembatalan akta kelahiran membawa akibat hukum yang cukup besar bagi anak. Hal ini berakibat pada status dan kedudukan anak, di mana dalam beberapa contoh penetapan dan putusan pengadilan yang menghasilkan akibat hukum dari anak sah menjadi anak luar kawin maupun anak luar kawin menjadi anak sah. Selain itu, hubungan antara anak dan orangtua yang terhubung dengan hak alimentasi tidak akan terputus selama terdapat bukti-bukti hubungan darah antara orangtua dan anak.Research on the legal consequences of the annulment of birth certificates against children aims to know the effect of law affecting the child, as well as review of the determination and judgment in court that acts in legal action cancellation of birth certificate. This research uses legal research methods, because in dealing with legal issues then it is necessary to find the legal rules, legal principles, and legal doctrines relating to these legal issues. In normative juridical type research, a deductive method is used which begins with a general nature and then applies to the problem formulation and can produce a specific and legitimate answer. Based on the results of research, from the various rules of law, doctrine and judgment and the determination of the court, that the cancellation of the birth certificate carries considerable legal consequences for the child. This has resulted in the status and position of the child, in which in some instances the determination and judgment of the court resulting in legal consequences of a lawful child being a child outside of marriage and an outsider becomes a legal child. In addition, the relationship between children and parents connected with alimentation rights will not be interrupted as long as there is evidence of a blood relationship between parent and child.

Dapat dikatakan bahwa politik adalah upaya untuk menentukan aturan yang dapat diterima oleh beberapa warga negara untuk membawa orang ke dalam kehidupan yang harmonis. Dalam menyusun penelitian ini, penulis menggunakan jenis penelitian lapangan. Karakteristik masyarakat sosial-politik para pendatang di Kota Metro masih cenderung membuat kelompok-kelompok berdasarkan ikatan emosional, ini terjadi karena kesamaan yang mereka miliki, tetapi proses pembauran dengan interaksi lingkungan sosial berjalan dengan baik. Tetapi kesadaran akan jumlah mereka masih belum bisa bersaing dalam perebutan kursi di parlemen. Di Kota Metro di mana pluralisme etnis tinggi, posisi kekuatan politik sentral masih dipegang oleh masyarakat adat. Kehadiran mereka dalam politik telah menunjukkan upaya untuk dapat bersaing dan dengan masyarakat adat memajukan Kota Metro dalam berbagai aspek kehidupan.It can be said that politics is an attempt to determine the rules that can be accepted by some citizens to bring people into a harmonious life. In preparing this research, the authors use the type of field research. Characteristics of sociopolitical societies of immigrants in Metro City still tend to make groups based on these emotional bonds occur because of the similarity they have, but the process of intermingling with the interaction of the social environment goes well. But the awareness of the amount of quantity they still cannot compete in the seizure of seats in parliament. In Metro City where ethnic pluralism is high, the position of central political power is still held by indigenous people. Their presence in politics has demonstrated an effort to be able to compete and with indigenous peoples advancing the Metro City in various aspects of life.
