PERSPEKTIF is a peer-reviewed journal that publishes scientific articles in the field of law. The published articles are the results of original scientific research and review of legal interactions. PERSPEKTIF is published by the Institute for Research and Community Services (LPPM) of University of Wijaya Kusuma Surabaya. PERSPEKTIF accepts any manuscripts or articles in the field of law or legal studies from both national and international academicians and researchers. The articles published in PERSPEKTIF is published three times a year (in January, May, and September). Submitted article should follow the writing guidelines.

To prove the element of misuse of power therefore, it is necessary apply legal concept under Administrative Law regime. in practice, however to determine whether there is an element of misuse of power, court relies upon principle of reasonableness and carefulness as a parameter that are only suitable to determine materially unlawful act. Doing as such, the court mixes up two parameters of different legal regimes in determining the element of misuse of power What court does is obviously incorrect because misuse of power is always intentionally carried out. Power is given due to certain purpose. If the power is exerted for other than its purpose, this may be deemed as misuse of power. Such principle is called principle of speciality Law given power is specified by law. On the other hand, discretionary power is general principles of good administration based on the purpose.

Persetubuhan atau perzinahan baik menurut hukum pidana dan hukum adat Tolaki memiliki pandangan yang sama di mana persetubuhan atau perzinahan merupakan perbuatan melawan hukum dan patut untuk diberikan sanksi pidana atas perbuatan pidana tersebut. Namun demikian, hukum adat Tolaki dalam konsep klasifikasi persetubuhan lebih mengatur secara komprehensif tentang perzinahan, di mana perbuatan zina tidak hanya terbatas pada mereka yang telah terikat dengan perkawinan sebagaimana dimaksud dalam Pasal 27 BW tetapi mengikat pula bagi mereka yang belum terikat perkawinan dengan penerapan sanksi adat Tolaki yang berbeda-beda berdasarkan klasifikasi jenis perzinahannya atau umoapi.Promiscuity or adultery either according to the criminal law and the Tolaki customary law, have the same view where promiscuity or adultery is against the law and so it is worth to be given criminal sanctions upon the criminal act. Nevertheless, Tolaki customary law regulated about promiscuity comprehensively about adultery, where the Act of adultery is not just limited to those who had been marriage as stipulated in article 27 BW but also bind those who are not marriage yet, with the application of Tolaki different customs sanctions based on classification type of the fornication or umoapi.

Recently, the existence of Tax Court has increased discussion comparing with the existing State Administrator Court. The independence of Tax Court can be explained that it is the only Court that has particular duty to handle the tax dispute. It has the place to do its juridical function, although at first, as stated in Tax Directorate General eq. Letter of Tax Assessment, the Tax Court was doing the Executive Function only. In term of doing its function, the Tax Court has the independence to make a verdict without decision of any other official office, as clarified in ps. 86 UU No. 14 th. 2002.

Kepemimpinan pasca Soekarno di Indonesia diwarnai dominasi militer khususnya Angkatan Darat yang beraliansi dengan teknokrat untuk merealisir pseudo – idiologi rezim orde baru yaitu pertumbuhan ekonomi yang pesat dalam stabilitas nasional. Lembaga presiden merupakan unsur yang paling menentukan kehidupan negara, keberhasilan orde baru dalam melaksanakan pembangunan dan penyelesaian secara cepat atas persoalan politik merupakan legitimasi yang sangat penting bagi rezim Soeharto. Dalam regimentasi sosial politik penyebab kekuatan birokrasi dan militer mempunyai kesempatan yang besar sekali untuk menopang kekuasaan Presiden dan memungkinkan melahirkan pemimpin nasional yang lain. Untuk suksesi ke depan perlukah dipersiapkan atau berproses secara alamiah dan teratur dengan sidang-sidang MPR. Yang jelas para pemimpin di Indonesia selalu takut dengan cara-cara pemaksaan atau kekerasan, oleh karena itu “mempersiapkan suksesi” adalah salah satu jalan yang rupanya diinginkan oleh para pemimpin negara untuk melahirkan pemimpin baru.

Perusahaan Penanaman Modal Asing berperan dalam alih teknologi melalui peralatan-peralatan perusahaan, termasuk didalamnya adalah paket mesin dan melalui Tenaga Kerja Warga Negara Asing Pendatang yang dibawa dari negaranya. Cara terjadinya alih teknologi adalah melalui metoda pendidikan dan latihan yang disediakan oleh perusahaan PMA dan melalui penggantian Tenaga Kerja Warga Negara Asing Pendatang kepada Tenaga KerjaIndonesia. Adapun peranan Perusahaan Penanaman Modal Asing dalam alih teknologi baru berada tahap pertama dari beberapa tahapan proses alih teknologi yang digariskan oleh Badan Koordinasi Penanaman Modal, yaitu pada tahap kemampuan Tenaga KerjaIndonesiauntuk mengoperasikan peralatan mesin.Sebagai negara berkembangIndonesiamasih membutuhkan perusahaan PMA untuk membantu dalam hal permodalan, manajemen maupun teknologi. Namun demikian, keberadaan perusahaan PMA tidak boleh menyebabkan terjadinya ketergantungan teknologi. Oleh karena itu sudah saatnya apabila pemerintahIndonesiamembuat UU tentang Alih Teknologi yang dapat melindungi kepentinganIndonesia, sehingga tujuan diijinkannya investasi asing yaitu untuk memodernisasi dan merubah struktur ekonomiIndonesiadapat tercapai.

Right to unite freely gather and expel opinion is a human rights. This right in Indonesia has receive law guarantee as has been stated in article 28 e paragraph (3) UUD 1945 which stated that “Every person has a right to unite, gather and expel opinion freely. "Worker is the part of Indonesian citizen, therefore they have right to be protected One kind of law protection that given by government for every worker is guarantee to unite and gather freely in an organization that called Union. The existence of Union today is more guaranteed with the existence of law No. 21 year 2000 about Union. Union is a media to create harmonic, dynamic, and justice in Industrial Relation that suitable with the valid law. If there is any dispute about Industrial Relation, Union is one of the parties in industrial relation dispute settlement.

Sepuluh tahun terakhir merupakan masa pertumbuhan perusahaan pertambangan batubara di Indonesia yang sangat pesat. Hal ini dikarenakan meningkatnya permintaan batubara sebagai pemasok energi di masa mendatang sehingga membuat industri ini memiliki daya tarik yang sangat besar bagi para investor dan banyak perusahaan batubara yang mengajukan Izin Usaha Pertambangan (IUP). Pemerintah telah menetapkan proyek pembangunan melalui proyek pembangkit listrik 35.000 MW. Metode penelitian yang digunakan bersifat yuridis empiris yaitu cara prosedur yang dipergunakan untuk memecahkan masalah penelitian dengan meneliti data sekunder terlebih dahulu untuk kemudian dilanjutkan dengan mengadakan penelitian terhadap data primer di lapangan. Dalam hasil penelitian, adapun cara yang digunakan oleh perusahaan pada sektor pertambangan dalam melakukan ekspansi adalah melalui cara pembentukan perusahaan baru. Ekspansi perushaaan pada sektor pertambangan tentunya memberikan beberapa implikasi yang bisa mengarah pada timbulnya praktek monopoli dan persaingan usaha tidak sehat, mengingat bertambahnya jumlah perusahaan. Adapun produksi yang dilakukan oleh empat group batubara terbesar, masing-masing belum mencapai nilai 75% dari produksi nasional, sehingga sesuai Undang-Undang No. 5 Tahun 1999 Pasal 4 ayat (2) ekspansi yang dilakukan oleh perusahaan group tersebut tidak terbukti berimplikasi terhadap adanya praktik monopoli dan persaingan usaha tidak sehat.The past ten years, coal mining industry in Indonesia develop very rapidly. Coal mining industry becomes the strong magnet for investors and coal companies who submitted for the Mining License (IUP) as a result from high demand of coal supply to be used as energy supplier in the future. The Government has set up the development project of 35.000MW power plant. The method for the research is juridical empirical. It is a problem solving procedure by investigating secondary data first to be able to continue with the primary data. As the result, mining companies expand their business through the new company establishment. Of course those ways of company’s expansion will lead to the implication of monopoly and unfair business competition, considering the increasing numbers of new companies. However, the total production forms the top 5 coal mining group companies has not reach 75% of national production, thus, according to the Law no. 5 Year 1999 article 4 paragraph 2, the company’s expansion does not implicate on the monopoly and unfair business competition.

It leads to the changing MPR existence as an institution that holds people sovereignty and is authorized to appoint President and Vice President.
