PERSPEKTIF is a peer-reviewed journal that publishes scientific articles in the field of law. The published articles are the results of original scientific research and review of legal interactions. PERSPEKTIF is published by the Institute for Research and Community Services (LPPM) of University of Wijaya Kusuma Surabaya. PERSPEKTIF accepts any manuscripts or articles in the field of law or legal studies from both national and international academicians and researchers. The articles published in PERSPEKTIF is published three times a year (in January, May, and September). Submitted article should follow the writing guidelines.

After changing Paragraph 5-article (1) and Paragraph 20 article (1) of UUD 1945 in 1999 as the first change on UUD 1945, then in practice there is a changed nuance on legislative power implementation in Republic of Indonesia. Initially as the main decision-maker; president had the right to formulate decree but then the right is given to Indonesian Legislative Assembly (DPR) without leaving cooperative relation between them. The results of the power shift asserts the function of Indonesian Legislative Assembly on decree making, so that they must be able to be initiators on every process of decree making. It is this claim that has been the pursuits of democratic life for this long and will provide larger authority to the parliament on state law suite to adjust parliament authority and government.

Problem HAM di negara-negara berkembang pada umumnya berkaitan dengan penerapan hak-hak sipil dan politik. Hak-hak sipil dan politik yang secara filosofis bercirikan kebebasan (liberty), secara konstitusional dijamin oleh Pasal 28 UUD 1945. eksisnya beberapa undang-undang yang dalam praktek membatasi dan mengebiri hak-hak dasar, semakin menyadarkan kita akan perlunya “Lembaga Toetsingswet” dan “Ketetapan MPR yang bersifat mengembangkan hak-hak dasar”. Kehadiran toetsingwet dan Ketetapan MPR dalam sistem hukum Indonesia semakin urgen, mengingat adanya kecenderungan masyarakat global yang menilai persoalan HAM bukan merupakan urusan domistik suatu negara semata, melainkan juga berdimensi internasional (horizontal/international accountability).

There are two types of government system known nowadays, presidential and parliamentary. Its system is then stated into each country's constitution, while in Indonesia we know as UUD 1945. Referring to UUD 1945, Indonesia’s government system can’t be classified as presidential or parliamentary, but a combination of both system of UUD 1945 version.

Remisi merupakan hak narapidana untuk mendapatkan pengurangan pidana apabila selama menjalani pembinaan berkelakuan baik. Remisi yang merupakan hak narapidana dapat ditambah apabila yang bersangkutan melakukan perbuatan-perbuatan antara lain: Berbuat jasa kepada negara, dan Melakukan perbuatan yang bermanfaat bagi negara atau kemanusiaan, serta Melakukan perbuatan yang membantu kegiatan Lembaga Pemasyarakatan. Pengaturan remisi ada dalam beberapa peraturan yaitu: Keputusan Presiden No. 174 Tahun 1999 tentang Remisi; Keputusan Menteri Hukum dan Perundang-undangan RI No. M.09.HN.02.01 Tahun 1999 tentang Pelaksanaan Keputusan Presiden No. 174 Tahun 1999; Keputusan Menteri Hukum dan Perundang-Undangan No. M.10.HN.02.01 Tahun 1999 tentang Pelimpahan Wewenang Pemberian Remisi Khusus; Keputusan Presiden No. 120 Tahun 1995 tentang Ampunan Istimewa; Keputusan Menteri Kehakiman RI No. 04.HN.02.01 Tahun 1988 tentang Tambahan Remisi bagi Narapidana yang Menjadi Donor Organ Tubuh dan Donor Darah; Surat Edaran No. E.PS.01-03-15 tanggal 26 Mei 2000 tentang Perubahan Pidana Penjara Seumur Hidup Menjadi Pidana Penjara Sementara; dan Peraturan Pemerintah No. 99 Tahun 2012 tentang Perubahan Kedua atas Peraturan Pemerintah No. 32 Tahun 1999 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan. Pelaksanaan remisi terhadap narapidana diawali dari permohonan Kepala Lembaga Pemasyarakatan kepada Kepala Kantor Wilayah Kementerian Hukum dan HAM terhadap narapidana yang layak mendapatkan remisi berdasarkan hasil pembinaan terhadap narapidana. Keputusan remisi yang diberikan oleh Kepala Kanwil Hukum dan HAM didasarkan atas laporan Kepala Lembaga pemasyarakatan dan Undang-Undang No. 12 Tahun 1995 tentang Pemasyarakatan dan PP No. 99 Tahun 2012.Remission is the right of inmates to get a reduction in crime when undergoing training during good behavior. Remission is the right of prisoners could be increased if the relevant deeds among others: Doing services to the state, and doing deeds that are beneficial to the country or humanity, as well as Perform the action that helps the activities Penitentiary. Remission arrangements in some of the rules are: Presidential Decree No. 174 year1999 concerning Remission; Minister of Law and Legislation Decree No. M.09.HN.02.01 year 1999 on the Implementation of Presidential Decree No. 174 of 1999; Minister of Law and Legislation Decree Number M.10.HN.02.01 year 1999 on Delegation of Authority granting Special Remission; Presidential Decree No. 120 year 1995 concerning the Special Forgiveness; Minister of Justice Decree No. 1988 on Additional 04.HN.02.01 Remission for prisoners Become Organ Donors and Blood; Circular Number E.PS.01-03-15 May 26 year 2000 on the Amendment of Criminal Life Imprisonment While Being Criminal Prison; and Government Regulation No. 99 Year 2012 regarding the Second Amendment to Government Regulation No. 32 Year1999 on Conditions and Procedures for the Implementation of the Right prisoners. Implementation of the remission of prisoners begins on the petition the Head of Penitentiary to the Head Office of the Ministry of Justice and Human Rights of prisoners are eligible for remission based on the guidance to the inmates. Decision remissions granted by the Head of Department of Law and Human Rights based on the reports of correctional and Head of the Institute of Law No. 12 Year 1995 on Penal and PP 99 Year 2012.

Dalam rangka menunjang usahanya para pengusaha baik pengusaha kecil, menengah maupun besar bahkan perorangan dalam meningkatkan kwalitas taraf hidupnya membutuhkan tambahan dana. Tambahan dana tersebut salah satunya dilakukan dengan cara mengajukan pinjaman kredit pada bank. Adanya ciri-ciri tersebut memberikan jaminan kepastian hukum bagi bank jika pada akhirnya terdapat kredit macet, bank selaku kreditur dapat melaksanakan eksekusi dengan cara menjual secara lelang di muka umum atas agunan yang ada tanpa melalui jalur pengadilan karena Sertifikat Hak Tanggungan mempunyai titel eksekutorial.Lahirnya Undang-Undang Hak Tanggungan bertolak belakang dengan BW, dimana Hak Tanggungan mengadopsi ketentuan yang ada pada BW yaitu hukum pertanahan sedangkan BW menganut asas perlekatan vertikal, artinya mengkaitkan antara tanah dengan benda-benda yang berada di atasnya. Sedangkan UUPA tempat lahirnya Hak Tanggungan yang berdasarkan pada hukum adat menganut asas pemisahan horisontal yaitu memisahkan antara tanah dengan benda-benda yang ada di atasnya.

The term of corporate governance to come afer moneytary crisis in Asia particularly in East Asia. For Indonesian the concern of this term since monetary crisis moment which factually that there is a lack of good corporate governance force monetary crisis. Corporate governance has influenced greatly on companies, the board of directors, board of commissioners and shareholders in Indonesia. The stakeholders are now given wider opportunity with the adoption of corporate governance. Many sure this will add value to company sure nationalism. The existency of corporate governance was also to result in investor to invest the capital in a corporate which to comply with the principles of good corporate governance. For this, investor to have the guts to pay more the share in a corporate which to comply with the principles of good corporate governance. From management science perspective between management and good corporate governance in principe is the same, that are the process to run a corporation. But there are some different of both. Managemen just see inside of a corporation, good corporate not only see inside of a corporation but also see outside of a corporation likes supplier community buyer; environment and all of stakeholders. So the conclusion is good corporate governance more than good management.

Alkisah, menurut penjelasan UUD 1945, Indonesia adalah negara berdasarkan atas hukum (rechtsstaat) dan tidak berdasarkan atas kekuasaan belaka (machtsstaat). Tetapi di dalam praktiknya justru citra negara kekuasaan lebih mengedepan daripada citra negara hukum. Konsekuensinya fungsi hukum selalu dikendalikan oleh pemegang kekuasaan.

Jurnal ini bertujuan untuk menganalisis konsekuensi hukum bagi Indonesia tentang pengendalian kabut asap pasca ratifikasi ASEAN Agreement on Transboundary Haze Pollution serta langkah-langkah yang harus dilakukan sebagai wujud asas itikad baik. Jenis penelitian yang digunakan dalam tulisan ini adalah penelitian hukum normatif dengan menggunakan pendekatan aturan hukum tertulis (statute approach). Hasil penelitian yang diperoleh yaitu Indonesia wajib mengambil tindakan di bidang legislatif, administratif serta tindakan teknis lain untuk mencegah kebakaran lahan dan hutannya supaya tidak menimbulkan pencemaran asap wilayah negara lain serta sebagai perwujudan asas itikad baik, Indonesia wajib mengambil langkah prioritas berupa penegakan hukum terhadap pelaku pembakar lahan dan hutan yang menyebabkan kabut asap.This journal aims to analyze the legal consequences for Indonesia on preventing and monitoring transboundary haze pollution after the ratification of ASEAN Agreement on Transboundary Haze Pollution and actions that should be taken by the Republic of Indonesia as a form of principle of good faith. This study is a normative legal research by using regulation of written law approach (statute approach). The result of this journal showed that Indonesia shall take legislative, administrative and other steps, as aprinciple of good faith, to prevent, control and mitigate land and forest fires that leads to trans boundary haze pollution. Indonesia also shall enforce the law as a main priority against the person or corporation that burns land and forest.

One of the terms of economic crisis in Indonesia is monetary crisis. Monetary crisis or economic up to now still occur in Indonesia, which is noted by banks which undergo liquidity that causes the banks “willing or not, wanting or not” have to throw away its stirring and shake hands with the other banks to build cooperation or to look for strategic partner in order to survive by doing merger consolidation, and bank acquisition. However, the member of merger banks should notice the effects of law appeared due to merger consolidating, and that acquisition, in addition to its bank employees, because the employees have the full control as the bank operational. Bank is impossible having its activity well without full supports of its employees.
