Abstract

Maqasid Syari‘ah berarti tujuan Allah Swt. dan Rasul-Nya dalam merumuskanhukum-hukum Islam. Tujuan itu dapat ditelusuri dalam ayat-ayat Al-Qur‘an dan Sunnah RasulullahSAW. Sebagai alasan logis bagi rumusan suatu hukum yang berorientasi kepada duasudut pandang. Pertama, maqasid al syari‟ (tujuan Tuhan). Kedua, maqasid al mukallaf (tujuanmukallaf). Dilihat dari sudut tujuan Tuhan, Maqasid Al Syariah mengandung empat aspek, yaitua) Tujuan awal dari Syari‘ menetapkan syariah yaitu kemashlahatan manusia di dunia danakhirat, b) Penetapan syariah sebagai sesuatu yang harus dipahami c) Penetapan syariah sebagauhukum taklifi yang harus dilaksanakan, d) Penetapan syariah guna membawa manusia ke bawahlindungan hukum.

Abstract

Abstract

The issue of qibla direction is a part of Islamic law (fiqh), while Islamic law is a partof Islamic precept itself. The criteria of someone‟s faith and Islamic state which declared bysyahadatain pledge are believing the thruth and performing the order of Allah swt. and ProphetMuhammad saw. included the leadership of Moslem community which implemented by the shiftof qiblat from Baitul Makdis ke Ka‟bah) to Masjid al-Haram Mecca. Abstract

Marriage is a physically and mentally bond between a man and woman to be husbandand wife to form a happy and eternal family based on the Almighty God. Marriage Law No.1/1974 regulates about marriage age limit. Someone who wanted to marry must reach thecertain age allowed by marriage law. The restriction age for marriage is 19 years old for menand 16 years old for women and also 21 years old for men and women without an obligation toget permission from their parents, is one of the conditions of marriage, but it is not legalrequirement for validity of marriage. The purpose of limitation age for marriage is to care thephysical and mentality health of the couple and also for their children later. This research noted:The violation of the restriction age of marriage is still occurs and it happened due of factorssuch as the occurrence of premarital sex, ignorance of the rules, kinship and other factors.

Abstract

This article aim at explaining the inter relation between local wisdomof pela gandongand cultural communications and also cultural communications of pela gandong based on theperspective maqasid syariah. The problem in this article is studied by using maqasid syariah as abasis for theory in studying local wisdom of pel gandong exist in Ambon. The result of thisstudy indicate that pela gandong besides having a meaning of tying also bear communicationspattern from two communities. This matter is shown with the quality of genetic relationshipbetween different citizen of community with call, the naming of greeting basudara (brothers).As cultural communication, pela gandong born from under, local wisdom of pela gandong havelinked relationship of human which in character as a human also and do not limit byvariousrules and normative limitation but as compliance and awareness and respect at ancestorsafter all pela gandong represent maximal masterpieces from all ancestor of Ambon - LeaseMaluku and formed from the way of thinking and behave from society when they respond theproblems of arising around them. Besides, pela gandong is suitable to maqasid syariah. Thismatter can be seen that target of law or declaring of law that was degraded by Allah is for thebenefit of mankind. Of that account, maqasid syariah can be told as benefit ―delivering all kindof benefit or refuse all damage possibility‖. This matter in line with existence of local wisdomof pela gandong recognized to society of Ambon with aim at creating peace in interfaith whichis symbolized with brotherhood (sister and brother). With existence of pela gandong, it appeartolerance in religion to be able to produce well-balanced cooperation among religionpeople insocial activity, economic, defense, security, environment, etc. Besides, demage of which canmeance soul, slan, property and mind can be avoided by the existence of pela gandong.

Abstract

Tulisan ini menganalisis tentang konstruksi keluarga sakinah berbasis kesetaraangender. Untuk menyelesaikan masalah tersebut maka digunakan metode Library Research.Pengambilan data melalui prosedur: Reduksi data, Penyajian dan Penarikan kesimpulan. Hasilkajian menunjukkan bahwa Konstruksi gender yang berkembang di masyarakat dapatmempengaruhi pembentukan keluarga. Keluarga yang memegang erat budaya patriakhis yangbias gender terdapat kecenderungan lahirnya diskriminasi gender. Pada umumnya perempuandipandang memiliki status, peran dan tanggungjawab serta hak-hak lebih rendah dari laki-laki.Sebaliknya konstruksi keluarga yang dibangun atas dasar kesetaraan dan keadilan gender dapatmenghapus gender stereotype, subordinasi, marginalisasi, beban ganda, dan kekerasa dalamrumah tangga. Menurut analisis gender, tujuan perkawinan akan tercapai jika di dalam keluargadibangun atas dasar kesetaraan dan keadilan gender. Kesetraaan dan keadilan gender dalamkeluarga merupakan kondisi dinamis, dimana suami isteri dan anggota keluarga lainnya, samasamamemiliki hak, kewajiban, peranan dan kesempatan yang dilandasi oleh saling menghormati,dan saling membantu dalam kehidupan keluarga.

Immunity laws and ownership rights by members of Parliament as State officials intoa huge deal lately. The right of immunity that attaches to the Member of Parliament is becomingattractive to examined in comparison with the existence of the principle of equality before thelawThe focus of this study is to analyze the basic concept of building immunity State officialsespecially ownership rights of immunity of members of Parliament, when faced with thefundamental problems in the country namely the presence of equality before the law in everycitizen. The outline of issues raised, namely whether the juridical foundation of legal immunityfor members of Parliament in Indonesia as a privilege that is owned in the context of hisposition as State officials? The second issue is how does the existence of the principle of legalimmunity for State officials when it examined the position and enforceability before theprinciple of equality before the law? As a conclusion here is that the right of immunity of itsexistence included expressly in the UUD 1945 specially section 20A para 3.
