Abstract

This study examines the governance of villages in Manggarai Regency, NTT Province. The performance of village governance is measured by the principles of good governance; transparency, accountability, responsiveness, rule of law, and participatory. The research method uses qualitative research methods with an empirical approach. Data obtained by literature studies and interviews. The study population consisted of villages in Manggarai Regency as many as 145 villages spread across 11 sub-districts (except Langke Rembong District). The results showed that village governance was classified as positive. Village officials and villagers organize village governance according to aspects of transparency, accountability, law enforcement, responsiveness and participation. However, village governance tends to be administrative.

Abstract

Abstrak Pemerintah berperan melakukan pemanfaatan dan penggunaan tenaga kerja asing untuk pengembangan tenaga kerja lokal dengan mekanisme transfer knowledge dan transfer technology. Selain pemerintah juga menjadikan tenaga kerja asing sebagai salah satu subjek PNBP (Penerimaan Negara Bukan Pajak) untuk pemasukan kas negara. Dengan melihat besarnya potensi tenaga kerja asing di Indonesia, maka pemerintah mengakomodir dengan menghadirkan undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, Peraturan Presiden Nomor 20 Tahun 2018 tentang Penggunaan Tenaga Kerja Asing, Peraturan menteri ketenagakerjaan Nomor 10 Tahun 2018 tentang Tenaga Kerja Asing, dan Keputusan Menteri Nomor 40 Tahun 2012 tentang Jabatan-Jabatan Tertentu yang Tidak Boleh Diduduki Tenaga Kerja Asing. Penelitian ini menggunakan jenis penelitian yuridis normatif dan perpustakaan dengan melakukan penilaian terhadap undang-undang dan peraturan, buku, jurnal, dan sumber-sumber dari internet terkait. Hasil penelitian menunjukkan bahwa terdapat problematika dalam pengadaan tenaga kerja asing seperti tidak sesuainya jabatan yang dibatasi oleh peraturan perundang-undangan, masa kerja yang melebihi batas kontrak, dan kurang jelasnya penyusunan hingga pengesahan RPTKA, sehingga mengakibatkan diskriminasi terhadap tenaga kerja lokal. Maka berdasarkan penelitian ini dapat disimpulkan bahwa dengan tidak adanya lembaga pengawasan tenaga kerja asing yang jelas, maka akan berimplikasi pada terderogasinya hak-hak warga lokal dalam memperoleh pekerjaan sesuai maklumat UUD NRI 1945.Kata kunci: Bela Negara, Pengawasan Tenaga Kerja Asing, Kontrak Sosial

Abstract

Abstract:The Constitutional Court in its position as guardian of the constitution has the authority to examine laws against the Constitution. The position of the Constitutional Court is only limited to negative legislature. However, in its implementation many Constitutional Court decisions sometimes make positive legislature decisions. This has become a debate among observers of state administration law. This research method uses a normative juridical legal research approach, while the type of research used is descriptive qualitative analytical, and data collection techniques are library research. Abstract

Abstract.The Constitutional Court is an institution that has the role of the guardian of the constitution. The Constitutional Court must ensure the supremacy of the constitution, and the constitution is carried out consistently in society. As the guardian of the constitusion, the constitutional court is attached to the authority of judicial review. The decision on testing the Law on Natural Resources has two different decisions which are caused by the interpretation of the Constitutional Court judges on Article 33 Paragraph (2), Paragraph (3), and Paragraph (4) of the 1945 Constitution of the Republic of Indonesia. The judge relies on his interpretation of the value of community development, especially to the value of water resources. This on the one hand has resulted in legal uncertainty, but on the other hand it includes the efforts of judges to harmonize the rules of constitutional law as living constitution to be in accordance with the development of society.Keywords: The Living Constitution, RI Constitutional Court

Abstract

The Election Law instructs election administrators to organize electoral techniques. However, the law regarding the Formation of Legislation said that the discussion and issuance of a rule must refer to the hierarchical concept of legislation. If the technical rules of the election organizer exceed the authority stipulated in the Election Law, then a norm collision will emerge that impacts the norm confusion. This study uses a qualitative narrative study. By explaining the relationship between one legislation and the other. Researchers found the impact of the issuance of PKPU Number 11 in 2017 and the use of Sipol was the death of 13 political parties that registered as candidates for election. In this case, the KPU proved to be a failure, both in maintaining the legality and Sipol application.

Abstract

The enactment of Law No.1/PNPS/1965 concerning Prevention of Abuse and/or Religion Blasphemy impacts on the exclusion of sects of belief in Indonesia from the recognised religions in Indonesia. The existence of the cults has long become polemic and debates in Indonesia. As a result, native-faith followers have experienced discrimination, stigmatisation and exclusion in society. The issuance of the Constitutional Court Decision number 97/PUU-XIV/2016 at the end of the year at the end of 2017 became a momentum for adherents of the faith to get recognition of their identity.Believers have been equalized with official religions in Indonesia. This article discusses the reality related to the effect of the implementation of the Constitutional Court ruling on the religious identity of believers. Based on the data, it was found that some believers still chose not to change their religious identity on the KTP. They are still comfortable with their identity, and changing religious identities is not a priority.

Abstract

The welfare state is an ideal country whose development is focused on improving welfare. This is can doing through giving a more important role to the state in providing universal and comprehensive social services to its citizens. The choice of such a country is also the same as what is thought by a Muslim philosopher named Al-Farabi. Al-Farabi's thought in politics such as the main state resembles the ideal state concept of Plato. The leader is the first mover of society to get happiness, as is the position of the heart in the body, while the other body members are helpers to produce the happiness that they aspire to. This paper presents the thoughts of an Islamic philosopher named Al-Farabi about the Prosperous State of Prosperity. This paper analyzes analytically and explores critically Al-Farabi's view of a State and the conception of a Prosperous State in Islam. The study uses qualitative research methods with a literary approach. The data obtained comes from several books and other sources about the conception of a Prosperous State.

Abstract

Implementation of the state in practice, sometimes experiencing abnormalities (emergency). The legal system, which is generally used, is often unable to accommodate the interests of the state or society, so a separate arrangement is needed to move the functions of the state to run effectively. This paper discusses the constitutional emergency law in Indonesia according to statutory regulations and state of emergency constitutional principles fiqhiyah perspective. This research uses a qualitative method with a conceptual approach. The data in this study came from the 1945 Constitution of the Republic of Indonesia, Perppu No. 23 of 1959 and Law No. 24 of 2007 and the Fiqhiyah Rule. The results of the study stated that the policy in the state administration of Islam must be eliminated emergency conditions, both those that come from the internal state and external. The state of state emergency in Indonesia is regulated in such a way as to protect all its citizens in order to realize the ideals of the proclamation.

Abstract

 Abstract Restorative justice is an approach that focuses on the needs of victims, perpetrators of crime, and also involves community participation, and does not merely fulfill legal provisions or merely impose penalties. In this case victims are also involved in the process, while perpetrators of crimes are also encouraged to be accountable for their actions, namely by correcting the mistakes they have made by apologizing, repaying the losses suffered, or by providing community service. The application of restorative justice in Indonesia has been stated in Law No. 12 of 11 concerning the Juvenile Justice System, which instructs law enforcement officials to undertake diversion efforts, namely bringing together the perpetrator, the victim, and their families to sit together to find a way out. AbstrakRestorative justice  adalah suatu pendekatan yang memfokuskan kepada kebutuhan dari para korban, pelaku kejahatan, dan juga melibatkan peran serta masyarakat, dan tidak semata-mata memenuhi ketentuan hukum atau semata-semata penjatuhan pidana. Dalam hal ini korban juga dilibatkan di dalam proses, sementara pelaku kejahatan juga didorong untuk mempertanggungjawabkan atas tindakannya, yaitu dengan memperbaiki kesalahan-kesalahan yang telah meraka perbuat dengan meminta maaf, mengembalikan kerugian yang diderita, atau dengan melakukan pelayanan masyarakat. Penerapan restorative justice di indonesai telah tertuang dalam Undang-Undang No. 12 Tahun 11 Tentang Sistem Peradilan anak yang memerintahkan kepada aparat penegak hukum untuk melakukan upaya diversi yakni mempertemukan pelaku, korban, dan keluarganya untuk duduk bersama mencari jalan keluar

Abstract

People in the Old Order era were not fully familiar with the Democratic System. This is because during the old order the people were directly confronted with their participation in democracy through legislative elections. This study uses a qualitative research method with a normative juridical approach. The results of the study stated that for the first time in the Old Order period elections were held in 1955 to elect members of the legislature, while more than 25 political parties participated in the general election. In addition, the condition of the state during the old order was not yet stable politically, socially, and economically, due to pressure from outside and the new state gained independence.Keywords: Old Order; Democracy; Multiparty.
