Abstract

AbstractThe purpose of this article is to discuss legal protection for migrant workers. However, there is a difference between the legal and cultural systems of the sending country and the recipient country, thus causing many problems. To anticipate such problems, both sending and receiving countries are required to take legal protection measures, so that they can avoid being the object of arbitrariness/lawlessness. Therefore, to avoid things that are not desirable, one of the efforts that need to be done is to make bilateral agreements in the form of legal documents in a model that is not too formal, but quite effective with the recipient country. In addition, the commitment of the Indonesian government is shown by its active participation in the discussion of various international legal instruments related to the rights of migrant workers.Keywords: Migrant Workers, Memorandum of Understanding, Constitutional Rights AbstrakTujuan artikel ini adalah untuk membahas perlindungan hukum bagi pekerja migran. Namun, ada perbedaan antara sistem hukum dan budaya negara pengirim dan negara penerima, sehingga menimbulkan banyak permasalahan. Untuk mengantisipasi masalah seperti itu, baik negara pengirim dan negara penerima diwajibkan untuk melakukan tindakan perlindungan hukum, sehingga mereka dapat menghindari menjadi objek kesewenang-wenangan/pelanggaran hukum. Oleh karena itu, untuk menghindari hal-hal yang tidak diinginkan, maka salah satu upaya yang perlu dilakukan adalah membuat perjanjian bilateral dalam bentuk dokumen hukum dalam model Nota Kesepahaman (MoU) yang tidak terlalu formal, tetapi cukup efektif dengan negara penerima. Selain itu, komitmen pemerintah Indonesia ditunjukkan dengan partisipasi aktifnya dalam diskusi berbagai instrumen hukum internasional terkait dengan hak-hak pekerja migran.Kata Kunci: Buruh Migran, Nota Kesepahaman, Hak Konstitusional

Abstract

AbstractGaps between regions and underdevelopment of an area are still issues that must be addressed. Thus, the objectives of social welfare and fulfillment of the constitutional rights of Indonesian citizens can be realized. Because, realizing social welfare is one of the goals of the State of the Republic of Indonesia which is stated in the opening of the 1945 Constitution of the Republic of Indonesia.Indonesia is still experiencing social inequality, as evidenced by the fact that there are still a number of regions in the Unitary State of the Republic of Indonesia that are left behind, outermost, and frontier which are considered to have lower development and welfare indexes than other regions in general. To overcome this problem, the Government in the National Medium Term Development Plan (RPJMN) for the 2015-2019 period prioritizes acceleration of infrastructure development in order to realize equitable national social welfare and development.In its implementation, this plan does look very effective because of real results. However, if seen further, it turns out that it is still far from effective, because it is sad in various regions to be the government's top priority such as in Eastern Indonesia (KTI). Therefore, the accelerated development policy must pay more attention to the economic aspects of society, human resources, facilities and infrastructure, regional financial capacity, accessibility and regional characteristics in order to run effectively.Keywords: Acceleration of Infrastructure Development, Constitutional Rights, Social Welfare Abstrak Kesenjangan antar wilayah dan ketertinggalan suatu daerah masih menjadi isu yang harus diatasi. Sehingga tujuan kesejahteraan sosial dan pemenuhan hak konstitusional warga negara Indonesia dapat terwujud. Karena, mewujudkan kesejahteraan sosial merupakan salah satu tujuan Negarta Republik Indonesia yang tercantum dalam pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Indonesia masih mengalami kesenjangan sosial, terbukti dengan masih terdapat beberapa wilayah di Negara Kesatuan Republik Indonesia yang tergolong sebagai daerah tertinggal, terluar, dan terdepan yang dianggap mempunyai indeks pembangunan dan kesejahteraan lebih rendah dibandingkan dengan daerah lain pada umumnya. Untuk mengatasi permasalahan tersebut, Pemerintah pada Rencana Pembangunan Jangka Menengah Nasional (RPJMN) Periode 2015-2019 memprioritaskan akselerasi pembangunan infrastruktur dalam rangka mewujudkan kesejahteraan sosial dan pembangunan nasional yang merata. Dalam pelaksanaannya, rencana ini memang terlihat sangat efektif karena hasil yang real. Namun, jika dilihat lebih jauh ternyata masih jauh dari kata efektif, karena mirisnya di berbagai wilayah yang menjadi prioritas utama pemerintah seperti di Kawasan Timur Indonesia (KTI). Oleh karena itu, maka kebijakan akselerasi pembangunan harus lebih memperhatikan aspek-aspek perekonomian masyarakat, sumber daya manusia, sarana dan prasarana, kemampuan keuangan daerah, aksesbilitas dan karakteristik daerah agar dapat berjalan secara efektif.Kata kunci : Akselerasi Pembangunan Infrastruktur, Hak Konstitusional, Kesejahteraan Sosial

Abstract

AbstractLand is one of the important elements of national development program, where each infrastructure development activity initiated by the government in the sector will always relate to land and land acquisition, for entities that can’t be ignored. The arrangement of land forms has also been accommodated in the form of laws and implementing regulations. However, in general, there’re no problems with the same problems from eviction and seizure, but conflicts between government and society are unavoidable. This paper presents a systematic analysis using the normative-empirical method for various cases of land acquisition by reviewing it based on a conceptual approach, which is seen from the viewpoint of the Law Number 5 Year 1960 and of the concept of The Theory of Justice from Rawls. The results of the research analysis lead researchers to Compulsory Rehabilitation and Resettlement as a solution that is considered to be able to realize justice as fairness in the concept of humanitarian and equitable land acquisition, so it can be a concrete effort to realize social welfare for all Indonesian people.Keywords: Land Acquisition, National Development, Justice AbstrakTanah merupakan salah satu elemen terpenting dalam rencana pembangunan nasional. Setiap kegiatan pembangunan infrastruktur yang digagas oleh pemerintah dalam sektor rill selalu berkaitan dengan tanah dan pengadaan tanah, sebagai suatu entitas yang tidak dapat dipisahkan. Regulasi mekanisme pengadaan tanah pun telah diakomodir dalam bentuk undang-undang dan peraturan pelaksananya. Akan tetapi secara implementatif, mekanisme pengadaan tanah di Indonesia tak terlepas dari problematika pelik yang berakar dari ketidakadilan pemerintah yang identik dengan penggusuran dan perampasan, sehingga konflik antara pemerintah dan masyarakat merupakan hal yang tidak bisa dihindari. Tulisan ini memaparkan analisis secara sistematis menggunakan metode normatif-empiris terhadap berbagai kasus pengadaan tanah dengan dikaji berdasakan pendekatan perundang-undangan dan pendekatan konseptual, yaitu dilihat dari sudut pandang Undang-Undang No. 5 Tahun 1960 Tentang Pokok-Pokok Agraria dan konsep Teori Keadilan dari Rawls. Hasil analisis penelitian mengarahkan peneliti kepada Compulsory Rehabilitation and Resettlement sebagai sebuah solusi yang dinilai dapat mewujudkan justice as fairness dalam konsep pengadaan tanah yang humanis dan berkeadilan, sehingga dapat menjadi upaya kongkrit dalam mewujudkan kesejahteraan sosial bagi seluruh rakyat Indonesia.Kata Kunci: Pengadaan Tanah, Pembangunan Nasional, Keadilan

Abstract

Abstract.The Supreme Audit Agency (BPK) is a state institution that has a role in upholding the principles of good governance. One that is rarely known to the public is the principle of environmental protection. Despite the role of the BPK in upholding principles, such as regulating positive activities, or providing reports on the results of environmental audits. However, it turns out that the position is not as effective as expected, because the BPK Institution only has 16 certified international environmental auditors, while its duties are related to the environment that is spread throughout the territory of Indonesia. Therefore, the author seeks to provide an effective solution to the concept of reform, namely synergizing the BPK Institution with the relevant Ministries, including the wider community, as well as non-governmental organizations. The author conducted a study based on data on the state of the legal environment, welfare, and environmental audits, then visualized in a frame of mind. With the formulation of the concept of BPK synergy with several relevant Ministries, it is expected to be able to uphold social and environmental welfare, and be able to reduce the country's economic losses.Keywords: Environmental Audit, Republic of Indonesia BPK, Integrity, Social Welfare Abstrak.  Badan Pemeriksa Keuangan merupakan Lembaga negara yang memiliki peran menegakkan prinsip tata kelola pemerintahan yang baik. Salah satu yang jarang diketahui publik adalah prinsip perlindungan lingkungan. Meskipun adanya peran BPK dalam menegakan prinsip, seperti mengatur aktivitas positif, atau memberikan laporan hasil audit lingkungan. Namun ternyata kedudukannya tidak seefektif yang diharapkan, karena Lembaga BPK hanya memiliki 16 auditor lingkungan internasional bersertifikat, sedang tugasnya berkaitan dengan lingkungan yang tersebar di seluruh wilayah Indonesia. Oleh karena itu, penulis berupaya memberikan solusi efektif dengan konsep reformasi, yaitu mensinergikan Lembaga BPK dengan Kementerian terkait, termasuk masyarakat luas, dan juga organisasi non-pemerintah. Penulis melakukan kajian berdasarkan data pada keadaan lingkungan hukum, kesejahteraan, dan audit lingkungan, kemudian divisualisasikan dalam kerangka berpikir. Dengan formulasi konsep sinergi BPK dengan beberapa Kementerian terkait, diharapkan dapat menegakkan kesejahteraan sosial dan lingkungan hidup, serta dapat mengurangi kerugian ekonomi negara.Kata Kunci: Audit Lingkungan, BPK RI, Integritas, Kesejahteraan Sosia

Abstract

Abstract.Problems in dismissing board members by their supporting political parties are still a polemic in the constitutional system of the Republic of Indonesia. The presumption of council members as an extension of the party is still a heated debate. So that a council member who should be a representative of the people seems to be a party representative. The regulation of dismissal of members of political parties is contained in article 16 of Act No. 2 of 2011 concerning Political Parties which explains that dismissal of party members is based on several factors, such as death, resignation in writing, becoming a member of another political party and violating code of ethics for Political Parties. This discussion uses qualitative research methods with a literature review approach.Keywords: Dismissal, Board Members, Political Parties Abstrak.Problematika pemberhentikan anggota dewan oleh partai politik pengusungnya masih menjadi polemik dalam sistem ketatanegaraan Republik Indonesia. Adanya anggapan anggota dewan sebagai kepanjangan tangan partai, masih menjadi perdebatan yang sengit. Sehingga seorang anggota dewan yang seharusnya menjadi wakil rakyat seolah menjadi wakil partai. Akan halnya pengaturan pemberhentian terhadap anggota partai politik tertuang dalam pasal 16 Undang-Undang Nomor 2 tahun 2011 tentang Partai Politik yang menjelaskan bahwa pemberhentian terhadap anggota partai didasari oleh beberapa faktor, seperti meninggal dunia, mengundurkan diri secara tertulis, menjadi anggota partai politik lain dan melanggar kode etik Partai Politik. Abstract

Abstract:Presidential elections are part of the democratic party event. However, the presidential elections in 2014 and 2019 were unique elections and took a lot of public attention. In addition to only being followed by two candidates, they also formed two big camps of supporters who shared high fanatics with each candidate. In this study, the extent to which political communication theory was built by the two candidates was examined, so as to convince potential voters. In various ways carried out to attract public sympathy for the feasibility of each candidate to become the leader of the country. Some people provide positive perceptions by giving appreciation, but others provide negative perceptions and consider their acts of political communication to be limited to mere imaging. Therefore, this study wants to answer these problems.Keywords: Political Communication, Public Perception, Presidential Election Abstrak:Pemilihan umum presiden merupakan bagian dari ajang pesta demokrasi. Akan tetapi pemilihan umum presiden di tahun 2014 dan 2019 merupakan ajang pemilu yang unik dan menyita banyak perhatian publik. Selain hanya diikuti oleh dua kandidat, juga membentuk dua kubu besar pendukung yang sama-sama memiliki fanatik yang tinggi kepada masing-masing kandidat. Dalam penelitian ini, dikaji sejauhmana teori komunikasi politik dibangun oleh kedua kandidat, sehingga dapat meyakinkan calon pemilihnya. Dengan berbagai cara dilakukan guna menarik simpati publik akan kelayakan masing-masing kandidat untuk menjadi pemimpin negeri. Sebagian masyarakat memberikan persepsi positif dengan memberikan apresiasi, akan tetapi sebagian lain memberikan persepsi negatif dan menganggap tindakan komunikasi politiknya hanya sebatas pencitraan belaka. Oleh karena itu, penelitian ini ingin menjawab permasalahan tersebut.Kata Kunci: Komunikasi Politik, Persepsi public, Pemilu Presiden

Abstract:Religion is the main foundation in the fabric of human life. Without religion, humans do not have guidelines in their lives. However, economic dominance in life often triggers people to forget religion as a guide to their life. As a result, religion is denied, antagonized, even considered as a trigger for poverty of the community. It is not surprising then that several countries in their order of state of life have eliminated aspects of religion in their constitution. In this study using a sociological normative approach and qualitative studies in several literatures. The final conclusion, the authors get a relationship between religion, economics and the constitution in the order of state life.Keywords: Religion, Economy, Constitution Abstrak:Agama merupakan landasan utama dalam tatanan kehidupan manusia. Tanpa agama, manusia tidak memiliki pedoman dalam kehidupannya. Namun, dominasi ekonomi dalam kehidupan sering malah memicu manusia melupakan agama sebagai pedoman hidupnya. Sehingga akibatnya agama dinafikkan, dimusuhi, bahkan dianggap sebagai pemicu kemiskinan warga masyarakat. Tak heran bila kemudian beberapa negara dalam tatanan kehidupan bernegaranya menghilangkan aspek agama dalam konstitusinya. Dalam penelitian ini menggunakan pendekatan normatif sosiologis dan studi kualitatif pada beberapa literatur. Kesimpulan akhir, penulis mendapatkan adanya hubungan antara agama, ekonomi dan konstitusi dalam tatanan kehidupan bernegara. Kata Kunci: Agama, Ekonomi, Konstitusi

Abstract

Abstract.Every citizen has the right to get the same opportunity in government. Therefore, the state must facilitate the rights of its citizens, because it is regulated in the constitution. This study uses normative legal research methods and literature studies. The results showed that the existence of individual candidates in the political and democratic system occurred because Law No. 32/2004 on Regional Government only limited and facilitated candidates for regional heads who came from political parties only. Individual candidates in the post-conflict local election in Indonesia are insignificant because one of them is the regulation governing individual candidates considered burdensome for individual candidates, even though the individual candidates have been regulated in the 1945 Constitution and strengthened by the Constitutional Court Decision Number 5/PUU-V/2007 which is the political right of the community to be chosen as a form of democracy and human rights. Deparpolization is caused by a decrease in public trust in political parties, so that people look for other political channels and provide space for people who do not have political vehicles, which are expected to be able to answer the deadlock of political parties so that their political rights can run well.Keywords: Individual Candidates, Democracy, Political Parties, General Election.

Abstract

AbstractViolence against women is an act that is contrary to human rights. That is why the act of violence against women is one of the acts that violates human rights, so we need a national legal instrument regarding the elimination of violence against women in Indonesia. The purpose of this research is to find out what are the factors of women becoming victims of domestic violence, and to find out legal protection efforts for women victims of domestic violence. The analysis used in this research is descriptive which uses qualitative research types with the aim of revealing facts, circumstances, phenomena and circumstances when researching. The results of this study indicate factors that cause women to become victims of domestic violence, such as individual factors, partner factors, socio-cultural factors, and economic factors, and efforts to protect the law of women victims of domestic violence are regulated in the Criminal Code, Law Number 23 of 2004 concerning Elimination of Domestic Violence. Forms of legal protection directly through institutions such as Integrated Service Centers and Legal Aid Institutions.Keywords: Violence, Household, Legal Protection

Abstract

Eksistensi saham dwiwarna pada Badan Usaha Milik Negara sejatinya merupakan bentuk kontrol pemerintah terhadap aksi korporasi Perusahaan. Namun, dalam rangka kontrol tersebut, terjadi sebuah problematika penerapan saham dwiwarna yakni superioritas keberlakuan saham dwiwarna pada Badan Usaha Milik Negara dan Superioritas kewenangan yang menabrak prinsip one share one vote, di samping itu problematika lain yang terjadi pada penerapan saham dwiwarna adalah terkait regulasinya, dimana ketentuan saham dwiwarna hanya ada dalam Peraturan Pemerintah dan tidak memiliki payung hukum setingkat undang-undang, padahal saham dwiwarna sebagai proteksi negara seyogyanya diatur dalam aturan yang setingkat undang-undang. Tujuan dari karya tulis ilmiah ini adalah untuk menjawab problematika penerapan saham dwiwarna pada Badan Usaha Milik Negara. Metode yang digunakan adalah yuridis normatif yakni metode dengan pendekatan legis positivis dengan pendekatan undang-undang dan pendekatan konseptual. Berdasarkan hal tersebut, penulis menawarkan gagasan limitasi dan sinkronisasi regulasi saham dwiwarna, dengan menempatkan saham dwiwarna hanya pada holding company BUMN, dan mencabut keberlakuan saham dwiwarna pada BUMN Non-holding company, kemudian dalam regulasi ketentuan saham dwiwarna ditempatkan dalam hierarkis setingkat undang- undang, yakni undang-undang BUMN, dan undang-undang Perseroan Terbatas.Kata Kunci: Privatisasi, Saham, Perusahaan Negara
