Abstract

Giving local government to arrange regional receipt to purchase expenses bugget is part of Regional Otonomy. Not only depend on Central Government, Government genuine Receipt is one regional receipt that shows how stronger local goverment finance can handled all the expenditure. Metro as a local government in Indonesia, has the increase in regional otonomy espescialy in finance. The higher decentralization is a indicatoin that indicate higher ability on local government to fulfill all expenditure. It can be shown on share of Government Genuine Receipt and Tax and non Tax Share compare Total Regional Receipt and Total Regional Expenditure. Higher fiscal Desentralization needed by Metro to get higher Regional otonomy. Government Genuine Receipt and Tax and non Tax must be increased to get higher regional receipt and increasing share in Total Regional Receipt and higher share to offord the Total Regional Expenditure.

Abstract

There are two types of financial institutions, namely bank and non Bank, which are operate under shariah and conventional system. Koperasi Simpan Pinjam dan Pembiayaan Syariah (KSPPS) is one of the financial institutions is not a Bank that operates with the Sharia system. In conducting its operations, whether Koperasi Simpan Pinjam dan Pembiayaan Syariah (KSPPS) runs its operations in accordance with sharia, or not. In this case, the rule of Sharia Supervisory Board is very crucial to ensure that Koperasi Simpan Pinjam dan Pembiayaan Syariah (KSPPS) has fulfil the shariah principle. Although they have Sharia Supervisory Board, but there are still many Koperasi Simpan Pinjam dan Pembiayaan Syariah (KSPPS) which are not comply with syariah principles. This problems is caused by weaknesses of Shariah Supervisory Board (DPS) and Hassle System from recruitment to the accountability of the Shariah Supervisory Board. Therefore, there is the thought of the author's alternative surveillance system Koperasi Simpan Pinjam dan Pembiayaan Syariah (KSPPS) in realizing the shariah compliance.

Abstract

Marriage as in islamic law is not civil case alone. But ties saint to mistaqan ghalizhan is a firm covenant and strong. For that marriage be maintained well, so what be the goal marriage namely the formation of family couple mawaddah wa mercy can be achieved. According to the indonesian ulemas council one of a barrier the formation of the purpose of marriage as above, is marriage different religion .But phenomena marriage different religion occurring dimasyarakat actually of an increasing and as if becomes regular issues. Remembering how the importance of problems marriage different religion widespread in indonesia.Hence, the indonesian ulema menguluarkan fatwa on prohibition of different religion marriage.Focus of study this writing is: (1) Think fuqoha and the indonesian ulema about a philosophy and wisdom ban different religious marriage? Abstract

Penelitian ini ditulis untuk menjelaskan mengenai pernikahan dalam masa iddah perspektif Hukum Islam dan Undang-undang perkawinan.kompleksitas permasalahan perkawinan ini ditunjukkan oleh berbagai macam problematika yang muncul dari zaman ke zaman dan jika dilihat dari sisi sosiologis dipengaruhi oleh perubahan sosial seiring perkembangan zaman yang menyebabkan perubahan way of thinking (cara berfikir) manusia kemudian mempengaruhi way of action (cara bertindak) yang mengubah way of life (cara hidup) manusia secara umum dan muslim secara khusus. Salah satu problematika yang muncul akibat perubahan sosial tersebut adalah perkawinan yang dilakukan dalam masa iddah. Yang berakibat dampak baik dari sisi indvidual maupun sosial masyarakat. Jenis penelitian ini adalah field research yang bersifat diskriptif kualitatif. Dengan menggunakan tehnik pengumpulan data secara analisis kualitatif. Dengan analisis ini diharapkan dapat menghasilkan deskripsi yang lebih objektif dan sistematis tentang faktor dan dampak perkawinan dalam masa iddah perspektif hukum Islam dan Undang-undang perkawinan (studi kasus di Kecamatan Trimurjo, Kabupaten Lampung Tengah). Dari penelitian diatas peneliti mendapat kesimpulan bahwasanya faktor-faktor dan dampak dari perkawinan yang dilakukan dalam masa iddah adalah faktor internal (faktor pendidikan, ekonomi dan biologis) dan faktor eksternal (lemahnya tingakat kontrol tokoh Agama dan Publik. Sedangkan dampak dari pernikahan tersebut adalah dampak individual dan sosial.

Abstract

The development of the world current business carrying logical konsuekwenses to make the birth of the new legal instrument that can respond the needs of business practition .Where instrumental law it can reflect a sense of justice but not forget the aspect of certainty in law. They called the instrument as a contract inside the agreement. But then became called as standard contract that has been determined by party its maker. Problems emerged at a later date related to what is called standard as contract, the practition of law may have different opinions, there is a negative views in also have positive views. This view born with regard to standard contract have a exemtion clause .Progressive law looked law as institutions which guarantee justice, make harmony between law and the human. It means that extent of standard contract was able to meet than legal purposes of the progressive and not opposed to fundamental norm in agreement and not opposed to regulations such as Undang-undang no 8 Tahun 1999 Tentang Perlindungan Konsumen, so the existence of legal contract until it .That contract default recognized or not they needed to answer time progress in current mobility business by efficiency time, cheaper charges but keep the justice and legal certainty.

Abstract

Currently indonesia often torn asunder with different kinds of events which is quite disturbing national stability start of the disintegration by separatist group and other’s. It is something that can be easy occur given indonesia is a archipelago state, so in controlled requires strength tight from own society or the state of directly. With the diversity of social conflict tribal often law ineffective so that we consider that the need for the role of an instrument informal as community figures, traditional leaders and religion figures that more actively in acktivity has purpose for making stability the condition from social conflict. This research, writter trying to give some description that is the participation from community, traditional leaders and religion figures most important for resolving the conflict and as the law in Indonesian that participation this fegures had tranformation from unformal side to formal side as the UU No. 7 Tahun 2012 Tentang Penanganan Konflik Sosial mandating. Abstract

Marriage is spiritually bond between two people, both men and women to achieve a happy family. Marriage in Indonesia is a sacred thing. One implication is the mixing of property owned by both actors marriage. in setting the ground in Article 21, paragraph (1) and paragraph (3) and Article 36 paragraph (1) of Law No. 5 of 1960 about Agrarian, that land ownership is based on the principle of citizenship (nationality). The application of the articles a quo, participants referred to mixed marriages do not have land rights, as stipulated in Article 35 paragraph (1) of Law Number 1 of 1974 concerning marriage. despite having waived by the Directorate General of Law and Human Rights No. AM2-HA.01.02-10, in fact, Article 21 of Law No. 1 of 1974 concerning marriage be prohibitive. The Constitutional Court then issued a decision No. 69 / PUU-XIII / 2015 return guarantee protection of the rights of the perpetrator of mixed marriages.

Abstract

Talking about poverty is never-ending, because poverty did not go to the completion of the skinning community. Poverty is a disease that bite people thinking of the community in terms of power, way of life and will even be a bottomless do anything to get out of poverty. Indonesian as a country that has a community with a strong national identity, it should not come to fall to the things that will bring in contemplation. The government must be intervene in maintaining national identity since eroded grinding poverty, economic transactions are increasingly siding with the bourgeoisie. Through empowerment Islamic patterns for the general public seems to be a necessity. Through cooperatives as one of the institutions that are rooted in the community seem to be easily absorbed by the public. Especially in the era of globalization that has sunk this nation's economic order to make the national identity civilized taawun society and work together in achieving a common goal; social welfare is a right for the people of this nation become faded.

Abstract: "Tradition ('urf) as a Source of Islamic Law Reasoning; Study Paradigm Sunnah wal Jama'ah Experts in Developing Local Culture "One tradition ( 'urf) can be used as a source of Islamic law if it does not conflict with Personality', and not all traditions can be used as a source of Islamic law. Tradition itself is an activity that is repetitive, but does not violate the order of Shariah, the tradition is not sharia, but branches (furu ') in order to address or even develop Islamic teachings amaliyah (amaliy) or often called (bid’ah hasanah) .The ahlu sunnah wal jama'ah develop local culture such as tahlilan, yasinan, istighasah, tawashul or the like in the implementation of the (practice) there is no standard rules, but it is the implementation of more emphasis on reading tahlil (la ilaha ilallah), or yasinan namely reading yasin as the heart of a Qur'an, namely istighasah appeal help in Allah and not in others, and that is ihtiram tawashul to teachers as washilah in a prayer, and of course this is bid’ah hasanah not teaching out of Personality ' ,Keywords: Tradition, 'urf, Ahl Sunnah Wa al-Jama'ah

Abstract

"Marriage under age Judging from Glasses Sociology" The view of the Jurists' that the minimum age to marry is puberty signs of puberty there are two, namely bi al-alâmaât; for men marked by a dream or out of sperm, while women are marked with menstruation. bi al-sin; according to Hanafi, 18 year old male and a 17 year old woman. Maliki, is characterized by the growth of hair. Shafi, 15 years for men and 9 years for women. Hanbali, 15 years in both men and women. In Indonesia, the minimum limit married 19 for men and 16 for women. Age children who have reached adulthood, called puberty phase, at this age the child already has a full awareness of himself, sehingg he was given the burden of responsibility, especially religious and social responsibility.
